APPROXIMATE ACREAGE: 1.367 acres (59,556.81 sq. ft.) PRESENT USE: Vacant and unimproved PRESENT ZONING: R-15, Residential PROPOSED ZONING: AR-2 (PUD), Accommodations and Recrea- tion District PROPOSED USE: Development of a maximum of ten (10) multiple- family dwelling units. Several units may be offered for sale. WATER AND SEWER: Aspen Water Department mains are installed in 7th Street adjacent to the property and although not in use, the city has indicated water will be made available. The property falls within the boundary of the Aspen Sanita- tion District and said district has indicated the area can be served. ZONING HISTORY: This property was zoned R-15 (with duplexes as a permitted use) in June of 1955 at the time of original zoning. In Pitkin County duplexes were deleted from the R-15 zone district in July of 1970 through an adopted Zoning Code amendment. PLANS FOR THE AREA: The 1966 Aspen Area General Plan has recommended a residential/planned unit land use in the area of the applicant's request: A designation recommended of all develop- ing residential areas of urban character including those east of Aspen along the Roaring Fork, Red Mountain, Castle-Maroon Creek area, Owl Creek area any additional undeveloped land necessary for urban resi- dential use in the future. The intention is to promote interesting and efficient utilization of land for residential pur- poses incorporating a variety of homesites and building types, encourage preservation ,, - 2 - of the natural landscape and creation of useable open space, and to allow open recreation uses including golf courses, riding grounds, parks and trails. Application of this desig- nated use is recommended on an indi- vidual project basis following review of precise development plans. Prin- cipal uses include single family and multi family dwellings plus the asso- ciated uses allowed in the rural resi- dential category. In addition the plan refers to the area of the applicant's request in the following statements: A 15,000 square foot minimum lot area is designated for land presently zoned R-15 Envisioned uses include single and multi family dwellings as allowed under the planned unit approach . And finally, although it was never included as part of any subsequent zoning code amendment, the 1966 Plan encouraged the inclusion of multi family residential land use in areas designated Residential/Planned Unit primarily in order to lessen land area coverage and increase the amounts of open space for each project. COMMEAITS: The applicant's summary statement is attached so that the primary reasons supporting the request are incorporated herein. Generally these supporting reasons would constitute a valid basis upon which to consider granting a zone change with an increase in density. However, at present, with the questions of satisfying exisiting public facility deficiencies unre- solved (ie, hospitals, transportation, land requirements for public buildings), and the impact of existing high density zoning on natural systems and master plan revision yet unsolved, any zone change allowing an increase in density would be un- timely. In its last several rezoning approvals, the Planning Office has not recommended any increases in residential den- sities for these stated reasons, and it is for these reasons that the staff recommends against any density increase in regard to this specific request. There is an existing unknown in addition to those factors mentioned above which indicates that zone changes in the area p R - 3 - of the applicant's request may be correct at a later date. If the future highway and transit access to Aspen were to be constructed in this area it would constitute such a sig- nificant change in condition, with increased volumes of traffic and noise, that a zone change for the area bounded by the new highway or transit right of way on the south, Castle Creek on the west, the city limits on the north, and 7th Street (extended) on the east, would be warranted. In keeping with a "no density increase" policy it could be expected that the area now used for primary highway access should undergo a density reduction. On the other hand, if the plan recommendation calling for a shift in density from the city to outlying activity centers was followed this would reaffirm our recommendation to hold the present density level in the area of the applicant's request. The staff recommendation against a density increase at this time does not include restricting land use to the present R-15 permitted uses. A change in zoning to PR, Planned Residential District would seem correct because of the fol- lowing considerations: 1. PR would require development of the property via an approved (by the County) PUD plan. 2. PR would allow a use change to a 4 unit multiple family dwelling which would be in keeping with the predominant land use in that area of the city. 3. One 4 unit multiple family dwelling would fit on the site better, causing less land coverage by buildings and parking. 4. PR, which would allow multiple family dwellings (as in AR-1), but the same density as in R-15, would constitute a valid transition zone between the two. In summary, the planning staff recommends that the zoning be changed from R-15, Residential District to PR, Planned Residential District and that development proceed according to a County approved PUD plan. WRITTEN STATEMENT IN SUPPORT OF REZONING APPLICATION OF JAMES S, ADAMS 1. Legal Description of Subject property. A tract of land being part of the SWy of Section 12, Township 10 South, Range 85 West of the 6th Principal Meridian, Pitkin County, Colorado, more fully described as follows; Beginning at a point whence Corner No. 7 of the Original Aspen Townsite bears N00°29'42"W 324.24 feet, said point also being record Corner No. 13 of the "Holden Tract"; thence S14°40'W 149.97 feet; thence S79°20'E 312.46 feet; thence S09°37'E 60.51 feet; thence N46°38'E 60.00 feet; thence N24°43'E 111.00 feet; thence N15°52'E 78.10 feet; thence S80°23'W 25.21 feet; thence S14°50'49"W 18.97 feet; thence N79°20'W 367.21 feet to the point of beginning, containing 59,556.81 square feet, more or less. 2. present Use of Subject Property. Unimproved. 3. Present Zoning. R-15. 4. proposed Zoning. AR-2 Planned Unit Development, subject to the hereinafter-described limitations and requirements. 5. Statement. (a) Proposed Use of Subject Property. It is the appli- cant's desire that the use of the subject property be contractually restricted to the development of a maximum of ten (10) multiple- family dwelling units, and that the location, density and type of buildings and dwelling units be governed by a Planned Unit Development Plan to be submitted to the County planning authorities under the provisions of the Pitkin County Subdivision Regulations. (b) Zoning History. The subject property was originally zoned R-15 in 1955, with duplexes a permitted use. The Aspen General plan adopted in 1966 recommended that the subject property, and all adjoining property in Pitkin County extending westerly to the Maroon Creek Bridge on both sides of State Highway No. 82, continue to be zoned R-15 with duplexes a permitted use. The same zoning was in effect when the applicant herein purchased the subject property in 1969. In July of 1970 duplexes were eliminated as a permitted use in the R-15 District in order to combat the urban sprawl occurring on the golf course property. However, the following year this golf course property was annexed into the City of Aspen, and under the City's R-15 zoning duplexes were once again permitted in the golf course area. In sum, immediately following the applicant's acquisition of the subject property, the permitted density thereof was cut in half as a result of a use change the philosophy of which (1) was not really appropriate for nor intended to affect the subject property, and (2) was rejected shortly thereafter by the very municipality whose boundary-densities it was designed to protect. It is submitted that the 1970 use change was accomplished with little or no consideration of the uses or densities appropriate to the County lands lying southwesterly of and adjacent to the City of Aspen and easterly of Castle Creek. It is further submitted that the original, as well as the General plan, R-15 zoning of the County lands lying easterly of Castle Creek was ill-considered, particularly with respect to the portion of such lands (which includes the subject property), lying northerly of the old Midland Railroad right-of-way. These lands adjoin a portion of the City of Aspen which was then zoned T-Tourist (now AR-1) for high density development, and yet these lands were given a low density R-15 designation. Traditionally, high and low density zones have been regarded as incompatible unless special geographic features are present,, and it is for this reason that the R-6 zone is ordinarily inserted as a transition zone between such districts. This applicant believes that both the original zoning of and the General plan recommendation for these lands were in error in not providing for a density transition zone, and ttat R-6 zoning would at that time have been - and under present con- ditions would most certainly be - a more appropriate density -2- designation for these lands. R-6 zoning of the subject property would permit approximately ten (10) dwelling units, and it is for this reason that the applicant seeks a limitation of ten (10) units under the present rezoning petition. (c) Geographical, Neighborhood and Social Justifications. The subject property lies parallel to and approximately ninety (90') feet to the South of Line 7-8 of the Aspen Townsite. All access routes to the subject property originate within the City, and the property is contiguous to Seventh Avenue as extended southwesterly. The availability to the subject property of essential utility services has already been confirmed by the distributing entities (see letters attached hereto as Exhibit A), and here again all such utility lines will originate within the City. Furthermore, the subject property is part of a fairly narrow strip of County lands which is bounded on the North by the City line, on the West by Castle Creek and on the East by U,S, Forest Service property. The subject property thus has a much stronger geographical affinity with the City than with the lands in the County lying westerly of Castl@ Creek, and the potential development thereof should most logically be considered on the basis of its harmony with adjoining City uses and its compatibility with the City's expanding housing needs. As stated in the Introduction to the Aspen General Plan, "In the assignment of character and intensity of land use for each area, political boundaries are much less important considerations than are the natural features of the land, its relation to neighboring uses and to circulation and community facility provisions." As p^e viously discussed, all of the lands lying within the City in the neighborhood of the subject property carry the high density AR-1 zoning designation. At the time these lands and the subject property were initially zoned, and even when the General Plan was adopted, the neighboring City lands were being utilized -3- primarily for low-density residential purposes, with a few lodges scattered throughout the area. However, the character of this neighborhood has undergone a radical change in the past 5-7 years, experiencing a substantial influx of multiple-family dwelling units for long-term occupancy, and an increase (on a smaller scale) in tourist accommodations as well. Moreover, current planning strongly suggests that both the new highway approach and the mass transit system will enter the City on either Main Street or over the Midland Railroad right-of-way. It should also be noted that as presently contemplated, the City's "Green Line" legislation (and probably the County's as well) will encourage higher density development on lands located immediately North of said line than would otherwise be planned or permitted. Such legislation will have a significant effect on properties lying adjacent to the subject property. The above-described changes in the circumstances of the lands neighboring the subject property constitute a sound and persuasive basis for reconsidering the most appropriate and beneficial use of the subject property at the present time. In fact, the authors of the General Plan expressly contemplated and approved the periodic reevaluation of the recommendations set forth in the plan when they stated in the latter part of the Introduction that "It is the duty of the planning commission to determine at what point in time a particular section of land should be rezoned for intensive urban use." And is seems clear that the rezoning requested hereunder is "generally in accordance with the Plan," in that under the Land Use portion thereof the plan provides that "residential densities shall generally be more intense close to Aspen", and that "residential use of an urban character is projected for the south side of the valley between the ski areas and the river." As indicated above, in recent years Aspen's high density residential core area has expanded to within a very few -4- yards of the subject property, and the particular character of the neighboring development suggests a real demand and need for long-term multiple-family housing. It is submitted that the use of the subject property contemplated by this application is far more compatible with the present use of the neighboring City lands than would be the development permitted under the existing zoning, and that the proposed use will far better serve the social needs of the Aspen community for medium- priced long-term housing. Because of the proximity of the subject property and the importance of the eventual use thereof to the City, the applicant respectfully requests that this Application be submitted to the Planning and Zoning Commission of the City of Aspen for consideration before it is finally acted upon by this Commission. (d) Summary. The applicant wishes to emphasize that this petition does not seek high-density zoning for the subject property, but rather the low-medium density which would be allowed if the land were zoned R-6. And R-6 zoning would provide an effective transition area between the high-density City lands to the northeast and the low-density County lands lying to the West of Castle Creek. Castle Creek is a natural geographical boundary for this sort of density buffer zone as well as for urban vs, non-urban residential land uses, and it is the applicant's belief that the Aspen General Plan was in error in failing to recognize these considerations in its recommendation for this area. In addition, the almost total orientation of the subject property toward the City rather than the County, and the significant changes which have occurred in the use of the neighboring City lands and in the housing needs of the City, warrant serious reconsideration of the uses to which the subject property should most properly and effectively be put. The AR-2 designation is not sought for purposes of increasing density, but in order to permit lower cost multiple- family dwellings and greater land use site planning flexibility in -5- the development thereof through utilization of the Planned Unit Development concept. This is in effect spot zoning of one piece of land, 59,576 sq. ft ., toward higher density within a low density residential area. This would not be compatible wit'r. tk:-e existing use of the lsnd. "r. Adams knew the 315 zoning when he bought the land and that the property owners were quite sstisfied witk: that zoning. This area is line a country lane and is much sdmired as is by residents and visitors. It would be regret able to see a development similar to the wall of Villa townhouses breai the openness of what is left of the Castle Creek bank. It seems to me that the zoning chaos we have inherited from the peat, which wa era only now trying to straighten out, is the result of precisely this kind of spot zoning in conformity to no over-all plan. Citizens of this valley expressed their opposition to random growth very strongly in the last election. It is time now to grant no increase in density until we have a plan Por the valley stating where, when and if further development should take place. Tha Adams property, on the bank of Castle Creek, is in a particularly sensitive area. An unfortunate mistake was made when the Villa Townhouses were allowed to create the entrance to Aspen in the form of a solid wall. Unless such development is stopped, this wall could continue along Castle Creak to the base of Shadow Mountain. Surely this ie not the way Aspen wishes to announce its presence. It is worth noting that Mr. Adams opposed the temporary increased public use of the area in the Form of the Aspen Theater Institute Childran~e Workshop in the neighboring barn last summer, but now proposes a permanent change that would nearly triple the density. I hope that the Pitkin County Planning and Zoning and County Commissioners will recognize the threat to this area such upzonirg would portend, and allow Mr. Adams to develop his land within the existing boundaries of R 15.
