The applicant is requesting Activity Envelope and Site Plan Review land use approvals to construct a barn on the property. The property is improved with a single family residence and caretaker dwelling unit (CDU). It is located at 3768 Snowmass Creek Road, just past Watson Divide. Please refer to the Vicinity Map in Attachment 1 This land use application includes the following sections: Background; Existing Conditions; Project Description; and Land Use Approvals. BACKGROUND The subject site was originally created as part of a Low Impact Subdivision for a two lot subdivision. Attachment 2, is the Board of County Commissioner Resolution No. 89 -128 granting "Final Plat Approval of the Lind Koppel Low Impact Subdivision and a Deed Restricted Employee Dwelling Unit (EDU) ". The Subdivision Improvement Agreement (SIA) for the Lind /Koppel Subdivision is found in Attachment 3. These approvals establish a building envelope for the primary residence and an EDU, both of which have been built. The owner would now like to add a barn and is requesting approval for an Activity Envelope to contain the barn. EXISTING CONDITIONS The subject property contains 38.3 acres, is relatively flat and is improved with an existing single family residence and an Employee Dwelling Unit (EDU). As shown in Attachment 4, the subject property is bounded by Snowmass Creek Road to the west and is accessed off the Road from an existing gravel driveway. Snowmass Creek (the water body) is adjacent on the east side of the lot. The 100 year flood plain is noted on the Site Plan, as is the mean high water line. Two large areas on the east and west sides of the site have been preserved as they are restricted against development for the protection of wildlife. The site is level with a slight slope from the Creek up to Snowmass Creek Road. Attachment 4 gives two foot contours for the proposed Activity Envelope where the barn is to be located. The site is zoned RS -30 and is used for agricultural purposes. An accessory barn structure in the applicable RS -30 zone district is allowed an additional 58 square feet of floor area for every acre of land. Therefore, there is an additional 2,221 square feet of floor area for the barn for the 38.3 acre subject property (38.3 acres x 58sf= 2,221sf). PROJECT DESCRIPTION The applicant is requesting approvals to build a new barn as an accessory structure to the existing single - family house. The barn is proximate to the existing home and accessory dwelling unit, in a location compatible with the site and the intent of the uses on site. Please refer to Attachment 5 for the elevations of the barn and Attachment 6 for the floor plans of the proposed barn structure. LAND USE APPROVALS The following sections address the land use approvals identified in the pre - application conference which appears as Attachment 7. The applicant is seeking the following land use approvals. Sec. 7- 10 -50: Activity Envelope /Site Plan; Sec. 2 -30 -20 (g): Activity Envelope and Site Plan Criteria for Approval; Sec. 7- 20 -20: Steep and Potentially Unstable Slopes; Sec. 7- 20 -10: Site Preparation and Grading; Sec. 7- 20 -30: Water Courses and Drainage; 0 00002 Sec. 7- 20 -60: Wildfire Hazard - Low Hazard; Sec. 7- 20 -70: Wildlife Habitat - Riparian habitat next to Snowmass Creek, adjacent to elk winter range and overall range and concentration area, in mule deer winter range, summer range and overall range; Sec. 7- 20 -80: River and Stream Corridors; Sec. 7- 20 -40: Floodplains; Sec. 7 -20 -130: Landscaping and Vegetation Protection; Sec. 7- 20- 120(d): Standards for Scenic View Protection Areas (View shed Bracket) Sec. 7- 20- 120(e): Rural Character Guidelines for Building Location; and Sec. 2- 20- 10(e): Prohibition of Commercial Agricultural Activities. As required, the following sections of the application demonstrate compliance with the above Land Use Code standards. Activity Envelope and Site Plan Section 7 -10 -50 This section of the Land Use Code explains the Site Plan and Activity Envelope review and approval process. The applicant has followed the process outlined in this section of the Code to prepare the Feitshans Activity Envelope and Site Plan found in Attachment 4. The key site planning considerations on the subject site have been location outside the 100 foot setback from Snowmass Creek, avoidance of the protected large acreage preserved for wildlife in the original approvals, minimizing visual impacts from Snowmass Creek Road and Watson Divide Road. Activity Envelope and Site Plan Criteria for Approval Sec. 2 -30 -20 (g) This Code Section was not identified in the Pre - application Conference Summary, but has been addressed anyway. The criteria for approving an Activity Envelope and Site Plan is based upon three factors, avoiding constrained areas, the affect on adjacent property owners, and consistency with the applicable Comprehensive Plan. The proposed barn's location avoids constrained areas, has no impact on adjacent property owners and is consistent with the Snowmass /Capital Master Plan which covers this part of the County. The application complies this section of the Code. 004803 Site Preparation and Grading: Section 7 -20 -10 (a) Grading and Fill Placement Grading and filling on a site shall take place only within a defined Activity Envelope . All grading and fill placement that exceeds fifty (50) cubic yards shall be indicated on the Site Plan . The two foot topographic contour intervals shown on the Activity Envelope in Attachment 4 show that the Activity Envelope is mostly level, with a few gentle slopes below 5% in grade. There will be minimal grading necessary for the new barn. A detailed grading plan will be submitted with the building permit application. The applicant shall obtain an earthmoving permit prior to initiating any grading. (b) Clearing, Grubbing, and Vegetation Removal Clearing or grubbing of land, or removal of vegetation shall take place only within an approved Activity Envelope , except removal of noxious weeds may occur outside of an Activity Envelope. Each Site Plan shall document compliance with the requirements of this Sec. 7- 20 -10(b) and Sec. 7 -20 -130. When necessary, clearing, grubbing and vegetation removal will be limited to the most minimal area within the Activity Envelope. (c) Tree Removal and Mitigation Each tree with six (6) inches or larger diameter at breast height (D.B.H.) that is removed within the Activity Envelope shall be replaced with one (1) or more trees with total D.B.H. at least equal to the caliper(s) of the tree(s) removed, to the maximum extent practicable. Any tree that (1) is diseased, or (ii) is required to be removed pursuant to the provisions of Sec. 7- 20 -60, as those requirements may be varied by a wildfire expert approved by the County, may be removed and no replacement shall be required. All revegetation shall also comply with the Pitkin County Revegetation Guidelines. Required replacement trees that do not survive for at least one (1) year after installation shall be replaced at the owner's expense, and the County may require financial security for such replacement pursuant to Sec. 7- 20- 130(b)(7). The Gambel oak in the Activity Envelope are clustered and removal will not be necessary. (d) Protection of Natural Terrain The County Engineer or Community Development Director shall suggest and may require design and construction techniques that lessen or mitigate any physical and visual damage caused by the proposed activity or development to Constrained Area s or to the natural terrain, stream vegetation, and other natural features of the landscape within the Activity Envelope . Techniques shall include, but are not limited to: (1) REVEGETATION Revegetation and reforestation utilizing native or similar horticultural material, to be completed during the first planting season after construction; where vegetation is removed, it shall be replaced with vegetation that will reach similar density and height to that removed within two (2) years following conclusion of construction. (2) TOPSOIL Removing and saving topsoil prior to any grading or excavating and replacement for revegetation. 0 400 (3) WEED PREVENTION Weed prevention, thistle management, and prohibition of non - native plants, which may include reducing animal damage to vegetation cover, as determined by the United States Soil Conservation Service Soil Survey. (4) UT/LITY/NSTALLAT/ON Locating and installing utilities in a manner minimizing damage to the natural environment and scenic quality. (5) EROSION, SEDIMENTATION, AND STORMWA TER MANAGEMENT (a) Land uses shall. 1. Not cause erosion problems and, if practicable, retain all soil on site; 2. Minimize disturbance of natural vegetation and soil cover; 3. Ensure that all cuts and fills are adequately designed and vegetated to control erosion as well as stability of the slope area; 4. Ensure that natural drainage patterns are preserved and protected from increased water flows that subject existing channels and adjacent areas to increased erosion; and 5. Preserve natural vegetation and soil cover within those buffer distances adjacent to rivers, streams, lakes, reservoirs and wetlands /riparian areas established in Sec. 7- 20 -80. (b) Mitigation measures identified in an approved erosion, sedimentation, or stormwater management plan shall remain in place until revegetation is viable. The applicant will comply with these standards. Steep and Potentially Unstable Slopes Section 7 -20 -20 This section of the Land Use Code requires development to be located on slopes of less than 30 percent unless there are unusual factors affecting site development. As shown in Attachment 4, the subject site is mostly level and there are no slopes greater than 5% in the Activity Envelope. Consequently, the standards in this section of the Code have not been addressed in detail because steep slopes will not be impacted by the proposed barn. Water Courses and Drainage Section 7 -20 -30 This section demonstrates compliance with the Land Use Code standards for Water Courses and Drainage. Standards appear in bold followed by the applicant's responses. (a) Encroachment or Channeling Encroachment or channeling activities in a river, stream (including intermittent streams), pond, wet meadow, or wetland are also subject to the requirements of Secs. 7 -20-40 and 7 -20 -80 of this Land Use Code, as well as all other applicable state and federal statutes and regulations (including, but not limited to the U.S. Army Corps of Engineers permitting requirements of Section 404 of the Federal Clean Water Act). 000005 -„ The applicant is not proposing to alter any rivers, streams, ponds wet meadows or wetlands on the site or in the site vicinity. (b) Drainage (1) GENERAL Activities and development shall provide for: Maintenance of historical flow patterns and runoff amounts to reasonably preserve the natural character of an area and prevent property damage attributable to runoff rate and velocity increases, diversions, unplanned ponding and /or stormwater runoff; The unimpeded flow of natural water courses and ditches; Adequate drainage for all low points; A drainage system designed to account accommodating runoff from a proposed from areas adjacent and upstream; for an entire drainage basin capable of development and, where applicable, the runoff Maintenance of drainage systems; and On -site treatment of stormwater by use of best management practices designed to detain and allow infiltration of runoff prior to discharge to any water body. (2) Runoff Volumes Runoff volumes and peaks within a development site and in areas affected by runoff from a development site shall not exceed the runoff levels attributable to the undeveloped site as determined by a professional engineer licensed in the State of Colorado. The applicant shall submit a drainage plan for the property as part of the building permit submission. The applicant commits to not alter drainage patterns in the site vicinity which would increase off -site drainage. (C) Groundwater Activities and development shall not result in the introduction of any contaminants to groundwater, or interfere with any recharge area or aquifer. The applicant will comply with this Land Use Code standard. (d) Irrigated Areas Activities and development shall: (1) Not adversely affect the adequacy of water supplies available for the irrigation of agricultural lands; and (2) Not adversely affect the exercise of any existing and decreed irrigation water right. The applicant will not adversely affect the adequacy of water supplies available for irrigation of agricultural lands or affect the exercise of any existing and decreed irrigation water right. This standard will be met. (e) Irrigation Ditches Activities and development shall: 0006 (1) ACCESS Provide for access to irrigation ditches by ditch owners and to the public if a ditch is to be, or is part of the Pitkin County Open Space and Trails System or other public property. (2) PREVENTING LEAKAGE Ensure that no building shall be constructed immediately downhill of a ditch unless the ditch can be placed in a culvert, lined, or otherwise treated to avoid leakage of water downhill towards the building. (3) AVOID FLOODING Design land uses to avoid flooding problems from flood irrigation. (4) AVOID SEEPAGE Place basements and soil absorption on -site wastewater treatment systems in locations where they will not be impacted by flood irrigation or seepage from irrigation ditches. There are no irrigation ditches in the Activity Envelope. This requirement will be met.. (f) Sedimentation Activities and development shall: (1) CONTROL DURING CONSTRUCTION Provide adequate sedimentation control throughout all phases of development. (2) SEDIMENTATION Retain sediment produced by soil disturbances on site where the disturbance occurs and prohibit run-off into any water body, wetlands, or riparian area. (3) REVEGETATION Revegetate clearing and grading as soon as possible, but in no event longer than one growing season after conclusion of development on a site. The applicant will comply with these standards. (g) Water Quality (1) All land uses shall comply with those setbacks required by Sec. 7 -20 -80 and those setbacks required by Table 5 -1. (2) Activities and development shall comply with all state and federal statutes and regulations concerning the protection and enhancement of water quality (including but not limited to the requirements of all state and federal permitting programs). (3) Activities and development shall be consistent with maintenance of the Stream Classifications for the Roaring Fork River watershed, as identified in Section 208 of the Roaring Fork Watershed Management Plan, and shall comply with state regulations pertaining to maintenance of those classifications. The applicant will comply with these standards. (h) Efficient Water Use Activities and development shall emphasize the most efficient use of water, including, to the extent permissible under law, the re- cycling and reuse of water. The applicant will comply with Code standards. 000007 Wildfire Hazard Areas Section 7 -20 -60 The subject site is located in a low wildfire hazard area. The location adjacent to Snowmass Creek minimizes the wildfire hazard. The site will be developed in compliance with the Land Use Code standards for low wildfire hazard areas. Wildlife Habitat Section 7 -20 -70 The subject site has been studied extensively as part of the previous land use approvals for the main residence and EDU. (See Attachments 2 and 3 for the approval documents.) There is riparian habitat next to Snowmass Creek and the site is adjacent to elk winter and overall range and is in mule deer winter range, summer range and overall range. There are two large concentrations of land area on the 38 acre subject property which have been identified and restricted against any development in order to preserve the wildlife habitat and range areas. The proposed barn is not located in these two areas and the barn will not impact the areas restricted against development. Wildlife will be protected as will the areas along Snowmass Creek. The applicant will comply with the Code standards in this section. River and Stream Corridors Section 7 -20 -80 As required by Section 7- 20- 80(2a) of the Code, all activity and development will be setback a minimum of 100 feet from Snowmass Creek. The 100 foot setback, the mean high water line have both been identified on the Site Plan. This section of the Code will be met. Floodplain Hazards Section 7 -20 -40 The 100 year flood plain was established with the Lind/Koppel Subdivision and is shown on the Subdivision Plat in Attachment 8 and the proposed Feitshans Activity Envelope and Site Plan in Attachment 4. The Activity Envelope is well outside the 100 year flood plain. Section 7 -20 -40 (a) (4) of the Code states: (4) Where the 100 -year or intermediate regional flood has not been established by the FEMA Flood I Insurance Rate Map pursuant to subsection (1) above, or by a property owner study pursuant to subsection (3) above, this regulation shall apply to all lands within an area that is twenty (20) horizontal or five (5) vertical feet (whichever land area is greater) from the existing high water line on any river, stream or material drainage channel, and any area that the County Flood Administrator determines to be a flood hazard area. Although the Snowmass Creek floodplain has not been mapped by FEMA, the Activity Envelope is over 120 feet from the designated100 year floodplain identified by the Subdivision Plat. Using the alternate criteria in item 4 above, the Activity Envelope is more than five vertical feet and more than twenty horizontal feet from the existing high water line (also shown on the Site Plan). �DE1Q�S ` This section does not apply as the Activity Envelope is well outside the 100 year flood plain. Standards for Scenic View Protection Areas Section 7 -20 -120 (d) The proposed barn is barely visible from Snowmass Creek Road, a mapped Scenic View Corridor. In the winter months, the barn may be seen, though probably not in the spring, summer or fall. The barn is compatible with the neighborhood, the site and the vicinity, so even if seen on occasion, the rural, agricultural character of the barn is suitable and appropriate. Please refer to the elevations of the barn in Attachment 5. There is a mapped "view shed bracket" looking out from Watson Divide Road. As one travels along Watson Divide, the views are out and up toward the surrounding Elk Mountains. The proposed barn is down along the Creek to the southeast and is over one mile away from this view shed. The view shed will not be negatively impacted by the barn. The barn is appropriate for the rural setting and is compatible with the character of the area, even when it is viewed from Watson Divide. The barn is proposed to be located proximate to the house, but not too close to the house. Although the applicant feels the proposed development within the Activity Envelope does not impacts the view shed or view protection areas covered in this section of the Land Use Code, the following section briefly demonstrates compliance with the Scenic View Protection Areas standards. Standards appear in bold followed by the applicant's responses. (1) The proposed development shall utilize existing topography and natural vegetation, such as ridges, hills, and existing trees, to screen buildings to the maximum extent practicable when viewed from those right -of -way listed in subsection (b) above. The barn is screened from Snowmass Creek Road by existing vegetation, topography and the lay of the land. The view from the Road will be east from the Road toward the narrow end of the rectangular barn. (See Attachment 5 for the East and West Elevations of the Barn.) The barn will be visible from Watson Divide but the distance and the rural setting do not negatively impact this viewshed. The barn will be over one mile away and is not the typical view as one travels along Watson Divide Road as it is more difficult to gaze back in this direction toward the subject property and barn. (2) The proposed development shall avoid the location of structures within the Scenic View Protection Areas, and shall avoid the location of structures within any Viewplane identified in the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan if possible. If location outside the Scenic View Protection Area and defined Viewplanes is not practicable, then the proposed development shall not be located on the highest ground or most visible portion of any site as viewed from those corridors listed in subsection (b) above. Please see the discussion above. Visual impacts from Snowmass Creek Road are negligible and the views from Watson Divide are out and across the mountains, not down and over to the Creek where the proposed barn is to be located. The barn is quite appropriate in this rural, agricultural setting. (3) The proposed development's height and bulk shall be designed to avoid, to the maximum extent practicable, the visibility of buildings from those corridors listed in subsection (b) above. 9 00U000 This may include, but shall not be limited to, breaking the mass of the building down into a series of smaller forms, articulation of the building fagades to avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane. Attachment 5 gives the elevations of the proposed barn. It is a typically sized barn and is not excessive in height, bulk or mass. (4) The proposed structure shall be placed so it does not project above a ridgeline such that a structure silhouettes against the sky when viewed from those corridors listed in subsection (b), unless there are no alternate building sites on the lot or parcel. The barn will not break a ridgeline. (5) The proposed development shall be designed to complement the natural topography of the land through the use of techniques such as earth sheltered design, the use of natural materials and coloring, the use of low reflectance materials, or clustering of structures on the least visible portions of the site. When a building is proposed near a ridgeline, then its form (particularly its roof form) shall replicate, parallel, or complement the natural form of the ridgeline so that it appears to be an element of the natural ridgeline. The proposed barn will complement the natural topography of the land through the use of appropriate barn design, color and materials. The barn is not clustered next to the house, but is not far from the house either. It is proximate to the residence as is appropriate for such an agricultural use in this rural, agricultural setting. Low - reflectance materials and colors will be used. A ridgeline will not be broken. 6. The proposed development shall preserve natural vegetation and avoid development within irrigated meadows, to the maximum extent practicable. The natural vegetation on the property will be preserved to the extent feasible. Most of the trees on site are found in clusters and the clusters of existing trees have been avoided. 7) The proposed development shall install utilities in locations and through procedures that minimize visual impacts to the maximum extent practicable. The utilities are existing and are all underground. 8) All satellite dishes in the proposed development shall be located to minimize visibility from those rights -of -way listed in subsection (b), and shall use earth tone colors and/or screening to minimize their visual impact. Satellite dishes are not proposed. 9) The proposed development shall not use earth moving and berms as the primary means of compliance with these regulations, but earth moving may be utilized in conjunction with other techniques to comply with standards in this section. Where earth moving techniques are necessary, man -made forms should be undulating and natural in appearance. The applicant is not proposing screening with berms and screening is not necessary. 10) In the Rural Areas only, development shall be located so that activities and development occur in at least one of the locations specified in subsection (e) as they may apply to the particular property. Development is proposed "behind an existing stand of vegetation ". There are numerous Gambel oak stands on the property which are clustered. The barn will be behind these oak as well as the other vegetation on the site. The barn will be in compliance with this section of the Code. 10 UOUGIQ 11. Earth Tone Materials. The exterior of all development, except development located and designed in the form of a ranch compound, shall be built or painted with indigenous earth tone materials or colors. The exterior of a ranch compound should be built or painted with indigenous earth tone materials, or shall be painted or stained using local, traditional ranch colors, which shall include shades of red, brown, or white. Paints or stains that simulate weathered barn wood also shall be permitted. The barn will be built, painted or stained using local, traditional ranch or earthtone colors and materials which will blend in the surrounding areas and be appropriate for this rural, agricultural setting.. 12. Roofs All roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. The applicant shall comply with this standard. 13. Revegetation of Disturbed Areas. Lands disturbed by earth moving or berms should be revegetated using native species that are already growing on or near the site. Topsoil shall be stockpiled and placed on disturbed areas. Irrigation shall be provided to the revegetated areas if it is necessary to ensure survival of planted native species. The site shall be revegetated in the first growing season after the barn is developed. Topsoil shall be stockpiled as required by this standard, if necessary. 14. Driveways Avoid Dividing Meadows and Pastures To the maximum extent practicable, roads and driveways shall be located to skirt the edge of and avoid dividing meadows and pastures and to avoid major road cuts. Roads and driveways should take advantage of the screening potential of natural topography and existing vegetation. Existing roads and driveways shall be used where practical. To enhance screening, a row of trees may be planted along the roads or driveways. To the maximum extent practicable, roads and driveways located around the edge of or in meadows shall be laid out with soft, curving edges and shall avoid straight line corridors that are incongruous with the natural setting. Access to the site is in place and is along an existing gravel driveway. Rural Character Guidelines for Building Location Section 7 -20 -120 (e) The proposed barn has been designed to be consistent with Section 7 -20 -120 (e), the rural guidelines for building locations. The barn will meet criteria number (2) as it will be "Located Behind Existing Stands of Vegetation." There is a substantial amount of Gambel oak, oak brush and native grasses in the area around where the barn is to be located. The Gambel oak are in many large clusters and provide adequate screening of the views from 11 �O�1t1�1 Snowmass Creek Road and the barn will not be visible from the Road, except possibility a negligible view in the winter months. Landscaping and Vegetation Protection Section 7 -20 -130 A landscape plan is not necessary. The level section of the property where the barn is proposed is surrounding by Gambel oak, oak brush and native grasses. The barn is proximate to the existing primary residence and accessory dwelling unit and it creates a rural, agricultural character which is consistent with the Code standards for the Rural Area. Native grasses and vegetation will be used as necessary to restore disturbed vegetation. Prohibition of Commercial Agricultural Activities Section 2- 20 -10(e) The property will continue to function as a residential land use, though agricultural activities do occur on the Property. The site is assessed as a residential property with the Pitkin County Tax Assessor's Office. See Attachment 9 for the Assessor /Treasurer Parcel Detail information which shows proof of ownership as well. SUMMARY The proposed land use application will be consistent with the prior land use approvals and will enhance the character of the site through the addition of a well located barn. This land use application has addressed the Land Use Code standards identified by the Pitkin County Community Development Department in the Pre - Application Conference Summary Sheet in Attachment 7. The proposed barn is in compliance with all applicable sections of the Code.
