COMMUNITY ASSOCIATION'S WINTERFEST ON FEBRUARY 5, 6, & 7, 2010

RECITALS
1. Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ("Director") may approve a
Temporary Commercial Use/Special Event Permit for commercial activities or special
events.
2. The Redstone Community Association (hereafrer, the "Applicant") has applied to the
Director for approval of a Temporary Commercial Use/Special Event Permit to conduct
the Redstone Winterfest. The event shall occur on February 5, 6 & 7, 2010.
Approximately 200 people per day are expected.
3. The Pitkin County Sheriff s Office, the Carbondale Fire Department, and the Emergency
Management Deparhnent, Land Management Department and Roads and Bridges
Department have all approved this event. County Risk Management has received and
approved a Certificate of Insurance covering this event.
4. Applicant has requested the use of Redstone and Elk Parks and has obtained the required
Special Event Permit from the Open Space and Trails Department.
5. The Director finds that, to the extent applicable, the application complies with the
standards in Subsection 4-30-50(i) of the Land Use Code.
THE DIItECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event
Permit for the Redstone Winterfest subject to Applicant's compliance with each of the following
conditions:
1. All material representations made by the Applicant in the application (which
shall specifically include representations made in all related supporting
documents, correspondence subsequently provided by the Applicant, and
representations made by phone), shall be adhered to, and considered conditions
of approval, unless superseded by specific conditions in this Determination.
2. The Applicant shall obtain, or require participating entities to obtain the proper
building and other related permits, including but not limited to temporary
structures (tents), electrical, liquor licensing, food licensing and
temporary/special event permits prior to commencement of any construction or
events connected with the event.
3. Applicant must demonstrate possession of applicable permits at all times during
the permitted activity and present such permits upon request.

4. Approval to hold this activity does not imply that extra services will be provided nor
does it place any additional liabilities on Pitkin County.
5. All activities at the Redstone Castle shall be restricted to outside aeeas only or
those covered under the Special Events Permit, permitted tours for 40 people
max a day, pursuant to Administrative Decision No. 086-2009) shall be
outside of the Castle. There shall be no use of inside facilities.
6. The Applicant has received permission from the Pitkin County Land Manager to
utilize the County property behind the Coke Ovens for Skijoring Clinics only during
the Winterfest. Parking of all vehicles is prohibited in the area behind the Coke
Ovens. No motorized vehicles with treads shall be utilized in this area. Disturbance
of soils under the snowpack in this area shall be prohibited.
The Applicant shall submit for and obtain a Special Event Permit from the Open
Space and Trails Departrnent for the use of Elk and Redstone Parks. Applicant shall
abide by all terms, conditions and stipulations as required in the permit.
8. The Applicant shall be responsible for assuring that all areas in which activities takes
place shall be cleaned up and restored to its prior condition within two (2) days after
the end of the event.
9. No event parking shall occur on Highway 133. Parking may occur along the fenced
portion of the Coke Ovens along Coal Creek Road. County Roads, including Coal
Creek Rd and Redstone Boulevard shall remain passable by all Emergency vehicles
and the traveling public. Applicant shall contact a towing company prior to the event
and arrange for their service on an as-needed basis. Contact information for the
towing company shall be provided to on-site parking attendants, the County
Engineer, and the County Sheriffs Departrnent prior to the event. No emergency
accesses shall be blocked.
10. Pedestrian walkways crossing Highway 133 shall be clearly marked. If there is
significant traffic during the event, the Applicant shall place traffic control
operators at walkways to ensure pedestrian safety when crossing.
11. All food and beverage service shall be limited to currently existing licensed
commercial food establishments.
12. Pennants, banners and posters advertising the event shall not be erected more than
two weeks prior to the event and must be removed within two (2) days after the
termination of the event.
13. Applicant shall receive written permission from all private land owners whose
properties are utilized for the event.
14. Failure to comply with the conditions of approval may result in revocation of this
permit.

Permit, "Redstone Winterfest 2010"
DATE: January 25, 2010
REQUEST: The Applicant is requesting approval of a Temporazy Commercial Use/Special Event
Permit in order to conduct the Redstone Winterfest.
APPLICANT: Redstone Community Association (hereafter, "Applicant").
LOCATION: Various locals along Redstone Boulevard; Events or parking will also take place at
the Redstone Stables, Elk and Redstone Pazks, Coke Ovens (Skijoring) and Redstone Castle Bounds
(no use of the Castle, other than regulazly scheduled tours are allowed). The `Expo' tent and the
Nordic Race will take place at the Redstone Inn.
BACKGROUND: This winter event is a metamorphosis of the Redstone Dog Sled Races. After
25 yeazs, the Town of Redstone has shifted the focus of the event from Dog Sled Races, to an in-
town winter festival. The event will include some of the previous activities and some new activities
- including a Nordic Ski Race, a Snowshoe Race, and an Expo tent.
The event will be held February 5-7 from approximately 9AM each day. Friday and Saturday's
scheduled events to end at approximately 9PM and Sunday by 1PM. Event Coordinators anticipate
approximately 70 people on Friday, the 5~' and up to 200 people each day on Saturday and Sunday.
REFERRAL COMMENTS: The application was referred to Carbondale Fire, Pitkin County
Sheriffs Office, Risk Management, Emergency Management, Open Space and Trails, Public Works,
Land Management (Coke Ovens), CDOT and Colorado State Patrol. Copies of their comments are
attached and included as conditions of approval in the determination.
Ellen Anderson signed off on the application for Emergency Management as well as Tom Grady for
the PCSO, and Ron Leach for Cazbondale Fire.
Kris Jewkes, Risk Management, reviewed and approved the Certificate of Insurance provided by
Applicant.
Open Space and Trails has issued their own Special Event Permit for the use of Elk and Redstone
Parks.
Crystal Yates-White, Pitkin Land Manager, has approved the use of County property for the use of
the Skijoring Clinics. G.R. Fielding County Engineer has approved the use of County Roads
(Redstone Boulevazd and Coal Creek Road).

STAFF COMMENTS:
Pwsuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that adequate
provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public pazking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other County
regulations. Each of these requirements is addressed, in turn, below.
Police Supervision/Roads: No special provisions for Police Supervision have been deemed
necessary. The Sheriff's Office has signed-off on the application. G.R. Fielding has approved
the use of County Roads, provided they remain open and passable by emergency vehicles and the
traveling public CDOT has agreed to plow Hwy 133 and the Elk Park parking lot and provide
two lit signs announcing the event and indicating possible pedestrian crossings.
Public Parkins: Approximately 100 parking spaces will be provided. People will park in town on
the street or on private property closer to the start the races. Property owners must give permission to
the event organizers. Elk Park as determined by Open Space & Trails will also be utilized for
parking. Plowing of Elk Park is restricted to CDOT personnel. No parking shall take place behind
the fence around the Coke Ovens. The Stables will have limited parking on site for handicapped and
Emergency access. The Coal Basin lot will also be utilized. There will be 4 pazking attendants each
day of the event.
Insurance: Applicant has provided adequate proof of insurance. Race participants will also sign a
liability waiver.
Site Set-Up, Maintenance and Clean-Ua: Redstone Community Association is responsible for
any clean up required at all sites. The Association shall also take care not to distwb the
ground/vegetation on the County lands located behind the Coke Ovens. All fencing shall remain in
place. Pennants, banners and posters advertising the event shall not be erected more than two weeks
prior to the event and must be removed within two (2) days after the termination of the event. The
Town has been working with Waste Management for chemical toilets, trash containers and possibly
recycling containers. The Town shall be responsible for clean-up and restoration to any areas in
which activities are held.
Emergency Services: The Applicant has provided a plan for dealing with emergencies during the
races. The professional medical service provider is Carbondale & Rural Fire Protection Services.
Local emergency personnel will be notified of the event.
Safety of Operations: The Applicant will have 1 ambulance, with a team of 4 EMT's per day. The
team will have radios to communicate any emergencies.
Conformance with Building Code: An Expo tent is scheduled to be set up at the Redstone Inn.
The Applicant shall be required to obtain the appropriate building and electrical permits and
inspections prior to the event.

compliance with each of the conditions in the attached Administrative Determination.

fun. Is there nothing planned for Redstone Park ?Please submit
the form for a special use for the Elk Park for parking for the
event. As usual, we will waive the fee but we do need to get the
application filled out by you. My concern is the impact on the
Restrooms at Redstone Pazk. Did I read that ,besides the
Stables, there will only be one other porta potti ? I believe there
is a formula for number of porta pots /guests and I would like
to see us address that. Please call me with any questions.

Coke Ovens. 100 parking places should be enough for 200
people at a community event.

following issues have been covered: • Will the insurance
coverage assure that all participants will be fully covered? I
would like assurance that there is no chance that the taxpayers
will have to pick up the tab for any medical expenses of
participants. • Are Town and County employees OK with trash
removal, plowing, etc.? • Is Carbondale Fire is OK with
medical plan? Is the "emergency vehicle" you reference an
ambulance? If it is not (for example, if it is a private vehicle)
you might want to ask Carbondale Fire for their opinions on
medical transport.

attached a copy of our waiver. Our insurance policy is fine.
The emergency vehicle is an ambulance along with a command
center to house the EMTs., again to be parked at the lower
Redstone Inn parking lot. Tim Holbrook from C-dot has
accepted the responsibility for plowing, Elk Park, In front of
the Coke Ovens on Highway 133, as well as parking azea
behind Coke Ovens along Coal Creek Road. Waste
Management is the provider of 13 trash receptacles plus a
dumpster. "Building" permit is in the mail with $80.00 check
for 1 canopy!

[01/12/2010 03:41 PM] Applicant Request:**The
Redstone Winterfest committee is asking permission to hold
the Ski-Joring (dog) clinics, scheduled for 11:00-2:00 Sat and
Sun, behind the Coke Ovens off Coal Creek Road. We would
create a 6' wide track with the use of snowmobiles. The track
will be as large of a loop as we can make, so the center area
will remain undisturbed. The fencing will be kept up, as we
anticipate no more than approximately 6 people and maybe 4
dogs at one time. We will set up a booth outside of the fenced
azea and all spectators will watch from the road. If we do not
receive more snow for this event it will most likely be
cancelled, unless we can manage to bring in some snow. We
will not expose any area under the snow, keeping the snow
pack intact. Thank you for your support in managing this event.

following summer. So NO PARKING will be allowed behind
the fence around the ovens --- only around the ovens in front
(parallel parking along 133 at coke ovens pull-off) and in back
(parking spots perpendicular to fence. GR would also allow

participate in this course. I am fully awaze of the risks and hazards connected with the
participation in this event, including physical injury or even death, and herby elect to
voluntarily participate in said event, knowing that the associated physical activity may be

any property belonging to me, while participating in physical activity, or while on or
upon the premises where the event is being conducted.
It is my expressed intent that this release and hold harmless agreement shall bind the
members of my family and spouse, if I am alive, and my heirs, assigns and personal
representative, if 1 am deceased, and shall be deemed as a RELEASE, WAIVE,
DISCHARGE, and CONVENTION TO SUE the above named RELEASEES. I hereby
further agree that this Waiver of Liability and Hold Harmless Agreement shall be
constructed in accordance with the laws of the State of Colorado.
In signing this release, I acknowledge and represent that I HAVE READ THE
FORGOING Waiver of Liability and Hold Harmless Agreement, UNDERSTAND IT

AGREEMENT FOR PAYMENT OF LAND USE APPLICATION FEES
PITKIN COUNTY (hereinafter "COUNTY") and the Redstone Community Association (hereinafter
"APPLICANT") AGREE AS FOLLOWS:
1. APPLICANT has submitted to COUNTY an application for Soecial Events Permit for the
Redstone Winterfest (hereinafter, the "PROJECT").
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 008-2008
establishes a fee structure for land use applications and the payment of all processing fees is a
condition precedent to a determination of application completeness. The fee structure is based on the
COUNTY'S policy that development shall pay, in full, the cost of development review in the COUNTY.
Fees have been set to be consistent and fair to the public and to reflect the expense incurred in
providing such services to the pubiic.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the
proposed PROJECT, it may not be possible at the time of application to ascertain the full extent of the
costs involved in processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use
applications shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to
complete processing or present sufficient information to the Planning Commission and/or Board of
County Commissioners to enable the Planning Commission and/or Board of County Commissioners to
make legally required findings for project approval, unless current billings are paid in full prior to
decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right
to collect full fees prior to a determination of application completeness, APPLICANT shall pay a base
fee in the amount of $499 which is based on 2 hours of staff time, and if actual time spent by staff to
process the application exceeds the average number of hours by more than 20°/a, then the COUNTY
will bill the APPLICANT quarterly for the additional time spent. Such periodic payments shall be made
within 30 days of the billing date. APPLICANT further agrees that failure to pay such accrued costs
shall be grounds for suspension of processing.

Hey there. As they are not serving the public food (or at least that's what they say) I am not certain if we would refer
this to you all or not. I've attached a copy for quick perusal. Other than the bathroom situation I don't see anything that
might bump to you, but since there is no on-line stuff from last year and it's changed a bit, I thought I should double
check.
If there is something that you think EH should review, let me know so I can get the fee from Becky asap. They haven't

General Conditions for All Special Use
1) No implied rights or reservations are granted for parking spaces. Admission is on a f rst-come first-served basis.
2) All participants in the activity agree to abide by and obey all rules and regulations of Pitkin County Open Space and Trails, and
any other regulations that may apply.
3) Approval to hold this activity does not imply that extra services will be provided nor does it place any additional liabilities on
Pitkin County Open Space and Trails.
4) The permittee agrees to provide signage regarding the activity one week prior to the activity should OST staff determine it is
necessary to minimize use conflicts.
5) The permittee agrees to hold harmless and indemnify Pitkin County Open Space and Trails and its staff from any death, injury
or property damage occurring as a result of this activity.
6) The permittee shall supply all necessary manpower and equipment to safely conduct this activity. The permittee shall be
responsible far any and all damage to park resources andlor facilities that result from this activity.
7) All Pitkin County ordinances and Colorado statutes apply.
8) The area in which the activity takes place shall be cleaned up and restored to its prior condition.
9) Entry to a propertylpark may be prohibited when the propertylpark is at capacity. Exceptions are not made for special
activities.
10) Pitkin County Open Space and Trails maintains the right and authority to amend or cancel this permit at any time should the
applicant fail to abide by conditions agreed to or if public health, safety and welfare so dictate.
11) The permittee may be assessed an Impact Fee for extra services provided by Pitkin County Open Space and Trails.
Payment, if required, is due upon submittal of this application unless other arrangements have been approved.
12) This permit does not grant exclusive use of the site. Permittee shall ensure that the rights and privileges of other park visitors
are recognized.
13) Permittee must demonstrate possession of applicable permits at all times during the permitted activity and present such
permits upon request.

2) Ne ice sculptures, ice or snow er demonstrations may be placed, erected orworked-on on any of the existing

plow into the gravel base of the lot.
