Sprint ("Applicant"), has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") for Special Review for the installation of 4telecommunication antennas mounted flush against the exterior wall of the existing penthouse on the roof of the Aspen Valley Hospital, and approval for the associated base platform with related equipment to be installed adjacent to the penthouse. 2. The property is located at 0401 Castle Creek Road and is more specifically described in Exhibit A. 3. The Planning and Zoning Commission ("Commission") at a regulazly scheduled meeting on August 1, 2000, reviewed the application, and forwarded a recommendation of approval to the BOCC. 4. The BOCC heard this application at a duly noticed public heazingon September 27, 2000, at which time evidence and testimony were presented with respect to this application. 5. The BOCC finds that the Applicant's proposal complies with applicable sections of the Pitkin County Land Use Code, provided that conditions of this document are adhered to. NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant approval to the Sprint Cellulaz Special Review, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and public meetings 2. The antennas shall blend-in with the color of the existing penthouse. The Applicant shall use materials for the platform structure that blend-in with the surrounding environment. Non-reflective materials should be utilized. 3. All structures and antennas associated with this approval shall be removed when the lease expires or when the use ceases. 4. The Applicant shall provide a radio frequency radiation (RFR) study to the Pitkin County Communications Engineer for review and approval prior to building permit application. 5. The Applicant shall conduct annual RFR site assessments with grid measurements. This information shall be submitted to the Pitkin County Communications Engineer on an annual basis. 6. Access shall be provided to Pitkin County to conduct an independent RFR study to ensure that the applicant is operating within the FCC's Maximum Permissible Exposure (MPE) standards. She stated that the communication department and Joanna Schaffner, the zoning officer, has reviewed the application and have indicated that they have no issues with this application. Pregl stated that John Dady, the TV engineer, is out of town and hasn't provided any written comments. Pregl stated that she has incorporated three comments that Dady has requested for other telecommunications that they've reviewed. Whipple asked for the status of the Master Plan that Dady is working on. Clarke responded that Dady had stated a master plan would be initiated within 30 days. Clarke stated that he is aware that this is a priority, but no action has been taken on the master plan yet. Thomas asked what the scope and intent of the Master Plan was. Clarke responded that the intent would be recommendations for types of locations that would be suitable for this type of activity, based on surrounding uses and visual and technological concerns. He stated that he hoped it would have provisions for joint tenancy as well as standazds for special review, etc... Clarke stated that he isn't sure when it will be completed. There was brief discussion on how long, and complex a master plan would be. Clarke stated that he doubted it would be done by the end of September. Rudnick stated that it would be nice to have a comprehensive Plan to refer to. He stated that, assuming there are no health concerns, this location seems to be an innocuous place to put a tower. Applicant Presentation Jones stated that she does believe that Pitkin County needs a Master Plan, as it would be much easier for the carriers to know what fits in the community. Jones stated that this plan fits the specs that Clarke just spelled out. She stated that although they are requesting approval for four antennas they would probably start with one or two and leave room for future growth. Whipple asked where the equipment is. Jones pointed out the equipment. Clarke asked if there were whip antennas. Jones responded that there were no whip antennas. Jones discussed a document that reviews their coverage in the area. Rudnick asked what the radius of the antennas is. Ki Socksville ?responded that the antennas have a 90° beam width on them. Rudnick asked if the antenna was mounted on a tower would they have a 360° radius. Socksville responded that the antennas are directional antennas that have a more specific coverage objective. Whipple stated that the County is dealing with a number of carriers right now that are using line of sight. If everybody is located on one structure there will be a huge cluster in one spot. He asked if it would be sensible to have these scattered throughout the area in places where they aren't noticeable, rather than having one common tower. 3 MINUTES of the Pitkin County Planning and Zoning Commission Tuesday, August 1, 2000 Rudnick reiterated his comment that this seems like an ideal location, a3'51~1~~g~z=~..~„ there is no health risk. Whipple stated that he doesn't want to see a tower on the hill that is loaded with fourteen different projections. Thomas stated that he doesn't want to see them littered up and down the Hwy 82 corridor. He stated that he isn't concerned with the visual impact but he does have issues. For one, there isn't an RFR study. The applicant discussed several locations where they have towers erected, including a children's hospital, and elementary schools, and there hasn't been any complications. Thomas stated that doesn't assure him that they aren't exceeding RFR guidelines. He asked if they've ever done a study of RFR exposure where they have placed towers. The applicant responded that they have very strict guidelines that are based on various group studies done by the American National Standards Institute (AMSI) ,and the American Electrical Engineering (AEE) Group. He stated that they give the FCC a standazd of exposure. The FCC takes that number and multiplies it by a 1,000 and the carriers must comply with that. He stated that they don't have a problem with that standard because their facilities aze so low powered. Whipple stated that the fact that they are so low powered that there is no standazd for them, is what the P&Z is concerned with. Clarke stated that his understanding from John Ely, the county attorney, is that the County can not impose RFR regulations that are stricter than FCC regulations. Thomas stated that they have to consider whether the use is consistent with the zone district and he doesn't think it is. Pregl clazified that this is included as a Special Review Use of that zone district. Thomas responded that this is not a consistent special review use of that zone district. Jones asked what areas in Aspen would be appropriate for telecommunications facilities, given that they are so new. Rudnick asked if they could argue that it is consistent with the purpose of the zone district in that it is utilized by the community at large and non-profit operations. Thomas stated that you are then still promoting a commercial enterprise. Public Comments There were no public comments. Commissioner Comments Whipple stated that it his responsibility to look at land use including visual qualities. He stated that this is a lot better than what he's looked at previously. Thomas agreed. Whipple stated that he isn't sure that he wants one tower with every carrier on it. He also doesn't want a proliferation of elements everywhere. Regazding the health and safety issue, he stated that it is appropriate for Environmental Health needs to review that. Ives Special Review and 1041 Hazard Review Summary of Request The Applicant is requesting Special Review approval pursuant to Code Section 3-210 for the installation of 4-telecommunication antennas mounted flush against the exterior wall of the existing penthouse on the roof of the Aspen Valley Hospital, as well as approval for an associated base platform with related equipment which shall be installed immediately adjacent to the penthouse. Staff Presentation Brian McNellis summarized the application as outlined above and in the meeting memo, pointing out the location on a map provided. McNellis stated that the facility would be fairly unobtrusive with virtually no visibility from Hwy 82 or Lower River Rd. He stated that there aze no major 1041 concerns. The application was referred to Jonathan Lowsky, the Pitkin County Wildlife Officer. He submitted no comments. The Colorado Division of Wildlife had minimal concerns and made recommendations for mitigation. The structure will require BOA approval. Applicant Presentation Keri Rousseau, the applicant's representative, introduced Chris Tenney the RF Engineer for Voicestream. Rousseau stated that if the County is ready to begin developing a Master Plan, they would definitely like to give some industry input, stating that essentially the same thing happening in Pitkin County happened in Denver about four years ago. She stated that now that everyone has a code in place, things are working very well. The Plans that work the best are the ones that have had industry input. Distributing a picture, Rousseau discussed the visual aspects and location of the facility. She stated that it would be very difficult to see the site from the road. She stated that they've worked with the Ives', who are very concerned with the aesthetics, for close to a yeaz. Rudnick asked if it would work for them to lease space at the Old Snowmass Cabins, which has already been approved. Rousseau replied that they have evaluated that candidate. She stated that SBA used to be Voicestream's build to suit company, but they fired SBA about a yeaz ago as they had very opposing views as to what should happen in a county such as Pitkin. She stated that site does not meet their coverage objective. There was further discussion about other possible locations. There were problems related to industry specifications for co-location and appropriate sepazation on the antennas so as not to cause interference. Rudnick asked what the range of their wave was. Rousseau responded that it was 1.8 to 1.9 gigahertz. ATTACHMENT 5 MEMORANDUM TO: Pitkin County Planning and Zoning Commission FROM: Tamara Pregl, Planner* RE: Sprint Cellular Special Review DATE: August 1, 2000 SUMMARY OF REQUEST: The Applicant is requesting Special Review approval pursuant to Code Section 3-210 for the installation of 4-telecommunication antennas mounted flush against the exterior wall of the existing penthouse on the roof of the Aspen Valley Hospital, as well as approval for an associated base platform with related equipment which shall be installed immediately adjacent to the penthouse. APPLICANT: Sprint APPLICANT'S REPRESENTATIVE: Denise Griffin-Jones LOCATION: Aspen Valley Hospital; 0401 Castle Creek Road. ZONING: PUB (Public) STAFF COMMENTS: SPECIAL REVIEW (SECTION 3-210) A telecommunication facility is considered a Special Review Use within the PUD zone district and is subject to the following standards pursuant to Section 3-210 of the Land Use Code: A. The special review use must be consistent with: 1. The applicable County Master Plan; 2. County Land Use Policies in Article 2; 3. The intent of the Zone District in which it is proposed to be Zocated,• and 4. The character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhance the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. Response: • The Aspeti Valley Hospital Master Plan was adopted by the BOCC in 1989, pursuant to Resolution No. 89-79. The plan was subsequently amended in 1991 and 1992 for expansion purposes. The Master Plan does not prohibit telecommunications equipment to be installed on top of the building or anywhere else on the subject property. • The proposed addition is consistent with applicable Code Policies in Article 2. • The intent of the PUB zone district it to `provide for the development of public uses, facilities and services for governmental, civic, educational, humanitarian, health care and other non profit public purposes consistent with the County land use plans and policies and to provide for related Spring Special Review August 1, 2000 Page 2 uses which are customarily incidental or accessory to public uses. " Telecommunication Facilities are Special Review Uses in the PUB zone district. The proposed antennas and equipment platform will not adversely affect the character of the immediate vicinity of the hospital. B. The location, size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. Response: The proposed antennas will be mounted flush against the building and will not exceed the existing roofline. The proposed antennas will match the color of the existing building. The proposed equipment platform will be located adjacent to the existing penthouse on the top of the hospital. Visibility of this platform should be minimal. There is no steady traffic associated with the telecommunication facility except for occasional routine maintenance. C. There must be adequate public facilities and services to serve the special review use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. Response: Not applicable. This project does not required public facilities. However, if any emergencies aze associated with the proposed antennas or the equipment platform, the project is located on top of the hospital, and the hospital is serviced by the Aspen Fire Protection District. D. An application for a special review use must demonstrate to the Board of County Commissioners that the proposed development will not: 1. Matertally endanger the public health, safety or welfare; and 2. Substantially injure the value of adjoining or abutting property. Response: The proposed project, to staff's knowledge, does not endanger the public health, safety or welfare or substantially injure the value of adjoining or abutting property. - OTHER: It appears from the site plan that aside from the 2 proposed antennas on the east side of the penthouse and the 2 proposed antennas on the north side of the penthouse, that the Applicant is proposing two more antennas in the future. It is staff's opinion that these antennas should be reviewed Administratively by staff prior to the installation to determine if they are truly necessary. Joanna Schaffner, Pitkin County Zoning Officer and Mark Gamrat, Communication Director, have reviewed the project and have noted that they have no issues. John Dady, Pitkin County TV Engineer did not provide written comments for the proposed project. However, he did request that additional information be provided to him regarding frequency transmission and output of the antennas, which the Applicant's representative has provided (attached email). This email was forwazded to Mr. Dady, however, no comments were received by Mr. Dady prior to the distribution of this memorandum. Staff has requested that Mr. Dady or his staff either provide comments written comments prior to the meeting or verbally at the meeting. The FCC, in regulating electromagnetic energy, applies a modNietl version of the standards developed by the American National Standards Institute (ANSI) and the Insttrilte Of Elecbical end Electronics Engineers (IEEE) to indude the NCRP standard for Spedftc Absorption Rate or SAR, for PCS bands. These standards, when converted over to the more familiar power density specificatton, set a maldmum power der>sity level for public areas at 1.00 mW/ark (miUiwatts per square Centimeter) for general population exposure and 5.00 mW/cmZ for ocwpafional exposure. AS a measure Of safety. this level is set 50 times lower than levels the standards committees felt could Our antennas are designed to concentrate the majority o} their signal power out of the front ~ the antenna in a very thin beam. These installations consist of three antennas each designed to Dover 120 degrees for a total of 360 degrees of coverage. Signal strength coming from the bads of an antenna and from positions well below an antenna Is typically hundreds of times lower than the signal in the main beam at the front of the antenna. PCS techndogy uses very bw power trensmitters espedally when compared with N and Radio broadcasting which can be hundreds of thousands of times more powerful than a PCS statton. Through software modeling techniques, we can calculate the power densty from a Sprint PCS irtstaUatton at a varfeiy of loc~ons around the proposed site. Sprint PCS evaluates all sites to determine the percent of exposure incurred by the general public and occupational exposure. resulting from the operation of our antennas. This ie an issue that we take very seriously with much effort anc~ ~ ~npower going into maintaining NEPA compliant sites. In atltlidon to this, regular audits are conducted to ensure accuracy and completeness. We have developed several proprietary software programs exdusively used to determine power density levels and to compute maximum exposure limits. It is also our pdicy that when a site is charged in any manner that would impact exposure levels, a new analysis is performed. The guidelines are given in terms of mW/cm^2 and the maximum limits are termed "Maximum Permissible Exposure" (MPE) for both occupational antl general cases. Because these guidelines are based upon the same SAR limits as those in the (EEE/ANSI and NCRP guidelines, they also include the safety factors of 10 and 50 for occupational and general public scenarios respectively. The graph in Figure 1-1 shows the current FCC MPE guidelines. The two arrows indicate the cellular (-850 MNz) and PCS (-1900 MHz) }requendes. The exposuro limits for PCS, expressed in terms of more readily deterrnined "power density", are 1.0 and 5.0 mW/cm"for general public and occwpational cases, respectively. Figure 1-f: FCC Exposure Limits. Current FCC Rules/Regulatlons The current regulations are contained in CFR Title 47, Sections 1.1307 and 1.1310. A brief summary of the current regulation is as follows: • In general, all }aalities, operations and transmitters regulated by the Commission must comply with the exposure limits put forth in the NEPA rules of Title 47, Part i ,Section 1.1307 and 1.1310. • Applications to the Commission ... must contain a statement confirming compliance with the limits unless...categodcallyaxcluded. • Technical information showing the basis for this statement must be submitted to the Commission upon roquest. a 12i>.Yioo 09:1a Fna ®ooa • In the case of multiple fixed transmitters, any action necessary to bring the facility into compliance is the shared responsibility of all licensees whose transmitters contribute more than 5% of the exposure Ilmlt applicable to that transmitter. SpMrlarl Modeling The concept of the spherical model is to assume that the EIRP of the actual antenna is being applied to a point source (tl'ue isotropic radiator.) This is really only valid in the center of the main beam of the antenna but it guarantees a woret-case view everywhere else. The power density is then calculated by dividing the EIRP by the surface area of the sphere (4tt~, for the distance r away from the antenna. In general we will cens(der the shortest distance between the antenna and asix-foot area above the roof or ground where a person might stand. Additionally, we must multiply the EIRP by a power reflection coefficient to account for the fact that reflections from the roof or ground could add constructively with the incident wave at the point in question. The concept of the cylindrical model is to take the power actually delivered to the antenna, P, (NOT EIRP) and assume tt i9 equally distributed over the surface o} a cylinder of the same length as the antenna. if the antenna is a directional antenna then we reduce the surface area of the cylinder by BW/360 (BW is the 3-dB beam-width in degrees.) This is a good near-field model. Addtionally, if the antenna is mounted above the rooftop level, the average power density in a 6-foot tall area immediately above the roof level (where a person migh# be standing) is reduced according to how far above the root the antenna is mounted. No Cellular Phones in Hospital: Commissioner Clapper requested that staff inquire as to whether there is a conflict with installing the proposed antennas on the hospital since there is a sign on the hospital doors that states that cellular use is prohibited within the hospital. The attached letter from the Aspen Valley Hospital indicates that there is no evidence to support that PCS equipment would pose any interference threat to the hospital's internal telemetry system. Code Amendment -Wildfire Section Summary of Request This is aCounty-initiated Ordinance proposing an amendment to section 3-80-070 of the Land Use Code. The proposed Ordinance is attached to this memorandum. Staff Presentation Tamara Pregl summarized the proposed Land Use Code amendment as outlined in the meeting memo, stating that it is to allow flat roofs within the wildfire azeas of the county. The County has received a number of complaints from local architects that the current pitch, 3:12, is too great for some of their design. Whipple asked how much of the original language of the Code has been modified. Clarke responded that the only portion that is new is what is stricken. Pregl read the new language into the record. The new language is included in attachment A to the ordinance as 3, a, 1-5. Clazke expounded on the summary stating that Staff began working with all of the fire districts and the Colorado Forest Service in adopting a wild land interface code. Although they haven't adopted this code yet, it came up during the meetings that Pitkin County should have no wood shake shingles or flat roofs in any wildfire hazard area. Staff then changed the code to read that way and it was adopted two years ago. Whipple stated that he was concerned with 6, b "Swimming pools shall be accessible to Fire Department vehicles." Clarke clarified that the Fire Department needs to be within 150 ft of the pool. Whipple asked if the statement could be changed to read that pools should be accessible for use during an emergency. From this amount, we subtract approximately 2 dB for loss through the coaxial cable and all the connectors giving us an ERP of 49 dBm. The closest visible antennas available to inspect a Sprint installation would be in Avon. We have antennas on top of a hotel/office building called the Lodge at Avon. It's a prominent building in town with about 10 floors. We also have our antennas on the elementary school in Vail which is right off of I-70. As far as safety concerns, there are 'maximum permissible exposure' (MPE) limits set by the FCC and Sprint must comply with these limits on every site constructed. Keep in mind also that according to the Telecommunications Act of 1996, no zoning board can legally deny Sprint a site for safety concerns - like I said, we have to comply with all regulations set by the FCC and are also required to put signs at the sites informing people that our antennas are close. We also have to submit forms to NEPA for each site which detail the emissions for all providers on a given site along with our own. You can let them know that one of our sites is the hospital on the Air Force Academy in Colorado Springs. This site has been on air close to 2 years now with no complications. We also have a site on the parking garage of a Denver Children's Hospital. Maybe this will help ease their minds. With regard to commercial enterprises within the PUB Zone District, the County posted an Sprint Cellular Special Review September 27, 2000 RFP for a tower site on county owned property. Staff is of the opinion that it is appropriate, with the help of a master plan, for private entities that specialize in the telecommunication industry to place towers and antennas where they are appropriately needed. RECOMMENDATION: Staff and the Planning and Zoning Commission recommend that the BOCC adopt the following motion, "to approve the Sprint Cellular Special Review, subject to compliance with the conditions of the attached Resolution."
