COLORADO, GRANTING A SUBDIVISION EXEMPTION FOR
FULLY DEVELOPED LANDS TO DARLYNE M. WOODWARD AND
MARTHA G. COLLISON
Resolution No. 88-
WHEREAS, Darlyne M. Woodward and Martha G. Collison
(hereinafter "Applicants") have applied to the Board of County
Commissioners of Pitkin County, Colorado (hereinafter "Board")
for a Subdivision Exemption for fully developed lands pursuant to
Section 4-2.2(a)(6) of the Land Use Code to separate two merged
parcels of land (as described in Exhibit "A" attached) which
contain separate residences; and
WHEREAS, the Board reviewed this application at a regularly
scheduled public meeting on May 17, 1988 at which time evidence
and testimony was presented with respect to this application;
and
WHEREAS, the Board finds that the subject parcels were
legally created and separately developed with single-family
residences and that approval of this application will have no
adverse land use impacts.
NOW, THEREFORE, BE IT RESOLVED by the Board that it hereby
approved the Applicant's request to separate the merged
properties.
APPROVED by the Board at its regular meeting on June 14,

APPLICANTS: Darlyne M. Woodward and Martha G. Collison.
ISSUE: The applicants purchased two adjoining "metes and bounds"
parcels in the Crystal River Valley in 1981 and 1986. One
property contains 1.76 acres, the other contains 2.09 acres.
Both parcels have existing legally constructed residences. The
zoning in this area is RS-30 which requires a 30 acres minimum
lot size. The applicants purchased these properties as "joint
tenants". Because of the joint tenancy and the fact that these
properties are non-conforming metes and bounds parcels, the
property is considered to merge into one parcel pursuant to
Section 7-2 of the Land Use Code.
The applicants are requesting approval of a Subdivision Exemption
for fully developed lands pursuant to Section 4-2.2(a)(6) of the
Land Use Code which states:
"Is for the purpose of subdividing fully developed lands
under existing zoning in effect when the development
occurred (even though resulting lots and uses be
nonconforming) if the development was done in conformance
with the law at the time and not done (without subdivision
approval) to avoid subdivision (or other land use)
regulations."
Because the properties were legally created in the late 1960's
and were legally developed with separate residences, the staff
opinion is that this request conforms to the above Land Use Code
requirement. Letters from the Environmental Health Department
and the County Land Use Engineer (attached) indicate no problems
with this application.
ALTERNATIVES:
1) The Board may approve this application as requested.
2) The Board may deny this application if you find that it
does not conform to the requirements of the Land Use
Code.
RECOMMENDATION: The Planning staff recommends that the Board
direct us to draft a resolution approving a subdivision exemption
for fully developed lands.

While this review is primarily to reestablish two previously
developed properties, The Aspen/Pitkin Environmental Health
Department has reviewed the above-mentioned land use submittal
under authority of the Pitkin County Code, Title II, and has the
following supplementary comments.
SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200:
The residences on each property are served by on-site wastewater
disposal systems, already constructed. Although no permit
records were located the southerly house apparently has a septic
system constructed prior to 1973. This department apparently
certified in an October, 1973 letter that the system complied
with regulations in effect at the time. The northerly house
septic system was replaced in 1986 and meets current Pitkin
County code. The permit records on this northerly system are
attached. Both of the on-site wastewater disposal systems appear
to be functioning satisfactorily at this time.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-205:
Water is to each residence is supplied from a well on the
property. There is no documentation submitted to verify yield,
quality or water rights. However, the wells have apparently
provided a satisfactory drinking water source for the last 15
years or more.
CONFORMANCE WITH OTHER LAWS: Section 2-2

I have reviewed the matex•ial submitted by the law offices of
Gideon I{aufman for the applicants. If this subdivision exemption
is approved, it is felt b,y this office that the applicants will
not need to prepare a plat for the two lots. It is apparent
that two individual plats alx•eady exist for the lots, and that
the lands are more or less fully developed. Therefore, I am
determining that plat preparation is not necessary as described
under Section 4-2.3(a)(4) of the Pitkin County Land Use Code.

Dear Francis:
Please consider this letter an application on behalf of
Darlyne M. Woodward and Martha G. Collison for the purpose of
exempting the conveyance of fully developed lands from the
definition of the term "subdivision" pursuant to Section
4-2.2(a)(6).
My clients are two Californians who inadvertently stumbled
into Pitkin County's mandatory merger rules in connection with
their acquisition of two adjoining parcels located between
Highway 133 and the Crystal River near Redstone, Colorado
because they chose to hold title jointly instead of
individually.
The first parcel is known as 15358 Highway 133 and was
acquired from Allen E. Nelson and Catherine I. Nelson in 1981
(see copy of the Deed of attached). This 1.76 acre parcel
contains a 1,900 sq. ft. home constructed by Edward Roszel in
1972-73 (see copy of plot plan attached). While the Building
Department has been unable to locate the original permits,
Edward Roszel confirmed by long distance telephone that he, in
fact, had all of the permits necessary to construct that home.
In this connection, I was able to locate a copy of a letter
from James C. Roark who, on behalf of the Pitkin County
Sanitation Department, made a final inspection of the septic
system on July 23, 1973 (copy attached).
The second parcel is known as 15324 Highway 133 and was
acquired by my clients from Jean Hawman and Charles Eldon Hauth
in 1986 (see copy of Deed attached) when the grantors obtained
a Certificate of Occupancy (copy attached) in connection with
the expansion of a cabin which was originally constructed
around 1965. This parcel contains 2.09 acres as disclosed by
the plot plan (copy attached).
The above parcels were created out of different fathering
parcels in the late 196os, before Pitkin County established
subdivision or zoning regulations for the Redstone vicinity.

A copy of the Deed from Richard K. Williams and James L.
Williams to Edward Francis Roszel and Joann Isabel Roszel dated
February 15, 1968, and recorded March 29, 1968 in Book 234 at
Page 174 creating the 1.76 acre parcel is enclosed to confirm
the legal creation of said parcel.
Because these parcels were independently developed single
family residential lots when acquired by metes and bounds
conveyance in ignorance of the mandatory merger rules, my
clients request that the County engineer find that the
preparation of a plat is unnecessary under Section 4-2.3(a)(4).
In addition, the history of these lots suggests that both
structures were, in fact, built legally and in conformance with
the laws at the time and not done to avoid subdivision or other
land use regulations.
Enclosed please find a check for $700.00 to cover the
application fee. In addition, if you have any questions or
require any additional information, please do not hesitate to

Dear Mr. Ronzel:
On July 23, 1973 s final inspectioa was made
_ by the undersigned of the septic system on your
property. The inapectioa showed that the system
met with Pitkin County and State regulations con- -
.cerning private sewago disposal. _
At the same time, a water sample was taken
from the domestic water supply. Tne sample was
sent to the State Laboratories and returned to
this office as safe. The construction of the
water system also met with the State and County
standards.

is approved, it is felt by this office that the applicants will
not need to prepare a plat for the two lots. It is apparent
that two individual plats already exist for the lots, and that
the lands are more or less fully developed. Therefore, I am
determining that plat preparation is not necessary as described
under Section 4-2.3(a){4) of the Pitkin County Land Use Code.

Please consider this letter an application on behalf of
Darlyne M. Woodward and Martha G. Collison for the purpose of
exempting the conveyance of fully developed lands from the
definition of the term "subdivision" pursuant to Section
4-2.2(a)(6).
My clients are two Californians who inadvertently stumbled
into Pitkin County's mandatory merger rules in connection with
their acquisition of two adjoining parcels located between
Highway 133 and the Crystal River near Redstone, Colorado
because they chose to hold title jointly instead of
individually.
The first parcel is known as 15358 Highway 133 and was
acquired from Allen E. Nelson and Catherine I. Nelson in 1981
(see copy of the Deed of attached). This 1.76 acre parcel
contains a 1,900 sq. ft. home constructed by Edward Roszel in
1972-73 (see copy of plot plan attached). While the Building
Department has been unable to locate the original permits,
Edward Roszel confirmed by long distance telephone that he, in
fact, had all of the permits necessary to construct that home.
In this connection, I was able to locate a copy of a letter
from James C. Roark who, on behalf of the Pitkin County
Sanitation Department, made a final inspection of the septic
system on July 23, 1973 (copy attached).
The second parcel is known as 15324 Highway 133 and was
acquired by my clients from Jean Hawman and Charles Eldon Hauth
in 1986 (see copy of Deed attached) when the grantors obtained
a Certificate of Occupancy (copy attached) in connection with
the expansion of a cabin which was originally constructed
around 1965. This parcel contains 2.09 acres as disclosed by
the plot plan (copy attached).
The above parcels were created out of different fathering
parcels in the late 1960s, before Pitkin County established
subdivision or zoning regulations for the Redstone vicinity.

A copy of the Deed from Richard K. Williams and James L.
Williams to Edward Francis Roszel and Joann Isabel Roszel dated
February 15, 1968, and recorded March 29, 1968 in Book 234 at
Page 174 creating the 1.76 acre parcel is enclosed to confirm
the legal creation of said parcel.
Because these parcels were independently developed single
family residential lots when acquired by metes and bounds
conveyance in ignorance of the mandatory merger rules, my
clients request that the County engineer find that the
preparation of a plat is unnecessary under Section 4-2.3(a)(4).
In addition, the history of these lots suggests that both
structures were, in fact, built legally and in conformance with
the laws at the time and not done to avoid subdivision or other
land use regulations.
Enclosed please find a check for $700.00 to cover the
application fee. In addition, if you have any questions or
