RESOLIITION OF THE BOARD OF COUNTY COMMISSIONERS OF PITRZN COIINTY, COLORADO, GRANTING APPROVAL FOR CARETAKER DWELLING UNIT TO THE BRABWELLS ON TRACT 9 OF THE WHITE STAR RANCH SIIBDIVISION Resolution No. 92-~ WHEREAS, Darrell and Kimberly Braswell (hereinafter "Applicants") have applied to the Board of County Commissioners of i,i*.kin County, Colorado (hereinafter "Board") for approval to construct an approximately 575 square foot Caretaker Dwelling Unit pursuant to Section 3-8.13(c) of the Land Use Code on Tract 9 of the White Star Ranch Subdivision; and WHEREAS, the Board heard this application at a regularly scheduled public hearing on February 25, 1992, at which time ~:~cic.nce and testimony were presented with respect to this =.pt7.ication; and WHEREAS, the Board finds that this application conforms to `_r'° requirements of Section 3-8.13 (c) of the Code. The following conditions requested by the Housing Authority shall be adhered to by the applicant: a. The applicant shall provide a deed restriction, as stipulated in Section 3-8.13 (c) of th.e Land Use Code, to the APCHA for approval. Upon approval. by the APCAA, the applicant shall record the deed with the Pitkin County Clerk and Recorder's Office prior t~ submission of any building permits for the dwelling. Prior to leasing the Caretaker Dwelling Unit, the applicant shall notify the Housing Authority, and have the prospective tenant complete the required qualification forms and submit those to the Housing Authority for approval. c. The applicant shall provide to the Housing Authority a copy of the executed lease at the time the unit is rented and upon every renewal of the lease term. d. Note: The applicant is not required to rent the unit, however, if rented, conditions b and c shall be met. 2. The applicant may increase the size of the Caretaker Dwelling Unit to 700 square feet, by modifying the deed restriction with the Housing Authority. 3. The unit must comply with the requirements of the Zoning Office prior to issuance of a building permit. 4. All material representations made in the public meeting and in the application shall be adhered to by the applicant unless amended by other conditions. SUMMARY: The Planning Office recommends approval of the applicant's request. The Land Use Code allows the construction of an Employee Dwelling Unit if the applicant meets the criteria of the Land Use Code. The Board approved an Ordinance on October 29, 1991 which amended Section 3-8.13 of the Land Use Code. The Ordinance permits the Board to approve Caretaker Dwelling Units on non-conforming sized parcels if the unit does not exceed 700 square feet; the resulting FAR of the parcel conforms to the FAR requirements of the zone district; a deed restriction is filed which meets the requirements of Section 3-8.13(a) of the Code; and, the proposal is consistent with the special review criteria of the Code. APPLICANT: Darrell and Kimberly Braswell. APPLICANT'S REPRESENTATIVE: Steve Conger, Aspen Design Group. LOCATION: The Caretaker Dwelling Unit is proposed for the 10.10 acre site, Lot 9 White Star Ranch Subdivision, which is zoned RS- 20. ISSUES: 1. The applicant meets all the requirements of Section 3-8.13 (c) of the Land Use Code. 2. The Zoning Office has indicated that the proposed garage is considered to be "connected" to the main house as opposed to "attached". Therefore the proposed unit above the garage will cause the structure to exceed the current maximum height limit for accessory structures. The applicant has also identified four of the required six parking spaces within the "Limited Use Area" on the lot. The approved Second Amended White Star Ranches Subdivision and PUD plat map states: "...Septic systems and non-habitable agricultural outbuildings are the only uses permitted in 'Limited Use Areas'." 3. The Environmental Health Department is satisfied that the applicant's proposal to connect to the subdivision water system and to construct an on-site wastewater disposal system will compatible with the requirements of the Land Use Code. 4. White Star Ranch Homeowners Association President, Bayard Hovdesven has reviewed the applicant's proposal and has no objections. 5. Section 3-8.13(c) permits Caretaker Dwelling Unit of up to 700 square feet. Staff has added a condition that would permit the applicant to expand the unit to 700 square feet, without further review by the Board. 6. The applicant will need to meet the deed restriction requirements for the Caretaker Dwelling Unit as required by Section 3-8.13 of the Land Use Code and the Housing Authority. ALTERNATIVES: The Board of County Commissioner's may: 1. Approve the applicant's request. 2. Deny the applicant's request. D. # 2643-220-10-090 The Aspen/Pitkin Environmental Health Department has reviewed the above-mentioned land use submittal under authority of the Pitkin County Code, Title II, and has the following comments. SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200: The plans for the proposed residence do not include an area for the on-site wastewater disposal system. The septic system should be constructed with a capacity of 900 gallons per day. Soil conditions are considered suitable under Pitkin County regulations for a "conventional" home. Therefore, it is our opinion that an individual wastewater disposal system can be designed and constructed which should be adequate to handle the expected flows from the main residence and a studio/caretaker apartment without engineering design or major site modifications. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-205: The parcel, Lot 9 White Star Ranch, is served by the subdivision water system. we have certified this system as meeting the subdivision review requirements for quantity and quality listed in our memos pertaining to general submission and final plat for the approved subdivision. The existing system meets the requirements of the drinking water supply sections of the Land Use Code. There should be no problems with the drinking water supply for the caretaker unit or for the larger house being built. There are two water storage tanks with a total volume of 13,000 gallons for the water system and six-inch water distribution mains in the roads. The previously submitted water supply analysis from the subdivision water system design engineer indicated that there is adequate water from the spring source. This system was designed with a build- out capacity of approximately 4200 gallons per day, limited by storage volume. The plans for the main house apparently show only one fireplace in the living room. The applicant or their representative might want to consider the placement of a second woodburning stove or gas-log fireplace in the structure. We suggest that the employee unit be restricted to gas-logs or gas appliances, if a fireplace unit is contemplated at all. The additional development would then generate no more wood smoke than those subdivision lots around it. Summary It is our conclusion that there should be minimal environmental impacts resulting from the additional water demand, wastewater disposal, and woodburning. Therefore, we have no technical objections to the requested approval for the project. M E M O RAND U M TO: Mary Lackner, County Planning FROM: Joanna Schaffner, County Zoning DATE: January 2, 1992 RE: Braswell Caretaker Dwelling Unit I have reviewed the above application and offer the following comments. ZONE: RS-20, twenty acre minimum lot size SETBACKS: The proposed unit is outside of all required setbacks. FLOOR AREA: 15,000 square foot maximum The proposed unit is measured at 576 square feet of floor area, not including the overhangs or porch area. The total house does not exceed 15,000 square feet. HEIGNT: This garage is considered by~the Zoning Staff to be "connected" to the main house as opposed to "attached". (See office policy on connector units) As such, the proposed unit above the garage will cause the structure to exceed the current maximum height limit for accessory structures. However, the County may consider a new height restriction for accessory structures as part of the new land use code. Applicant may wish to wait for the new code or redesign the structure. PARKING: To fulfill the parking requirements of Ordinance 91-11, • the applicant must provide six parking spaces. The applicant has indicated on the "Partial Topographic Survey" prepared by High Country Engineering that six spaces will be provided. However, four of these spaces lie within the platted "Limited Use Area". The approved Second Amended White Star Ranches Subdivision and PUD plat map states: "'Limited IIse' areas of Tracts 2,4,5 & 6 can be used for the construction of septic systems, septic systems and non-habitable agriculture outbuildings are the only uses permitted in 'Limited Use Areas'." Based on this notation, the four parking spaces indicated by the applicant to be in this area are not permitted uses.
