Aspen Sports Caz Club, LLC ("Applicant"), has applied to the Community Development Director of Pitkin County, ("Director"), pursuant to Section 2-20-] 50(6) of the Pitkin County Land Use Code ("Code") for a Minor Amendment to a Special Review Use permit approval in order to amend the Aspen Raceway Special Use Permit to allow the use of twenty-one (21) cargo/trailers to be used as member-only car storage. 2. The parcel is caned RS-2Q, contains approximately 45 acres, and is conforming in size. 3. The Lot is located at 0550 Raceway Circle. PID#: 2643-164-00-047. 4. The Raceway use was approved pursuant to Resolution No. 93-134, which was a Special Review Use Permit with an associated Operations Plan. In 1995, the Board further granted approval to the Raceway use pursuant to Resolution No. 95-25, which again granted a Special Review Use Permit with an Operations Plan. The Permit and Plan were amended three times to allow for the winter use of the track, each for one year pursuant to BOCC Resolution No. 171-2004 and Administrative Determinations Nos. 16-2006 and 117-2007. The Community Development Director finds that the request is reasonably consistent with the requirements of Section 2-20-150(6). 6. The Director further finds that the parcel is located on slopes less than 15% and is mapped within a scenic view protection area as viewed from Hwy 82 and Woody Creek Rd., however, the proposed storage containers will not be visible as viewed from the public right-of--way. APPROVED by the Director, subject to the following conditions: 1. The Applicant shall adhere to all material representations made in the current application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless hereby amended by other approvals. 2. The Applicant shall comply with all previous land use approvals, unless otherwise amended by this Determination. 3. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit review. Structures represented in the application might not be permitted under building and zoning regulations. Within 60 days, and prior to the submission of any other permits on the parcel, the Applicant shall be required to submit for and obtain the necessary building or zoning permits associated with the temporary storage structures. As part of the permit application, the Applicant shall provide the following: a. A site drawing shall be submitted showing the location on the property where the storage stmctures are placed, size of the unit(s) and distance to all applicable properly lines and all other building or structures. 5. The Applicant shall be required to submit an earthmoving permit application for review and approval by the Planning Engineer for the re-gading in the amended area. As part of the permit application, the Applicant shall provide the following: a. A detailed drainage and erosion plan. i. The plan shall include the location of all BMPs that will be used during constmction. ii. If the project disturbs more than one acre a SWMP shall be applied for and obtained prior to issuance of permits. iii. All historical drainage patterns shall be maintained. b. A comprehensive Weed Management Plan which incorporates both the southern berm, and the entire parcel. The plan shall be reviewed and approved by the Community Development Department and the Open Space & Trails Departrnent. Financial security may be required to ensure the plan is adhered to. The plan shall include: i. A detailed noxious weed management plan to eliminate all noxious weeds on the parcel, starting with the southern most berm. ii. A detailed re-vegetation plan for all areas disturbed by earthmoving on the site using only Pitkin County approved seed mixes. iii. A detailed time schedule for the continual spraying required for the removal and prevention of noxious weed species on the parcel. 6. Any grading improvements shall be limited to a slope of 2:1, no steeper. 7. The Applicant shall comply with all representations made during the scenic review process. 8. The storage structures shall not be considered floor area for Growth Management purposes. No future buildings shall be approved as a replacement for the same square footage (6,720 square feet) without Growth Management consideration. 9. In the event the primary Special Review Use is terminated, all storage containers shall immediately be removed from the premises and the area shall be restored to it's natural state. 10. The Applicant shall be limited to the existing twenty-one (21) 8 foot x 40 foot storage stmctures. No additional storage stmctures shall be allowed without prior land use approval and appropriate building permits. 11. The storage stmctures shall be utilized only for race vehicles owned by members of the Aspen Sports Car Club. Documentation of this shall be submitted in the Annual Review. Administrative Decision No. ~-2010 Page 3 12. The Applicant shall remove any un-utilized storage structures from the property within 15 days of discontinuance. 13. All storage structures shall be maintained in a condition free of rust, peeling paint and/or other visible forms of deterioration. 14. No signs, lettering or mazkings shall be allowed on the storage structures. 15. All storage structures shall be kept locked when not in use. 16. The Applicant shall be responsible to ensure no hazardous substances are stored or kept within the storage structures. 17. No lighting shall be allowed within the storage structure azea. 18. Prior to commencement of any earthmoving or other activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site within the perimeter of the storage area. The fencing shall remain in place until a Certificate of Completion is issued. 19. All azeas disturbed by earthmoving shall be re-vegetated with native shrubs and grasses within one growing season of the project's completion. 20. The Applicants shall comply with all the requirements of the Aspen Fire Protection District. 21. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. The containers are located in a flat area near the raceway, off an existing drive. The parcel lies within a Scenic View Protection Area as viewed from Hwy 82. APPLICANT: Aspen Sports Car Club, LLC REPRESENTATIVE: Chris Stryker LOCATION: 550 Raceway Drive, Woody Creek. PID#: 2643-164-00-047. ZONING/LOT SIZE: The Lot is zoned RS-20, approximately 45 acres, and is therefore conforming in size. PREVIOUS APPROVALS, EXISTING CONDITIONS, and REQUEST: The Raceway has been located at the current site with the same use continually since 1963. The use itself was approved pursuant to Resolutions No. 93-134 and 95-25, which were Special Review Use Permits subject to the use of the raceway in compliance with accompanied Operating Plans. Pursuant to the Special Review, an Annual Review is conducted to assure compliance to the Operating Plan. The Permit and Plan were amended three times to allow winter use of the track for one year, per each determination -Resolution No. 171- 2004, Decisions Nos. 16-2006 and 112-2007. Currently, the 21 containers -each 8' x 40' are located near the racetrack just south of a 'bam' which received a Certificate of Occupancy in 1995. The site is located in a flat area surrounded by earthen berms and is not visible from Highway 82. The site was leased by Aspen Earth Moving for use to store and maintain large dump trucks. In 1991 the operation was issued a stop work order and correction notice for operating a commercial business without special review approval. The Board ultimately decided in 1995 not to issue a special review permit. The subject site was required to be returned to its original state. The racetrack has been using the site, with the retained berms for sometime since then, without the proper approvals/permits for temporary structures. A notice of violation was issued for the containers, which must be cured prior to any future building permit submittals. REFERRAL COMMENTS: The application was referred to the Woody Creek Caucus, OS & T, the Aspen Fire Protection District, Zoning and the White Star Ranches HOA. Comments were received from the Woody Creek Caucus, Zoning and AFPD; they are attached and are incorporated as conditions of approval. And include the planned dates of application (month is okay). Also, an end-of-work date of June 15 2010 is not acceptable -- they will need to do follow-up treatments in midsummer and fall. Note that hand-cutting is only an acceptable method of control for Canada thistle when performed on an ongoing basis throughout the summer (e.g. weekly on ALL infestations) or when combined with chemical control.
