Thus, there is no way to require any air quality mitigi ation of the proposed use through a land use arena. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-205: •n is the policy of the County to ensure that land is not committed to any use and that no use is initiated without adequate evidence that a water supply of adequate quality, quantity, pressure and dependability is available to support the use intended.' This Department requires that adequate water be available to the site. There is a sufficient water supply to this site for the purposes of an ice rink. SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and~.5-200: •It is the policy of the County to ensure that land is not committed to any use and that no use is initiated without adequate evidence that facilities to collect, treat and dispose of anticipated types and quantities of waste water are available or can and will be provided with suitable capacity, quality of discharge, suitable point of discharge and dependability.' Iselin park is serviced by the Aspen Consolidated Sanitation District anal meets all requirements from this Department. WATER QUALITY IMPACTS: Seetions_2-22 and 5-107.2: •n is the policy of the County to preserve and protect ks presets water resources. To this end it is the policy of the County that no land use beinitiated which would adversey affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water-dependent agricukural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or. redistribute major water resources, his also the policy of the County to maintain a natural vegetative butter along its surface waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands.' The Environmental Health Department will be addressing water quality impacts only on down stream water quality. As is required of all proposed development, such as the Hines Interests and Moore plans, increases in traffic in the non-attainment area must be completely mitigated or offset. There will be a significant increase in traffic to and from the proposed rink, in that the stated purpose of the application is to "accommodate the increasing number of kids." The traffic increases will be partly offset by allowing kids (in the earliest session of the day only) to walk from school. But this may be negated by the fact that parents must drive farther to Iselin to pick their kids up instead of the existing rink closer to where the parent's work. The use of Iselin cannot be granted and still be consistent with requirements that are imposed on the private sector without a detailed analysis of traffic increases and how they will be mitigated. For this proposal to be approved by this Department, it will have to be proposed by the applicant how Iselin can function as an additional ice rink and bringing the kids to and from the rink without increasing traffic by any such means as car pooling, busing, etc. A condition of approval for this application is that prior to construction, the Environmental Health Department must receive and approve a traffic mitigation plan. CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS: Section 2-2 •ni~tne policy of the County to ensure that no use or development of land is permitted which is in violation of the laws of the County, the State of Colorado, or the United States of America.' Any amplified music or P.A. systems will require a noise variance from this Department if used. Otherwise no required permits are necessary. We have researched various sites around the community to install a temporary outside rink and feel that the baseball diamond at Iselin Park would be ideal. An outside rink has five requirements: 1. Lighting. 2. Water. 3. Flat surface. 4. Parking. 5. Heated storage area (to keep the hose from freezing). Iselin Park fulfills all of these requirements. We propose the following: 1. HOURS OF OPERATION We would schedule our practices around peak hours of traffic congestion from skiing: Monday - Friday 4:30 pm - 9:00 pm Saturday - Sunday 10:00 am - 2:00 pm 4:30 pm - 9:00 pm The rink would be covered up with a tarp during off hours. 2. NO AMPLIFIED MUSIC Some low level music may be needed for figure skaters. 3. LIGHTING Lights would be used as needed and turned off each evening by 9:30. The existing lights in the outfield would not be needed. The existing lighting system is currently inoperable, but we would offer to correct the problems at our own cost. Ms. Suzanne Konchan November 15, 1994 RE: Iselin ice rink Page 2 4. OCCUPANCY We would generally schedule three to four practices a day with thirteen to fifteen children practicing at any one time. The practices would run 1 - 134 hours each. 5. SUPERVISOR At least one adult would accompany the children at all practices. 6. INSTALLATION/REMOVAL The rink would be installed as soon as it is permitted and would be removed in the spring prior to baseball season. The baseball diamond would be restored to its original state. All costs would be paid for by the Aspen Youth Hockey Program.
