The existing unit is attached to the Vaughn residence and contains approximately 435.square feet of net liveable space. The applicant wishes to deed restrict the residence to "caretaker unit" status, pursuant to Ordinance 91-11. LOCATION: The residence and caretaker unit are located at 0221 S. 7th Street, Aspen. The property is also known as lot 1 of the Sawmill Subdivision. ZONING: R-15. /~l ~~J N~Q:n SG~iwk r7`"b STAFF DISCUSSION: Except for the fact that the bandit unit is 35 square feet over the allowable square footage for a caretaker unit in the R-15 zoning district (400), the bandit unit complies with all other applicable requirements of Ordinance 91-11. The unit is attached to the primary residence, and was constructed between June 1981 and October 1991. The application for approval of the bandit unit was received prior to the close of the amnesty period, and the applicants state that they are prepared to execute a deed restriction for the caretaker unit in conformance with 3- 8.13(a)(4). The Certificate of Occupancy issued 7/27/90 describes the entire residence and states that the structure was constructed in conformance with the Uniform Building Code. However, sometime after issuance a bedroom was converted into a unit by the addition of a kitchen. This unauthorized construction requires a new building permit. Staff has visited the property and finds that this development is in harmony with its neighborhood and does not constitute overcrowding or impart any unusual visual impacts to the area. The referral agencies have submitted comments about the application. The Water Department wants to ensure that applicant pays any associated top fees for the increase in water demand generated by the unit. A condition has been added that requires the applicant to contact the water department to resolve this issue. Additionally, the Building Department requires that an application for all unauthorized work be submitted. RECOMMENDATION: Staff recommends that the board approve the Vaughn bandit caretaker unit subject to conditions indicated below: 1. Within one month of approvals the Applicant shall submit a complete building permit application in compliance with all provisions of the Uniform Building Code; The Applicant shall contact both the Water Department and the Aspen Consolidated Sanitation District to determine if any additional fees or actions are required of the applicant in regards to the bandit unit. If fees or actions are required, they shall be fully complied with prior to recordation of a deed restriction with the Housing Office; and 3. Specifically, this letter is intended to comply caith the provisions of sub-section (e) of said ordinance, pursuant to which the Board is authorized to "approve as an employee unit attached to or within a principal unit one residential dwelling unit on a lot or parcel of land under the following conditions": 1.(a) The subject unit was constructed between June 8, 1981 and October 29, 1991 (the Certificate of Occupancy is dated July 27, 1990); accordingly, application is being made pursuant to the six-month "amnesty" provision of the ordinance. 2. Except as expressly noted below, the application comports with the requirements of sections (a), (b), (c) and (d) of the Ordinance, to-wit: (a) The subject unit meets the criteria set forth in Section 3-8.13 (a) in all respects, with one exception: The subject property is zoned F.-15, and the subject unit contains approximately 435 square feet of net livable space, thus slightly exceeding the maximum square footage permitted under this sec- tion. The applicant is prepared to execute a deed restriction consistent with the provisions of Section 3-8.13(a)(4). (b) The provisions of Section 3-8.13 (b) do not pertain to the subject unit, as it does not exceed 700 square feet, and is not within the designated. zone districts. ZONE: R-15 - 15,000 square foot minimum lot size HISTORY: The main residence located on Lot 1 of the Sawmill Subdivision was approved in 1989 as a four bedroom residence. A Certificate of Occupancy was issued in 1990. Sometime thereafter, a kitchen was installed in Bedroom #3, located directly behind the garage. This kitchen was not approved. FLOOR AREA: The main residence is well below the maximum allowed floor area for the site. I concur with the applicants calculations for the caretaker unit: 435 net livable square feet. This exceeds the allowed net livable square footage for caretaker units in the R-15 zone district by 35 square feet. PARKING: The applicant must provide four parking spaces on site. OTHER: As this unit is an integral part of the main residence, and as the main residence received zoning approval in 1989, Zoning Staff has no further comment. SEWAGE TREATMENT AND COLLECTION• Sections 2-7 and 5-200• The sewer service for the employee dwelling unit can be provided from the Aspen Consolidated Sanitation District. The provision of service to this area by the Aspen Consolidated Sanitation District meets the requirements of this department. This conforms with Section 1-2.3 of the Pitkin County Regulations On Individual Sewage Disposal Systems policy to "require the use of public sewer systems wherever and whenever feasible, and to limit the installation of individual sewage disposal systems only to areas that are not feasible for public sewers". The existing residential unit is served with public sewer. We consider this sufficient documentation "...that both the applicant and the service agency are mutually bound to the proposal and that the service agency is capable of serving the development..." as defined in Section 5- 200.2 of the Pitkin County Code. ADEQUATE PROVISIONS FOR WATER NEEDS• Sections 2 6 and 5 205 Water service is to be provided from the Aspen Water System. The provision of potable water from the Aspen Water System is consistent with the area service plan and should provide a satisfactory quantity of water meeting- all standards of the Colorado Department of Health for drinking water quality. The plan conforms with the Pitkin County Code requiring projects to be connected to the municipal water utility system as a logical extension of utilities. AIR QUALITY: Sections 2-17 and 5-106• Only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County: this development will not. In fact, by having the employee unit attached, there will be no additional fireplaces or woodstoves.
