RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO
VACATING ASPEN DRIVE IN THE REDSTONE TOWNSITE
Resolution No. 84-~ -

WHEREAS, Dr. Lewis McBUrney representing the "Church at Redstone" (hereinafter
"Applicant") has presented a petition requesting vacation of Aspen Drive in the Townsite
of Redstone signed by the owners of all abutting property; and
WHEREAS, Aspen Drive does not complete its intended connection of Redstone Boulevard
to the Crystal River but rather is surrounded on three sides by property owned by the
Applicant; and
WHEREAS, the Applicant has committed to the construction of a landscaped river walk
which will be available at all times to provide the public with access to the river; and
WHEREAS, the Aspen Drive easement creates a significant constraint to the development
of the Applicant's property; and
WHEREAS, the Applicant intends to develop the property with a facility which will be
available for numerous beneficial community purposes; and
WHEREAS, the Pi tkin County Planning and Zoning Commission recommended conditional
approval at its regular meeting on January 17, 1984; and
WHEREAS, a public hearing was held before the Board of County Commissioners of Pitkin
County, Colorado (hereinafter "Board") at their regular meeting on February 27, 1984, at
which time evidence and testimony were presented with respect to the proposed road vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board that it does hereby vacate the easement
known as Aspen Drive in the Townsite of Redstone subject to the following conditions:
1. The Applicant shall prepare an amended plat or an .amendment to the plat evidencing
the vacation of Aspen Drive and a flood control easement along the Crystal River
frontage to be approved by the County Engineer and County Attorney prior to
recording;. and
2. The Applicant shall construct a landscaped river walk simultaneous with the
construction of the church to be available at all times to provide the public
access from Redstone Boulevard to the Crystal River.

At your last meeting, the applicant for this road vacation requested
that the Board refund the $700.00 process fee. The argument presented
was that the Church would be a community facility and would be made
available for town meetings and other community events. The purpose
for this memo is to advise the Board that the application process
required a total of three (3) hours of Planning Office time.

The attached letter of application from Dr. Louis McBurney requests
vacation of Aspen Drive in Redstone in order to facilitate the con-
struction of The Church at Redstone. Aspen Drive is a short 110 foot
access easement which begins at the edge of Redstone Blvd. and dead-
ends within the property owned by the Church. The drive is therefore
surrounded on three sides by the Church's property and its presence
creates a serious constraint to the development of the property.
The Church hopes to build a facility which will be available for
numerous beneficial community purposes. Since Aspen Drive was orig-
inally intended to provide river access, the Church has committed to
the construction of a landscaped river walk which will be available to
the public at all times. A flood control easement was also offered
along the Crystal River.
The Code provides a procedure for road vacation in Section 4-4.2.
These procedures call for the submission of a petition signed by all
property owners abutting the subject road (attached), notification to
adjacent landowners of the Planning Commission's consideration of the
petition (this was done), recommendation by the Planning Commission and
final action by the BOCC at a public hearing.
In light of the broad community benefit to be derived from the con-
struction of the Church facilities and considering that the easement
currently serves no useful purpose, the Planning Office recommends your
approval of the road vacation request.
The Planning and Zoning Commission concurred with our recommendation
and recommended approval with the attached Resolution. Approval is
recommended subject to the preparation and recording of an amended
plat or an amendment to the plat evidencing such vacation and subject
to the construction of a landscaped river walk simultaneous with the
construction of the church to be available at all times to provide the
public access from Redstone Blvd. to the river.

The undersigned property owners of all the land abutting Aspen Drive
Petition for Vacation of the Drive.
The land is desired for more beneficial development of the property by the
Church at Redstone for a multi-use building. The facility will be planned for
church and community purposes, including a day care center, AA meetings,
community cultural events, retired citizens use, marriage and family enrichment
seminars, a library, conference rooms for counseling, as well as religious
services.
We will provide access to the river walk area which will be landscaped for
more pleasant use and will also give a flood control easement along the Crystal
River as requested by the County Engineers.
In view of the public nature of our development, we would also petition the
commission to waive this application fee.

February 27, 1984, at 10:00 A.M. in the Commissioners' Meeting Room,
506 E. Main Street, Aspen, Colorado, to consider the application of
the Church at Redstone in which it is petitioning for the vacation
