of Redstone on Highway 133, Section 20, Township 10 South, Range
88 West

REQUEST: Thomas and Sherry Rubin are requesting approval of a
minor 1041 Environmental Hazard Review/Category 2 Exemption.
They are proposing a building envelope on and access to Lots 59
and 60 of the Elk Mountain Subdivision. The lots are a total of
approximately 19,166 square feet in size and are currently
vacant. The applicants propose to build a three bedroom, year-
round residence which is to be accessed off of an existing
private gravel road which is maintained by subdivision property
owners. As the proposed driveway is not encumbered by excessive
slopes, it should be relatively easy to grade in.
Water will be provided to the site via an existing, established
well and sewer will be provided by an approved septic system.
Utilities will be placed underground.
The site is located in mapped winter range for elk. The Elk
Mountain Subdivision is built-out to some extent. As a result,
the Elk population has moved out of the immediate vicinity and
uses the area behind and above the subdivision. Nonetheless,
Kevin Wright, of the Division of Wildlife, and Planning Staff
recommend that dogs be kenneled and leashed, that any fencing on
the lot be restricted to 3 strand wire and 42" or less in height
and that vegetative manipulation be limited to the area within
the building envelope.
The applicant intends to remove as few trees and shrubs as
possible during excavation of the building site and agrees to
mitigate the wildlife habitat impact as recommended.
FINDING:
1) The building envelope and driveway are located in an area
which will not directly effect elk habitat. However,
because of the close proximity of elk habitat, the applicant
has agreed to abide by recommendations made by the Division
of Wildlife regarding the mitigation of impacts on said
habitat.
2) The applicant has provided a site plan for sign-off.
3) The County Attorney is satisfied that the property was
legally created and has not merged with any contiguous lots.
4) The applicant has addressed the category 2 exemption
criteria for land use.
RECOMMENDATION:
Sections 5-400.3(b) and 5-400.5(b) of the Land Use Code provide
that the Planning Director is authorized to approve a site plan
and application for a Minor 1041 Hazard review. Based on the
findings referenced above, Staff recommends approval of the Rubin
1041 Minor Hazard Review and Category 2 Exemption. Said approval
is subject to the recommendations listed below. If you agree
with Staff's recommendation, please sign this memo, which will
serve as a reference document authorizing approval of said
application. Planning Director's sign-off on a 1041 Review Site
Plan is also necessary for completion of the administrative
review process. The Site Plan shall be recorded in the Clerk &
Recorder's office. A copy shall be placed in the file.
CONDITIONS OF APPROVAL:
1. Wildlife habitat on Lots 59 and 60 of the Elk
Mountain Subdivision shall be mitigated in the
following manner:
a. All dogs shall be kenneled or chained
b. Native vegetation shall be maintained outside of
building envelope
c. All fencing shall be 42" or less in height, and 3
strand wire, or less.
2. Prior to issuance of a building permit, the applicant shall
receive a setback variance to accommodate siting of the
building envelope.

To Whom It Mati Concern,
We, The Rubins have lived in Colo for the past seventeen years and
love the state and the friendly people.
Tom has recently been employed with a company in the Aspen area.
Needless to say this has brought us to make a move with our family to
the Aspen area.
When looking for property we traveled to Redstone and liked what we
saw. We enjoy small towns and felt that the Crystal River Valley would
be a lovely place to make our home.
We are looking forward to building our own custom home that will fit in
with the la~• of the land and the surrounding area. Our plans at this time are
to build a three bedroom home that will be a tri-level. We will take full
advantage of the scenic view and the southern exposure.
We hope to begin building in April or May of 1990 if whe*_her permits
and all of the applications to Pitkin County have been approved. We are
planning to have our home completed some time in late 1990 or early- 1991.
We take pride in our home and fell we will enhance the area.
