Sturm, hereafter "Applicant" has applied to the Pitkin County Hearing Officer, hereafter "Heazing Officer" fora 1041 Hazard Review and Conceptual Submission for the expansion of an existing building envelope in order to accommodate the replacement of an existing residence with a new single-family residence. 2. The property is located at 460 Red Mountain Road and is specifically described in Exhibit A. 3. The property is zoned R-30. The site contains approximately 1.002 acres. 4. The Hearing OfScer heard this application at a public hearing on May 14, 1998 at which time evidence and testimony were presented with respect to this application. NOW THEREFORE , BE IT RESOLVED by the Pitkin County Heazing Officer that approval is hereby granted to the Sturm 1041 Hazard Review and Conceptual Submission, subject to the following conditions: 1. Prior to the issuance of a building permit, the Applicant shall submit an amended 1041 site plan to the Community Development Department for approval and recording. The site plan shall also be submitted in digital format for integration into the County's GIS system. The final site plan shall be modified as follows: A. The setback from Red Mountain Road right-of--way on the face of the site plan should be changed from 30 foot to 50 foot. B. Slopes greater than 30% have been identified on the southwest and northeast comers of the proposed building envelope expansion. Pursuant to Section 3-80.50(C)(2), development is prohibited on slopes greater than 30%. Therefore, the slopes that are greater then 30% shall be excluded from building envelope expansion. C. The site plan shall be identified as "Sturm 1041 Hazard Review." D. The following 1041 Hazard Review warning and disclaimer shall be placed on the site plan: "The provisions of these regulations do not in any way assure or imply that areas outside of the designated hazard area will be free from hazards, or that approved mitigation measures will guarantee the safety of any property. " Prior to recordation of the 1041 site plan, the applicant shall submit to the Community Development Department documentation regarding wildfire mitigation measures for the vegetation that lies between the subject property and the property to the east (Ruby). Brush, debris, and non-ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around a structure built on flat ground. C. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. D. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and removal of ladder fuels from around trees and brush. E. Tree crown separation within the 30 foot perimeter shall have a minimum of 10 feet between the edges of the crowns. This does not apply to mature stands of Aspen trees where the above recommendation for removal of ladder fuels have been compiled with. In areas of aspen regeneration, the spacing guidelines shall be followed. F. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. G. The density of fuel within a 100 foot perimeter of the structures shall be reduced where natural reduction has not already occurred. H. AlI deadfall within the 100 foot perimeter shall be removed. I. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 4. The Applicant shall comply with the following additional wildfire mitigation standards A. Roof construction shall be Class A, non-combustible material with no flat roofs. B. Vents shall be screened with corrosive resistant wire mesh with mesh 1/4 inch maximum. C. Roofs and gutters shall be kept clear of debris. D. Yards shall be kept clear of all litter, slash, and flammable debris. E. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. F. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more than 6 inches. G. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away from the structure. H. Fences shall be kept clear of brush and debris. I. Wood fences shall not connect to the structure. J. Fuel tanks shall be installed underground with an approved container. K. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with defensible space vegetation mitigation around any above-ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire-resistive construction on the exterior side of the walls. L. Each structure shall have a minimum of one 10 pound ABC fire extinguisher. M. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible and installed on anon-combustible post. N. The driveway shall be designed to comply with County standards. O. All utility extension shall be buried. Landscaping outside of the building envelope shall be allowed subject to the review and approval by the Community Development Department of a landscaping plan. 6. A fireplace/woodstove application must be filed and approved by the Environmental Health Department prior to the issuance of a building permit. A Board of Adjustment variance will be required should any structure, including retaining walls and earthen fills, exceed 30 inches in height within the setback. 8. For any free mazket residential structure of 5,000 gross square feet or greater, the applicant shall comply with Section 4.01.01(B) of the Pitkin County Road Management and Maintenance Plan, which requires the applicant to provide construction trip and residential trip generation studies. The applicant shall comply with this provision as it is in effect at the time of building permit issuance to the satisfaction of the County Engineer. 9. All material representations made by the applicants in the application or in public meeting shall be adhered to and considered conditions of approval; unless amended by other conditions. Dear Rick, This application is being submitted on behalf of Melanie Stumt, owner of the above mentioned property, for the request to extend the existing building envelope as indicated in the attached site plan. Extension is being requested to allow better use of the site, further separation from Red Mountain Road, and to maximize the view corridors of Aspen Mountain and Moroon Creek. It is our understanding that the previous owner submitted to PTTCO and was granted a 1041 Hazard review approval. It is our intention to abide by restrictions of that approval and comply with mitigation as defined per sections 3-80.50 and 3.80-70 of the Land Use Regulations. Per our previous discussions, and as indicated on the attached site plan, the envelope extension and proposed footprint of the project aze to be located away from slopes greater than 30%, and clear of wildfire azeas. Improvements to the site and connection to available utilities aze to conform to section 3-110 of the Land Use Regulations. The previous owners application indicated installation of a new road at the south side of the property. It is our intention to retain the existing road to minimize impact to the site and view corridors from our site and the adjoining site. APPLICANT: Melanie L. Strum REPRESENTATIVE: Scot Broughton, Conger Fuller Architects LOCATION: The subject property is located at 460 Red Mountain Road, across from the intersection of Willoughby Way and Red Mountain Road. The parcel is legally described in Exhibit A. ZONING/SIZE: The property is zoned R-30 and contains approximately 1.002 acres and is conforming in size. BACKGROUND: The former property owner, Gerd Zeller, applied fora 1041 Hazard Review in 1996 to establish a building envelope to replace an existing single family residence, as well as the relocation of the driveway. The request was reviewed and approved by the Pitkin County Hearing Officer. This application is requesting an expansion of the originally approved building envelope, however, the applicant is proposing to retain the current location of the driveway. The applicant would like to utilize the existing building envelope, however, expand the envelope to the south and to the east. The applicant is proposing to increase the proposed building footprint size, however the new residence is proposed to be moved away from the slopes to the north and east. SITE DESCRIPTION: The slopes behind the existing building envelope are approximately 40 to 50 percent and aze stabilized by a retaining wall. The existing retaining wall will be replaced with a new retaining wall to ensure the stability of the slope. The applicant has indicated that the area behind the existing house will be regraded and landscaped. There is an existing shed and incinerator located on the site which the applicant has indicated will be removed. The slopes in the area of the proposed building envelope expansion range from flat to 50 percent. REFERRAL COMMENTS• The following agencies have been referred on this case. L County Attorney* 2. STAFF COMMENTS: 1041 HAZARD REVIEW Wildfire: Vince Urbina of the Colorado State Forest Service has rated the wildfire above (north) the existing house as severe, even though the lot is mapped as low. The vegetation above the house consists of Gambel oak and serviceberry. Mr. Urbina has rated the portion of the lot below the building site as moderate. The vegetation on this lower half consists of narrowleaf cottonwood. The applicant is proposing to expand the existing building envelope to the south and to the east away from the slopes. Mr. Urbina has recommended the same mitigation measures that were addressed in his letter dated Apri123, 1996. Geologic: The slopes on the southwest corner of the proposed building envelope, beyond the existing driveway, as indicated on the site plan submitted for review are approximately 50 percent and the slopes on the northeast corner of the proposed building envelope aze approximately 40 percent. Development is prohibited on slopes of greater than 30% pursuant to Section 3-80.50(C)(2) of the Land Use Code. Therefore, the areas of slopes greater than 30 percent must be eliminated from the proposed building envelope expansion. Although, Nicholas Lampiris reviewed the original 1041 Hazazd Review for this site, staff would agree with his comment addressed in his letter dated February 17, 1998, that the drainage around the house be adequate, especially at the rear of the house where snow melt or rain water can accumulate and percolate down to the foundation. Positive drainage at the reaz of the house should be established. GENERAL SUBMISSION Water and Sewer: The Environmental Health Department has indicated that no additional comments from their previous review were needed. Water is provided by the Aspen Water Deparhnent and the Aspen Consolidated Sanitation District (ACSD) already services the site. In a letter dated, April 1, 1996, the ACSD indicated that the applicant must ensure that "clear water connections" (foundation drains, driveway drains, roof drains, etc.) are prohibited. Access: Access to this parcel is off of Red Mountain Road. As part of the original 1041 review for this site, the applicant proposed a new driveway to be located to the south of the existing access. However, as part of this application, the applicant is proposing to keep the existing access and forego the approval for new driveway location: Visual/Environmental Impacts: As mentioned in the previous review for this site, there aze numerous existing mature cottonwoods in the area below the existing development which provide an excellent visual Sturm 1041 Hazard Review and Conceptual Submission May 14, 1998 Page 3 buffer from Red Mountain Road and adjacent residential development. The applicant has indicated to staff that they may landscape outside of the proposed building envelope along Red Mountain Road. Staff is recommending that a landscaping plan be submitted to the Community Development Department for review and approval prior to building permit application. Staff has received a letter of objection, dated May 8, 1998 (Attachment C), from Design Workshop who is representing the adjacent property owner to the south. They have indicated that the proposed building envelope expansion will impact the privacy and views of the adjacent property and will force the owners to make major changes to their architectural plans. Furthermore, Design Workshop has indicated that additional screening between the two properties will be a problem and that there are slopes in excess of 30% within the proposed building envelope expansion. DesignWorkshop has noted that amending the "existing building envelope, namely opening a visual corridor to views of Aspen Mountain and Mazoon Creek, are clearly insufficient grounds for granting the applications." In addition, they have indicated that "there seems little to justify the placement of the structure outside of the existing envelope since the existing residence proves the site is suitable for construction as defined by the building envelope." Other Issues: Joanna Schaffner, Zoning Officer, has indicated that the setback from Red Mountain Road is 50 feet, not 30 feet, as represented on the site plan submitted for review. Prior to recordation, the site plan should be amended to indicated the appropriate setback. RECOMMENDATION: Staff recommends that the Hearing Officer approve the Sturm 1041 Hazazd Review and Conceptual Submission for the expansion of the existing building envelope excluding the areas of slopes greater then 30%, subject to the conditions of approval in the attached Hearing Officer Determination. Access tc the parcel is via Red Mountain Road. The existing driveway originates at a right angle to Red Mountain Road, which is desirable for emergency service vehicles. There is an existing house on the parcel. I reviewed this parcel in 1996 (see- enclosed copy of letter) when the owner was Zeller. At that time I said that there was narrowleaf cottonwood below the house. Above the house the slope exceeds 30% for a short distance before you come to a ditch and the neighbor's driveway. The vegetation on the steep slope is Gambel oak and serviceberry. Above the house the wildfire hazard rating would be severe and below it is medium. In other words the situation is basically the same as it was in 1996. According to Scot, the new owner will not be encroaching on the steep slope and has plans to terrace the land and incorporate less flammable landscaping. With that in mind I will stand by my recommendations of 1996. 1) Establish and maintain a cleared 10 foot perimeter around all structures where the vegetation can be maintained at 6 inches or less (e.g., mowed grass). No woody plant material should be planted within this perimeter. 2) Remove the lower branches on any of the narrowleaf cottonwoods up to 10 feet in height that will remain after construction activities to eliminate ladder fuels. 3) I don't see any real need to disturb the oak/serviceberry above the house if it is no closer than 30 feet from any structure. If there are oak/servicebeny allowed to remain within this perimeter then I recommend thinning and clumping as prescribed in Section 3-80.7.C.3 of the Pitkin County Land Use Code. Room 416 Grand Junttion. Colorado 81501 Telephone 13031 2a8-7325 I read the plan and inspected the site with the owner and his agent on April 11th. The property has a south aspect. Below the the existing house the vegetation is mature narrowleaf cottonwood. Above the house the slope exceeds 30% for a short distance before you come to a ditch and the neighbor's driveway. The vegetation on this steep slope is Gambel oak and serviceberry. I advised the owner that this would be rated as a severe wildfire hazard even though the lot has a low wildfire hazard rating. All three of us discussed how to mitigate the wildfire fire hazard. Using the Pitkin County land use code and the National Fire Protection Association (NFPA) 299 standard, my wildfire mitigation recommendations are as follows. 1) Maintain a cleared 10 foot perimeter around all structures. This clear space can have vegetation but it must be kept at 6 inches or less (e.g. mowed lawn). Trees that could eventually touch structures at their mature height should not be planted in this zone. 2) The area above the. proposed structure should be thinned to incorporate defensible space principles. As we discussed on the site visit day I recommend removing the existing serviceberry and leaving the Gambel oak. The remaining Gambel oak should also be thinned so that remaining clumps are no larger than two times the height of the plants. The distance between clumps should also be this same distance (2 times the height). This recommendation is spelled out in the Pitkin County Code 3-807.C. All remaining Gambel oak should have lower branches removed up to half the total height of the stem or 10 feet whichever is least. 3) The area below the house has mature narrowleaf cottonwood where the proposed driveway will be located. Access to the parcel is via Red Mountain Road. The existing driveway originates at a right angle to Red Mountain Road, which is desirable for emergency service vehicles. There is an existing house on the parcel. I reviewed this parcel in 1996 (see- enclosed copy of letter) when the owner was Zeller. At that time I said that there was narrowleaf cottonwood below the house. Above the house the slope exceeds 30% for a short distance before you come to a ditch and the neighbor's driveway. The vegetation on the steep slope is Gambel oak and senriceberry. Above the house the wildfire hazard rating would be severe and below it is medium. In other words the situation is basically the same as it was in 1996. According to Scot, the new owner will not be encroaching on the steep slope and has plans to terrace the land and incorporate less flammable landscaping. With that in mind I will stand by my recommendations of 1996. 1) Establish and maintain a cleared 10 foot perimeter around all structures where the vegetation can be maintained at 6 inches or less (e.g., mowed grass). No woody plant material should be planted within this perimeter. 2) Remove the lower branches on any of the narrowleaf cottonwoods up to 10 feet in height that will remain after construction activities to eliminate ladder fuels. 3) I don't see any real need to disturb the oak/serviceberry above the house if it is no closer than 30 feet from any structure. If there are oak/serviceberry allowed to remain within this perimeter then I recommend thinning and clumping as prescribed in Section 3-80.7.C.3 of the Pitkin County Land Use Code. The property has a south aspect. Below the the existing house the vegetation is mature narrowleaf cottonwood. Prove the house the slope exceeds 30°s for a short distance before you come to a ditch and the neighbor's driveway. The vegetation on this steep slope is Gambol oak and serviceberry. I advised the owner that this would be rated as a severe wildfire hazard even though the lot has a low wildfire hazard rating. All three of us discussed how to mitigate the wildfire fire hazard. Using the Pitkin County land use code and the National Fire Protection Association (NFPA) 299 standard, my wildfire mitigation recommendations are as follows. 1) Maintain a cleared 10 foot perimeter around all structures. This clear space can have vegetation but it must be kept at 6 inches or less (e.g. mowed lawn). Trees that could eventually touch structures at their mature height should not be planted in this zone. 2) The area above the proposed structure should be thinned to incorporate defensible space principles. As we discussed on the site visit day I recommend removing the existing serviceberry and leaving the Gambol oak. The remaining Gambol oak should also be thinned so that remaining clumps are no larger than two times the height of the plants. The distance between clumps should also be this same distance (2 times the height). This recommendation is spelled out in the Pitkin County Code 3-807.C. All remaining Gambol oak should have lower branches removed up to half the total height of the stem or 10 feet whichever is least. 3) The area below the house has mature narrowleaf cottonwood where the proposed driveway will be located. Fart of the existing driveway is built an fill but there are no signs that it has been unstable. The new driveway will climb this old fill platform, as shown. The lower portion needs to b• designed to conduct surface water along it in the form of borrow ditches. Also, in the fill areas, the material needs to b• compacted properly as it is placed.
