Proof must be provided that the system meets present Pitkin County ISDS Regulations. If the present system does not meet regulations, all necessary changes must be done so that it does meet regulations. Based on a 2 bedroom house, less than 2,000 sq ft, with a pert rate of 5 mpi (based on soil data from the barn/conf center) a 750 gallon, two compartment septic tank and an absorption area of 235 sq ft are required. Receipts for supplies and service must be provided to help indicate size of tank and field. An inspection must be done by this department to verify proper installation and sizing. This would include an inspection of : (a) the septic tank including inlet and outlet t's, (b) the method of equal distribution of flow to the field by exposing the manifold or distribution box, (c) the actual size of the absorption field by must be verified by exposing the corners of the field. A condition of approval for this application is the Environmental Health Department must receive and approve a septic system application, and issue a permit for construction of the septic system, prior to issuance of a building permit. A condition of approval for this application is the Applicant shall file a fireplace/woodstove registration document with the Building Department prior to submittal for a building permit. A condition of approval for this application is that any more extensive projects than a single family home, such as building a large pond or a large landscaping project, do require a Fugitive Dust Plan if it will impact adjoining neighbors and/or roads. The Aspen/Pitkin Environmental Health Department must approve the plan. If an earthmoving permit is require, a Fugitive Dust Plan shall be approved by EHD prior to issuance of the earthmoving permit. When application is turned in for an Earthmoving Permit, the approved Fugitive Dust Plan must be attached. The other concerns this department has is that Richard McIntrye and Flying Dog Ranch West have not fulfilled all the requirements in Resolution 99- 75. The requirements of the septic permit issued on 6/2/1/99 for legalizing the unpermitted ISDS for the guest house have not been met. Mr. McIntrye has not provided proof that the present illegal system meets present Pitkin County ISDS Regulations. The EHD has not been called to do an inspection to verify proper installation and sizing. If the present system does not meet regulations, all necessary changes must be done so that the system does meet regulations. Winter is approaching and if changes are required, they should be done now. We have no documentation that a water meter was installed for the barn. No monthly reports have been provided to the Environmental Health Department documenting the water usage, particularly the water usage per event. A septic permit was issued to expand the existing septic system for the ham. This department has agreed that the additional septic tank could be installed this fall, so that the garden area would not be disturbed during the summer season events. 000007 P. Any changes must be approved by this department and the design engineer prior to them being made. Minimum horizontal distances between components of the system and physical features shall conform to the Pitkin County ISDS regulations. There must be at least 54 feet from the ditch to the absorption field. If a drinking water tank will be installed on the property, it must be within the Activity Envelope and must be at least 25 feet from any component of the septic system. The design will consist of one 1500 gallon two compartment tank with an effluent filter on the outlet. Effluent will be distributed to three trenches via a distribution box. The distribution box should be filled with water at the time of final inspection to check for equal distribution. Each trench will consist of 8 Biodiffuser chambers, for a total of 24 chambers. There must be at least 6 feet of undisturbed soil between each trench. This permit is expressly conditioned on the property owner providing for the regular inspection, cleaning and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations. This department does not endorse any brand of products. This permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an as -built letter to this department. This department must also be called for an inspection with a minimum of 48 hours advanced notice. Revegetation over the area of the field is very important for the functioning of the system. Pitkin County has guidelines that must be followed to assure the plants that are introduced are appropriate for the conditions of the area. (RESOURCE) has eva uated the capability of Vandeventer Spring Ditch to serve all of the current uses at Flying Dog Ranch (Ranch) and the proposed guest cabin. In addition, this letter is intended to meet the Pitkin County requirement that the Ranch demonstrate to the Environmental Health and Natural Resource Department that there are adequate water rights to serve the proposed guest cabin as outlined in Administrative Decision No. 089-2007. BACKGROUND Potable uses on the Ranch are currently served by the Vandeventer Spring Ditch (Spring). A portion of the Spring is diverted into a collection and distribution box for use by the Ranch and both the Danciger and Piller properties. All three properties split the available spring water collected equally. Water yield from the Spring was evaluated by Wright Water Engineers, Inc. (WWE) at the collection and distribution box from 1989 to 1991. WWE reported that the box collected 5 gallons per minute (gpm) during the study period, however as much as 20 gpm may have been collected in past years. In addition to the domestic uses, water from the Spring box historically served approximately 250 head of livestock when the Ranch functioned as a commercial cattle operation. Water for irrigation purposes is supplied from other ditch water rights owned by the Ranch. WATER DEMAND Present water demand on the Ranch from the Spring consists of a main residence, guest house, barn apartment, and conference center. A guest cabin is proposed. Table 1 summarizes the average daily water demands for both current and proposed uses. The conference center has approximately 35 yearly events: 15 events at 75 persons maximum and 20 events at 25 persons maximum) with no more than 3 events in any one week. Peak day at the Ranch is therefore based on 75 persons at 15 gpd per person or 1,125 gallons plus 1,030 gallons for the existing and proposed domestic uses. Five (5) gpm is the equivalent of 7,200 gallons per day (gpd) and a one third (1/3) share of the flow is 2,400 gpd which exceeds the proposed demand. Because 5 gpm is much less than the maximum day or peak hour flow rates, water storage must be provided. Therefore, RESOURCE recommends a minimum of 2,500 gallons of storage be provided for the Ranch. CONCLUSIONS Vandeventer Spring Ditch can meet the water demand for the proposed guest cabin and existing uses. The requirement for a 2,500 gallon storage tank is recommended to offset maximum day and peak hour demands provided that the collection and distribution box reliably distributes 2,400 gpd to the Ranch. One third of the collected 5 gpm flow (minimum) from the Spring can meet the peak day demand of 2,155 gallons. Should the Spring become unreliable in the future, the Ranch has the option and right to construct up to six (6) exempt wells as allowed by C.R.S. 37-92-602 Presumption 3b -IIA on tracks of land of 35 acres or more. Each exempt well can serve up to three single-family dwellings, irrigate up to one acre of lawn and garden, and provide water for the individual's domestic animals and livestock. Results of a gradation analysis performed on a sample of sandy gravel (minus 5 inch fraction) obtained from the site are presented on Figure 3. No free water was observed in the pits at the time of excavation and the soils were moist. /1 Foundation Recommendations: Considering the subsoil conditions observed in the exploratory pits and the nature of the proposed construction, we recommend spread footings placed on the undisturbed natural soil designed for an allowable soil bearing pressure of 2.000 psf for support of the proposed residence. Footings should be a minimum width of 16 inches for continuous walls and 2 feet for columns. All conditions of the permits had been met by April 2000. The Environmental Health Department (EHD) has given our "Final Inspection Approval" on the ISDS permits. EHD signed -off on the Certificate of Occupancies (CO's) from the Building Department, but other signatures were still required. The Building Department should be contacted to see if the CO's have been issued. 2. The water meter was installed and Lydia McIntyre is providing monthly reports to track activities, # of people, # of cars, and water usage at each event. (See Attached) 3. The ISDS for the Event Center was evaluated by their engineer and modified in size to handle the caretaker unit and 75 people per day at the Event Center. The system is sized to handle a peak capacity of 1,238 gallons per day. 4. In reviewing the water use data submitted, one activity exceeded the design flow capacity of the ISDS. On 9/4/99 the meter usage showed that 1,300 gallons of water went into the system. The next event on 9/11/99 used 1,190 gallons, close to but not exceeding the design capacity of the system. No event since then has come close to exceeding the design capacity. Exceeding the capacity of the system is cause to 'void' the ISDS permit. Flying Dog West will need to monitor the water usage with regards to the type of event, duration of the event and number of people attending so that the capacity of the system is not exceeded. The events on 9/4/99 and 9/.11/99 were both weddings, attended by 65-67 people and the duration was 4-1/2 to 5 hours. Twice in the past year the water usage at the Event Center came close to and exceeded the design capacity of the ISDS. A condition of approval for this application is that any more extensive projects than a single family home, such as building a large pond or a large landscaping project, do require a Fugitive Dust Plan if it will impact adjoining neighbors and/or roads. The Aspen/Pitkin Environmental Health Department must approve the plan. If an earthmoving permit is require, a Fugitive Dust Plan shall be approved by EHD prior to issuance of the earthmoving permit. When application is turned in for an Earthmoving Permit, the approved Fugitive Dust Plan must be attached. The other concerns this department has is that Richard McIntrye and Flying Dog Ranch West have not fulfilled all the requirements in Resolution 99- 75. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104: "It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if service is available." The applicant intends to host 75 special events at the Barn. This qualifies the project as a public water system. Under the Colorado Primary Drinking Water Regulations it states that "a public water system is a drinking water system that regularly serves an average of at least 25 persons daily at least 60 days out of the year." The applicant must contact the State Water Quality Control Division (WQCD) for specific requirements. A condition of approval is that the applicant acquires State approval and follows all monitoring guidelines. The County cannot issue a septic permit, building permits or food service license until the applicant meets these requirements. SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: "It is the policy of the County to ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System Regulation." The average wastewater flows for this project will be in excess of 2 000alg lons per day, and will require review, permitting and approval by the WQCD of the Colorado Department of Public Health and Environment (CDPHE). Prior to state review, the Board of County Commissioners must approve the site application before the state will consider analyzing the application. Sewage amounts used in calculating the minimum design flow were taken from Table 1 in the 1998 Pitkin County ISDS Regulations. For this review, the Department only looked at the food service and bar use at the Barn during special events when estimating sewage amounts. We estimated for an event serving 150 people with food and bar service the average wastewater flow would be 4500 gallons. The applicant must include all uses of the Barn and the other structures on the property when sizing a septic system. The WQCD will also require a discharge application to be submitted as part of the National Pollutant Discharge Elimination System (NPDES) program. Approval will require sampling of water from monitoring wells, and annual association costs related to that sampling. A condition of approval for this application is the receipt and approval of the site application by the Environmental Health Department, the Board of County Commissioner and the WQCD. WATER OUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710 "It is the policy of the County to preserve and protect its present water resources. To this end it is the policy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water -dependent agricultural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also the policy of the County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands." The Environmental Health Department will be addressing water quality impacts on down stream water quality. This application should not impact down stream water quality if the setbacks between the septic system and physical features comply with the Pitkin County Sewage Regulations. The Environmental Health Department's mission is to preserve and protect the quality of Pitkin County's water resources. Since a large percentage of the population is dependent upon water from wells, elimination of groundwater pollution, and protection of aquifers and their drainage areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of water discharge that can contaminate water supplies. This Department recommends that nonpoint sources of discharge be retained on the property of origin. To accomplish this, the owner can use landscaping, drainage patterns, detention ponds, and/or dry wells for water runoff from buildings. FUGITIVE DUST Activities such as road building and landscaping require a Fugitive Dust Plan. The measures must prevent windblown dust from blowing off the property or creating a nuisance. This plan needs to include, but is not limited to, fencing, watering of haul roads and disturbed areas, daily cleaning of adjacent paved roads to remove mud carried out by trucks, speed limits, or other measures. I have reviewed the water use data from David. Middleton for Elk Mt Lodge, which is a similar special events operation. David has been keeping data for each event since May 1997. The highest water use was 1.9 gallons per person per hour for an event that last 6 hours for a total of 12 gallons per person per event. Most other events were reported to use about 1 gallon/person /hour. The actual water usage for Elk Mt is similar to that suggested in the Resource Engineering report, so 13 gallons per person per event could be assumed to be a figure that could be used to size the septic system for the Event Center portion of the barn if Flying Dog Ranch West uses the same controls that Elk Mt uses : Elk Mt Lodge has a water meter to monitor the actual water usage to be sure it does not exceed the capacity of the septic system. No food is prepared at the site. No dishes are washed at the site. These practices have kept water usage to a minimum. EHD has no permit on record for the guest cabin. The EHD is willing to work with the Flying Dog Ranch West to correct this in an agreed upon time. They must apply for a permit and an engineer must assure that the system is working properly and sized adequately under present regulations. Design Flow for the combination of the caretaker unit and clubhouse and recreational building use is therefore reduced to 681 gallons per day averaged over the week. In our report of October 6, 1998, we noted that: " Wastewater treatment for the barn structure is currently provided by an individual sewage disposal system (ISDS) that comprises (according to the permit record) a 1,250 gallon septic tank and a seepage pit (drywell) of approximately 450 square fleet of sidewail and base area. Constructed under permit number 90051 in 1990, it provided for an average flow of 450 gpd and a design flow of 675 gpd. According to the permit documentation, the system anticipated flows from a one -bedroom caretaker unit in the barn and floor drain systems in the main building. Under today's regulations, the drywell system has a theoretical capacity of up to 1,000 gpd of design flow (emphasis added, 3/9/99).° Based on the reductions to the proposed program for the Flying Dog Ranch West clubhouse and recreational building use, the existing ISDS is now entirely capable of handling the design flow of 681 gallons per day under the current regulations. The existing septic tank, at 1,250 gallons, is also capable of providing sufficient detention time for the per event flow of 975 gallons so our prior concern about handling the "slug flow" aspect of special events at the property are addressed by the existing system. From the standpoint of the condition of and access to the current ISDS system, the October report also noted the following: " We did note that the septic tank and drywell are not easily accessible at this time and are probably located under some revised landscaping west of the barn structure. I would recommend locating and excavating the access manways on both the septic tank and drywell structures to establish access for maintenance and inspection purposes. Access to a location near the surface would permit pumping of the septic tank chambers for intermittent solids removal as well as inspection of both structures. Access would be, perhaps, annually at most so replacement of landscape features over a buried access lid should not be a problem." I would continue to recommend that these actions be taken to ensure the adequacy of the existing ISDS for special event use. As we had also noted in October, data gathered at special events at the Elk Mountain Lodge clubhouse and recreational building facility in 1997 and 1998 would suggest an average demand of 0.8 gallons per attendee per hour per event and a design demand of 1.5 gallons per person per hour. Assuming 75 people at a four hour event, this would represent a total water demand impact of 450 gallons per event on the high end. Anticipating 975 gallons per event therefore appears highly conservative for purposes of this discussion. GORDON MEYER, INC. [1.. n n 4 C k 1, March 9, 1999 Mr. Alan Richman Page 3 As you know, in a memorandum dated November 19. 1998, the Pitkin County Environmental Health Department suggested that the Flying Dog Ranch West clubhouse and recreational building could generate as much as 4,500 gallons of wastewater flow for an event accommodating 150 persons. In referencing Table 1 of the Pitkin County Individual Sewage Disposal System Regulation, the Environmental Health Department utilized a food service and bar use figure to estimate sewage flows at the Flying Dog Ranch West facility. We would respectfully disagree with this approach to estimating potential sewage flow at this facility since the calculations for food service establishments under the coae is calculated on a "per seat' basis. Restaurant and bar seats are typically expected to turn over in the course of daily operations, accommodating several people in the same "seat'. The proposed use at the Flying Dog Ranch West facility are truly one-time events each day they occur so a calculation which assumes multiple occupancy of a single seat seems inappropriate. I would stress the comparison to the actual data from the Elk Mountain Lodge facility as more directly applicable to the Flying Dog proposal and we are utilizing flow figures substantially higher than even that data would support. Suitable on-site wastewater treatment that avoids contamination of creeks and area water features and wells will be feasible for the Flying Dog Ranch West clubhouse and recreational building using the existing on-site wastewater system. Access and Road Impacts The Flying Dog Ranch West Special Review clubhouse and recreational building will now generate a maximum occupancy of 75 persons at a special event. The applicant will be offering a van shuttle service to groups using the facility although my analysis has assumed that a larger group may not take full advantage of this service. Based on a maximum event of 75 persons and assuming an average 2 persons per vehicle (likely to be low for a planned event at a specific location) up to 38 vehicles could be expected to park at the site. Assuming, again, that they all arrive within the same hour, an additional 38 vehicles per hour would be the maximum impact on Prince Creek Road. Access to the property will continue to be from existing ranch entries off of Prince Creek Road located approximately 1.52 miles (the parking field entry) and 1.61 miles (the ranch entry) from the intersection of Prince Creek Road with Colorado Highway 133. The internal access to existing and proposed uses will utilize existing ranch roads meeting Pitkin County driveway standards. The parking field entry will be utilized for access during lark a events at the barn building. The parking field access off of Prince Creek Road is located on the west side of the County roadway on a straight segment of the road before the road turns east up the Prince Creek Drainage. The available intersection sightline to the north and south is in excess of 500 feet, well in excess of the 350 feet that is required for a County roadway posted at 35 miles per hour. Fr, -.-n a conversation with Pitkin County Road and Bridge Supervisor Brian Pettet, specific traffic counts on Prince Creek Road were last taken in June of 1997 when a count of 421 vehicles per GORDON MEYER, INC. This represents a low existing volume on a road with a 19 to 20 foot chip/seal surface plus shoulders meeting a Class IV Rural Access standard accommodating up to 800 vpd. Trip generation rates for the maximum anticipated event size at the Flying Dog Ranch West clubhouse and recreational building would be 76 vehicle trip -ends per day impacting Prince Creek Road (38 vehicles, round trip). Adding a theoretical 76 vehicle trips per day to the currently existing traffic on lower Prince Creek Road results in a total volume of approximately 497 vpd in the Summer. Even adding in the anticipated trip -generation associated with build -out at the Tybar Ranch Subdivision (105 vpd), total volumes in the range of 602 vpd would be the maximum impact. Prince Creek Road, the existing County road #5 adjacent to the project site, is a paved two-lane roadway which is classified under the Pitkin County Road Management and Maintenance Plan as a Class IV Rural Access and a "Moderate Service Area" road. A total projected traffic volume of 602 vpd for the lower Prince Creek Road does not suggest any further need to upgrade the road section under Pitkin County standards as a result of the Flying Dog and proposed Tybar Ranch projects. When I arrived they had prepared percolation test holes, not only in,the bottom of the recently excavated dry well holes, but on the surface of the ground. The surface perc holes were dug only about 25 feet from irrigation water running at a pretty good flow in several ditches crisscrossing the acreage out beyond the house itself. These test holes perced at rates from 60 min's: to the inch to about 20 mins. to the inch. But, with the Construction of the house and the exiting points of the sewer lime, the gradual uphill slope and the fact that the slowest test hole was in the ntighborhood where any leach field would have to be installed, I suggested they use the dry well, which breaks through to the sand and gravel strata, percing about 5 min. to the inch around 3 feet below the surface of the ground, as their absorption area. This enables them to stay 50 feet away from all irrigation ditches in the area and, at the same time, come out of the house using some of the existing plumbing. The contractor indicated that he would build a dry well out of cinder block, approximately a 300 block dry well, which I sized at 12 feet in diameter and 10 feet below the inlet for the three bedroom house. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104: "It is the policy of the County tb insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if service is available." The applicant intends to host 75 special events at the Barn. This qualifies the project as a public water system. Under the Colorado Primary Drinking Water Re ations it states that "a public water,system is a drinking water system that regularly serves an average of at least 25 persons daily at least 60 days out of the year." The applicant must contact the State Water Quality Control Division (WOCD) for specific requirements. A condition of approval is that the applicant acquires State approval and follows all monitoring guidelines. The County cannot issue a septic permit, building permits or food service license until the applicant meets these requirements. SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: "It is the policy of the County to ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System Regulation." The average wastewater flows for this project will be in excess of 2,000 gallons per day, and will require review, permitting and approval by the WQCD of the Colorado Department of Public Health and Environment (CDPHE). Prior to state review, the Board of County Commissioners must approve the site application before the state will consider analyzing the application. The PAnW m R. Wr.11 000106 system must comply with Pitkin County Sewage Regulations as well as the state regulations. The state approval process for a site application can be quite lengthy. Sewage amounts used in calculating the minimum design flow were taken from Table 1 in the 1998 Pitkin County ISDS Regulations. For this review, the Department only looked at the food service and bar use at the Barn during special events when estimating sewage amounts. We estimated for an event serving 150 people with food and bar service the average wastewater flow would be 4500 gallons. The applicant must include all uses of the Barn and the other structures on the property when sizing a septic system. The WQCD will also require a discharge application to be submitted as part of the National Pollutant Discharge Elimination System (NPDES) program. Approval will require sampling of water from monitoring wells, and annual association costs related to that sampling. A condition of approval for this application is the receipt and approval of the site application by the Environmental Health Department, the Board of County Commissioner and the WQCD. WATER OUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710: '4t is the policy of the County to preserve and protect its present water resources. To this and it is the policy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water -dependent agricultural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also the policy of the County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands." The Environmental Health Department will be addressing water quality impacts on down stream water quality. This application should not impact down stream water quality if the setbacks between the septic system and physical features comply with the Pitkin County Sewage Regulations. The Environmental Health Department's mission is to preserve and protect the quality of Pitkin County's water resources. Since a large percentage of the population is dependent upon water from wells, elimination of groundwater pollution, and protection of aquifers and their drainage areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of water discharge that can contaminate water supplies. This Department recommends that nonpoint sources of discharge be retained on the property of origin. To accomplish this, the owner can use landscaping, drainage patterns, detention ponds, and/or dry wells for water runoff from buildings. FIREPLACE The less densely populated parts of the county like this site may have two devices per building. The owners can install no more than one wood burning fireplace and a second device that can be either a gas log fireplace or a certified woodstove. In addition, the owner can install unlimited numbers of decorative gas appliances. Occupants may not burn coal in any device. The owners cannot install fireplaces or woodstoves in barns or agricultural buildings. Any remodeling that affects the firebox of your fireplace will necessitate that the device meet current regulations. A condition of approval for this application is the receipt and approval of the fireplace/woodstove permit by the Environmental Health Department. With food prepared off-site this facility must comply with Colorado Food Service Regulations. Section 10-401 of the Rules and Regulations Governing the Sanitation of Food Service Establishments in the State of Colorado requires a review of plans and specifications by this Department. The operators will need to consult with this Department well before preparation of plans and specifications. A minimum of two weeks is necessary for this Department to review and approve plans. Also, final approval from this Department is necessary before opening for business and before issuance of a Colorado Food Service License.
