Laug and Mary ;ierley (heteinafter "Applicants") are the owners of real property in the portion of Pitkin County known as Lots 3 & 4, Block 4, Filing 1, Meadowood Subdivision; and WHEREAS, the Applicants have proposed a lot line adjustment pursuant to Section 4-2.2(a)(2) of the Pitkin County Land Use Code; and WHEREAS, the Board of County Commissioners considered the Applicants request at a regularly scheduled public meeting on August 14, 1990; and WHEREAS, the Board of County Commissioners found the proposed Lot Line Adjustment to be consistent with the Pitkin County Land Use Code criteria for a Lot Line Adjustment. Conformance with Plat Requirements: A proposed plat for the lot line adjustment was not submitted. Therefore, I am unable to review the plat for conformance with land use code regulations. Parties to the Lot Line Adiustment. Ronald F. Laug, Trustee of the Ronald F. Laug Trust, is the owner of Lot 3, Block 4, Filing 1, Meadowood Subdivision, Pitkin County, Colorado (the "Laug Property"). Mary A. Berley, formerly Mary A. Duffey, is the owner of the adjacent property described as Lot 4, Block 4, Filing 1, Meadowood Subdivision, Pitkin County, Colorado (the "Berley Property"). 2. Existing Use. Both the Laug Property and the Berley Property are improved with their respective single family residences. 3. Purpose of the Lot Line Adjustment. The purpose of the lot line adjustment as depicted on the plat attached hereto is to adjust the lot line between the two parcels so that it will conform to the historical use of the property. It is obvious that the Laug Property predecessors believed the boundary was along the fence because of the location of the construction. The result of the requested lot line adjustment would be to make the boundary conform to the historical use, eliminate any encroachments and leave both the Laug property and the Berley Property with the same amount of square footage, the trade being exactly equal as depicted on the proposed lot line adjustment plat. 4 . Conformance with Section 4-2.2 (a~ (21 of the Land Use Code. Each of the elements of this section of the Code are complied with by this exemption, specifically as follows: (a) "...that the adjustment creates not more than the original number of lots or parcels..." This being an equal trade of property, there are no new lots created. (b) "...that the purpose or effect of the lot line adjustment is not the creation of a new lot or parcel (that is, one substantially different in size or dimensions) for development or resale purposes..." This being an equal trade of property, there are no new lots or parcels being created and the size of the existing lots will remain the same. (c) "...that, in the case of conforming lots or parcels, any resulting lot or parcel shall conform to the minimum requirements for area or width established by the provisions of this Code..." This provision is not applicable to our application. (d) "...that, in the case of existing non- conforming lots or parcels, any resulting lot or parcel shall not increase in non- conformity..." These being lots that were .. There shall be no increase in the non-conformity as is explained above. (e) "...that all laws relating to the amendment of recorded plats are complied with (if applicable)..." To the extent this Section applies, the applicants will comply with all laws and, of course, the final plat of the lot line adjustment will be approved by Pitkin County before it is recorded. 5. Proof of Ownership and Merger. Attached hereto is a statement from Pitkin County Title, Inc. setting forth the ownership of both parcels of property reflecting that Lot 4 is owned by Mary A. Berley, formerly Mary A. Duffey, and Lot 3 is owned by Ronald F. Laug, Trustee of the Ronald F. Laug Trust. Also attached is a title chain for the adjacent properties showing that there has been no merger of lots since the subdivision was created and the lots deeded out. In the letters of authorization accompanying this application, both parties have recited that they have never owned any other property contiguous to their specific parcel. 6.
