The Aspen Chapel Trustees, (hereafter "Applicant"), have requested a Growth Management Quota System Exemption and Scenic Overlay approval to construct an approximately 900 square foot addition to the Chapel. 2. The Pitkin County Board of County Commissioners (hereafter "Board") finds that the Chapel represents an essential community facility and is therefore eligible for a Growth Management Quota System Exemption for Essential Community Facilities. 3. The Planning and Zoning Commission reviewed this application at their regularly scheduled public meeting on March 7, 1995, and recommended approval of the Chapel addition. 4. The property is described on Exhibit "A" attached. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that it hereby approves this application subject to the following conditions: 1. The addition shall be built according to the plans presented by the applicant and shall be limited to approximately 900 square feet. 2. A Growth Management Quota System Exemption is requested for the addition. Scenic overlay Review is required because the Chapel is within the mapped Highway 82 scenic overlay. LOCATION: The Chapel is located at the intersection of Maroon and Castle Creek Roads. ZONING: The property is zoned R-30 and contains approximately 1.14 acres. RECOMMENDATION: The Planning Commission reviewed this application on March 7, 1995, at which time they unanimously voted approval of the proposed project. The Meadowood Homeowners' Association also recommended approval of the proposed addition. The Planning staff also recommends approval of this application pursuant to the attached draft Board resolution. Zoning: The proposed addition lies within required setbacks. The proposed addition also appears to exceed the allowable floor area ratio (FAR) for this site. This project will require review and approval by the Pitkin County Board of Adjustment. 2. City of Aspen Water Department: The Water Department notes that a water service agreement may be necessary. The Water Department also encourages the applicant to consider upgrading its existing service connection. 3. Meadowood Homeowners' Association: The Meadowood Homeowners' Association recommends approval of this application. 4. Environmental Health Department: No conditions of approval were recommended by the Environmental Health Department. STAFF COMMENTS: This application requires Scenic Overlay approval and a Growth Management Quota System (GMQS) Exemption for Essential Community Facilities. These reviews follow: 1 GMQS EXEMPTION FOR ESSENTIAL COMMUNITY FACILITIES Section 3-1512 of the Land Use Code provides an exemption from the Growth Management Quota System for Essential Community Facilities. The criteria for an exemption and staff comments follow: 1. Provides a basic or fundamental public service upon which the community is dependent upon for support. Staff Comment: The staff opinion is that the Chapel does provide a fundamental public service by providing a public place for religious services. 2. Will be available to the general public. Staff Comment: The Chapel is open to the general public. 3. Serves primarily the local community. Staff Comment: The Chapel primarily serves the local community. 4. Provides facilities in response to growth and is not itself a growth generator. Staff Comment: The Chapel expansion is in response to community need for religious services and classroom space. 5. An applicant shall demonstrate the mitigation of demands for: a. Additional affordable housing; b. Transportation services and parking; and c. Basic services such as water supply, sewage treatment, fire and police protection and solid waste disposal. Staff Comment: The proposed expansion provides for an improved learning/teaching environment. No additional employees are expected to be created by the proposed expansion; additional affordable housing is accessible to public transportation. Additional parking area should not be necessary for this expansion. Basic services to the Chapel exist. No expansion of service is necessary; however, the staff notes that the Aspen Water Department has identified the need for a water service agreement with the Chapel. A condition of this review should be that the Chapel enter into a water service agreement with the City of Aspen. 6. An applicant shall demonstrate the development has negligible adverse impacts on: a. Air quality; b. Water, land and energy resources; and c. Scenic quality. 2 Staff Comment: The staff does not foresee any adverse environmental impacts resulting from this project. SCENIC OVERLAY The Chapel is located within the Highway 82 Scenic overlay. The Scenic Overlay criteria and staff comments follow: 1. whether the development has utilized existing topography and natural vegetation, such as ridges and hills to screen buildings to the maximum extent possible. Staff Comment: The proposed addition is approximately 900 square feet and is integrated into the base of the existing structure. Existing landscaping and berming should substantially screen the addition from Highway 82. 2. Whether the development has been designed to complement the natural topography of the land, including, whenever possible and appropriate, the utilization of innovative architectural techniques such as earth sheltered design natural materials and coloring, non-reflectability and clustering of structures on the least visible portions of the site. Staff Comment: The addition is integrated into the existing structure. Materials will complement the existing Chapel. 3. Whether the development's height and bulk has been designed to avoid, to the maximum extent possible, the visibility of buildings from the highway and public viewplanes. Staff Comment: The addition is proposed within the existing building footprint. No additional height or bulk will be apparent with this addition. 4. The proposed structure shall be placed so it does not break a ridgeline, unless there are no alternate building sites on the lot. Staff Commettt: The addition does not break a ridgeline. 5. Whether the proposed development has avoided the location of uses on the highest ground or most visible portion of the site as viewed from State Highway 82 and public right-of-ways, identified in Section (B)(1). Staff Comment: The addition avoids the highest ground and the most visible portions of the site. 6. Whether the development has been located outside of the designated Scenic Overlay, or on a suitable site at the greatest distance possible from State Highway 82 and 3 identified ridgelines. Staff Comment: The addition is at the edge of the mapped Scenic overlay. 7. Whether the development has been landscaped in accordance with the adopted State Highway 82 Corridor landscape guidelines and has preserved natural vegetation, to the maximum extent possible, including the avoidance of development within irrigated meadows. Existing vegetation shall be maintained to the maximum extent possible, while using existing vegetation to screen development. A landscaping plan shall be submitted by the Applicant and approved by the Planning and Zoning Commission. Staff Comment: The site has previously been landscaped in accordance with Highway 82 landscaping guidelines as part of a review for the parking lot expansion. The addition preserves existing vegetation. The staff opinion is that additional landscaping is not necessary for this addition. 8. Whether the development's exterior lighting has been designed in such a manner that light sources, such as facade and landscape lighting, will not be seen from public right-of- ways as identified in Section (B)(1). In addition, an application shall be consistent with the lighting regulations identified in the Pitkin County Land Use Code. Staff Comment: The plans submitted do not show additional exterior lighting. The applicant addressed this criteria at the Planning Commission meeting by indicating that no outside lighting is proposed at this time, other than recessed lighting to be used at the new entryway of the Chapel. 9. Landforms and earth moving shall generally not be acceptable as the sole measure of compliance with these regulations. However, they may be utilized in conjunction with other site techniques designed into the development plan. These methods may be acceptable when utilized as one of several methods to complement and enhance development, rather than as the single device for screening development from view from the State Highway 82 Corridor and as mapped. Staff Commeat: Landforms are not proposed. Perspectives provided by the applicant indicate that the addition will create insubstantial visual impacts as seen from Highway 82. 10. Whether the development has been designed so as to avoid, to the maximum extent possible, any Scenic Viewplane identified on the adopted State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan. 4 Staff Comment: The addition avoids mapped scenic viewplanes. 11. In the case where 1041 Hazard Areas may be in conflict with preservation of scenic areas, the Board acknowledges that 1041 issues take precedence over scenic concerns. These issues shall be reviewed on a case by case basis. Staff Comment: There are not any 1041 issues affecting this addition. SIIMMARY: The staff opinion is that the proposed addition to the Chapel complies with both the GMQS Exemption for Essential Community Facilities and the Scenic Overlay review criteria. RECOMMENDATION: The staff and the Planning Commission recommend approval of this application to the Board of County Commissioners, subject to the following conditions: 1. Prior to issuance of any building permits, the existing floor area of the Chapel shall be verified with the Zoning Office. If the structure is over the allowed floor area, a variance from the Board of Adjustment will be required. Side yard setback variances may also be required. 2. Schaffner, Zoning Officer DATE: February 13, 1995 RE: Aspen Chapel GMQS Exemption & Scenic Overlay Review Parcel ID# 2735-114-00-801 I have reviewed the above referenced application and offer the following comments. ZONE: R-30, thirty thousand square foot minimum lot size This parcel contains approximately 1.14 acres and is conforming is size. SETSACRB: The required setbacks for this parcel are: 100 foot major road setback as measured from the Maroon Creek Road right-of-way 30 foot front yard setback 15 foot side yard setback 30 foot rear yard setback Access to the site (ie. front yard side) is on the East. The proposed addition lies within the 30 foot rear yard setback (West side). The site plan which was submitted does not appear to be correct in that there is no road between Maroon Creek Road and the chapel. Therefore, compliance with the 100 foot major road setback cannot be determined. However, it appears that the proposed addition will encroach into this setback. FLOOR AREA: Sufficient information has not been submitted to determine compliance with County floor area regulations. The existing floor area is 5,843 excluding decks and overhangs. The allowed floor area is 6,456 square feet. It is believed that once decks and overhangs are included in the total amount of existing floor area, the structure will exceed the amount of allowed floor area. The applicant is proposing 910 square feet of floor area. A portion of the new development would be included in the existing floor area calculation as it is located under a portion of the deck which is counted in floor area calculations. Therefore, the proposed floor area is somewhat less than 910 square feet. As the existing structure is already over the allowed floor area, any new development must receive approval by the Pitkin County Board of Adjustment before a building permit can be issued. HEIGHT: Sufficient information has not been submitted to determine compliance with County height regulations, however, it does not appear that the proposed addition will exceed the maximum height limit. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104: 'h is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if service is available.' The application shows 'no or minor changes to the use of the water supply system. A condition of approval for this application is -None. SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: 'K is the policy of the Counly to insure that adequate sewage treatment facilities are available to serve existing and new developments. Any proposed system must be shown to be financially feasible considering a reasonable tax base and other legal criteria prior to approval of any land use.' The Aspen Chapel is provided sewage disposal with public sewer as provided by the Aspen Consolidated Sanitation District. There are no changes to the amount of sewage to be added to the District's collection lines. A condition of approval for this application is -None. WATER QUALITY IMPACTS: Sections 2-14, 3-705 and 3-710 'k is the policy of the County to preserve end protect its presentwater resources. To this end it is the policy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water-dependent agricuhural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildl'rfe habitat, or major expenditures to reacquire or redistribute major water resources. The City of Aspen presently provides water service to the Chapel and the surrounding Meadowood Subdivision. While the Meadowood Subdivision has an existing Water Service Agreement for Filing 2, there is no corresponding document to provide water service to the Aspen Chapel. We would encourage the Prince of Peace Chapel to cleaz up this administrative procedure to ensure continued potable water service and fire protection for this essential community facility. Water Department staff has reviewed the proposed improvement plans and does not have any unresolved questions with regard to payment of tap fees associated with the classroom, study, or additional bathroom. However, we would encourage the Chapel to clarify their commitment to annex to the City at a future date, pursuant to existing City policies for water service. The Water Department is proposing to install a new 8-inch water main and fire hydrant in Meadowood Drive opposite the Chapel during the summer of 1995. An easement will be provided by the Aspen Valley Hospital for the line and hydrant. The Chapel's current water service connection is to a 12-inch water transmission main located in Castle Creek Road. The reliability of this existing service is less than if it were connected [o the water distribution system to be completed this summer. Fire protection to the Chapel will be improved by the new hydrant. The Water Department encourages the Chapel to consider upgrading their service connection to the new 8-inch main in Meadowood Drive concurrent with its construction this summer. Without this new connection, water service to the Chapel could be subject to substantial interruption due to scheduled improvements for the 12-inch transmission main necessary if the City elects to serve the Moore and Highlands projects. Unfortunately, such a connection would need to be the financial responsibility of the Chapel since service connections are performed at the property owners expense under the Municipal Code. Water service will continue to be provided at current levels of reliability for the existing and expanded Chapel facilities in the absence of this new connection. This may be acceptable since there aze no residential uses of the property. This application is submitted by Gideon Kaufman pursuant to Sections 3-1501 (L), Section 3-1512 (Essential Community Facility), Section 3-42Q and Section 3-604 (scenic overlay) of the Pitkin County Land Use Code (see Exhibit A, Authorization) on behalf of the Chapel of the Prince of Peace at Aspen, the property's owner (see Exhibit B). EXISTING CONDITIONS The property in question consists of approximately 1.14 acres located in Pitkin County, Colorado, as described in Exhibit B. The present building consists of a chapel, one multi-purpose classroom, and one study for the professional leaders of the different religious congregations. Presently the classroom is used by approximately forty children of a particular faith regardless of the vast variety in their respective ages. There is only one joint study for the Christian Minister(s) and the Rabbi(s) which requires that all religious study materials be taken home after each use. In response to the needs of the community the following improvements have been authorized by the various congregations. PROPOSED IMPROVEMENTS The proposed improvements are for the purpose of adding one additional classroom, one additional study, and a bathroom which meets the requirements of the American Disabilities Act. These improvements will enable the communities' religious leaders to provide a much needed, essential service to the community. It goes without saying that children of ages varying from six to sixteen need different programs and that trying to teach everyone in one classroom is at best chaotic and at worst a wasteful exercise. Staff Comment: The plans submitted do not show additional exterior lighting. The applicant should address this criteria at the meeting. 9. Landforms and earth moving shall generally not be acceptable as the sole measure of compliance with these regulations. APPLICANT understands and agrees that Board of County Commissioners Resolution No. 91-08 and Ordinance No. 93-1 established a fee structure for Planning Office applications (including consultant costs) as part of the application fee charged for THE PROJECT and the payment of all processing fees is a condition precedent to a determination of application completeness. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it is impossible to ascertain the full extent of the costs involved in processing the application upon initiation of case processing. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision. 5. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the amount of $ z,049.00 which is for 12 hours of Planning Office time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to COUNTY to reimburse the COUNTY for the processing of the application mentioned above, including post approval review. Such periodic payments shall be made within 30 days of the billing date.. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing.
