ISSOS: Sullivan Investments inc., owner of the Star Mountain
Ranch tracts and Stanwood Ranch, inc. are applying for a sub-
division exemption to adjust lot lines (see attached appli-
cation). Three changes are requested:
1) Exchange 3.3 acres with Stanwood Ranch, inc., the owner
of the property directly west of Lot 1. The exchange
would allow for an improvement in the configuration and
grade of the access for Lot 1.
2) Alter the southern boundary line of Lot 1 to conform to
the placement of the waterline and roadway which
roughly follows the existing boundary line. In order
to avoid unnecessary disruption of the natural land-
scape, the applicant proposes to place the roadway
along the waterline.
3) Widening the southern portion of Lot 2 by subtracting
four acres from the southern portion of Lot 3 to
increase the area of Lot 2 in the vicinity of the
proposed building site.
Section 4-2.2(a)(2) provides that the Board may approve lot line
adjustments if the proposal does not create additional lots,
resul ting lots conform to area and width requirements and laws
relating to amended plats are complied with. The Planning
staff's opinion is that this proposal complies with the Code
requirements for lot line adjustments, because this proposal does
not create additional lots, the resul ting lots meet all Code
provisions and the applicant has submitted an amended plat.
ALTERNATIVES:
1) Approval of this application will allow the applicants
to provide improved lot design and access drive
configurations.
2) Denial of this application could create some minor site
design problems regarding access drive design and could
require the applicant to destroy more natural vege-
tation than is necessary.
RECOMI+IENDBD ACTION: The Planning staff recommends that the Board
direct us to draft a resolution approving this request with the
condition that an amended plat be sutmitted for recording which
meets the approval of the Planning Office and County Attorney and
which shall be signed by the Chairman of the Board.

EXHIBIT "A"
This proposal is submitted under Subsection 4-2.2(a) as
an exemption from the full subdivision process for the
adjustment of certain lot lines for Star Mountain Ranch
Tracts. There are three lots in Star Mountain Ranch: Lot 1
contains 35.80 acres, Lot 2 contains 35.48 acres, and Lot 3
contains 70.50 acres. The 141.80 acres comprising the Star
Mountain Ranch Tracts were once part of a 171 acre tract
known as the Star Ranch Subdivision. On December 30, 1982,
John Sullivan acquired Lot 4, Star Dountain Ranch, consisting
of 35.225 acres. On December 6, 1984, Robert P. Diorris, the
owner of Lots 1, 2 and 3, entered into a stipulation with
Pitkin County setting forth the provisions for an amended
plat, re-configuring Lots 1, 2, 3 and 4 into three lots (see
Exhibit "B" attached hereto). On December 11, 1984, John
Sullivan acquired Lots 1, 2 and 3.
The Stipulation recorded in Book 477 at Page 791 of the
Pitkin County records recites the special review approval by
the Board of County Commisisoners which established approved
locations for the construction of improvements and imposed
certain conditions thereon. The approved locations (referred
to as "building envelopes") are described on the Plat Map of
the Star Mountain Ranch Tracts recorded in Plat Book 13 at
Page 44 of the Pitkin County records. The Stipulation also
established that the subject property received prior
subdivision review, special review and generally satisfied
the conditions of the Pitkin County Land Use Code.
The Stipulation granted a lot split approval and
required a reconfiguring of the four lots into three lots
with approved building sites as designated on The Star
Mountain Ranch Tracts Amended Plat Map.
The Star Mountain Ranch Tracts Amended Plat Map
(recorded in Plat Book 16 at Page 73 of the Pitkin County
records) depicts the reconfigured three lots. This proposal
is to effect three changes:
1. Exchange 3.3 acres with Starwood Ranch, Inc., the
owner of the property directly west of Lot 1. The proposed
exchange would narrow the center portion of Lot 1, and widen
the southern portion of the lot where the access occurs. The
exchange would allow for an improvement in the configuration
and grade of the access for Lot 1.
2. Alter the southern boundary line of Lot 1 to
conform to the placement of the waterline and roadway which
roughly follows the existing boundary line. The water line
which has recently been constructed varies somewhat from the
platted driveway and boundary line. In order to avoid
unnecessary disruption of the natural landscape, the
applicant proposes to place the roadway along the waterline.
The centerline of the roadway forms the southern boundary for
Lot 2.
3. The third proposed change is the widening of the
southern portion of Lot 2 by subtracting four acres from the
southern portion of Lot 3. This proposal would increase the
area of Lot 2 in the vicinity of the proposed building site
to avoid the placement of a boundary line close to the
proposed building site.
There are presently three lots comprising the Star
Mountain Ranch, and this proposal creates no new lots. The
lots are each greater than 35 acres in size, and this
proposal results in each lot remaining greater than 35 acres
in size.

Pursuant to our telephone conference of November 18,
1986, I am writing you to document your file with the
information that the Final Plat for the Star Mountain Ranch
Lot Line Adjustment will show certain private equestrian
easements along the southerly property line of Lots 2 and 3,
and a private easement for the movement of stock along the
gully which crosses the southerly tip of Lot 1. It is my
understanding that the equestrian easement was an existing
easement inadvertently omitted from the preliminary plat
submitted to you earlier, that the private easement for the
movement of stock merely formalizes an existing but very
light informal use, and that neither of these easements have
any bearing on the issue of the lot line adjustments being
presented to the Board of County Commissioners.

EXHIBIT "A"
This proposal is submitted under Subsection 4-2.2(a) as
an exemption from the full subdivision process for the
adjustment of certain lot lines for Star Mountain Ranch
Tracts. There are three lots in Star Mountain Ranch: Lot 1
contains 35.80 acres, Lot 2 contains 35.48 acres, and Lot 3
contains 70.50 acres. The 141.80 acres comprising the Star
Mountain Ranch Tracts were once part of a 171 acre tract
known as the Star Ranch Subdivision. On December 30, 1982,
John Sullivan acquired Lot 4, Star Mountain Ranch, consisting
of 35.225 acres. On December 6, 1984, Robert P. Morris, the
owner of Lots 1, 2 and 3, entered into a stipulation with
Pitkin County setting forth the provisions for an amended
plat, re-configuring Lots 1, 2, 3 and 4 into three lots (see
Exhibit "B" attached hereto). On December 11, 1984, John
Sullivan acquired Lots 1, 2 and 3.
The Stipulation recorded in Book 477 at Page 791 of the
Pitkin County records recites the special review approval by
the Board of County Commisisoners which established approved
locations for the construction of improvements and imposed
certain conditions thereon. The approved locations (referred
to as "building envelopes") are described on the Plat Map of
the Star Mountain Ranch Tracts recorded in Plat Book 13 at
Page 44 of the Pitkin County records. The Stipulation also
established that the subject property received prior
subdivision review, special review and generally satisfied
the conditions of the Pitkin County Land Use Code.
The Stipulation granted a lot split approval and
required a reconfiguring of the four lots into three lots
with approved building sites as designated on The Star
Mountain Ranch Tracts Amended Plat Map.
The Star Mountain Ranch Tracts Amended Plat Map
(recorded in Plat Book 16 at Page 73 of the Pitkin County
records) depicts the reconfigured three lots. This proposal
is to effect three changes:
1. Exchange 3.3 acres with Starwood Ranch, Inc., the
owner of the property directly west of Lot 1. The proposed
exchange would narrow the center portion of Lot 1, and widen
the southern portion of the lot where the access occurs. The
exchange would allow for an improvement in the configuration
and grade of the access for Lot 1.
2. Alter the southern boundary line of Lot 1 to
conform to the placement of the waterline and roadway which
roughly follows the existing boundary line. The water line
which has recently been constructed varies somewhat from the
platted driveway and boundary line. In order to avoid
unnecessary disruption of the natural landscape, the
applicant proposes to place the roadway along the waterline.
The centerline of the roadway forms the southern boundary for
Lot 2.
3. The third proposed change is the widening of the
southern portion of Lot 2 by subtracting four acres from the
southern portion of Lot 3. This proposal would increase the
area of Lot 2 in the vicinity of the proposed building site
to avoid the placement of a boundary line close to the
proposed building site.
There are presently three lots comprising the Star
Mountain Ranch, and this proposal creates no new lots. The
lots are each greater than 35 acres in size, and this
proposal results in each lot remaining greater than 35 acres
in size.
