The Planning Office has reviewed the Angle 1041 hazard review as
a minor 1041 because the following findings have been made:
1. After the application was filed and reviewed by the
Division of Wildlife it was determined that the lot is not
located in an important wildlife area The DOW has concerns
regarding the areas on the steeper slopes located to the
east of the parcel. The DOW also has concerns relative to
the potential use of the parcel for animals getting to the
Crystal River for watering purposes. The following
conditions are recommended by the DOW for approval of the
1041. Said conditions should be noted on the Plat:
a. There shall be no cutting of aspens outside of the
building envelope.
b. There shall be no fences higher than 42" in height
and no greater than 4 strands.
c. All dogs on the property shall be kenneled or on a
leash at all times.
2. The Building envelope is outside of the 100 year
floodplain.
3. Access to the site is by way of an easement along the
Crystal River Railroad ROW.
4. The applicant has agreed to grant a fishermans easement
through the Crystal River as it passes through the property.
Said easement shall extend to five feet above the high water
mark on the property along the bank of the River.
5. A site plan for recordation has been submitted by the
applicant noting the Division of Wildlife restrictions and
the fishermans easement.
The Planning Staff recommends approval of the Angle Minor 1041
Review subject to the following condition:

Enclosed herein is the documentation requested by the County
for a 1091 Review. It is a requirement of a Contract to
Purchase this property that Pitkin County give approval of
this parcel of land as a building site on or before December
31, 1989. Specific building approval need not be given
however Purchaser needs to satisfy himself that the property
be deemed a legal building site for a residential home, not
unlike the homes in the immediate area numbering
approximately 10.

exists in part of an elk winter range. Applicant will accept
restrictions such as kenneling or leashing of any domestic
animals on this land. The portion of this parcel below the
road, immediately adjacent to the Crystal River is in the
flood plain and will not be built upon.

Conditions and Stipulations
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument
2. If the proposed Insured has or acquires actual knowledge of any defect, Ben, encumbrance, adverse claim or other matter
affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B
hereof, and shall faB to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for
any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose
such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company otherwise
acquires actual knowledge of any such defect, hen, encumbrance, adverse claim or other matter, the Company at its option
may amend Schedule B of this Commitment accordingly, but such amendment shall no[ relieve the Company from liability
previously incurred pursuant to pazagraph 3 of these Conditions and Stipulations.
Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included
under the defurition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance
hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in
Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event
shall such Bability exceed the amount stated in Schedule A for the policy or policies committed for and such Bability is
subject to the insuring provisions, the Conditions and Stipulations, and the Exclusions from Coverage of the form of policy

Conditions and Stipulations
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter
affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B
hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for
any Ions or damage resulting from any act of reliance hereon to the extent the Company is prejuodr ddhe Comp Ysotherwrse
such knowledge. If the proposed Insured shall disclose such knowledge to the Company,
acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option
may amend Schedule B of this Commitment accordingly, but such amendment shall aot relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Comautment shall be only to the named proposed Insured and such parties included
under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance
hereon in undertaking in good faith (a) to comply with the requirements hereot, or (b) to eliminate exceptions shown in
Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event
shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is
subject [o the insuring provisions, the Conditions and Stipulations, and the Exclusions from Coverage of the form of policy
or policies committed for in favor of the proposed Insured which are hereby incorporated by reference and are made a part
of this Commitment except as expressly modified herein.
4. Any action or actions or rights of action That the proposed Insured may have or may bring against the Company arising out
of the status of the title to the estate or interest or the status of the mortgage thereon covered by [his Commitment must
be based on and are subject to the provisions o[ this Commitment.
