The lot is 11.4 acres in size. requesting approval of a :ategory 2 Exemption. They foot addition onto their is currently 1600 square on which their home sits 1041 REVIEW The applicant's lot is adjacent to the Crystal River, and as such, is subject to a floodplain review. The site is also mapped as Elk Winter Range. Wildlife Kevin Wright, of the Division of Wildlife has reviewed the site and made the following comments: There will be little to no wildlife impacts as long as: 1. Addition remains out of riparian area along Crystal River. This should be no problem as they have the addition staked out and it does not encroach on riparian areas. Redstone Ranch acres lies within elk winter range and adjacent to bighorn sheep winter range. However, due to existing homes and dogs, there is little use within the subdivision. The Division of Wildlife has recommended that all dogs be kenneled or chained on previous new construction in the area. The applicant agrees to kennel or chain their dogs and to maintain existing riparian habitat, as per Kevin's request. Floodolain Wright Water Engineers has conducted a floodplain study of the site. In summary the study, (attached as Exhibit"A"), concludes the following: The proposed building addition is 1) not in the 100-year floodway, 2) within the flood fringe, but above the flood depth by at least 5 feet and, 3) will not significantly impact the 100-year floodplain or flood profile. Any change in flood profile will be negligible. In summary, given recommended mitigation measures, the proposed addition will have negligible impacts on the 100 year floodplain and wildlife use of the area. BUILDING PERMIT EXEMPTION REVIEW Pursuant to Section 18-2.5 of the Code, the applicant has addressed water supply and waste water disposal for the site. Bob Nelson, having reviewed the site, indicates that the existing septic system was originally sized to accommodate three bedrooms. The proposed expansion will bring the total number of bedrooms in the residence to three. The septic system is adequately sized to accommodate the proposed addition. There is also an existing well on site which is adequate in terms of water quality and quantity. The site will continue to be served by the existing access drive which adequately serves the residence. FINDING: 1) The proposed addition is outside of the 100. year floodplain and is located such that it will have a negligible impact on the Crystal River flood profile, as determined and described by Wright Water Engineers in attached Exhibit "A". Staff notes that the applicant shall be required to reduce the building envelope to reflect the area reviewed by the water engineer. As the only floodway impact studied was that of the proposed addition, building will be restricted to the area of the proposed addition. No additional building will be allowed in the floodway without further study of potential impacts. 2) The applicant has provided a site plan for sign-off. Prior to recording, the applicant agrees to amend the site plan in the following manner: a) A note shall be added which indicates that dogs on site shall be kenneled or leashed, due to wildlife use of the area. b) A note shall be added which indicates that no development shall occur within the area designated as 100 year floodplain. 2 .. c) The building envelope shall be reduced to reflect the impact area studied by Wright Water Engineers. 3) The County Attorney is satisfied that the property was legally created and has not merged with any contiguous lots. 4) The applicant has addressed the category 2 exemption criteria for land use. RECOMMENDATION: Sections 5-400.3(b) and 5-400.5(b) of the Land Use Code provide that the Planning Director is authorized to approve a site plan and application for a Minor 1041 Hazard review. Based on the findings referenced above, Staff recommends approval of the Brin/Hipp 1041 Minor Hazard Review and Category 2 Exemption. Said approval is subject to the recommendations listed below. If you agree with Staff's recommendation, please sign this memo, which will serve as a reference document authorizing approval of said application. Planning Director's sign-off on a 1041 Review Site Plan is also necessary for completion. of the administrative review process. The Site Plan shall be recorded in the Clerk & Recorder's office. The property is located olt the Crystal River above Coal Creek in the SE1/4 NW1/4, Section 29, Township 10 South, Range 88 West, 6th P.M. in Pitkin County, Colorado. The FEMA 100-year floodplain study and Flood insurance Rate Map (FIRM) dated June 14, 1987 was used as the basis of our study. The proposed building addition is not within the 100-year floodway according to the FIRM. It is within the 100-year flood fringe, defined as having flood depths less than one foot. The addition will extend into the flood fringe less than 15 feet and will impact less than one percent of the total flood cross-section. Any change in flood profile will be negligible. The flood elevation of the proposed addition is about 11 feet above the existing water elevation and at least 5 feet above the 100-year flood water elevation. In summary, it is our opinion that the proposed building addition shown on the referenced drawing is: 1) not in the 100-year floodway, 2) within the flood fringe, but above the flood depth by at least 5 feet and, 3) will not significantly impact the 100-year floodplain or flood profile.
