IS5UE STATEMENT: This is a second reading of an ordinance adopting by reference the
Model Traffic Code. At its work session on October 13, 2009, the Board of County
Commissioners directed staff to move forward with the adoption of portions of the Model Traffic
Code for Colorado. This is the first reading of an ordinance for the Regulation of Traffic by
Pitkin County. The ordinance creates a new chapter within Title 9 of the Pitkin County Code,
entitled Roads and Public Places. There was a clerical change to the title of ordinance for
second reading to include language referencing classification of the ordinance into the Pitkin
County Code.
BACKGROUND: In the fall of 2009, the Pitkin County SherifPs Office began to explore the
adoption of portions of the State of Colorado's Model Traffic Code as a means to increase
revenue for the County.
Currently, the Sheriff's Office collects no revenue when traffic citations are written. All revenue
goes to the State of Colorado with the exception of victim surcharge funds which, for example,
on a citation written for speeding 10-19 mph over the speed limit, amounts to approximately
$15.00 as opposed to the actual fine which is $135.00. After an analysis of citations issued by
the Sherif~s Office between January 1, 2008 and the fall of 2008 projected gross revenue to the
County could be as much as $50,000.00.
To date an estimated one-half of the 64 counties in Colorado have adopted the Model Traffic
Code or portions thereof by ordinance for the regulation of vehicles and traffic on state and
county roadways within their counties, with several others in the process of adopting the code.
Sheriffs around the State reported no negative impacts from the adoption of the Model Traffic
Code.
Staff proposes adoption of Colorado Class A and Class B Traffic Infractions pursuant to the Model
Traffic Code of Colorado.
LINK TO STRATEGIC PLAN: The ordinance directly supports the County's Strategic Plan by
continuing to provide a safe and healthy community for the residents of Pitkin County as well as
Fiscal Sustainability by developing new revenue sources for Pitkin County.
BUDGETARY IMPACT: An estimated annual revenue increase of up to $50,000 for Pitkin
County. Printing costs of new ticket books would be taken from this revenue. The Sheriff's
Office administrative staff would be responsible for the collection of fines/surcharges as well as
returning those surcharges that by law go to the State (brain injury surcharge and DNA
surcharge) to the State of Colorado. Because of the Sheriff's Office absorbing these
administrative responsibilities utilizing current staff, there would be no budgetary impact to the
county for collection of fees aside from mailing costs.
RECOMMENDED BOCC ACTION: Approve at second reading and public hearing on
January 27, 2010.

ORDINANCE NO. -2010
RECITALS
1. The Pitkin County Sheriff's Office has conducted an analysis of the Colorado Model
Traffic Code and the potential for utilizing that Code in Pitkin County. To date an estimated
one-half of Colorado's 64 counties have adopted the Model Traffic Code or portions thereof.
Several other counties are currently in the process of adopting the code. Sheriffs around the
State report no negative impacts from the adoption of the Model Traffic Code.
2. The Sheriff recommends adopting a portion of the Code as provided for herein.
3. The Board of County Commissioners of Pitkin County, upon the recommendation of the
Pitkin County Sheriff, finds that adopting the Model Traffic Code for Colorado will promote the
health, safety and welfare of Pitkin County's residents and guests.
NOW THEREFORE, be it ordained by the Board of County Commissioners of Pitkin County,
Colorado that:
1. Pursuant to parts 1 and 2 of article 16 of title 31, and part 4 of article 15 of title 30,
C.R.S., there is hereby adopted by reference those portions of Articles I and II of the 2003
edition of the Model Traffic Code (as promulgated and published by the Colorado Department of
Transportation, Safety and Traffic Engineering Branch, 4201 East Arkansas Ave, EP700,
Denver, CO 80222) addressing and relating to Class A and Class B traffic infractions. The
subject matter of the Model Traffic Code relates primarily to comprehensive traffic control
regulations for Pitkin County. The purpose of this ordinance and the code adopted herein is to
provide a system of traffic regulations consistent with state law and generally conforming to
similar regulations throughout the state and the nation.
2. The Class A and Class B traffic infractions contained within the 2003 edition of the
Model Traffic Code are identified in Exhibit A attached hereto.
3. Said adopted Code is subject to the following additions or modifications:
a) The provisions of § 42-2-127(5.5), C.R.S., as amended, are
applicable to penalty assessment notices issued by the County.
b) If a court reduces a traffic offense, the points assessed for
the reduced offense shall be those set forth in the point assessment
schedule in § 42-2-127(5), C.R.S., as amended.
4. The following penalties shall apply to violations of this ordinance:
(a) It is unlawful for any person to violate any of the provisions adopted in this
ordinance. The penalty assessment procedure may be followed by the arresting officer
for any such violation of this ordinance.
(b) Every person convicted of a violation of any provision adopted in the ordinance
commits a traffic infraction pursuant to § 30-15-402(1), C.R.S., as amended.
(c) For its schedule of fines and penalties, Pitkin County incorporates by this reference
the schedule of fines and penalties set forth in § 42-4-1701, C.R.S. (as that section may
be amended), as those fines and penalties correspond to the sections of the Model Traffic
Code adopted by this Ordinance, for all cases wherein the alleged violator acknowledges
guilt of liability, is found guilty by a court of competent jurisdiction, or has judgment
entered against him or her. If the penalty assessment procedure is not used, and the
alleged offender is found guilty, court costs and surcharges as provided for in § 30-15-
401, C.R.S. may be assessed in addition to the fines and penalties set forth in § 42-4-
1701, C.R.S.
(d) Unless otherwise provided by law all fines and penalties, and the surcharges payable
to the County thereon, for the violation of this Ordinance shall be paid into the treasury of
Pitkin County.
5. This ordinance shall apply to every street, alley, sidewalk, driveway, park, and to every
other public way or public place or public parking area, either within or outside the corporate
limits of this County, the use of which this County has jurisdiction or authority to regulate.
6. If any part or parts of this ordinance are for any reason held to be invalid such decision
shall not affect the validity of the remaining portions of this Ordinance. The Board of County
Commissioners hereby declares that it would have passed this ordinance and each part or parts
thereof, irrespective of the fact that any one part or parts be declared invalid.
7. This ordinance shall be so interpreted and construed as to effectuate its general purpose to
conform with the State's uniform system for the regulation of vehicles and traffic. Article and
section headings of the ordinance and adopted Model Traffic Code shall not be deemed to
govern, limit, modify or in any matter affect the scope, meaning or extent of the provisions of
any article or section thereof.
8. This ordinance shall be classified to Title 9 of the Pitkin County Code, entitled
"Regulation of Vehicles and Traffic."
