OF PITKIN COUNTY, COLORADO AUTHORIZING PROCEEDINGS IN
EMINENT DOMAIN
ORDINANCE NO.98-3'1
WHEREAS, Pitkin County, Colorado (the "County") is a home -rule county
organized under the Constitution and statutes of the State of Colorado.
WHEREAS, it is a goal of Pitkin County to promote affordable housing for its
citizens and employees.
WHEREAS, the preservation of affordable housing is in the best interests of the
community.
WHEREAS, the property commonly known as the Woody Creek Mobile Home
Park currently provides affordable housing for citizens of Pitkin County.
WHEREAS, the future availability of affordable units at the Woody Creek Mobile
Home Park is in doubt and cannot be guaranteed.
WHEREAS, prior negotiations to acquire the property through a purchase and
sale contract have failed.
WHEREAS, pursuant to Section 2.8.1.1. of the Pitkin County Home Rule Charter,
"official action by ordinance shall be required for the following actions of the Board ...
proceedings in eminent domain."
NOW THEREFORE, be it ordained by the Board of County Commissioners of
Pitkin County, Colorado that the Board of County Commissioners authorize that
proceedings in eminent domain be commenced for the property commonly known as the
Woody Creek Mobile Home Park and all other real property associated with the
maintenance of the Woody Creek Mobile Home Park.

THE 12th DAY OF AUGUST, 1998.
NOTICE OF PUBLIC HEARING PUBLISHED IN THE WEEKEND
EDITION OF THE ASPEN TIMES ON 15th DAY OF AUGUST, 1998.
APPROVED UPON SECOND READING AND PUBLIC HEARING ON
THE 26th DAY OF AUGUST, 1998.
PUBLISHED AEI ER ADOPTION IN THE WEEKEND EDITION OF THE
ASPEN TIMES ON THE 5th DAY OF SEPTEMBER, 1998.
THIS ORDINANCE SHALL BECOME EFFECTIVE 30 DAYS AFTER PUBLICATION FOLLOWING
FINAL ADOPTION BY THE BOARD.
