RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, GRANTING A TEMPORARY USE PERMIT TO THE
HARD ROCK & ROLL RUN & RIDE TEMPORARY USE PERMIT

1. Quality Time Events, in association with the Hazd Rock Cafe, hereinafter
"Applicants," have applied to the Board of County Commissioners of Pitkin
County, Colorado, hereinafter "Boazd," for approval of a Temporary Use Permit
to hold a foot race and bike race, pursuant to Section 3-200.30 of the Land Use
Code.
2. The Land Use Code requires that the Boazd determine that the request for a permit
is necessary to hold the public event or celebration and that adequate provision
has been made for police supervision, insurance, area maintenance and public
pazkmg.
3. The Boazd considered the Applicant's request to hold the events at a public
meeting on July 24, 1996, at which time the Boazd found that the Applicant's
request meets the requirements of the Land Use Code.
NOW, THEREFORE, BE IT RESOLVED by the Boazd that it does hereby
grant a Temporary Use Permit for the Hazd Rock & Roll Run & Ride subject to the
following conditions:
1) This temporary use permit is issued to Quality Time Events and the Hazd
Rock Cafe for a foot race and a bike race from the Hazd Rock cafe in Aspen
to the Aspen Highlands Pazking Lot and on to the Mazoon Bells and back.
The events will take place from 6:00 a.m. to noon on Sunday, August 4,1996.
2) The applicants shall post a $10,000 bond and indemnification for the event, to
the satisfaction of the County Attorney, prior to issuance of the temporary use
permit.
3) The applicants shall provide an insurance certificate to the satisfaction of the
Risk Manager prior to the issuance of the temporary use permit.

4) The applicants shall provide additional details on the Safety and Operating
Plan to the satisfaction of the Emergency Management Coordinator prior to
the issuance of the temporary use permit.
5) The applicants shall secure the proper Environmental Health permits for the
use of a public address system at the Aspen Highlands Pazking Lot.
6) The applicants shall adhere to all material representations made in the
application and in the public meeting.

APPLICANT'S REPRESENTATIVE: Joel Scott
REQUEST: The applicants are requesting approval of a temporary use permit to accommodate a
SK foot race from the Hazd Rock Cafe in Aspen up to Aspen Highlands and a 22K bike race from
Highlands to Maroon Bells and back on Sunday August 4, 1996.
PROCEDURE/PROCESS: The Board of County Commissioners may permit the temporary use
and occupancy of land for commercial activities subject to compliance with the standards specified
in section 3-200.30 of the Land Use Code.
EVENT DESCRIPTION: Racers can run the SK, or bike the 22k, or race both in a duathlon
format. The Aspen Highlands parking lot will be used as a staging area and transition azea for the
bike race and as a termination for the run and the bike race. The organizers have received
permission from the Hines-Highlands Limited Partnership for use of the Highlands parking lot.
They have also secured approval from the Forest Service and the T-Lazy-7 Ranch. The event is a
benefit for the Aspen Valley Ski Club and Mountain Rescue. A concert follows the races on Little
Nell at the base of Aspen Mountain. The City of Aspen has issued Special Event Permits for the
portions of the events which impact the City, and Environmental Health permits are being
processed.
STAFF COMMENTS: Following are the standazds of review pursuant to Section 3-200.30 of the
Pitkin County Land Use Code by which a temporary use may be permitted:
1. The commercial activity is part of a public event or celebration.
Staff Response: The proposed events are open to the public for a registration fee.

2. The applicant demonstrates that adequate provisions have been made for police supervision,
if necessary; public parking; insurance; and site maintenance and clean-up.
Staff Response: The applicants have been working with County Emergency Management
Coordinator, Steve Crockett, and Special Event Safety and Operating Plans have been included in
the application.
The Pitkin County Sheriffs Office has required that the applicants provide a $10,000 cash bond and
indemnification to offset any costs to the County associated with an emergency rescue or response
for this event.
The County Engineer has reviewed the application and made recommendations to the applicants on
operations.
Additional police supervision is not anticipated.
The Risk Manager is reviewing the insurance certification that has been submitted.
3. Temporary structures constructed or placed on the premises shall conform to any and all
applicable building codes and other County regulations.
Staff Response: There will be no additional structures constructed or placed on the premises for
this event.
4. These pemuts shall be issued for no more than 72 hours.
Staff Response: The events as proposed will run from 6:00 a.m. until noon on Sunday August 4,
1996.
RECOMMENDATION:
Staff recommends that the Board approve the Hard Rock & Roll Run & Ride Temporary Use
Permit subject to the conditions listed in the attached Resolution.

MBSSAGS: Joel - As we discussed in May, I see no problems with your bicycle leg
of the Hard Rock event up to the Maroon Bells . We will work out the permit
specifics in our meeting on July 29th.
As a reminder, the turn-around at the top may need to be lowered down to the
West Maroon Portal because of the construction work currently going on at the
Maroon Lake Campground. I should know more by our meeting on the 29th as to
the progress of the construction.
Another item will be the requirement to have road marshals along the Maroon
Creek Road in various locations. These will be the same as those that were
required last year.

Prevention: the Hard Rock Cafe has secured 1 million dollars worth of insurance
for all involved parties. They include: City of Aspen, Hines Interest, USFS, Pitkin
County, Aspen Valley Ski Club, Mountain Rescue, and Quality Time Events.
1. All participants must sign waiver that reviews dangers of competition, bike
riders must wear helmets and abide by the "Yellow Line Rule."
2. Quality Time Events is responsible for the organization of this event. We have
organized the last 3 Hard Rock Races. In addition, we have organized the
following events in Pitkin County:

Race for the Cure® 1993 - 1996
Ride for the Pass 1995 - 1996
Ducky Derby Waddle 1995 - 1996

Pre Event planning: The experience of previous events has helped with
identification of possible as well as actual problems in this type of event. Eoch
year after the event is completed, a review of procedure is completed and
recommendations have been implemented.
1. QTE has met with Scott Messina of Mountain Rescue to establish this years
emergency medical procedures for race day. In April, we notified the Aspen
Ambulance District of all of our events for the summer as per their protocol.
2. Our director of course, Ned Ryerson will review the course prior to race day
and will mark all natural and man-made hazards on race day with our rented
cones and barricades, as needed.
3. The director of course will meet with all course marshal volunteers prior to
the race to review their specific responsibilities which includes traffic control,
race rule enforcement and emergency response.
4. The event chain of command has been formulated by Scott Messina and
QTE.
5. The events organizer's safety training is limited to Advanced First Aid and
CPR. Therefore, QTE has enlisted the assistance of Mountain Rescue, since they are
a beneficiary.
b. At the Start of each race, course rules and safety issues will be announced
with the use of a megaphone to all participants.
7. The Aspen Valley Ski Club is providing volunteers for all aspects of the event
to include: course marshals, refreshments, registration, aid stations, site set-up and
clean-up.
Emergency Response Plan: As stated earlier, QTE has worked with Mountain
Rescue over the last three years of this event, to develop this Emergency Plan.
Mountain Rescue has agreed to provide medical personnel for this event. In the
case that Mountain Rescue has an outside emergency, they will still provide a
skeletal medical crew consisting of three people. In the worst case scenario, we
would have two basic first aid skilled personnel stationed at the Maroon Bells with
a personal vehicle, an event medical kit, and a radio for the bike race.
The Accident Detection/Dispatch procedure is as follows:
• In the racers pre-race instructions, the importance of self reliance will be
stressed, this includes the duty to inform a marshal and or Mountain Rescue on
course of any and all accidents to fellow racers. This is the primary mode of injury
detection and location. A final sweep of the course will be used to assure
location of every competitor by the end of the race. It is important that all racers
leaving the course, for medical or any other reason, check-out of the event by
notifying a marshal, who then will notify Tom Clapper, our communications

• There will be several course marshals along the Sk and 22k race routes, some

In the case of an emergency or notification from a participant, they will radio

injured and needs medical attention, the marshal will stay with the injured racer

our responsibility every year to distribute a notice to neighbors surrouhding the
Aspen Highlands.

Weather Contingency Planr The event is impacted very little by weather, but if
severe conditions occur, this event can be canceled.
Emergency access routes: The running. course is on the city streets and bike

If the bib number is not visible on your front, you will be instantly
disqualified. No strollers allowed in the 5K Run.

SPECIAL EVENT SAFETY AND OPERATING PLAN
Description: The Hard Rock & Roll Run & Ride is a Sk run and 22k bike race where
participants run from the Hard Rock Cafe Aspen up to Aspen Highlands, jump on
their bicycle and pedal to Maroon Bells and back. Racers can run the Sk or bike
the 22k or race both in a Duathlon format. This event is a benefit for two non-profit
groups, the Aspen Valley Ski Club Alpine and A.S.K. programs and Mountain
Rescue.

Prevention: the Hard Rock Cafe has secured 1 million dollars worth of insurance
for all involved parties. They include: City of Aspen, Hines Interest, USFS, Pitkin
County, Aspen Valley Ski Club, Mountain Rescue, and Quality Time Events.
1. All participants must sign waiver that reviews dangers of competition, bike
riders must wear helmets and abide by the "Yellow line Rule."
2. Quality Time Events is responsible for the organization of this event. We have
organized the last 3 Hard Rock Races. In addition, we have organized the
following events in Pitkin County:

Race for the CureC~ 1993 - 1996
Ride for the Pass 1995 - 1996
Ducky Derby Waddle 1995 - 1996

Pre Event planning: The experience of previous events has helped with
identification of possible as well as actual problems in this type of event. Each
year after the event is completed, a review of procedure is completed and
recommendations have been implemented.
1. QTE has met with Scott Messina of Mountain Rescue to establish this years
emergency medical procedures for race day. In April, we notified the Aspen
Ambulance District of all of our events for the summer as per their protocol.
2. Our director of course, Ned Ryerson will review the course prior to race day
and will mark all natural and man-made hazards on race day with our rented
cones and barricades, as needed.
3. The director of course will meet with all course marshal volunteers prior to
the race to review their specific responsibilities which includes traffic control,
race rule enforcement and emergency response.
4. The event chain of command has been formulated by Scott Messina and
QTE
5. The events organizer's safety training is limited to Advanced First Aid and
CPR. Therefore, QTE has enlisted the assistance of Mountain Rescue, since they are
a beneficiary.
6. At the Start of each race, course rules and safety issues will be announced
with the use of a megaphone to all participants.
7. The Aspen Valley Ski Club is providing volunteers for all aspects of the event
to include: course marshals, refreshments, registration, aid stations, site set-up and
clean-up.
Emergency Response Plan: As stated earlier, QTE has worked with Mountain
Rescue over the last three years of this event, to develop this Emergency Plan.
Mountain Rescue has agreed to provide medical personnel for this event. In the
case that Mountain Rescue has an outside emergency, they will still provide a
skeletal medical crew consisting of three people. In the worst case scenario, we
would have two basic first aid skilled personnel stationed at the Maroon Bells with
a personal vehicle, an event medical kit, and a radio for the bike race.
The Accident Detection/Dispatch procedure is as follows:
• In the racers pre-race instructions, the importance of self reliance will be
stressed, this includes the duty to inform a marshal and or Mountain Rescue on
course of any and all accidents to fellow racers. This is the primary mode of injury
detection and location. A final sweep of the course will be used to assure
location of every competitor by the end of the race. It is important that all racers
leaving the course, for medical or any other reason, check-out of the event by
notifying a marshal, who then will notify Tom Clapper, our communications
director, so that we do not search for someone who is already back home.

Aid Stations: an aid station for the Sk running course will be located just across
from the Aspen Middle School on the bike path at Mile 2. An aid station for the
22k bike course will be located at the turn-a-round point.

Restrooms: two portable toilets will be located in the finish line/transition area
and one will be located at the Hard Rock Cafe for the start.
Traffic Control: the forest service will temporarily move their traffic turn around.

eliminates all morning traffic to Maroon Bells. As part of the USES Special Event
permit, we will distribute a notice of the event to ali campers for the weekend
asking them to consider spectating for the morning hours and to be aware of
cyclists. in cooperation with RFTA, we will start the Bike only event strategically
offer a RFTA bus has begun its route up to the Bells.
Parking: Duathletes and Bike only racers will park in the Aspen Highlands
parking lot under the direction of our parking officials.
Noise Variance: we will have amplified music at the finish line only. Our noise
variance was secured during the City special event permit process. It has been
our responsibility every year to distribute a notice to neighbors surrounding the
Aspen Highlands.
Emergency Response Funding: Hard Rock Cafe
Weather Contingency Plan: The event is impacted very little by weather, but if
severe conditions occur, this event can be canceled.
Emergency access routes: The running course is on the city streets and bike
path accessible from street/road. The bike course is cccessed from Maroon Creek
Road.
