Richard Blum (hereafter "Applicant") has applied to the Community Development Director for approval of a detached caretaker dwelling unit. 2. The property is located at 1425 Star Mesa Drive and more specifically described in Exhibit "A". 3. The Applicant proposes to deed restrict.the proposed caretaker dwelling unit pursuant to Section 3-150.130 (B) 4. The proposed caretaker dwelling unit requires administrative approval by the Community Development Director as provided in land use Code Section 3-150.130. 5. The unit will consist of 679 SF net livable azea and include one pazking space. APPLICANT: Richard Blum LOCATION: 1425 Star Mesa Drive, P.I.D.# 2643-232-00-001 ZONING/LOT SIZE: RS-20 PUD/36.37 acre DESCRIPTION OF PROPOSAL: The Community Development Director may approve a Caretaker Dwelling Unit subject to the standards in Section 3-150-130 of the Land Use Code. The applicant proposes to modify an approved structure on the property to include a caretaker dwelling unit. The structure will be detached and less than 700 squaze feet. The existing footprint and bulk of the structure will be maintained. RECOMMENDATION: Staff recommends that the Community Development Director approve the Blum Caretaker Dwelling Unit subject the conditions in the attached Administrative Approval Document. ~; r, . Trotta Jr. Attorney at Law One Fawcett Place, Suite 131 Greenwich, CT 06830 RE: Blum Caretaker Dwelling Unit Dear Mr. Trotta: I am writing in regards to a letter I received from David Mueller dated February 24, 2b00. In the. letter Mc Mueller expressed (on behalf of your clients Lewis and Louise Lehrman) concerns about the proposed Blum Caretaker Dwelling Unit Application. Those concerns were mainly that 1) the structure be built within the approved building envelope, 2) the proposed CDU comply with Pitkin County bulk and height requirements, and 3) that water sources and septic requirements be accommodated by approved systems. Mr. Mueller also expressed concerns pertaining to the lack of notification regarding the previous Blum 1041 Hazard Review. Prior to approval'of the Blum Caretaker Dwelling Unit, I made certain that Mr. Mueller's concerns were addressed. The Blum Caretaker Dwelling unit application was referred to the Pitkin County Zoning Officer at which time the proposed CDU was found to lie within the approved building envelope, The Zoning Officer also confirmed that the structure complied with Pitkin County dimensional requirements. The Pitkin County Environmental Health Department approved septic permit No. 99087 for the proposed caretaker dwelling unit and the State of .Colorado issued well permit No. MH29473 for the main residence. Both the well and septic systems were deemed sufficient by the Environmental Health Department for the proposed caretaker dwelling unit. Lehrman, and is a follow-up to the general objection letter received yesterday sent by Mr. Frank P. Trotta, Esq. In your comments to me yesterday, you indicated that you would consider either postponing a decision, or determining if a public hearing is warranted, pending more specific comments or objections. Essentially, the Lehrman's have the following concerns. There is a concern that the approved outbuilding, referenced in a letter from David F. Gibson as "previously authorized under Building Permit #0822-1999", may not be located in the building envelope. Please verify. A site visit with the architect and surveyor, where the envelope and building footprint were clearly staked, would likely alleviate any concern. 2. There is a concern about visual impacts, particularly the height and bulk of the outbuilding structure the CDU is to be housed within-please verify that it complies with height limitations, and overall FAR requirements for RS-20 (PUD). There is a concern about water use impacting the adjoining Star Mesa properties. Is a new well necessary, or will all domestic water requirements be provided from an existing well or other source? Similarly, is additional effluent to be handled by an existing septic system?. 4. Finally, the Lehrman's were not noticed concerning the prior approval of the outbuilding, and did not have an opportunity to comment on the approval of the outbuilding. In closing, I appreciate your willingness to include these comments in the project file. I believe that these questions and concerns can likely be resolved without the need for public hearing, but would like to reserve the opportunity for a BOCC hearing should the aforementioned issues not be satisfactorily addressed by the Applicant.
