RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO,
APPROVING THE DOUBLE X QUARTER CIRCLE SUBDIVISION MINOR AMENDMENT TO A
DEVELOPMENT PERMIT TO AMEND THE DEED RESTRICTIONS AFFECTING THE EIGHT LOTS
RESOLUTION No. ~-2009
RECITALS
The Owners of the Double X Quarter Circle Subdivision, Lots 1-8 ("Applicants"), have applied to the Board of
County Commissioners, ("Board"), pursuant to Section 2-20-150(b) of the 2006 Pitkin County Land Use Code
("Code"), to amend language of the deed restrictions affecting the lots.
1. The application was received after July 6`h, 2006 and therefore is reviewed under the 2006 Land Use Code.
2. The property is zoned AH PUD, and the PUD is approximately 60 acres in size.
3. The parcels are described as Lots 1-8 Double X Quarter Circle Ranch Subdivision.
4. The Board has determined that the application meets the standards for a minor amendment as set out in
Section 2-20-150 (b).
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, THAT, the Double X Quarter Circle Ranch Subdivision request for a Minor Amendment
to a Development Permit to modify the deed restrictions affecting lots ]-8 to allow the "Ownership Unit" to be rented
to a category 4 qualified renter if it is not occupied as the sole and exclusive place of residence of the owner, is
approved, subject to the following conditions.
1. The Aspen/Pitkin County Housing Authority (APCHA) shall prepare for review and approval of the
County Attorney, and for subsequent execution by the parties, an amended "Occupancy, Rental, and
Resale Deed Restriction Agreement" between each of the owners of Lots 1-8 of the Double X Quarter
Circle Subdivision and APCHA. There should be one deed restriction document signed by all 8
"owners".
This amended deed restriction shall clarify that the "Ownership Units" shall be rented to qualified
category 4 renters (or a lower category) if the owner is not occupying the unit as a sole and exclusive
place of residence. The tenants must be qualified by APCHA prior to occupancy. A copy of the signed
lease shall be provided to and approved by APCHA. If an ownership unit is sold to anon-family member,
the new owner must abide by all aspects of the APCHA Guidelines, including residing in the unit at least
nine months a year and continuing to be a full time working resident.
