RE: Shelton Conceptual Submission, Public Hearing
ISSUE: The applicant has applied for Conceptual Submission approval to develop a single
family residence. The property contains low to moderate wildfire hazards and is close to mapped
deer and elk winter range.
LOCATION: The property is located in Crystal River Country Estates in the Crystal River
Valley.
ZONING: The property is zoned RS-s0 and contains approximately 1 S acres. It is a legal non-
conforming lot.
CODE STANDARDS:
Access and Utilities: This property is located within a substantially developed subdivision.
Access to the lot exists on developed roads and utilities are located in close proximity to the
development azea.
1041 Hazards: This site is affected by Moderate Wildfire Hazards and Wildlife Habitats
including Deer, Elk and Bighorn Sheep winter range.
In regazd to Wildlife impact mitigation, Kevin Wright of the CDOW recommends that the
approval contain conditions to mitigate wildlife impacts.
In regazd to Wildfire concerns, Vince Urbina of the CSFS recommends conditions to mitigate
wildfire hazards.
The staff recommends that the above concerns be adopted as conditions of approval as outlined
below.
RECOMMENDATION: The staff recommends approval of the Shelton Conceptual
Submission subject to the following conditions.
To mitigate wildfire hazazds the applicant shall comply with the following conditions:

a) For a distance of 10 feet around all structures create and maintain a clear space
where vegetation can be kept at or below 6 inches (e.g. mowed grass). Woody
vegetation like trees and shrubs should not be planted within this perimeter.
b) For a distance of 37 feet uphill and to the sides, and 42 feet downhill thinning
should take place to establish defensible space (see enclosed chart). Defensible
space is defined as an area where the fuels have been modified to protect
structures from approaching wildfire. According to the Pitkin County code 3-
807.C., spacing between clumps of brush (i.e. Gambel oak/serviceberry species)
shall be a minimum of two times the height of the fuel. Maximum diameter of the
clumps shall be two times the height of the fuel. For example, if the clumps aze
10 feet tall then the maximum diameter of any clump should be 20 feet with a 20
foot spacing between remaining clumps. If woody vegetation is allowed to return
into these spaces the effectiveness of defensible space will be compromised.
c) Trees allowed to remain within the defensible space perimeter should have the
lower limbs removed to a height of 10 feet to eliminate ladder fuels. Ladder fuels
aze defined as any vegetation which may allow a fire to bum from ground level
into the lower branches and then proceed into the crown. If these trees aze less
than 10 feet tall, I suggest removing the lower branches to half the total height of
the tree.
d) Tree crown sepazation shall have a minimum of 10 feet between the edges of
crowns for any trees that aze allowed to remain within the defensible space
perimeter. This spacing applies to any trees that may be planted after the
structures have been built. -
e) All deadfall within a 100 foot perimeter shall be removed.
2. The applicant shall mitigate wildlife hazazds. The applicant shall:
a) The applicant is encouraged to maintain the Ponderosa Pine and dead pinon tree;
b) Dogs shall be kenneled;
c) Maintain native vegetation outside building envelope;
d) Fences aze limited to a maximum of four strands of wire or three rails. No fence
shall exceed 42 inches in height; and
e) If bears become a problem, all trash be kept in approved beaz proof gazbage
containers.
All development other than the access drive and utility extensions will be contained
within the approved development envelope.

4. The applicant shall abide by all representations and commitments made as part of this
review.
5. The applicant shall submit a 24x36 inch mylaz site plan for recording as approved by the
Hearing Officer.
6. Development within the development envelope shall avoid slopes in excess of 15%.
The driveway entrance shall be approved by the County Engineer.

Shelton's Lot 1, Block 1 of Crystal River Country Estates lies
within elk winter range and is close to bighorn sheep winter
range, winter concentration area, and production area. There is
little elk use of the property but a fair amount of mule deer
sign (browsing, droppings, tracks) was observed. The bighorn
sheep are located along the ridge to the west of the property.
Black bears may inhabit the area and could become a problem with
trash/garbage. The ponderosa pine and dead pinon located and
mapped on the property provide good resting/feeding perch sites
for various raptors, owls, and other neotropical birds.
Development of a single family home should not have significant
negative impacts to wildlife due to existing and surrounding
homes and the existing disturbance.
Impacts to wildlife can be minimized by the following:
1. Place home in southern 1/2 of envelope in the more open
meadow area of the lot
2. Maintain the Ponderosa Pine and dead pinon tree
3. Restrict to 1 dog with a kennel restriction
4. Maintain native vegetation outside building envelope
5. Any fences be 42", 4 strand or less with a 12" kickspace
between the top 2 strands. Any rail fencing be the round or
split rail type, 48", 3 rail of less with at least 18"
between 2 of the rails
6. If bears become a problem, all trash be kept in approved
bear proof garbage containers

As I mentioned to you on October 18th please submit this letter with the Shelton 1041
application. Bill Gavette of the Carbondale Fire Department and I walked over the entire parcel
after you left.
171e site is located iu Crystal River Cowltry Estates. Access is via a one lace road that rwls
parallel to the Crystal River (Le. the old railroad grade). This road is shared by three other
properly owners. Puel density along this road does not present a problem for access purposes.
This road is presently one lazte. The building site has a south aspect with a slope of 10-15%- The
existing fuels consist of scattered pine and juniper, clumps of Gambel oak, rabbitbrush and grass.
There is a stand of Gambel oak just west of the building envelope. 173is dense oak stand helps
stabilize the steep slope above the access road. I would rate the existing wildfire hazazd as
moderate.
The Colorado State Forest Service (CSFS) uses the National Fire Protection Association 299
standard for the Protection of Life and Property from Wildfire, the I'itkiu County Land Use Code
and other CSFS publications to develop mitigation recommendations. My specific wildfire Lazard
mitigation recommendations aze as follows.
1) For a distance of 10 feet around all structures create and maintain a clear space where
vegetation can be kept at or below 6 inches (e-g. mowed grass). Woody vegetation like trees and
sluubs should not be planted within this perimeter.
2) For a distance of 37 feet uphill and to the sides, and 42 feet dowldlill thhuliug should take place

This parcel contains 1.52 acres and is non-conforming in size.
SETBACKS: The required setbacks for this parcel are:
30-foot front yard setback
20 foot side yard setback
30 foot rear yard setback
The approved building envelope lies outside of these required
setbacks.
FLOOR AREA: The allowed floor area on this parcel is a total of
15,000 square feet. All structures are included in the
calculation of floor area. The applicant has not represented how
much floor area is anticipated at this time.
HEIGHT: Sufficient information has not been submitted to
determine compliance with County height regulations.
OTHER: Development is not permitted outside of approved

L APPLICANT has submitted to COUNTY an application for
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Pitkin County Resolution
No. 95-226 establishes a fee structure for Planning applications and the payment of
all processing fees is a condition precedent to a determination of application
completeness.
3. APPLICANT and COUNTY agree that because of the size, nature or
scope of the proposed project, it is not possible at this time to ascertain the full
extent or' the costs involved in~processing the application. APPLICANT and
COUNTY further agree that it is in the interest of the parries to allow
APPLICANT to make payment of an initial deposit and to thereafter permit
additional costs to be billed to APPLICANT on a monthly basis. APPLICANT
