Charlie Westerman, hereafter "Applicant", has applied to the Community Development Director of Pitkin County, Colorado, hereinafrer "Director", for approval of a Temporary Use Permit for a Budweiser Clydesdale Photo Shoot. 2. The photo shoot will take place on January 15, 16, 17, 1998, between the hours of 8:00 AM to 4:30 PM at Aschcroft from the King Cabin to the Pine Creek Cookhouse. 3. Section 3-200.30 of the Land Use Code, as amended by Ordinance No. 97-16, requires that the Director determine that the request for a permit is necessary to hold the public event or celebration and that adequate provision has been made for police supervision, insurance, area maintenance and public parking. 4. The County's Risk Manager has deemed the insurance for the event adequate. 5. The Director finds that the Applicant's request meets the requirements of the Land Use Code. NOW, THEREFORE, the Director does hereby grant a Temporary Use Permit to the Applicant, subject to the following conditions: 1. The Applicant shall adhere to all material representations made in the application. 2. This temporary use permit is issued to Chazlie Westerman for Budweiser Clydesdale Photo Shoot at Aschcroft. The photo shoot will take place between the hours of 8:00 AM to 4:30 PM on January 15, 16, 17, 1998. 3. The Applicant shall comply with the County Engineer's requested that the applicant attempt to minimize the amount of space used in the parking lot area across from Toklat due to weekend pazking demands. MEMORANDUM To: Cindy Houben, Community Development Director FROM: Tamara Pregl, Planner RE: Budweiser Clydesdale Photo Shoot Temporary Use Permit DATE: Jannary 5, 1998 APPLICANT: Charlie Westerman for Budweiser REQUEST: The applicant is requesting approval of a temporary use permit for a Budweiser Clydesdale photo shot at Ashcroft on January 15th, 16th and 17th of 1998. REFERRAL AGENCIES: The following agencies have been referred on this case. 1. County Engineer 2. State Forest Service 3. Risk Management 4. Sheriff Department 5. Homeowner's Association Comments from the agencies listed above are referred to as necessary in the appropriate sections of this memo. EVALUATION OF REQ[IEST: The photo shoot is proposed to take place on January 15th, 16th, and 17th at Ashcroft. Eight (8) horses will be brought in from Glenwood Springs. According to the applicant, the horses and wagon will be walked in from the Toklat parking area to the King Cabin. The photo shoot will take place on the closed portion of the road between the King Cabin to the Pine Creek Cookhouse. The photo shoot will occur between the hours of 8:00 AM unti14:30 PM. The applicant has noted that no equipment or horses will be stored at the site overnight. Two blazers and the three horse trucks will be parked across from Toklat in the 72 hour parking zone. There will be 6 horse handlers, 3 photo shooting staff, and 3 clients from the design company in the group. Temporary Commercial Uses: Section 3-200.30 of the Land Use Code (as amended by Ordinance No. 97-16) stipulates that the Director may permit the temporary use of land in the County for commercial uses, subject to the following standards: A. An applicant must demonstrate that adequate provisions have been made for police supervision, if necessary; public parking; insurance; site set-up maintenance and clean-up,~ emergency services; and safety of operations. Staff Comments: The photo shoot will take place on January 15th, 16th and 17th between the hours of 8:00 AM and 4:30 PM. The Sheriff's Department, the US Forest Service and the Castle/Maroon Caucus and neighbors have no objections to this photo shoot. Insurance for the event has been approved by the County's Risk Manager. B. Temporary structures constructed or placed on the premises shall conform to any and all applicable building codes and other County regulations. Staff Comment: No temporary structures will be erected. C. These permits shall be issued for no more than 72 hours. Staff Comment: The photo shoot will take place for three days (January 15, 16, 17) between the hours of 8:00 AM and 4:30 PM. No set-up or clean-up is necessary. RECOMMENDATION: Staff recommends that the Community Development Director approve Budweiser Clydesdale Photo Shoot Temporary Use Permit subject to the conditions in the attached Administrative Decision.
