AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO ACCEPTING THE
CONVEYANCE OF REAL PROPERTY FROM JIM MARKALUNAS AND
RAMONA MARKALUNAS TO THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO
Ordinance No. 98-
Recitals
1. Jim Markalunas and Ramona Markalunas are the owners of real property
situated in the Redstone Subdivision generally described as Lots 98, 99 and 99A of the Redstone
Subdivision attached hereto.
2. As a condition of approval in connection with Pitkin County Resolution #98-
101, the Markalunas' are required to quit claim to the County any right they have to the
intervening land between their property line and the paved portion of Redstone Boulevard.
3. The Quit Claim Deed satisfying this condition is attached as Exhibit A.
4. The Quit Claim Deed references a 1041 map to be recorded and the
Markalunas' have agreed to depict the two access driveways across the property being conveyed
on the 1041 map.
NOW, THEREFORE, be it ordained by the Board of County Commissioners of Pitkin
County, Colorado that the Board of County Commissioners does hereby accept the Quit Claim
Deed of real property from Jim Markalunas and Ramona Markalunas to the Board of County
Commissioners of Pitkin County, Colorado more fully described in Exhibit A attached hereto.
INTRODUCED, FIRST READ AND SET FOR PUBLIC HEARING ON THE 12th
DAY OF AUGUST, 1998.
NOTICE OF PUBLIC HEARING PUBLISHED IN THE WEEKEND EDITION OF THE
ASPEN TIMES ON 15th DAY OF AUGUST, 1998.
APPROVED UPON SECOND READING AND PUBLIC HEARING ON THE 26th
DAY OF AUGUST, 1998.
PUBLISHED AFTER ADOPTION IN THE WEEKEND EDITION OF THE ASPEN
TIMES ON THE 3 a of oe-rrr3e2., 14V.
THIS ORDINANCE SHALL BECOME EFFECTIVE 30 DAYS AFTER PUBLICATION FOLLOWING
FINAL ADOPTION BY THE BOARD.

THIS DEED, made this day of July, 1998, between JAMES J.
MARKALUNAS AND RAMONA MARKALUNAS of the County of PITKIN, State of
Colorado ("Grantor(s)"), and PITKIN COUNTY, whose legal address is
Aspen, Colorado(Grantee(s)").
WITNESSETH, that the Grantor(s), for and in consideration of
the sum of TEN DOLLARS ($10.00), the receipt and sufficiency of
which is hereby acknowledged, has/have remised, released, sold,
conveyed and quit claimed, and by these presents do/does remise,
release, sell, convey and quit claim unto the Grantee(s),
his/her/their/its heirs, successors and assigns, forever, all the
right, title, interest, claim and demand which the Grantor(s) has
in and to the real property, together with improvements, if any,
situate, lying and being in the County of Pitkin and State of
Colorado, legally described as follows:
All property lying between the extension of boundary lines
N59,44,13,W and N67,15,45,W in the North 1/4 Corner, Section 20 to
Redstone Boulevard and the outside of the boundary line N62, 20,
46, E as conveyed under Warranty Deed recorded in Book 605 Page 464
and 465 to Lots 98 and 99 in Redstone Subdivision, subject to the
two historical driveways and access, not to exceed twenty feet in
width, that are currently in place, one driveway servicing each of
Lots 98 and 99 from Redstone Boulevard, as will be depicted on the
MARKALUNAS 1041 HAZARD REVIEW MAP to be recorded. The Grantors
retain their existing rights for access through the historical
driveways and points of ingress and egress over this narrow parcel
as depicted on this recorded map.
TO HAVE AND TO HOLD the same, together with all and singular
appurtenances and privileges thereunto belonging or in anywise
thereunto appertaining, and all the estate, right, title, interest
and claim whatsoever of the Grantor(s), either in law or equity, to
the only proper use, and benefit of the Grantee(s),
his/her/their/its heirs and assigns forever.
IN WITNESS WHEREOF, the Grantor(s) has/have executed this deed
on the date set forth above.
