NOW, THEREFORE, BE IT RESOLVED by the Board that it does hereby grant Subdivision Exemption and Employee Unit Special Review approval subject to the following conditions: 1) The Applicant shall submit an amended plat for the Chairman to sign which meets the approval of the Planning Office and County Attorney. 2) Prior to the issuance of a building permit for the main residence, the Applicant shall deed restrict the caretaker unit in conformance with Housing Authority Guidelines. '_;TEF'N F MEMORANDDM TO: Pitkin County Board of County Commissioners FROM: Francis Krizmanich, Planning Office RE: Stern Subdivision Exemption/Employee Unit Special Review DATE: March 23, 1987 APPLICANTS: Edgar and Pauline Stern and William Ziff. REQOEST: The applicants are requesting approval of a Lot Line Adjustment to increase the size of Lot R-53 of Starwood Subdivi- sion. The present lot is 5.6 acres in size. The proposed lot line adjustment will add 5.6 acres to create a new conforming lot of 10+ acres. A modular home permitted in 1972 exists on the 5.6 acres which are to be added to lot 53. The applicants are requesting approval of the modular home as a caretaker unit. The application is attached. ZONING: AF-1. ACCESS: Access exists via the platted roads within the Starwood Subdivision. iiATER: Water is provided by the Starwood Subdivision water system. SEWER: Sewage is treated by individual septic systems. MAJOR ISSDES AND CONCERNS: I. Referral Agency Comments: 1. Environmental Health Department: In a memo dated March 9, 1987 (attached) Bob Nelson submitted the following comments: o Water Supply: The property is served by the Starwood water system which can serve the existing caretaker unit as well as any future residence. o Sewage Disposal: The existing septic system which serves the caretaker unit appears to be function- ing properly. A new residence may require an engineered system. o Air Quality: It is suggested that limitations be placed on the number of woodstoves or fireplaces which may be installed. o Water Quality: Care should be taken when con- structing the future main residence to avoid pollution of the small drainage through sedimenta- tion. 2. Housing Office: In a memo dated March 4, 1987 (at- tached), Jim Adamski recommended approval of the caretaker unit with the standard deed restrictions to be recorded if this proposal is approved by the Board. 3. County Planning Engineer: In a memo dated March 12, 1987 (attached), Tom Newland commented that he has reviewed the Lot Line Adjustment plat and recommends approval. II. Staff Comments: Lot 53 of Starwood Subdivision was approved for the separate development of a residence by Board Resolution No. 80-54 (attached). The proposed Lot Line Adjustment conforms to Sections 4-2.2(a)(2) of the Land Use Code which permits lot line adjustments based on the following criteria: "(A) That the adjustment creates not more than the original number of lot or parcels;" This proposal does not create any additional parcels or lots. "(B) That the purpose or effect of the lot line adjustment is not the creation of a new lot or parcel for development or resale purposes;" Lot 53 has been granted the right for separate development by Board Resolution No. 8--54; this proposal will not affect the developability of the lot. "(C) That in the case of conforming lots and parcels, any resulting lot or parcel shall conform to the minimum requirements for area or width established by the provisions of this Code;" and "(D) That in the case of existing nonconforming lots or parcels, any resulting lot or parcel shall not increase in nonconformity." This proposal involves a 79 acre conforming lot and a 5.6 acre non-conforming lot. The lot line adjustment will make the 5.6 acres lot conforming by increasing its size to 10+ acres. The 79 acre parcel will remain conforming at 73 2 acres. "(E) That all laws relating to the amendment of recorded plats are complied with." The applicant has submitted an amended plat which will be recorded if this application is approved. The Planning staff recommends approval of the proposed Lot Line Adjustment because it meets the above criteria. In regard to the caretaker unit, the applicant is applying for approval based on Section 3-8.13(d) of the Code which sets forth the following criteria: "(1) The applicant must demonstrate to the satisfaction of the Board that the proposed employee unit was completed and in existence prior to June 8, 1981;" The applicant has provided a foundation permit for the caretaker unit that was issued in 1972. "(2) The applicant must specify the applicable require- ments of Section 3-8.13 which can or cannot be met and the reasons therefore;" This application does not meet the requirement that care- taker units on conforming lots must be attached to or within the main residence, or within an agricultural outbuilding of at least 1500 square feet. The unit was constructed in 1972 before the caretaker unit regulations were adopted. "(3) The approval must require compliance with the otherwise applicable requirements of this section to the full extent practical;" The applicant has committed to deed restrict for the caretaker use unit and to rent it under the moderate income guidelines as recommended by the Housing Office. "(4) The approval must require the applicant to meet the health and safety requirements of the Uniform Building Code, as determined by the Building Inspec- tor;" The caretaker unit was issued a building permit in 1972. The staff recommends approval of the caretaker unit. The unit has been historically used to house a caretaker. Granting approval of this request will insure its continued use as a caretaker unit. The staff agrees with Bob Nelsons recommendation to limit the total number of woodburning 3 devices. The caretaker unit and a future residence should be limited to a combined total of one fireplace and one certified woodburning device as currently permitted for new residential construction. RECOMMENDATION: The Planning staff recommends that the Board grant Lot Line Adjustment and Employee Unit approval to the applicants subject to the following conditions: 1) The applicant shall submit an amended plat for the Chairman to sign which meets the approval of the Planning Office and County Attorney. 2) The applicant shall deed restrict the caretaker unit in conformance with Housing Authority Guidelines. 3) The total number of woodburning devices for the caretaker unit and any proposed future main residence shall be limited to one fireplace and one certified "clean burning" device. As I advised you over the phone, only a foundation permit exists for the original dwelling as the structure is a double-wide modular and was trucked to the site and, at that time, no further permits were required. Also, a copy of the building permit for this addition is enclosed. The dwelling consists of two bedrooms and 2 baths as well as a living roam, dining room, kitchen, small off ice. and entry hall. The square footage, including the recent addition, is approximtely 1,400 square feet. Since complete plane do not exist, Ann Bowman of the Aspen/Pitkin Housing Authority inspected the dwelling on February 24th. Aa a result of this inspection, she has suggested that we represent this employee unit to be rented under the Moderate Income Guidelines. EXHIBIT B VICINITY MAP STARWOOD - 26 25 QN ~ SCALE 1"= 400 35 36 NOTE:SECTIONS 35&26 ZONED AF-1 /~ ~/ J yg EXHIBIT A This proposal requests exemption from the terms "subdivi- sion" and "subdivided land", under Section 2.2(a)(2) of the Pitkin County Land Use Code, for a lot line adjustment in Starwood Subdivision, and also requests approval of an existing detached "Employee Unit" under Section 3-8.13(d) of the Code. In essence, it is proposed that Lot R-53, Starwood Seven (containing 5.618 acres) be enlarged and replatted to include an adjoining 5.657 acres, resulting in an AF-1 zone conforming lot of 11.275 acres, and that the present caretaker residence on said 5.657 acre parcel be designated as a legal Employee Unit. The Map attached hereto as Exhibit C indicates the locations and acre- ages of the properties for which this lot line adjustment exemp- tion is sought, and depicts all other information required by Code Section 4-2.3(a)(2). The proposed Employee Unit was constructed in the fall of 1972 (see Building Permit attached hereto), and since that time has served as the caretaker house for the Edgar Stern residence on Lot R-86-A, Starwood Fifteen. The caretaker house is cur- rently located on a 79 acre parcel of land commonly known as the Polgar Tract, which is undeveloped other than with the caretaker house near the northerly boundary thereof. Lot R-53 lies direct- ly between said Polgar Tract and Lot R-86-A. In December of 1986, Edgar and Pauline Stern sold Lot R-86- A, together with certain adjacent tracts and lots including Lot R-53 (all consisting of approximately 74 acres), to William Ziff. The Sterns retained ownership of the entire Polgar Tract, but immediately following final approval of this application they will convey the 5.657 acres to Mr. Ziff, who will then be the owner of all of Lot R-53 as amended and replatted (to be known as Lot R-53-A), including the caretaker house which serves his main residence on Lot-86-A. It should be noted that following such conveyance, the remaining Polgar Tract will be no less conforming at 73.610 acres. The final Replat of Lot R-53 (into Lot R-53-A) will contain dedication language customary to replats of Starwood Subdivision lots, particularly including a recital that Lot R-53-A shall thereafter be considered as one individual "Residential Tract" for all purposes of the Starwood Protective Covenants and Pitkin County zoning and other land use regulations. At present, Lot R- 53 is unimproved and is developable by right (ie. without special review) with a free market residential unit. Lot R-53-A shall, of course, continue to be entitled to this same development right. Exhibit A Continued Furthermore, the Applicants are prepared to guarantee and dedicate the caretaker house as a legal Employee Unit, pursuant to Code Section 3-8.13(d)(6), simultaneously with the execution and recording of the approved Replat. We have completed a site inspection of the employee unit to ascertain existing conditions and wish to offer the following pertinent review comments for your consider- ation: 1. WATER SUPPLY The created parcel, Lot 53 A, is served by the Starwood Subdi- vision water system and there should be no problems with the drinking water quantity or quality for the existing unit or for the house which may be developed in the future. There are large water storage tanks in the immediate vicinity and eight inch water mains in the adjacent road which were reconstructed in 1984. 2. SEWAGE DISPOSAL Lot 53 was separated from contiguous parcels under the same ownership by action of the Board of County Commissioners in 1980. Because of the anticipated soil conditions, the main house, which we expect will be constructed in the future, will be required by County Regulations to install an engineered sewage disposal system. However, it appears that the septic system for the modular house installed in 1972 is continuing. to function satisfactorily. While we have no permit for this on-site waste water disposal system installation, we would not require any changes or modifications to the septic system, so long as it continues to operate properly. 3. AIR QUALITY IMPACTS It is our interpretation that the employee unit, a detached modular house, and the main house which might eventually be constructed are each allowed a fireplace or noncertified wood stove. In addition, each structure would be allowed one certi- fied wood stove. If agreeable to the indi- vidual applicants and their representatives, the lot would then generate no more wood smoke than those subdivision lots around it. 4. WATER QUALITY IMPACTS Care should be taken in future planning of the construction to avoid the small drainage adjacent to the modular house and limit the sedimentation of this water course during runoff. M E M O R A N D U M T0: THE HOUSING AUTHORITY BOARD OF THE CITY OF ASPEN AND PITKIN COUNTY, COLORADO FROM: J. LUCAS ADAMSKI, DIRECTOR DATE: MARCH 4, 1987 RE: POLGAR EMPLOYEE UNIT -JOHN DOREMUS REQUEST John Doremus contacted the Rousing Office requesting that the Polgar Employee Unit be legalized and made a caretaker unit under the moderate income guidelines (see the attached letter to the Planning Office- dated February 25, 1987). I directed Ann Bowman to inspect the unit in Starwood which she did February 27, 1987. She reported that the unit is in very good condition and would be an attractive addition to the employee caretaker inventory. The unit is a two bedroom, two bath mobile home on a permanent foundation with a living room, dining room kitchen and an additional stick built family room. The present occupants have been caretakers for the Polgar home for eight years. The Rousing Office was impressed with the overall quality of this unit and highly recommend approval as a caretaker. This information was forwarded to Mr. Doremus and a copy of this memo upon your approval will be forwarded to the Planning Office. If the Planning Office also approves this request a deed restric- tion will be recorded for the Polgar Employee unit. ACTION NEEDED: Approval of staff recommendation. The memorandum refers to the unit that is the subject of the application as a "mobile home" on a permanent foundation. Please note that the Pitkin County Land Use Code, Section 5- 504.1(m), defines a mobile home as follows: "A structure designed to be transported after fabrication and equal to or exceeding eight feet (8') in body width or thirty-two feet (32') in body length, excluding towing gear and bumper. Such a structure is suitable for human habitation on a year-round basis when provided with required plumbing, heating, and electrical facilities. Provided, however, that any substandard size units existing at the time of adoptions of these regulations shall be allowed to continue." Section 5-504.8(a), specifies that no mobile home shall be installed, maintained, used, occupied, etc., within any area of Pitkin County except within a mobile home park meeting the requirements of the code. Please review the Polgar employee unit application within the context of these limitations. If the structure is a mobile home within the meaning of the code, it cannot be approved as a caretaker unit, even if it otherwise meets the caretaker unit requirement.
