SUMMARY: The Planning Office recommends approval of the applicant's request. The Land Use Code allows the construction of an Employee Dwelling Unit if the applicant meets the criteria of the Land Use Code. The Board approved an Ordinance on October 29, 1991 which amended Section 3-8.13 of the Land Use Code. The Ordinance permits the Board to approve Employee Dwelling Units on conforming sized parcels if the unit does not exceed 1,500 square feet; the resulting FAR of the parcel conforms to the FAR requirements of the zone district; a deed restriction is required to be filed which meets the requirements of Section 3-8.13(b) of the Code; and, the proposal is consistent with the special review criteria of the Code in that there will be minimal impact to the neighborhood, roads, scenic quality and utility extension. APPLICANT: Bricol N.V. APPLICANT'S REPRESENTATIVE: William Jordan III, Its Agent and Attorney. LOCATION: The Employee Dwelling Unit is proposed for a 35 acre site, Lot 1 Star Mountain Ranch Subdivision, which is zoned RS- 20. ISSUES: 1. The applicant meets all the requirements of Section 3-8.13(b) of the Land Use Code, as the unit is not to exceed 1,500 square feet; the resulting floor area of the parcel will be 14,305 square feet; the unit is located within a County approved building envelope; the applicant has agreed to the requirements of the deed restriction; and the unit appears to be compatible with the special review criteria of the Code. 2. The Zoning Office has indicated that the proposed location of the Employee Dwelling Unit immediately adjacent to the building envelope boundary does not allow for any expansion to occur to the west, including steps, porches, decks, etc. Staff recommends that the unit be adjusted to within the building envelope boundary to allow for such development without amending the building envelope. Prior to issuance of a building permit of the Employee Dwelling Unit, the Zoning Office must verify that the existing residential development on the parcel, including the addition of this dwelling unit, will not exceed 15,000 square feet. If residential square footage exceeds 15,000 square feet, a special review for additional square footage will be required. 3. The Environmental Health Department is satisfied that the existing septic system is designed to accommodate this proposed employee unit. Additional drainage and grading improvements will be necessary with the construction of the employee unit to avoid additional water from intruding into the sewage system. The applicant is proposing to connect to the Starwood Subdivision water system. Generally, the Environmental Health Department believes that the proposed development will meet the requirements of the Land Use Code or water and septic needs. The applicant will need to meet the deed restriction requirements for the Employee Dwelling Unit as required by Section 3-8.13 of the Land Use Code and the Housing Authority. ALTERNATIVES: The Board of County Commissioner's may: 1. Approve the applicant's request. Deny the applicant's request. SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200: There is no indication of the means of wastewater disposal in the application. We learned during the design review committee process that the proposed unit will be connected to the main house engineered on-site wastewater disposal system. This evapotranspiration system has been permitted and is currently under construction. The engineering design calculations included provisions to accommodate the caretaker house, should it be approved. This system is designed to conform to Pitkin County regulations. The limited amount of wastewater added to the system from the caretaker unit should actually benefit the sewage disposal system by adding some organic material to the tank when the main house is empty for prolonged periods of time. In addition, there is an indication of a large amount of runoff, which could saturate the sewage system area soils during the Spring. Runoff and a perched water table on top of the shallow clay stone bedrock evident in the area will require additional drainage and grading improvements when the caretaker house is built to avoid additional water intruding into the sewage system. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-205: The parcel is served by the Starwood Subdivision water system. Water mains are already installed. The existing conditions meet the requirements of the drinking water supply sections of the Land Use Code. There should be no problems with the drinking water quantity or quality for the main structure or the proposed employee dwelling unit. There are large water storage tanks in the immediate vicinity and eight-inch water mains located in the adjacent road which will provide sufficient flows. This dwelling is not expected to contribute significantly to air quality degradation in the county. A report on air quality impact is required to address potential or existing alternatives to automobile traffic and any special design or construction methods or improvements which would reduce the impacts of pollutants produced by the proposed development. While there may be no alternatives to auto use, since the caretaker will be working onsite, the impacts may be minimal. The report should address construction methods which will minimize pollution, including the number and types of fireplaces and woodstoves and any energy-saving fixtures or measures to be used in the building. SPECIFIC REQiIEST FOR APPROVAL Section 3-8.13(b)(1) of the Pitkin County Land Use Code (Ordinance 91-11) states that the Board of County Commissioners may permit one detached employee dwelling unit on a lot in this zone, which dwelling unit shall not exceed 1,500 square feet of floor area. In that the proposed caretaker unit is located within an approved building envelope in a subdivision that exists pursuant to an approved plat, the unit is therefore located in conformance with the standards of the Pitkin County Land Use Code, including but not limited to, scenic and environmental standards and 1041 Hazard Regulations. The Applicant shall, by Deed Restriction as approved by the Board, guaranty those applicable matters set forth in Section 3- 8.13(b)(4). The unit, as approved, shall be registered with the Pitkin County Housing Authority. The proposed caretaker unit is compatible with the existing neighborhood. The proposed caretaker unit is located in close proximity to an approved caretaker unit in existence on the nearby Lot 84, Starwood Subdivision as well as two approved caretaker units on the adjacent Lot 2, Stanwood Ranch Subdivision. Access to the proposed caretaker unit is the same access for the primary single-family residence on the subject lot, i.e., off of North Stanwood Drive. All utilities are available to the subject lot and the subject site. The subject lot is within the Stanwood Water District and as such will be supplied water by such District. The proposed caretaker unit will utilize the same waste water system as the primary single-family residence on the subject lot, which system will be an approved E.T. Bed system. Once the Applicant is furnished with the notice form promulgated by the Planning Office, Applicant shall mail notice to all adjoining landowners listed on Exhibit D and shall provide the Board with proof of such mailing prior to the hearing. Additionally, Applicant shall post a visible sign at least fifteen (15) days in advance of the hearing, all of which shall be done pursuant to the provisions of Section 3-8.13(f). 3. SII1!gfARY In summary, the proposed unit, the site, the lot and this application are all in compliance with the provisions of Section 3- 8.13. Such individual may be an employee of the Owner, provided such person(s) fulfills the requirements of a qualified employee. 3. The Employee Dwelling Unit shall not be occupied by the Owner or members of the immediate family ("Immediate family" shall mean a person related by blood or marriage who is a first cousin (or closer relative) and his or her children) nor shall the Employee Dwelling Unit be used as a guest house or guest facili- ties. 4. Written verification of employment of employee(s) proposed to reside in the Employee Dwelling Unit shall be completed and filed with the Authority by the Owner of the Employee Dwelling Unit prior to occupancy thereof, and such verification must be acceptable to the Authority. 5. The Employee Dwelling Unit shall be required to be rented and be rented for periods of no less than six (6) consecu- tive months. Upon vacancy of the Employee Dwelling Unit, the Owner is granted ninety (90) days in which to locate a qualified employee. If no employee is placed by the Owner, the Authority may rent the Employee Dwelling Unit to a qualified employee. 6. The maximum rental rate shall not exceed the Category #3 rental rate as set forth in the Rental Guidelines established by the Authority and may be adjusted annually as set forth by the Guidelines. The maximum permitted rent for the unit on the date of execution of this deed restriction is Rent shall be verified and approved by the Authority upon submission and approval of the lease. Employees shall be qualified by the Authority as to employment only, and not maximum income or asset limitations. 7. Lease agreements executed for occupancy of the Employee Dwelling Unit shall provide for a rental term of not less than six {6) consecutive months. A signed and executed copy of the lease shall be provided to the Authority by the Owner within ten (10) days of approval of employee(s) for the Employee Dwelling Unit. 8. This Agreement may be removed by the Owner with the approval of the Board of Pitkin County Commissioners, subject to the requirement that the Employee Dwelling Unit is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a "Dwelling Unit" as defined in the Pitkin County Land Use Code and must meet otherwise applicable code requirements. 9. Unless modified as stated above, this Agreement shall constitute covenants running with the Real Property as a burden thereon for the benefit of, and shall be specifically enforceable by, the Authority, the Board of County Commissioners of the County 2 of Pitkin, Colorado, and their respective successors, as applica- ble, by any appropriate legal action including, but not limited to, injunction, abatement, or eviction of non-qualified tenants.
