John Beetham, hereinafter "Applicant" applied to the Board of County , U ~ Commissioners of Pitkin County, Colorado, hereinafter "Board", for approval of 1041 ~ Environmental Hazard and Conceptual Submission Review for the construction of a single- ~ family residence. ~ 2. The subject parcel is zoned RS-30 and is approximately 35 acres in size. ~~~d ~ ~ .:~ 3. Said parcel is located approximately 3.5 miles up Woody Creek Road from Upper River Road, and is more specifically described in Exhibit A, attached. 4. The Planning and Zoning Commission reviewed this application on September 2, 1997 p and found that this proposal does not comply with the criteria set forth in the Pitkin County Land Use Code, and forwarded a recommendation of denial to the Board. 5. The Board heard this application at a regularly scheduled meeting on December 17, 1997, at which time evidence and testimony was presented with respect to the 1041 Hazard Review ~( application. 0 v ~ 6. Pursuant to Sections 3-290, 4-150 and 5-220 of the Land Use Code, the Applicant filed for a Takings Determination Hearing. S. The Board of County Commissioners heard the Applicant's appeal of the December 17, 1997 denial on February 25, 1998, at which time further evidence and testimony was presented with respect to the application. 9. The Board determined that the previous denial constitutes a regulatory taking, as defined in the Pitkin County Land Use Code. In order to avoid this situation, the Board resolved that the Applicant be granted an approval to build asingle-family residence and customary accessory uses on the subject property, provided that the Applicant comply with all the conditions of approval in this document. _ NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it does hereby approve the Beetham 104 f Hazard Revievv and General Submission, subject to the following conditions: The Applicant shall adhere to all material representations made in the application and in the public meetings. 2. Prior to building permit application, the Applicant shall record a 24 x 36 inch mylar 1041 Hazard Review Site Plan which meets the approval of the Community Development Department and County Attorney. The Site Plan shall also be submitted in digital format on a 3.5" diskette to the Community Development Department, prior to the issuance of a building permit. The site plan shall include the following 1041 Hazard Review Warning and Disclaimer: "The provisions of these regulations do not in any way assure or imply that areas outside. of designated hazard areas will be free from hazards, or that approved mitigation measures will guarantee the safety of any property. Outside illumination shall comply with County lighting standards in effect at the time of building permit issuance. 4. The Applicant shall comply with the following wildlife mitigation measures: a. One kenneled dog shall be allowed on this parcel. b. Fencing shall be a maximum height of 42", 4 strands or less with a 12" kickspace between the top 2 strands. Any rail fencing shall be the round type, 42", 3-rail or less with at least 18" between 2 of the rails. c. Native vegetation shall not be disturbed outside the building envelope, except as required for the access driveway and the implementation wildfire mitigation measures. Vegetation within the envelope shall be preserved as much as possible in order to screen the residence. 5. Wildfire mitigation shall be as follows: a. All vegetation shall be removed within 10 feet of proposed structures. This "defensible space" area shall be maintained in mowed grass or non-flammable material, such as decorative rock or gravel. b. Brush shall be thinned and standing dead or dead down trees shall be removed for a distance of 37 feet upslope and 43 feet downslope of proposed structures to break up the vertical and horizontal continuity of the fuel. c. Spacing between clumps of brush and vegetation within the 37/43 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. d. All branches from trees and brush within the stated perimeters shall be pruned to a height of 10 feet above the ground. e. Tree crown separation within the perimeters shall have a minimum of 10 feet between the edges of the crowns. This does not apply to mature stands of Aspen trees where the above recommendation for removal of ladder fuels have been complied with. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. g. Roofs and gutters shall be kept clear of debris. h. Yards shall be kept clear of all litter, slash, and flammable debris. i. Firewood shall be stacked on a parallel contour a minimum of 15 feet away from any structure. j. At least one ten pound approved ABC class fire extinguisher shall be placed in a visible and accessible location for each structure. k. Fences shall be kept clear of brush and debris. 1. Wood fences shall not be connected to the structure. m. Fuel tanks shall be installed underground with an approved container. n. Roof construction shall be Class A, non-combustible material with no flat roofs. o. All vents shall be screened with corrosive resistant wire mesh of one quarter inch (1/4") maximum. p. Addresses shall be clearly marked and visible with minimum 2" letters. q. Maintenance of the "defensible space" shall be required in order to retain it's value as wildfire mitigation. Oak and serviceberry tend to sprout vigorously after cutting, so it will be necessary to trim back vegetation eve `ry year or two. r. Any additional buildings shall incorporate wildfire mitigation measures. 6. The Applicant shall install a water storage tank, the size and location to be approved by the Aspen Fire Protection District with an approved and accessible fire district connection, for fire-fighting purposes. 7. Prior to issuance of a building permit, the Applicant shall provide documentation of an adequate domestic water supply. Quantity and quality of said supply shall meet the approval of the Environmental Health Department. The septic system designed for the site shall meet the approval of the Environmental Health Department. The Applicant shall obtain such approval prior to the submittal of a building permit. The Applicant shall obtain afireplace/woodstove permit from Environmental Health Department, prior to the issuance of a building permit. 10. The disturbed areas within the building site shall be revegetated with native grasses to limit water consumption and additional runoff, immediately following project completion. 11. All development included grading, septic system, well, and landscaping shall occur within the building envelope, except for grading necessary to construct the access driveway. 12. The Applicant shall obtain an access perrrLit from the County Engineer, prior to commencement of any construction. 13. The Applicant shall adhere to the following standards for development on slopes: a. Adequate mechanical support shall be provided for cut slopes. b. Adding water which may decrease slope stability shall be avoided. c. Adding weight to the top of the slope shall be avoided. d. Disturbed slopes must be contoured so that they can be revegetated. e. Steepening of existing slopes shall be avoided. f. Confine cuts, fills, grading and excavation to the minimum area needed for construction. 14. .Prior to the issuance of an access permit, the Applicant shall submit plans, profiles and cross-sections for the proposed access driveway to the County Engineer for review and approval. Any retainage of cuts/fills necessary for construction of the road shall consist of a pre-cast concrete block system which is colored to blend with the surrounding landscape. 1 ~. The Applicant shall submit an updated survey to the Community Development Department which depicts the building envelope to be within the boundaries of the subject property, prior to the recordation of the 1041 Site Plan and/or the issuance of any building or access permits. Said Memorandum is attached hereto and made a part of this record as EXHIBIT "M". Carol Craig, adjacent owner of the property in question, pointed out that, based on the map displayed for this discussion, the building envelope, as shown, was on her property. Mr. Ferguson stated this was the old map of Mr. Beetham's application. Mr. Magill said this was the envelope that he reviewed since day one. Mr. Ferguson and Ms. Craig both approached the map on display trying to explain to the Board what was in error. This request has been made as a result of the Board's December 1.7, 1997 denial of the Beetham application for 1041 Environmental Hazard Review and General Submission (see attached memo and resolution of denial). STAFF COMMENTS: On December 31, 1997, the Owner's Attorney submitted a written request for a Takings determination. The letter of request includes the information required by Section 5- 220 in the Code (see attached letter). 1041 ISSUES: Geologic Hazard Areas- The parcel is encumbered by steep slopes, some exceeding 40%. A building envelope has been proposed which avoids slopes exceeding 15%. However, to access the proposed envelope, it will be necessary for the driveway to cross slopes exceeding 40%. The Land Use Code prohibits development on slopes exceeding 30%. Wildfire Hazards- The State Forest Service has rated the wildfire hazard as medium for the proposed building envelope and as severe for the slope below and outside the building envelope down to the Woody Creek Road. The proposed driveway off of Woody Creek Road passes through areas rated as severe wildfire for brush. The Land Use Code prohibits development in severe wildfire areas. TAKINGS: The standard for review of a taking is identified in Section 3-280 of the Code and reads as follows: "The Board shall determine whether the property owner will be denied all reasonable use and economic return on the property as a reszdt of the questioned determination. If the Board determines that a takings has or may occur, it should take such action as it deems appropriate to remedy the situation. In making its decision, the Board shall consider the valise of the property as a whole and shall not base its decision on the impact of the regulation on one portion of the ownership interest. In making its determination the Board shall consider the beneficial uses which remain in the property nottivithstanding the challenged determination and shall give due consideration to the reasonable investment- backed expectations of~the landowner". Applicant's Response: The applicant contends that the Board's denial of the application (the questioned determination) "constitutes a taking of private property without just compensation in violation of the United States and Colorado Constitutions." The applicant argues that the location proposed for a residence is the only suitable site for development on the property and that the site is not appropriate for ranching or other agricultural uses. The applicant states that the sale value of the property with the offending determination is $0, while the sale value without the offending determination is $800,000.00. According to the Pitkin County Assessors Office, the current assessed value (ASD) of the subject property is $00,000.00. Staff Response: Staff believes that there are no other acceptable building sites on the subject property which would avoid the construction of a road which crosses slopes in excess of 30 percent. The best available solution to the access problem would be the utilization of an existing access road on the adjacent Craig property. Staff understands that negotiations with the adjacent property owner have been unproductive to date and there does not appear to be any alternative but to approve the proposed road off of Woody Creek Road. In an effort to minimize the visual and environmental impact of the road. Staff recommends that the road cuts/fills be retained by means of retaining walls (pre-fabricated concrete block systems), not boulder retainage. Staff feels that walls require less grading and can be designed and colored to blend more effectively with the surrounding landscape. Case in point: the Maroon Creek Club residential roads on Buttermilk/Tiehack. Staff believes that the Board's denial of the Beetham 1041 Review may constitute a regulatory taking, as defined in the Pitkin County Land Use Code. In order to avoid this situation, the Board 0 can grant an approval to build asingle-family residence and customary accessory uses on the subject property. RECOMMENDATION: Staff recommends that the Board of County Commissioners approve the Beetham 1041 Hazard review and Conceptual submission, subject to the recommended conditions outlined in the attached resolution of approval. The County Engineer points out that a driveway in the proposed location would create very large cuts, potentially requiring structural walls and the loss of vegetation on the hillsides. Bud Eylar believes that the resulting visual scaring and environmental damage is unacceptable and should result in denial of the proposed access. Wildfire Hazards- The State Forest Service has rated the wildfire hazard as medium for :he proposed building envelope and as severe for the slope below and outside the building envelope down to the Woody Creek Road. GVildlife Habitat- Vlike Villa, the County's Wildlife Biologist, has determined that wildlife activity areas will not be significantly impacted by construction and habitation of a residence in the proposed building envelope. Standard wildlife impact mitigation conditions are recommended. 0 0 C_'once~tual Submission Policies and Requirements All development in Pitkin County must show compatibility with and consideration for a set of guiding policies and minimal standazds set out in Article ? of the Land Use Code. It is staff s opinion that the applicant has adequately addressed these issues in his proposal. RECOMMENDATION: Staff recommends that the Planning and Zoning Commission recommend denial of the Beetham 1041 Hazard Review application based on the finding that Section 3-80.0 C. ?. of the Land Use Code prohibits development on slopes of greater than ~0% and Section 3-80.70 which prohibits development in severe wildfire hazard areas. If the BOCC agrees with the Commission's recommendation, the applicant may appeal pursuant to Section 3-290 ("Takings"). If it is ultimately determined that a "Takings" proceedings should ensue and if it should be resolved that some development may take place on this parcel the Commission may wish to have a set of recommendations in place for the BOCC to consider. A suggested list of conditions follows: 1. The Applicant shall adhere to all material representations made in the application and in the public meetings. ?. Prior to building permit application, the Applicant shall record a 24 s ~6 inch mylar 1041 Hazard Revie~.v Site Plan which meets the approval of the Community Development Department and County Attorney. Outside illumination shall comply with County lighting standards in effect at the time of building permit issuance. 4. The Applicant shall comply with the following wildlife mitigation measures: a. One kenneled dog shall be allowed on this parcel. b. Fencing shall be a maximum height of 42", 4 strands or less with a 12" kickspace between the top 2 strands. Any rail fencing shall be the round type, 42", 3-rail or less with at least 18" between 2 of the rails. 3 0 0 c. Native vegetation shall not be disturbed outside the building envelope, except as required for the access driveway and the implementation wildfire mitigation measures. Vegetation within the envelope shall be preserved as much as possible in order to screen the residence. ~. Wildfire mitigation shall be as follows: a. All vegetation shall be removed within 10 feet of proposed structures. This "defensible space" area shall be maintained in mowed grass or non- flammable material, such as decorative rock or ~ avel. b. Brush shall be thinned and standing dead or dead down trees shall be removed for a distance of ~ 7 feet upslope and ~~ feet downslope of proposed structures to break up the venical and horizontal continuity of the fuel. c. Spacing between clumps of brush and vegetation within the ~.;a~ foot perimeters shall be a minimum of tw-o times he height of the fuel. vlaximum diameter of the clumps shall be two times 'he height of the fuel. All measurements shall be from the edges ofthe crowns of the fuel. d. All branches ~•om trees and brush ~.vZthin the stated perimeters shall be pruned to a height of 10 feet above the ;round. e. Tree crown separation within the perimeters shall have a minimum of 10 feet between the edges of the crowns. This does not apply to mature stands of Aspen trees where the above recommendation for removal of ladder fuels have been complied with. In areas of aspen regeneration. The spacing guidelines shall be followed. f. All branches which extend over the roof eaves shall be trimmed and all branches within 1 ~ feet of the chimneys shall be removed. g. Roofs and gutters shall be kept clear of debris. h. Yards shall be kept clear of all litter, slash, and flammable debris. i. Firewood shall be stacked on a parallel contour a minimum of 1 ~ feet away from any structure. j. At least one ten pound approved ABC class fire extinguisher shall be placed in a visible and accessible location for each structure. k. Fences shall be kept clear of brush and debris. 0 Wood fences shall not be connected to the structure. m. Fuel tanks shall be installed underground with an approved container. n. Room X16 Grand .!unction. Colorado 8101 Telephone: i S)70) _-18-732 i read the application and inspected the site with john Beetham on December 12th. We walked in on an existing ranch road that passes through a portion of the property. We discussed the present access as well as the proposed access which was surveyed and flagged in by the surveyor. The existing road does not have a prohibitive grade to it. There are hazardous fuels next to the road for short distances. The proposed access would have hazardous fuels next ~o it Tor she entire length because it traverses an oakiserviceberry slope. If possible the existing ranch road would be a getter choice from a wildfire hazard standpoint because portions of the road have fuels (i.e., cottonwood) that are less hazardous. This same road does originate at a right angle to the Woody Creek road ~Nhich is also a desirable feature for emergency vehicle access. The building has a west aspect with 10-15% slopes. The fuel is scattered Gambel oak/serviceberry. sage, snowberry and grass. I would rate the wildfire hazard for the building envelope as medium because of the slope and the scattered nature of the woody fuels. The slope below and outside the building envelope down to the Woody Creek road would be rated as a severe wildfire hazard for brush. I noticed in the application that this parcel was rated as a low wildfire hazard. That low rating only exists for the grass meadow above this property. The Colorado State Forest Service (CBEs) uses the National Fire Protection Association 299 standard for the Protection of l ife and Property form Wildfire, the Pitkin County Land Use code and other CSFS publications to develop wildfire mitigation recommendations. My specific wildfire hazard recommendations for this property are as follows. 1) Establish and maintain a cleared 10 foot perimeter around all structures where the vegetation can be maintained at 6 inches or less ii.e., mowed grass). No woody vegetation should be planted within this perimeter. In addition fuelwood or other flammable materials should not be stored within this perimeter. D 4 BEETHAM 1041 -PAGE 2 2) For a distance of 37 feet uphill and to the sides of any structure and 43 feet on the downhill side {see enclosed graph) establish defensible space by thinning and clumping existing vegetation. The Gambel oak and serviceberry shrubs are presently growing in clumps. Any future thinning would just be a matter of creating cleared spaces between some of these clumps. If the existing clumps average 10 feet in height then the clumps allowed to remain should be no larger than 2 times the height in diameter {i.e., 20 feet wide) with an equal distance between them {i.e., 20 feet). I discussed the defensible space concept with Mr. Beetham. I suggested to him that leaving Gambel oak over serviceberry would be a wiser choice since the Gambel oak seems to be the larger plant on this site. 3) Remove the lower branches on these clumps to eliminate ladder fuels. The Pitkin County code states that the lower branches should be removed to a height of 10 feet. Most of these clumps are only 10 feet tall so I recommend removing only the lower branches to half the total height of the stems. 4) Remove al! deadfall within 100 feet of all structures. Little Texas Lane Woody Creek, CO Re: 35-acre parcel of vacant land in sections 14 & 23, T. 9 S., 85W., 6th PM, Pitkin County, Colorado Dear Mr. Beetham: I have completed my geologic evaluation of the captioned parcel, with references to the building envelope, access road and other factors affected by bedrock, soils, slopes, and vegetation. The subject parcel lies east of the Woody Creek Road at elevations of about 7650 to 7850 feet. The parcel is largely covered by scrub oak (Quercus gumbeli) and service berry (Amelanchier sp.) with scattered underbrush of snowberry (Symphoriarr~us sp.), forts and grasses. The slopes just above the Woody Creek Road are steep, with gradients ranging up to about 40%. The west-facing hillside is stable and shows no sign of recent or former solifluction or landslip. The slopes moderate near the top of the bench where the proposed building envelope includes slope grades averaging 12 %. The majority of the proposed building envelope contains slopes of 8 % or less. The whole parcel is underlain by red mudstones and sandstones of the Maroon Formation. The mudstones are sandy enough to maintain stable slopes. Soils over the parcel are derived entirely from the Maroon sandy mudstones. Soil thickness on the building envelope is greater than three (3) feet, and the ground is cultivated in the property adjacent to the building envelope. The soil composition is largely sandy clay with numerous cleats of residual sandstone. This soil is stable and the clays are of the non- swelling variety. No unusual substrate difficulties are anticipated if standard soil tests and engineered foundations are used in construction. The proposed access road crosses the steep west-facing slope below and south of the building envelope. Whereas this road could, at excessive expense, be built and made stable, it probably encroaches on slopes with gradients >30%. In addition, a substantial amount of slope stabilizing vegetation would be removed to make a road acceptable to local fire access regulations. Vegetation in the building envelope is considerably less dense than on the adjacent slopes and drainages. Except where required by fire codes, all vegetation should be maintained outside of the actual construction areas. A flat fee or deposit is collected for land use applications based on the type of application submitted. Referral fees for other County departments reviewing the application will also be collected when necessary. One check including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the Aspen/Pitkin Community Development Department. Applications will not be accepted for processing without the required application fee. A flat fee is collected by Planning for Staff Approvals which normally take a minimal and predictable amount of staff time to process. The fee is not refundable. A deposit is collected by Planning when more e:ctensive staff review is required, as hours are likely to vary substantially from one application to another. Actual staff time spent will be charged against the deposit. After the deposit has been expended, the applicant will be billed monthly based on actual staff hours. ~ Current billings must be paid within 30 days or processing of the application will be suspended. If an applicant has previously failed to pay application fees as required, no new or additional applications will be accepted for processing until the .outstanding fees are paid.
