RECITALS
Christopher Hopkins ("Applicant"), has applied to the Community Development Director of Pitkin County,
("Director"), pursuant to Section 2-20-150(b) of the Pitkin County Land Use Code ("Code"), to amend the Woody
Creek Subdivision (formally the mobile home park) PUD Guidelines for Lot 46 to the following amendments as
measured pursuant to Section 5-20-100 of the 2006 Land Use Code:
a. Front Yard Setback-Eave encroaches by 1' 8.5" (20.5");
b. Rear Yard Setback - Eave encroaches by 8"; foundation encroaches by 2";
c. Sonth Side Yard Setback - Gazage eave encroaches by 1' ] 0" (22"); garage wall encroaches by 2";
2. The setbacks aze established on Pages 6 & 7 of the PUD Guidelines; which are recorded per Reception number
515412.
3. The property is located in the Woody Creek Subdivision and is described as Lot 46, Woody Creek Subdivision.
PID#2643-161-06-046.
4. The property is zoned MHP/P.U.D. and contains 3,087 square feet.
5. The Planning and Zoning Commission granted approval to the Housing Office for a fully developed land
subdivision exemption for the Woody Creek Tavern and Mobile Home Pazk pursuant to Resolution No. PZ-99-2.
A Fully Developed Land Subdivision Plat was recorded at Book 54, Page 76.
6. Additionally, the BOCC granted approval in 2001 for Conceptual Subdivision, Planned Unit Development,
GMQS Exemption for deed-restricted housing units, Rezoning from SR to MHP/PUD and Special Review for
pazking in the PUD pursuant to Resolution No. 085-2001. In April 2005, the property received Detailed and
Final Plat and GMQS Exemption approval pursuant to BOCC Resolution 046-2005. A Minor Amendment was
granted in 2006 pursuant to Administrative Decision No. 99-2006 for some lot line adjustments and a
subsequent Amendment was granted by the BOCC to eliminate the fire sprinkler requirement for each residence
pursuant to Resolution No. 020-2007. The BOCC pursuant to Resolution No. 047-2007, amended Condition
No. 5 of Resolution No. 046-2005 to allow the issuance of Building Permits prior to the infrastructure of the
subdivision park being completed
Administrative Decision No. 96-2007 amended the PUD Guidelines to reduce soma of the existing setbacks for
Lots 45-58 (the newer portion of the Subdivision). The Decision reduced the South, side yard setback for Lot
46 from fifteen (15) feet, to ten (10) feet.
8. The existing structure/eaves were erroneously approved in the setbacks under Building Pernrit 012.2009.PRBU.
9. The Drector fmds that the request is consistent with the requirements of the Land Use Code, the National Fue
Protection Agency and the 2003 International Residential Codes for horizontal separation.
APPROVED by the Director, subject to the following conditions:
1. The Applicant shall adhere to all material representations made during the application process.

The Applicant shall comply with the provisions of Planning and Zoning Commission Resolution No. PZ-99-2, and
the Boazd of County Commissioners Resolution Nos. 085-2001, 046-2005 and 020-2007, and Administrative
Decision Nos. 99-2006 and 96-2007 unless otherwise replaced or amended by the conditions of this or said
approvals.
The PUD Guidelines for Lot 46 are hereby amended to allow only the current, south garage wall, rear
foundation and the eaves/overhang which are in the setbacks (Exhibits A & B) to encroach into the prescribed
setbacks, as measured by the horizontal distance between the Lot line and the closest projection of the principle
or accessory structure by the following distances and all encroachments into the required setbacks for the
property shall remain unoccupied and unobstructed from the natural grade skyward:
a. To allow a twenty foot, six inch (20'6") long garage wall to encroach into the required ten foot, South
side setback resulting in a vaziance of four inches (4") for an overall setback measurement of nine feet,
eight inches (9' 8") for this structure only [Area 1, Exhibit B].
b. To allow an eighteen inch (18") garage overhang to encroach into the required ten foot, South side
setback resulting in a variance one foot ten inches (1' 10") for an overall setback measurement of eight
feet, two inches (8' 2") for this structure only [Area 1, Exhibit B].
a To allow an overhang on the southwest corner of the residence to encroach into the required five foot,
rear setback resulting in a vaziance of eight inches (8") for an overall measurement of four feet two
inches (4' 2") for this area of the structure only [Area 2, Exhibit B].
d. To allow the foundation on the southwest corner of the residence to encroach into the required five
foot, rear setback, resulting in a variance of two inches (2") for an overall measurement of four feet ten
inches (4' ] 0") for this portion of the strucmre only [Area 2, Exhibit B].
e. To allow the northeast corner overhang to encroach into the required ten foot, front setback, resulting
in a variance of one foot six and one-half inches (1' 6.5") for an overall measurement of eight feet three
and one-half inches (8' 3.Y') for this portion of the structure only [Area 3, Exhibit B].
4. This approval shall be limited to the existing structures as described and exhibited above. Any future
development, redevelopment, restoration, reconstruction, replacement, remodel, addition or alteration shall meet
the original prescribed setbacks for the Lot as listed in Condition No. 7 below. Only repairs required for health,
safely and upkeep of the existing garage wall and overhang are allowed provided all necessary permits are
obtained in advance.
5. All other improvements, not specifically listed in this approval for Lot 46 shall be measured from the original
prescribed setbacks as listed in the amended PUD Guidelines pursuant to Administrative Decision No. 96-2007.
6. The Applicant shall cover the entire encroaching overhang of the South side yard leave and soffit) with one-hour
fire rated material or remove all of the structure which encroaches into the South Side Yazd, ten (10) foot
setback.

MEMORANDUM

DATE: September 25, 2009
REQUEST: The Applicant is requesting to amend the Subdivision/PUD approval for Lot 46 of the Woody
Creek Subdivision. Specifically the Applicant is requesting approval for an encroachment into the South,
side yard setback to allow for the wall and eave of a newly built garage. Additionally, the eaves on the front
and rear of the parcel also encroach into the setbacks for the property lines. There are concerns about
reducing the setback with regard to fire & safety issues.

BACKGROUND/EXISTING CONDITIONS: The Planning and Zoning Commission granted approval to
the Housing Office for a fully developed land subdivision exemption for the Woody Creek Tavern and
Mobile Home Park pursuant to Resolution No. PZ-99-2. A Fully Developed Land Subdivision plat was
recorded as Book 54 at Page 76.
Additionally, the BOCC granted approval in 2001 for Conceptual Subdivision, Planned Unit Development,
GMQS Exemption for deed-restricted housing units, Rezoning from SR to MHP/PUD and Special Review
for parking in the PUD pursuant to Resolution No. 085-2001. In April 2005, the property received Detailed
and Final Plat and GMQS Exemption approval pursuant to BOCC Resolution 046-2005.
A Minor Amendment was granted in 2006 pursuant to Administrative Decision No. 99-2006 to adjust lot
lines for some of the parcels and a subsequent Amendment was granted by the BOCC to eliminate the fire
sprinkler requirement for each residence in 2007 (020-2007). The BOCC amended Condition No. 5 of
Resolution Number 046-2005 (Resolution 047-2007); which allowed the issuance of building permits prior to
the infrastructure being complete.
In 2007, Decision No. 96-2007, the PUD Guidelines were amended to reduce the setbacks for Lots 45-58 (the
newer portion of the Subdivision). The setbacks were established on Pages 6 & 7 of the Guidelines, which
are recorded per reception number 515412. This amendment decreased the south side yard setback from
fifteen (15) feet, to ten (]0) feet. Lot 47, next door is allowed per the PUD to have a zero lot line on the
south side yard setback. Thus the setbacks for Lot 46 are:
Front Yard Setback: 10 feet
Rear Yard Setback: 5 feet
North Side Yard Setback: 0 feet
South Side Yard Setback: 10 feet
Currently, a residence with an attached garage is under construction on Lot 46. The structure was approved
under Building Permit 012.2009.PRBU. The following measurements were taken and confirmed by the
Community Development Department (Attachment A and Exhibit A):
- The separation between the walls of the structures on Lots 46 (garage) and 47 (residence) is
128" (10' 9").
- The eave of the structure on Lot 47 is 13" (1' 1 ").
- The garage wall Lot 46 is 116" (9' 8") from the drip line (eave) of the residence on Lot 47.
- The distance between the drip lines (eaves) of the two residences is 98" (8' 2").
- The distance between the eave and the rear yard property line on the southwest corner of the
structure is 50" (4' 2") where a five foot setback is required.
- The distance between the foundation and the rear yard property line on the southwest corner of the
structure is 58" (4' 10"), where a five foot setback is required.
- The distance between the eave and front yard property line on the northeast corner of the structure is
99.5" (8' 3.5") where a ten foot setback is required.
Pursuant to Land Use Code 5-20-100: "In measuring a front, side, or rear yard setback, the horizontal
distance between the Zot line and the closest projection of the principle or accessory structures shall be used.
Required front, rear and side setback areas shall be unoccupied and unobstructed front the natural grade
skyward. "
Therefore, all measurements for zoning purposes and the PUD Amendment are from the eave (aka overhang
or drip line) on Lot 46 to the eave on Lot 47 (which is considered to be zero lot line development). Based on
these measurements, the garage wall and the garage eave/overhang on Lot 46 encroach into the ten (10) foot
South side yard setback by 22". The front yard eave encroaches into the setback by 1' 8.5"; the rear yard
eave encroaches into the setback by 8" and the foundation wall by 2".
REFERRALS: The Woody Creek Caucus (Attachment B) reviewed the application and deferred to the
Home Owners Associations recommendations (which hinge on fire and safety issue).
The Woody Creek Homeowner's Association (Attachment C) met on August 11, 2009 and voted that the
PUD variance for Lot 46 be allowed with the following conditions:
• The written approval of the Aspen Fire Marshall, Ed Van Walraven.
• The variance approval would be inclusive to the eave extension.
The Aspen Fire Marshall, Ed Van Walraven, (Attachments D1-D3) commented that the horizontal separation
required by the National Fire Protection Agency (NFPA) for modular homes (SOIa), when `combustible
materials' are used, is ten (]0) feet [5' for each structure]. The horizontal projection can be reduced to six
(6) feet [3' for each structure] when `materials that do not support combustion' are used. Fortunately, this is
only an issue for the encroachment into the South side yard setback. To assure compliance with NFPA
requirements, two remedies were supplied:
• Cover the overhang (eave) and soffit with one hour rated material; which would provide adequate
fire protection for the portion of the eave that reduces the horizontal separation.
• Remove the portion of the eave that reduces the horizontal separation.
Z
Joanna Schaffner, Zoning Officer commented (Attachment E) that any variance granted for this situation
should be for the existing structure only and should not be available for any future development. This has
been incorporated in the conditions of approval.
Tony Fusazo, the Chief Building Officer (Attachment F), confirmed that structure on Lot 46 meets the 2003
International Residential Codes (IRC) separation requirements is six (6) feet [3' for each structure].
STAFF COMMENTS:
MINOR AMENDMENT (SECTION 2-20-150B):
A) Minor Amendments Defined
A minor amendment to any development application or permit is one that meets the following criteria, as
determined by the Community Development Director:
1. Is consistent with action(s) taken during previous development approvals for the property; and
Response: The request for variances to allow for the existing structure and eave/overhang to encroach into
the following setbacks as follows:
- Front Yard Setback -Eave encroaches by 1' 8.5" (20.5")
- Rear Yard Setback -Eave encroaches by 8"; foundation encroaches by 2"
- South Side Yard Setback- Garage eave encroaches by 1' 10" (22"); garage wall encroaches by 2"
The request is consistent with the original action taken. The approval shall be conditioned such that only the
current structure -garage wall, rear foundation and eaves -are granted the variance. All future development,
redevelopment, restoration, reconstruction, replacement, remodel, addition or alteration must meet the
original property setbacks as prescribed in the PUD.
2. Does not change the use of the proposed development between residetttial, commercial and tozmist
accommodation uses; and
Response: The use will remain the same.
3. Does not change the basic character of the approved use of land on which the activity occurs,
including basic visual appearance and method of operation; and
Response: The proposed variance will not change the basic character of the approved use. The variance will
only apply to the existing gazage and eave, on the specific lot (Lot 46).
4. Does not constitute a new land development activity; and
Response: The proposal does not constitute a new development activity.
5. Does not increase off-site impacts in the surrounding neighborhood; and
Response: The variance for the encroachment for the garage and eave will not increase off=site impacts. The
structure, with the condition to construct the eave of one-hour fire rated material, will meet both the Fire
Department's and Building Department's setbacks. Only the eave which encroaches into the South side yazd
setback also encroaches into the required 10' horizontal separation for fire protection and will be required to
meet the additional fire rated material condition.
6. Does not endanger [he public health, safety or welfare; and
Response: The proposal will not endanger the public.
Z Does not violate any Land Use Code standard,' and
Response: The proposal does not violate any known Code Standard. The variance will still meet NFPA and
the 2003 IRC Codes. Only the currently existing structure will be allowed to encroach into the setbacks.
8. Does not substantially increase the need for on-site parking or utilities, or affect affordable housing
generation; and
Response: The request does not affect parking, utilities or affordable housing generation.
9. Does not increase the,/loor area of the use by more than five (.i) percent or decrease the open space
on the site by more than five (5) percent.
Response: The request is in compliance with the criteria.
RECOMMENDATION: Staff recommends that the Director approve the Hopkins Minor Amendment to a
Development Permit to amend the PUD guidelines for Lot 46 to allow only the existing structure (garage
wall, rear foundation and eaves) to encroach into the setbacks based on compliance with the standards noted
above and subject to the conditions of the attached Administrative Decision.

At our August 11 cn Board Meeting, Chris Hopkins and his contractor, Kerry Karnan presented a
request for a setback amendment and an approved set of plans for his new house. Although the house
was built according to plans, it became apparent that the eave extension on the garage encroached in
the 10' setback.
There was a lengthy discussion, and in conclusion, our Board voted 5-2 to approve the request with
the following conditions attached; the written approval of Ed Vanwalraven, Fire Marshal, and that the
variance would be inclusive to the eave extension.

Hello all,
This is in reference to the Hopkins residence, 203 Woody Creek Mobile Home Park.
A site visit was done on August 28th with Susan Pearson (Zoning Officer), Brian Nichols
(Deputy Fire Marshal), and Ed Van Walraven (Fire Marshal).
We were joined by the owner Chris Hopkins and the contractor Kerry.
Results found:
The structures are 10'8" apart.
The overhang from the Hopkins residence is 16"
Amount of overhang encroachment is 8"
Remedies include but not limited to:
Cover the overhang and soffit with one hour rated material and retain the 8"
encroachment
Remove the 8" encroaching portion
Either solution would work and meet with the approval of the Fire Marshal's Office.

6.2.1 Fire Safety Separation Requirements.
6.2.1.1 Fire separation distances shall comply with local rules or
regulations. In their absence, NFPA 5000, eui/ding Construction and
Safety Code, shall apply.

7.3.2.1 Exterior walls shall have a fire resistance rating based on
Table 7.2.1.1 or Table 7.3.2.1, whichever is greater.

6.4.1.1 Accessory buildings or structures shall be permitted to be located immediately adjacent to a site line
when constructed entirely of materials that do not support combustion and provided that such buildings or
structures are not less than 0.9 m (3 ft) from an accessory building or structure on an adjacent site.
6.4.1.2 An accessory building or structure constructed of combustible materials shall be located no closer than
1.5 m (5 ft) from the site line of an adjoining site.

I have reviewed the application for a setback variance at 203 Woody Creek and offer the following comments
1. Any variance granted for this situation should be for the existing structure only and should not be available for
any future development.
2. The encroachment for the overhang of the garage should be removed and no variance should be granted as
there is no compelling reason to amend the PUD and grant a variance for a garage overhang.
3. This contractor also had difficulties properly placing a mobile home in the Aspen Village Subdivision which
resulted in an administrative "height variance" being granted for a residence. I suggest the matter be referred to
the Chief Building Official.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 08-2008 establishes a

development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be
consistent and fair to the public and to reflect the expense incurred in providing such services to the public.

RECITALS
Woody Creek Homeowners Association ("Applicant"), has applied to the Community Development
Director of Pitkin County, ("Director"), pursuant to Section 2-20-130(b) of the Pitkin County Lend
Use Code ("Code"), to amend the Woody Creek Subdivision (formally the mobile home park) PUD
Guidelines to reduce the setbacks for Lots 43-38 (new portion of the Subdivision). The setbacks are
established on Pages 6 and 7 of the Guidelines, which are recorded per reception number 515412.
This will constitute the fourth amendment to the Subdivision approvals.
2. The properties are zoned MHP/PUD.
3. The Planning and Zoning Commission granted approval to the Housing Office for a fully
developed land subdivision exemption for the Woody Creek Tavem and Mobile Home Park
pursuant to Resolution No. PZ-99-2. A Fully Developed Land Subdivision plat was recorded as
BQ.ok 54 at Page 76.
Additionally, the BOCC granted approval in 2001 for Conceptual Subdivision, Planned Unit
Development, GMQS Exemption for deed-restricted housing units, Rezoning from SR to
MHP/PUD and Special Review for parking in the PUD pursuant to Resolution No. 085-2001. In
Apri12003, the property received Detailed and Final Plat and GMQS Exemption approval
pursuant to BOCC Resolution 046-2003. A Minor Amendment was granted in 2006 pursuant to
Administrative Decision No. 99-2006 for some lot line adjustments and a subsequent
Amendment was granted by the BOCC to eliminate the fire sprinkler requirement for each
residence in 2007 (020-2007). The BOCC amended Condition No. 5 of BOCC Resolution No.
046-2005 pursuant to BOCC Resolution No. 047-2007,
The Applicant submitted a complete application after July 6, 2006, therefore, the application is
being considered pursuant to the 2006 Land Use Code.
6. The Director finds that the request is consistent with the requirements of the Land Use Code.

PLANNED UNZT DEVELOPMENT GUIDE
I. Purpose
On May 11, 2005 the Pitkin County Board of County Commissioners
(hereinafter the "Board") approved the Woody Creek Subdivision
Planned Unit Development (hereinafter "WCSPUD" or "PUD") Detailed
Submission/Final Plat (Site Specific Development Plan) pursuant to
the Pitkin County Land Use Code (hereinafter the "Code") Section
3-170 of the Code establishes the Planned Unit Development
(hereinafter "PUD") standards which allows variance from the strict
adherence to the area and bulk requirements of underlying zone
district within the PUD.
The County has requested the Aspen/Pitkin County Housing Authority
Board (hereinafter "applicant") to prepare the Woody Creek
Subdivision Planned Unit Development Guide (hereinafter referred to
as "PUD Guide" or "Guide") to be reviewed and adopted in
conjunction with the WCSPUD. The purposes of the PUD Guide are to:
A. Identify area and bulk requirements approved pursuant to
Section 3-170 of the Code.
B. Identify variations from Land Use Code standards approved
during the land use review process.
C. Facilitate the Pitkin County Zoning and Building
Department reviews by establishing approved variations
from typical review standards.
D. Identify standards enforceable by Pitkin County in one
document separate from the Declaration of Protective
Covenants, Conditions and Restrictions for the Woody
Creek Subdivision Planned Unit Development.
II. Pitkin County Land Use Code
The Woody Creek Subdivision Planned Unit Development has been
reviewed based upon the Pitkin County Land Use Code in effect on
May 11, 2005 ("the Code"), the date the Detailed Submission/Final
Plat land use application was certified complete by the Pitkin
County Community Development Department- Zoning and building permit
reviews for all development in WCSPUD shall be based upon the Code
and the WCSPUD Guide. Unless noted, the WCSPUD Guide supersedes
section 3-270 of the Code.

IIZ. Land Use Plan
Figure 1 depicts an overall site plan for the WCSPUD. This section
establishes permitted land uses. Land uses not identified are
prohibited.
A. Lots 1-58
Permitted land uses are limited to one single-family dwelling unit
per lot and related accessory outbuildings such as sheds.
B. Open Space Parcels A-C
Open space parcels are to remain undeveloped. The existing
structure located on Open Space Parcel C shall be demolished prior
to issuance of a certificate of occupancy for the waste water
treatment facility building.
Landforms in excess of 30 inches in height developed in compliance
with the WCSPUD Landscape Plan (see Figure 2) and landscaping are
permitted on the Open Space Parcels.
C. Common Tracts 1-3
This section establishes permitted land uses on the Common Tracts.
1. Common Tract 1 - Common Tract 1 may be improved with a
trash structure to enclose a dumpster(s) and a waste
water treatment facility. The dumpster(s) need not be
enclosed within a structure. The waste water treatment
facility building will be developed in general compliance
with Figure 3, WCSPUD Waste Water Treatment Plant
Improvments Plan; Figure 4 and WCSPUD Waste Water
Treatment Plant Outfall Line. The waste water treatment
plant shall be located within the building envelope on
Common Tract 1 as defined on Figure 3 and the WCSPUD
Final Plat recorded at Book Page
2. Common Tract 2 - Common Tract 2 will be improved with the
common building(s) for the WCSPUD Homeowners. Future
improvements shall be located within the building
envelope defined on Figure 1 and the WCSPUD Final Plat

3. Common Tract 3 - Common Tract 3 may be improved with a
laundry mat for use of the WCHMP residents and a trash
structure to enclose a dumpster(s). The dumpster need
not be enclosed within a structure. Use of the laundry
mat by non-residents is prohibited.
D. Parking
Parking in the WCSPUD is limited to residents and their guests.
Automotive vehicles and trailers shall be parked in the common
parking areas designated on Figure 1 or on Lots 1-54. Thee three
designated common parking areas are located west of the Woody Creek
Tavern, north of Common Tract 2~and west Open of Open Space C.
(Wastewater Treatment Facility).
Each individual lot shall include areas to park two vehicles. On-
street parking and parking in Open Space Areas or Common Tracts is
prohibited. Use of the parking areas by non-residents is prohibited
unless they are guests visiting WCSPUD residents.
Vehicles or trailers parked in common parking areas shall be
limited to vehicles and trailers with current, valid, Colorado
license plates.
The existing structure located in the parking lot on the south side
of Lot 15 shall be removed or demolished upon redevelopment of
Common Tract 2. Parking may be permitted on the south side of the
buildings on Common Tract 2 until the Tract is redeveloped.
IV. Area and Bulk Requirements
This section establishes area and bulk requirements for the WCSPUD.
The development of most lots in the Park will benefit from some
form of zero lot line development. The purposes of the zero lot
line development are to maximize solar gain and the size of yards
and to minimize fire danger.

A. Tall grass shall be cleared and maintained within ten feet
(10') of residential and accessory structures.
B. Non-combustible roof material, including, but not limited to,
tile, asphalt, or metal roof material is required. Wood shake
shingle roofs are prohibited.
C. All new dwelling units developed after the effective date of
the approval of the WCSPUD Detailed Submission shall contain
operational interior sprinkler systems.
D. Lot Owners shall be required to keep all roofs clear of
debris.
E. Lot Owners shall be required to remove tree branches hanging
within fifteen feet (15') of chimneys.
F. Lot Owners shall be prohibited from parking any motor vehicle
in tall dry grass.
G. Lot Owners shall be required to stack firewood at least 10
feet away from structures, and to keep fire fuels away from
stacked wood.
H. Lot Owners shall be required to maintain at least one (1) ten-
pound ABC-class fire extinguisher in each dwelling unit.
VII. Lighting
Lighting shall comply with the standards of the Pitkin County Land
IIse Code in effect at the time of installation.
VIII. General Restrictions
The following general restrictions shall apply to the WCSPiJD.

At our August 11th Board Meeting, Chris Hopkins and his contractor, Kerry Kaman presented a
request for a setback amendment and an approved set of plans for his new house. Although the house
was built according to plans, it became appazent that the eave extension on the gazage encroached
into the 10' setback.
There was a lengthy discussion, and in conclusion, our Boazd voted 5-2 to approve the request with
the following conditions attached; the written approval of Ed Vanwalraven, Fire Marshal, and that the
vaziance would be inclusive to the eave extension.

(hereinafter "APPLICANT") AGREE AS FOLLOWS:
1. APPLICANT has submitted to COUNTY an application for 2-03 lJoaDy CFt~ ~ K P~A2sS

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 08-2008 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the COUNTY'S policy that
development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be
consistent and fair to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
PROJECT, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree thaf fees charged for the processing of land use applications
shall accumulate rf an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ =which is based on3,2 hours of staff time, and if actual time spent by staff to process
the application exceeds the average number of hours by more than 20°k, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

Yes, the eaves encroach on an angle on the east, entry end and the west end.
The good news is that I changed the "house" eaves to be shorter just prior to construction in the factory. That gave me
more than a 2 7/16" factor of safety on the north side. The north side does not encroach because this was the property
line. County code allows the eaves to extend into the "set backs" 2'-0" .That is why the design as some minimal over
hangs. I will measure the structure distances on the neighboring property, or assist you in the field.
West side: As designed the eaves are on ari angle with respect to the set back. They are 1'-1 1/2" to the angle point and
reduce to zero as the angle of the set back line approaches the house. There is no neighboring structure on this entry
side.
On the East entry side the eaves are on an angle with respect to the set back. They extend 1'-8" to the angle point and
reduces to zero as the angle of the set back line approaches the house.

This email is to notify you that your determination will not be receiving approval today. Unfortunately, as I was preparing
the Exhibits for the determination I had prepared, I noticed that additional portions of the overhangs on both the front and
rear also encroach into the setbacks for Lot 46 as indicated on the submitted building plans in the original permit. There
is also the possibility that the overhang on the north side encroaches into the lot line.
Until I can determine if the overhang on the additional three sides do in fact encroach into those setback and the exact
amounts of the overhang into the setback, I cannot move forward on the determination. At this point, I will also need to
verify horizontal separation distances on the north and rear of the lot to ensure fire safety. If the overhangs do indeed
encroach into the horizontal separation (as the building plans lead me to believe) they will also have to either be removed
or be covered with one hour fire rated material.

It has come to the attention of the Woody Creek Caucus District Planning Commission that
the Hopkins home in the WCHOA is being built in variance of set back recuirements as
defined in the PUD. It is our understanding that a "correction notice" was given to the
contractor a couple of weeks ago, however, construction has continued unabated. As of
Friday, no application for a variance had been submitted to your office. The result is
that it would now be even more onerous for the owner to pay to have the building brought
into compliance, creating a "hardship."
It is our position that any variances should be applied for in writing to Community
Development and require customary review by the Caucus before being decided upon by the
county. It is troubling that one of the reasons for having to consider a variance now is
that this
critical issue of setback was missed when the plans were approved.
The Hopkins house was not pre-existing, the lot size is in the new area of the Park and
and was therefore adequate, and the POD is clear.
We request that the property be immediately red tagged and construction put on hold until
the proper applications can be filed and acted upon.

I've heazd about the Hopkins encroachment issue in Woody Creek, and would appreciate it if you would
send me a little information, as I'd like to take the matter to our Caucus Planning Commission on
Monday.
I thought the reduction from the 15' setback to 10' was the final allowance for space between homes in
the new side of the Pazk. Will there always be the possibility of a variance in setbacks? If Hopkins
were to be given the variance, how will we prevent adjoining neighbors from also building out into their
setbacks? Apparently, the eave is 1.5' into the setback, and if his neighbor (now or in the future) also
decides to take that option, we're left with only T fire space between homes. I also understand that the
homeowners may plant as they choose in that space - is that considered safe?
I feel this may be a much broader issue than just one neighbor, as the surrounding neighbors have
previously been concerned that a fire within the Park may jump to their homes, as well.
