The property is zoned R-30 and is located on Lot 4, of the Clasen-Pecjak Subdivision in Section 11, Township 10 South, Range 85 West. Please review this material and send in your comments to this office no later than October 9, 1987 in order for this office to have adequate time to prepare for its presentation before P&Z. Box 10421 Aspen, CO 81612 Dear Carol, This letter is in response to your letter of December 20, 1987, at which time you made several requests of us regarding your recent Planning Office bill. I can understand how upsetting it must be to have expected a refund of $655 and be informed that you are receiving only $280. I will try to address all of your concerns in this letter. First I want to tell you that I was in error regarding the amount of your refund. I said that you would receive $280, based on 2 hours @ $140. The refund rate is actually $145, for a total refund of $290. I apologize for my error. The fee structure for all County Land Use Applications is set by the Board of County Commissioners. I have enclosed a copy of Resolution No. 86-138 which established the fees for 1987. As it states in this resolution, the Board has adopted a policy whereby the Land Use Applications received each year will pay for the entire current planning operations for that year. This means that the hourly rate that we charge has nothing whatsoever to do with the planner's actual salary but instead also includes the overhead of the planning office (i.e. secretarial, administra- tion, supplies, copy charges, etc.) and must offset the cost of time associated with public inquiry, routine code amendments and similar activities. We are well aware of the fact that the rate exceeds that charged by many professionals in town. Resolution No. 86-138 also explains that the Environmental Health, Engineering and Housing Departments are referral agencies that review land use applications and sets fees they should charge to offset their cost. The Planning Office collects the fees for these other departments and they receive credit for them. I am enclosing a copy of Francis' timesheet for the period 10/24- 11/8/87, in which he spent the 3 hours on your review. I asked Francis if 3 hours was accurate for this review and he said yes it was. He inspected the site, which took 45 minutes, leaving 2 Carol Farino December 24, 1987 Page 2 hours and 15 minutes to review the application, write a memoran- dum to the Planning Commission and attend the hearing. Carol, the Planning Office is the administrator of the Land Use Application Fees and not the entity which governs their struc- ture. If you still have concerns regarding this you need to address them to the Board of County Commissioners. I hope this letter addresses all of your concerns and that it will help you to be better informed if you again submit a land use application. REQUEST: The Applicant is requesting Scenic Foreground Overlay Review approval to construct an approximately 720 square foot second floor addition to an approximately 1,474 square foot single story residence. The application is attached. LOCATION: The residence is located on Lot 4 of the Clasen-Pecjak Subdivision. ZONING: The property is zoned R-30 and contains an existing residence of approximately 1,474 square feet. The Board of Adjustment granted an FAR variance for the proposed 720 square foot addition by their Resolution 87-09 (attached). ISSUES AND CONCERNS: 1) County Planning Engineer: In a memo dated October 9, 1987, Tom Newland submitted the following comments: "I have reviewed the application and have found the proposed addition to conform to the criteria estab- lished in sub-section 3-1.13 of the Land Use Code. The smallness of the site limits the ability of the applicant to conform to some of the SFO criteria. However, the proposed addition will have a negligible effect on the highway viewplane because it will be partially obstructed by, and will blend into, the surrounding residential buildings. The peak of the roof (south elevation) is represented as being 26 feet in height. The northern lot is about 500 feet from Highway 82 right-of-way." 2) Planning Staff: The Applicant has applied for Scenic Foreground Overlay approval to add a 720 square foot addition to an existing 1,474 square foot residence. Section 3-1.13 of the Land Use Code provides criteria for review of development within the Scenic Foreground. The criteria and the staff evaluation of this project's conformance with the criteria follow: (1) Whether the development has utilized existing topography, such as dry ridges and hills, to screen buildings to the maximum extent possible. Staff: The building site is virtually flat so that topographical features cannot be utilized to screen the project. There is a dry ridge behind the residence which will prevent the addition from protruding into viewplanes from Highway 82. (2) Whether the development has been designed to complement the natural topography of the land, includ- ing, whenever possible, and appropriate, the utiliza- tion of innovative architectural techniques such as earth sheltered design and clustering of structures in the least visible portions of the site. Also, whether the development's height and bulk has been designed to avoid, to the maximum extent possible, the visibility of buildings from the highway. Staff: The project utilizes a fairly standard architec- tural design, however, the addition will be screened by existing residences which are taller than this ad- dition. (3) Whether the development has avoided the location of uses on the highest ground or most visible sites from State Highway 82. Staff: The proposal is neither on the highest ground nor the most visible site from Highway 82. (4) Whether the development has been located outside of the designated Scenic Foreground, or on a suitable site at the greatest possible distance from State Highway 82. Staff: The site is within the designated Scenic Foreground. The residence is approximately 50o feet from Highway 82. (5) Whether the development has been landscaped in accordance with the adopted State Highway 82 Corridor landscape guidelines and has preserved natural vegeta- tion, to the maximum extent possible, including avoidance of irrigated meadows. Staff: The site has existing landscaping which screens the residence from view. No additional landscaping is necessary. The property contains no irrigated meadows. (6) Whether the development's exterior lighting has been designed in such a manner that objectionable light sources will be incapable of being seen from State Highway 82. Staff: Lighting will be directed toward the ground to minimize off-site glare. The lighting must conform to the adopted lighting standards in the Land Use Code. (7) Whether any landforms and earth moving techniques designed into the development are utilized as one of several methods to complement and enhance development, rather than as the single device for screening develop- ment from view from the State Highway 82 Corridor.
