DEPARTMENT OF PTTKIN COUNTY, COLORADO, APPROVING THE COLLINS/MARTENS
1041 HAZARD REVIEW AND GENERAL SUBMISSION
Determination No. 99-~
RECTTALS
1. John Collins and Jan Martens (hereafter "Applicants") have applied to the Pitkin County Hearing
Officer (hereafter "Hearing Officer) for 1041 Hazard Review and General Submission approval to establish a
building envelope for the purpose of single family residential uses.
The property is located north of Redstone on an access road off of Dorais Way and is more
particularly described in Exhibit A.
The property is zoned AFR-2 and contains approximately 2 acres.
4. The Hearing Officer heard this application at a public hearing on September 21, 1999, at which time
evidence and testimony were presented with respect to this application.
5. The Hearing Officer finds that the application complies with the applicable Code sections.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Community Development
Department Hearing Officer, that he hereby grants approval to the Collins/Martens 1041 Hazard Review
and Conceptual Submission subject to the following conditions which shall run with the land and be
binding on all successors in interest:
1. The Applicant shall submit a 24" x 36" mylar 1041 Hazard Review site plan to the Community
Development Department for approval and recording prior to the submittal of any building permit
applications.
2. The site plan shall be submitted in digital format suitable for integration into the County's GIS system.
3. The following Disclaimer shall be placed on the Site Plan: "IO~JI environmental ha_ard areas exist
[hat might affect the property, any improvements, and the use and occupancy thereof. "
4. Prior to submission of a building permits, the Applicant shall:
A. File afireplace/woodstove permit with the Community Development Department
B. Obtain an access permit from the County Engineer to extend the driveway to the building
envelope and to install a turn around to accommodate emergency vehicles.
C. Provide a trip generation and construction trip generation study for any free market residential
structure of 5,000 sq. ft. or greater for review and approval by the County Engineer.
5. Prior to issuance of any building permits the applicant shall obtain approval of an ISDS permit from
the Environmental Health Department. The septic system must comply with all minimum horizontal

setback requirements between its components and physical features. A qualified professional
engineer must design the system. The septic system shall be located within the building envelope.
6. Prior to the issuance of septic or building permits the applicant must document to the Environmental
Health Department that the well meets setback requvements and that quantity and quality of the well
water are adequate.
7. The Applicant shall comply with the following standards for development in geologic hazard areas:
Development on 15% or Greater Slopes:
A. Adequate mechanical support shall be provided for cut slopes.
B. Adding water which may decrease slope stability shall be avoided.
C. Adding weight to the top of the slope shall be avoided.
D. Disturbed slopes must be contoured so that they can be re-vegetated.
E. Steepening of existing slopes shall be avoided.
F. Cuts, fills, grading and excavation shall be confined to the minimum area needed for
construction.
G. The Applicant shall submit a drainage and erosion control plan to the County Engineer for
review and approval, prior to submittal of any building permit applications.
H. The house shall be designed to preclude the accumulation of radon gas.
I. The foundation for the residence shall be designed by a Colorado registered professional
engineer and approved by the County Engineer.
J. With the exception of the minor portion of 30% slopes in the middle of the building
envelope and those just above the existing shed, the building envelope shall avoid 30% or
greater slopes.
Regarding th< Two Drainages Surrounding the Building Envelope:
A. The applicant shall show the location of the two drainages on the site plan and development
shall not occur within 20 fr. of these drainages.
The following wildfire mitigation conditions shall be applicable to all structures on the property:
Defensible Space:
NOTE: Actual vegetation manipulation to meet these conditions may not be necessary where the
natural vegetation patterns have already fulfilled these conditions. The owner of the property is
responsible for creating and maintaining the defensible space as required below.
A. Brush, debris, and non-ornamental vegetation shall be removed within a minimum of a 10 foot
perimeter around all structures. Vegetation in this area shall be at 6" or less (i.e. mowed grass, low-
growing perennials, and ornamental vegetation that is non-woody).
B. The owner shall thin existing brush within 50 feet downhill and 30 feet uphill and to the sides of the
structures on site such that the diameter of the clumps of brush shall be less than two times the height
of the brush.
C. Within 50 feet downhill and 30 feet uphill and to the sides of the structures on site the outside of tree
crowns shall be spaced least 10 feet apart.
D. All branches from trees and brush within 50 feet downhill and 30 feet uphill and to the sides of the
structures on site shall be pruned to a height of 10 feet above the ground and removal of ladder fuels
from around trees and brush.

E. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the
chimneys shall be removed.
F. The density of fuel within a 100 foot perimeter of the structures shall be reduced where natural
reduction has not already occurred.
G. All deadfall within the 100 foot perimeter shall be removed.
H. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation
requirements.
Structural Design and Construction Requirements:
A. Roofs shall have a Class A, non-combustible roof system. Wood shake/shingle roof
coverings and~at roofs (up Yo a 4:TZ-pifcTij~are pro~tibited in all wild£re hazard areas.
B. All vents shall be screened with corrosive resistant wire mesh ofone quarter inch maximum.
Maintenance:
A. Roofs and gutters shall be kept clear of debris.
B. Yards shall be kept clear of all litter, slash, and flammable debris.
C. All flammable materials shall be stored on a parallel contour a minimum of I ~' from any
structures.
D. Weeds and grasses within the 10' perimeter shall be maintained to a height no more than 6
inches.
Miscellaneous:
A. Firewood shall be stacked on a pazallel contour a minimum of l5 feet away from any
structure.
B. Propane tanks shall be installed according to NFPA 48 standards and on a contour away
from the structure with standard defensible space vegetation mitigation aroundany above-
ground tank. Any wood enclosures around the tank shall be constructed with materials
approved for 2 hour fire-resistive construction on the exterior side of the walls.
C. Fences shall be kept clear of brush and debris.
D. Wood fences shall not be connected to the structure.
E. Fuel tanks shall be installed underground with an approved container.
F. Each structure shall have a minimum ofone 10 Ib. ABC fire extinguisher.
G. Addresses shall be clearly marked and visible with minimum 2" non-combustible letters and
shall be clearly visible at the primary point of access from the public or common access road
and installed on anon-combustible post.
H. If required by the Carbondale and Rural Fire Protection District, the Applicant shall install
and maintain a water storage tank, the size and location to be approved by the District with
an approved and accessible fire district connection, for fire fighting purposes. The water
storage tank shall be located within the approved building envelope.
I. Any outbuildings or additional buildings shall adhere to the same standards as structures.
Access and Utilities:
A. Utility lines shall be buried.

B. The Owner shall form and/orjoin a Road Improvements District and/or Association and
shall contribute 25% of the current estimate of road improvements required by the
Carbondale Fire Protection District and County Engineer. Prior to the issuance of a
building permit, the required road improvements to the shared access road coming from
Dorais Way to the Owner's .and his or her three neighbors shall be complete.
8. The Applicant shall comply with the following wildlife impact mitigation conditions:
A. There shall be only one kenneled dog on this property.
B. Fencing outside of the building envelope must comply with currentPitkin County Fencing
Guidelines.
C. The Applicant shall install an approved bear-proof trash container and all trash shall be kept
in it.
D. Native vegetation shall be maintained outside of the building envelope.
E. Grazing of livestock shall be prohibited on this property.
9. No development, including grading, landscaping, vegetation removal or disturbance, and septic
system shall occur outside of the approved access and building envelope except as may be necessary
to implement the wildfire mitigation measures required elsewhere in this approval.
10. The Applicant shall adhere to all material representations made in the application and public
meetings.
11. The vested rights for this approval shall expire on September 21, 2002.

' A bear-proof trash container must be a fully enclosed steel container of any size with a steel lid that has a 2-step
opening mechanism. Approval is granted by the Pitkin County Wildlife Biologist or personnel of the Colorado
Division of Wildlife.

MEMORANDUM

DATE: September 21, 1999
REQUEST: The Applicant requests approval of a building envelope for residential and customary
accessory uses.
APPLICANTS: John Collins and Jan Martens

REPRESENTATIVE: Jeff Bier, Mason and Morse
LOCATION: The property is located on an access road off of Dorais Way north of Redstone.
REFERRAL COMMENTS: Comments were received from Zoning, Environmental Heahh, County
Wildlife Biologist, Division of Wildlife, Colorado Geologic Survey, and Colorado State Forest Service.
ZONING: The property contains 2+ acres and is a conforming parcel in the AFR-2 zone district.
STAFF COMMENTS:
Wildfire: Vince Urbina of the Colorado State Forest Service visited the site and rates it as low to medium
wildfire hazard (See Attachment A). He recpmmends defensible space conditions to mitigate the wildfire
hazard. Mr. Urbina also notes that the access roads leading to this property are problematic from a wildfire
standpoint. The road improvement issue will be addressed below.
Wildlife: Both Kevin Wright of the Division of Wildlife (See Attachment B) and Pitkin County Wildlife
Biologist Jonathan Lowsky (See Attachment C) reviewed this application and made the following
observations:
• The property lies within elk winter range.
• The property is located within bear habitat.
The Wildlife Biologist and the Division of Wildlife recommend the following conditions:
• Dogs shall be kenneled.
• Fencing outside of the building envelope must comply with currentPitkin County Fencing Guidelines.
• The Applicant shall install an approved bear-proof trash container and all trash shall be kept in it.
• Native vegetation shall be maintained outside of the building envelope.
In addition, Kevin Wright of the Division of Wildlife recommends that no livestock be allowed on this lot
because of the detrimental effects of overgrazing on the native vegetation.
Geologic:
Slopes: The proposed building envelope slopes in excess of 30%. The continuous 30%+ slopes along the
upper end of the proposed building envelope will need to be excluded from the building envelope along with
the 30%+ slopes running along the northeastern and southwestern sides of the proposed building envelope.
The 30%+ slopes in the middle of the proposed envelope can be developed on as per Code Section 3-80-050
C.2.a., Exception for Minor Changes in Slope. The following standazds must be met for development to be
eligible for this exception:
The change in slope must be due to the presence of a minor natural or man-made change in the gradient of
a continuous slope.
Response: The portion of 30%+ slopes is due partially to a small rock out-cropping and partly because of
some grading that occurred many years ago.
The slope's ground surface is not prone to instablility or failure and the proposed development will not
cause greater instability or increase the potential of slope failure.
Response: The August 16 letter from Jeff Hynes of [he Colorado Geologic Survey indicates that no slope
instability will result from development of this minor portion of 30%+ slopes because the residence will
eliminate entirely the slope.
Rockfall and Debris Flow.• Jeffery Hynes of the Colorado Geologic Survey noted in his July 27, 1999 letter
(see Attachment D) that the site is "underlain by older debris flowkockfall deposits that aze now fairly
stable and well vegetated." He did not suggest any risk associated with futurerockfall and debris flow.
However, Mr. Hynes did state that the two "well developed drainageways" should be avoided by all
structures. Staff recommends that the two gullies be included on the site plan and that the building envelope
be set back from these gullies by 20 feet.
GENERAL SUBMISSION (3-110):
Utilities: The Applicant should have no problems obtaining utilities
Water and Sewer: The applicant will need to get the proper state permits and drill a well. The applicant
will need to obtain a septic permit from the Environmental Health deparhnent.
Road Improvements: This is the last of four lots accessed by an existing road branching off to the right
near the end of Dorais Way. In the Sakson, Beny, and most recently the Burgess 1041 hazazd reviews, the
Applicants were required to create a road improvement association in order to improve the common access
road to standards acceptable to the County Engineer and the Carbondale and Rural Fire Protection District.
Each of the Applicants is required to contribute 25% of the costs of improving the road. Prior to the
issuance of a building permit for the currently proposed development, the road improvements will be
required to be complete.

As stated above, not only is the common access road to the aforementioned four properties currently a
potential hazard in the event of a wildfire, but so isDorais Way. The County currently has no mechanism
for requiring improvements to Dorais Way, but perhaps upon the adoption of the pending Wildland Interface
Code, the County may be able to require improvements to this potentially hazardous road. In the mean time.
Staff supports the current approach of requiring road improvements in this area where it is possible to do so.
RECOMMENDATION: Staff recommends approval of this application subject to the conditions in the
attached resolution.

I read the application and visited the site on June 7th with Jeff Bier the
owner s representative. Access to the property is via the Dorais Way road. I have
done at least 8 hazard reviews on this road and will probably do more in the future.
To date nothing has been done to make the access for em®rgency service vehicles
or the opportunity for safe egress for residents any better. This is a single lane road
that will present future problems as more people build homes along this road. Jeff
Bier informed me that the owners of the McKinney Tracts (i.e., four lots) intend to
improve their portion of the road but that will only be for four lots.
The site has west aspect with a slope of 10-20%. The vegetation is a mix of
aspen, mountain maple, chokecherry, serviceberry and scattered Gambel oak. I
would recommend the wildfire hazard as low to medium. The existing plants would
benefit from some thinning. I also have these recommendations to establish a
defensible space.
1) For a distance of 10 feet around all structures establish and maintain vegetation
at 6 inches or less. Mowing grass, planting low growing perennials or
incorporating nonflammable hardscape (e.g., stones, bricks, pavers) can do this.
In addition flammable material (i.e., firewood) should not be stored in this zone.
2) This site could easily be returned to being an aspen site, which is more fire
resistive by removing the Gambel oak and serviceberry. This should be done for
a distance of at least 50 feet downhill and 30 feet uphill and to the sides of the
structure.
3) The standing dead and deadfall should be removed for a distance of 100 feet in
every direction.

The Collins/Martens lot lies within elk winter range. In addition, black bear inhabit the
area. This lot and adjacent lots do contain serviceberry, chokecherry, and oakbrush,
which will attract beazs during the fall.
The following recommendations will help minimize impacts to wildlife:
1. Maintain native vegetation outside building envelope. This includes any dead
aspen or other snags which are important for cavity nesters. Should try to
maintain 2-5 snags/acre.
2. All trash garbage be kept in approved bear proof garbage containers. In
addition, bird feeders will attract bears; any feeders should be kept away from
any windows or decks and suspended on a cable high enough to be out of
reach of any bears.
3. Restrict to 1 dog with a kennel restriction. Kennel be constructed before the
C.O. is issued.
4. Discourage any fencing. Any fencing meet Pitkin Co. specifications
5. No horses/livestock as lot is too small and any remaining vegetation would be
severely impacted by grazing.

MEMORANDUM

SUBJECT: Collins/Martens 1041 Hazard Review
DATE: 07/07/99
Portions of the Collins/Martens Parcel (#2729-092-00-004) proposed building envelope lie within elk
winter range as indicated on CDOW WRIS maps. In addition, the property is in an area of very high
human/black bear conflict. Given the above, I have the following recommendations:
1. Dogs must be kenneled as per Sections 3-80.80(C)(2) of the Pitkin County Land Use
Code.
2. Fencing outside the building envelope must comply with current Pitkin County Fencing
Guidelines.
3. Installation and use of approved bear-proof trash containers should be required.
4. Native vegetation must be maintained outside the building envelope as per Section 3-
80.80(A)(3). In addition, native vegetation should be maintained within the building
envelope to the maximum extent possible. This area supports a rich and diverse breeding
bird community and the preservation of native vegetational communities will allow them
to persist.
5. When existing vegetation must be altered, for an access road, utility line or similar uses,
an applicant will cooperate with the County and the Colorado Division of Wildlife to
devise a compensation plan acceptable to the County. Such compensation plan may
substitute (in a neazby area on the subject property) vegetation equal in type and quantity
to that being removed to mitigate effects on wildlife species as per Section 3-80.80(A)(4).

We have reviewed the 1041 hazard conditions on this lot as well as adjacent lots in the
past. TMs tract was revisited with you on May 13,1999.
The area is underlain by older debris flowJrockfall deposits that are now fairly stable and
well vegetated. There is some risk associated with two fairly well developed

The height of this slope is approximately 5-6 feet and, as such, creates no inherent
instability with respect to the proposed dwelling. The primary concern for slopes greater
than 30% is to assure that any potential for slope instability is identified and addressed as
part of the review process. In general, if the extent of the feature is such that the
proposed structures and attendant development overwhelms the minor zone of steepness,
then it can be disregarded. This is the case on this site.
In summary, we continue to feel that the development of this lot as a single family
residence is appropriate.

LOCATION: The property is located on an access road off of Dorais Way north of Redstone.
REFERRAL COMMENTS: Comments were received from Zoning, Environmental Health, County
Wildlife Biologist, Division of Wildlife, Colorado Geologic Survey, and Colorado State Forest Service.
ZONING: The property contains 2+ acres and is a conforming parcel in the AFR-2 zone district.
STAFF COMMENTS:
Wildfire: Vince Urbina of the Colorado State Forest Service visited the site and rates it as low to medium
wildfire hazazd (See Attachment A). He recommends defensible space conditions to mitigate the wildfire
hazard. Mr. Urbina also notes that the access roads leading to this property are problematic from a wildfire
standpoint. The road improvement issue will be addressed below.
Wildlife: Both Kevin Wright of the Division of Wildlife (See Attachment B) and Pitkin County Wildlife
Biologist Jonathan Lowsky (See Attachment C) reviewed this application and made the following
observations:
• The property lies within elk winter range.
• The property is located within beaz habitat.
The Wildlife Biologist and the Division of Wildlife recommend the following conditions:
• Dogs shall be kenneled.
• Fencing outside of the building envelope must comply with currentPitkin County Fencing Guidelines.
• The Applicant shall install an approved bear-proof trash container and all trash shall be kept in it.
• Native vegetation shall be maintained outside of the building envelope.
In addition, Kevin Wright of the Division of Wildlife recommends that no livestock be allowed on this lot
because of the detrimental effects of overgrazing on the native vegetation.
Geologic:
Slopes: The property contains slopes in excess of 30%. The geologic report did not address whetherthe
stability of the 30% slope running right through the center of the proposed building envelope would be
adversely affected by excavation and development. With the exception of one minor 30% pitch near the
existing, dilapidated shed on site caused mostly by an old road cut, the applicant will be required to delineate
the building envelope such that 30% slopes aze avoided.
Rockfall and Debris Flow: Jeffery Hynes of the Colorado Geologic Survey noted in his July 27, 1999 letter
(see Attachment D) that the site is "underlain by older debris flowkockfall deposits that aze now fairly
stable and well vegetated:' He did not suggest any risk associated with futurerockfall and debris flow.
However, Mr. Hynes did state that the two "well developed drainageways" should be avoided by all
structures. Staff recommends that the two gullies be included on the site plan and that development be set
back from these gullies by 20 feet.
GENERAL SUBMISSION (3-110):
Utilities: The Applicant should have no problems obtaining utilities.
Water and Sewer: The applicant will need to get the proper state permits and drill a well. The applicant
will need to obtain a septic permit from the Environmental Health department.
Road Improvements: This is the last of four lots accessed by an existing road branching off to the right
near the end of Dorais Way. In the Sakson, Berry, and most recently the Burgess 1041 hazard reviews, the
Applicants were required to create a road improvement association in order to improve the common access
road to standazds acceptable to the County Engineer and the Carbondale and Rural Fire Protection District.
Each of the Applicants are required to contribute 25% of the costs of improving the road. Prior to the
issuance of a building permit for the currently proposed development, the road improvements will be
required to be complete.
As stated above, not only is the common access road to the aforementioned four properties currently a
potential hazard in the event of a wildfire, but so is Dorais Way. The County currently has no mechanism
for requiring improvements to Dorais Way, but perhaps upon the adoption of the pending Wildland Interface
Code, the County may be able to require improvements to this potentially hazardous road. In the mean time,
Staff supports the current approach of requiring road improvements in this area where it is possible to do so.
RECOMMENDATION: Staff recommends approval of this application subject to the conditions in the
attached resolution.

1041 HAZARD REVIEW AND GENERAL SUBMISSION
RECITALS
John Collins and Jan Martens (hereafrer "Applicants") have applied to the Pitkin County Hearing
Officer (hereafrer "Hearing Officer) for 1041 Hazard Review and General Submission approval to establish
a building envelope for the purpose of single family residential uses.
2. The property is located north of Redstone on an access road off of Dorais Way and is more
particularly described in Exhibit A.
3. The property is zoned AFR-2 and contains approximately 2 acres.
4. The Hearing Officer heard this application at a public hearing orrAugust 17, 1999, at which time
evidence and testimony were presented with respect to this application.
5. The Hearing Officer finds that the application complies with the applicable Code sections.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Community Development
Department Heazing Officer, that he hereby grants approval to the Collins/Martens 1041 Hazazd Review
and Conceptual Submission subject to the following conditions:
1. The Applicant shall submit a 24" x 36" mylar 1041 Hazard Review site plan to the Community
Development Department for approval and recording prior to the submittal of any building permit
applications.
2. The site plan shall be submitted in digital format suitable for integration into the County's GIS system.
3. The following Disclaimer shall be placed on the Site Plan: "1041 environmental hazard areas exist
that might affect the property, any improvements, and the use and occupancy thereof. "
4. Prior to submission of a building permits, the Applicant shall:
A. File afireplace/woodstove permit with the Community Development Department
B. Obtain an access permit from the County Engineer to extend the driveway to the building
envelope and to install a turn around to accommodate emergency vehicles.
C. Provide a trip generation and construction trip generation study for any free market residential
structure of 5,000 sq. fr. or greater for review and approval by the County Engineer.
5. Prior to issuance of any building permits the applicant shall obtain approval of an ISDS permit from
the Environmental Health Department. The septic system must comply with all minimum horizontal
setback requirements between its components and physical features. A qualified professional
engineer must design the system. The septic system shall be located within the building envelope.
6. Prior to the issuance of septic or building permits the applicant must document to the Environmental
Health Department that the well meets setback requirements and that quantity and quality of the well
water are adequate.
7. The Applicant shall comply with the following standards for development in geologic hazard areas:
Development on 15% or Greater Slopes:
A. Adequate mechanical support shall be provided for cut slopes.
B. Adding water which may decrease slope stability shall be avoided.
C. Adding weight to the top of the slope shall be avoided.
D. Disturbed slopes must be contoured so that they can be re-vegetated.
E. Steepening of existing slopes shall be avoided.
F. Cuts, fills, grading and excavation shall be confined to the minimum area needed for
construction.
G. The Applicant shall submit a drainage and erosion control plan to the County Engineer for
review and approval, prior to submittal of any building permit applications.
H. The house shall be designed to preclude the accumulation of radon gas.
I. The foundation for the residence shall be designed by a Colorado registered professional
engineer and approved by the County Engineer.
J. With the exception of the minor portion of 30% slopes just above the existing shed, the
building envelope shall avoid 30% or greater slopes.
Regarding the Two Drainages Surrounding the Building Envelope:
A. The applicant shall show the location of the two drainages on the site plan and
development shall not occur within 20 ft. of these drainages.
2. The following wildfire mitigation conditions shall be applicable to all structures on the property:
Defensible Space:
NOTE: Actual vegetation manipulation to meet these conditions may not be necessary where the
natural vegetation patterns have already fulfilled these conditions.
A. Brush, debris, and non-ornamental vegetation shall be removed within a minimum of a
10 foot perimeter around all structures. Vegetation in this area shall be at 6" or less (i.e.
mowed grass, low-growing perennials, and ornamental vegetation that is non-woody).
B. Spacing and thinning of existing vegetation brush within 50 feet downhill and 30 feet
uphill and to the sides of the structures on site shall be a minimum of two times the
height of the fuel. Maximum diameter of the clumps shall be two times the height of the
fuel. All measurements shall be from the edges of the crowns of the fuel.
C. All branches from trees and brush within 50 feet downhill and 30 feet uphill and to the
sides of the structures on site shall be pruned to a height of 10 feet above the ground and
removal of ladder fuels from around trees and brush.
D. Tree crown separation brush within 50 feet downhill and 30 feet uphill and to the sides of
the structures on site shall have a minimum of 10 feet between the edges of the crowns.
E. All branches which extend over the roof eaves shall be trimmed and all branches within
15 fee[ of the chimneys shall be removed.
F. The density of fuel within a 100 foot perimeter of the structures shall be reduced where
natural reduction has not already occurred.
G. All deadfall within the 100 foot perimeter shall be removed.
H. The Applicant shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
Structural Desi¢n and Construction Requirements
A. Roofs shall have a Class A, non-combustible roof system. Wood shake/shingle roof
coverings and flat roofs (up to a 4:12 pitch) are prohibited in all wildfire hazazd areas.
B. All vents shall be screened with corrosive resistant wire mesh ofone quarter inch
maximum.
Maintenance:
A. Roofs and gutters shall be kept clear of debris.
B. Yards shall be kept clear of all litter, shsh, and flammable debris.
C. All flammable materials shall be stored on a parallel contour a minimum of 15' from any
structures.
D. Weeds and grasses within the 10' perimeter shall be maintained to a height no more than 6
inches.
Miscellaneous:
A. Firewood shall be stacked on a parallel contour a minimum of 15 feet away from any
structure.
B. Propane tanks shall be installed according to NFPA 48 standards and on a contour away
from the structure with standard defensible space vegetation mitigation azoundany above-
groundtank. Any wood enclosures around the tank shall be constructed with materials
approved for 2 hour fire-resistive construction on the exterior side of the walls.
C. Fences shall be kept cleaz of brush and debris.
D. Wood fences shall not be connected to the structure.
E. Fuel tanks shall be installed underground with an approved container.
F. Each structure shall have a minimum ofone 10 16. ABC fire extinguisher.
G. Addresses shall be cleazly marked and visible with minimum 2" non-combustible letters
and shall be clearly visible at the primary point of access from the public or common access
road and installed on anon-combustible post.
H. If required by the Carbondale and Rural Fire Protection District, the Applicant shall install
and maintain a water storage tank, the size and location to be approved by the District with
an approved and accessible fire district connection, for fire fighting purposes. The water
storage tank shall be located within the approved building envelope.
I. Any outbuildings or additional buildings shall adhere to the same standards as structures.
Access and Utilities:
A. Utility lines shall be buried.

B. The Applicant shall form and/or join a Road Improvements District and/or Association
and shall contribute 25% of the current estimate of road improvements required by the
Carbondale Fire Protection District and County engineer. Prior to the issuance of a
building permit, the required road improvements shall be complete.
8. The Applicant shall comply with the following wildlife impact mitigation conditions:
A. There shall be only one kenneled dog on this property.
B. Fencing outside of the building envelope must comply with currentPitkin County Fencing
Guidelines.
C. The Applicant shall install an approved bear-proof trashcontainerl and all trash shall be
kept in it.
D. Native vegetation shall be maintained outside of the building envelope.
E. Grazing of livestock shall be prohibited on this property.
9. No development, including grading, landscaping, vegetation removal or disturbance, and septic
system shall occur outside of the approved and access and building envelope except as may be
necessary to implement the wildfire mitigation measures required elsewhere in this approval.
10. The Applicant shall adhere to all material representations made in the application and public
meetings.

Portions of the Collins/Martens Parcel (#2729-092-00-004) proposed building envelope lie within elk
winter range as indicated on CDOW WRIS maps. In addition, the property is in an area of very high
human/black bear conflict. Given the above, I have the following recommendations:
1. Dogs must be kenneled as per Sections 3-80.80(C)(2) of the Pitkin County Land Use
Code.
2. Fencing outside the building envelope must comply with current Pitkin County Fencing
Guidelines.
3. Installation and use of approved bear-proof trash containers should be required.
4. Native vegetation must be maintained outside the building envelope as per Section 3-
80.80(A)(3). In addition, native vegetation should be maintained within the building
envelope to the maximum extent possible. This area supports a rich and diverse breeding
bird community and the preservation of native vegetational communities will allow them
to persist.
5. When existing vegetation must be altered, for an access road, utility line or similar uses,
an applicant will cooperate with the County and the Colorado Division of Wildlife to
devise a compensation plan acceptable to the County. Such compensation plan may
substitute (in a nearby area on the subject property) vegetation equal in type and quantity
to that being removed to mitigate effects on wildlife species as per Section 3-80.80(A)(4).
~ A bear proof trash container must be a fully enclosed, steel container of any size with a steel lid that has a two step
opening mechanism. Approval is granted by the Pitkin County Wildlife Biologist or personnel of the Colorado Division
of Wildlife.

The Environmental Health Departmem will need adequate information on the quantity and the quality of
water available. To do this, the owners will need a test of the on-site well done by a water engineer or well
driller to determine yield. The apphcam must ensure that the water quality is acceptable by having it tested by
a laboratory such as the Snowmass Water and Sanitation District or Aspen Consolidated Sanitation District.
Before the Environmental Health Department can issue a septic system permit, the owners must drill
the well to eoaure that the well will meet the required setback distance from the septic system. Before
drilling the well, the applicant should be sure that it will be possible to fit the waste water disposal
system far enough away from the well. Pitkin County Land Use Code requires that the well site be within
the building envelope.
The Environmental Health Department recommends low water landscaping (xeriscaping), wjth the timing of
anY sP~d~' systems decreased for low water plants. Contact the Colorado State University Cooperative
Extension offrce or Denver Water Board for more information on xeriscaping.
A condition of approval for this application is: the applicant moat document to the
Environmental Health Department that the well meets setback requirements and that quantity
and quality of the well water are adequate, prior to issuance of septic system and building
permits.

Lots in this azea north of Redstone have individual septic systems. Ail such systems installed within Pitkin
County require septic permits issued by the Environmental Health Department, and must comply with the
County's Individual Sewage Disposal System Regulation. Owners should realize that a Registered
Professional Engineer must perform the soil tests between April 15 and Nov. 15. The County cannot issue
building and septic system permits without these soil tests. To receive a permit, the applicant will need to
submit an application through a Registered Professional Engineer who will design the septic system. The
packet must include several items, including percolation test results and profile hole information. It must also
include a site plan with pertinent physical features. A floor plan for the dwelling and a copy of the County's
land use approval are needed as well. Once the completed application is received, the Environmental Health
Department will analyze and review the proposed septic system design.
The applicant should know that it may take from 2-6 weeks to obtain a well permit (required before
septic system design). It may take some time to Gave soil tests performed and additional time to have
the system designed. The department can evaluate the site and soil teats only betweeu April 15 and
Nov. 1S. The owner should carefully evaluate this schedule to make sure all steps have been taken to
make the permitting process proceed as quickly as possible.
The applicant must adhere to minimum horizontal setback requirements for placement of septic system
components and pertinent physical features such as wells, creeks, imgation ditches, dry gulches, etc. The
greater the sewage flow, the greater the distance must be between the septic system and the well. Sewage
flows are a function of the size of the house and the number of rooms that these or future owners may use as
bedrooms as their family size and situation changes. The minimum setback distance from the closest point on
a leach field to a well is I00 lineal feet. However, for example, a 3-bedroom house with one office that
occupies 2,400 square feet of living space must have its well 132' from the septic system. Applicants should
carefully evaluate this information so they can ensure the house they want to build can meet the required
setbacks.
The leach field should be in an area of no traffic (vehicular or domestic large animals). The owner should plant
the field azea with dry land grass, and residems should not water the leachfield area. Approval of a septic
system located outside the building envelope must be granted by the Community Development Department.
A condition of approval for this application is: the Environmental Aealth Department must
receive and approve a septic system application, and issue a permit for construction of the
septic system, prior to issuance of a building permit.

The Environmental Health Department addresses impacts on down stream water quality. This application
should not impact down stream water quality if the setbacks between the septic system and physical features

The Environmental Health Department's mission is to preserve and protect the quality of Pitkin County's
water resources. Since a large percentage of the population is dependent upon water from wells, elimination
of groundwater pollution, and protection of aquifers and their drainage areas are of utmost importance. Roofs
and asphalt areas can be nonpoint sources of water discharge that can contaminate water supplies. The
Environmental Health Department recommends that ^onpoint sources of discharge be retained oa the
property of origin. To accomplish this, the owner can use landscaping, drainage patterns, detention ponds,
and/or dry wells for containment of water runoff from buildings.

This project should not contribute significantly to degradation of air quality in Pitkin County since it consists
of a single family home.
FIREPLACE
The less densely populated pazts of Pitkin County like this site may have two devices per building. The
owners can install no more than one wood burning fireplace and a second device that can be either a gas log
fireplace or a certified woodstove. In addition, the owner can install unlimited numbers of decorative gas
appliances. Occupants may not burn coal in any device. The owners cannot install fireplaces or woodstoves in
bazns or agricultural buildings.
A condition of approval for this application is: the Building Department must receive the
fireplace/woodstove registration document.

ZONE: AFR-2, two acre minimum lot size
This parcel contains 2.07 acres and is conforming in size.
SETBACKS: The required setbacks for this parcel are:
30 foot front yard setback
20 foot side yard setback
30 foot rear yard setback
The proposed building envelope lies outside of all required
setbacks.
Any development which exceeds 30 inches in height within required
setbacks require a variance from the Pit kin County Board of
Adjustment. This includes driveway construction and improvements.
FLOOR AREA: This parcel is allowed a total floor area of
9,258 square feet. All structures are included in the calculation
of floor area.
HEIGHT: Sufficient information has not been submitted to
determine compliance with county height requirements.
OTHER: All development must be contained within the approved
