HomeMy WebLinkAboutbocc.ord.037.1998AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO AUTHORIZING A CONVEYANCE OF THE EMMA BRIDGE TO THE TOWN OF BASALT AND THE ENTRY OF AN INTERGOVERNMENTAL AGREEMENT CONCERNING THIS CONVEYANCE. / `S'Ordinance No. 98-37 Recitals a.,,,,eed # Fg57 1. Pitkin County is the owner of a bridge known as thef'Emma Bridge, State Bridge No. PIT-002-00.1, to the extent that such bridge is located in Pitkin County, Colorado, and the County road known as County Road No. 2 from the Eagle County line across the Emma Bridge to the intersection of the CDOT Right -of -Way for Highway 82. This road is also known as Basalt Avenue and has previously been known as the Emma Road. 2. Pitkin County has entered into certain agreements with the Town of Basalt, both through a written Memorandum of Understanding relating to the Emma Bridge in November of 1997, and oral discussions and understandings concerning funding of a round -about and westbound slip lane at the intersection of Highway 82 and Basalt Avenue, in the Spring of 1998. 3. Pitkin County has authorized expenditures from the Pitkin County Highway 82 Use Tax Fund in the amount of $350,000.00 for construction of the round- about and a westbound slip lane from Emma Road to Highway 82, partly based upon representations by Basalt that it would annex the portion of Basalt Avenue from Two Rivers Road to the Highway 82 Right -of -Way and accept ownership of the Right -of -Way. 4. With respect to the agreement relating to the Emma Bridge, the County delayed any improvements on the Emma Bridge in order to allow Basalt to construct a new bridge as a replacement for the Emma Bridge, allowed the State Bridge Grant funds to be used by Basalt for the new bridge, upon conditions which include that the Town of Basalt would construct the new bridge, and the Town of Basalt would take possession of the existing Emma Bridge no later than September 1, 1998, all as set forth in the written Memorandum of Understanding between Pitkin County and Basalt dated November 20, 1997. 5. The Town of Basalt has substantially completed the new bridge replacing the Emma Bridge and the round -about and has requested funds for those projects from Pitkin County. 6. An intergovernmental agreement is necessary to establish the responsibilities of both entities in connection with the transfer of ownership of Basalt Avenue and the Emma Bridge. Ordinance # 98 - 37 Page 2 7. It is in the best interest of the County, and the public to transfer ownership of the Emma Bridge to Basalt. 8. A draft Intergovernmental Agreement in a form acceptable to Basalt is attached as Exhibit A and incorporated by this reference. NOW THEREFORE, be it ordained by the Board of County Commissioners of Pitkin County, Colorado that the Board of County Commissioners does hereby authorize the conveyance of the Emma Bridge to the Town of Basalt and the entry of an Intergovernmental Agreement concerning this conveyance.
