Septic permit approved per compliance with the engineer design and specifications dated and stamped 10125/01.
Any changes must be approved by this department and the design engineer prior to them being made.
Minimum horizontal distances between components of the system and physical features shall conform to the Pitkin
County ISDS regulations.
The engineer design is for a minimum 1750 gallon two-compartment septic tank. Pitkin County regulations require
an effluent filter on the outlet of the tank. A 30% reduction is taken in the absorption field for use of infiltrators in a
bed configuration for a total of 58 units.
This department does not endorse any brand of products. The engineer must do a final inspection of the
installation and submit an as-built letter to this department. This department must also be called for an inspection
with a minimum of 48 hours advanced notice.

Plans and specifications of the p osed individual sewage disposal system have been reviewed and are considered
satisfactory. Permission is hereby granted to the owner or the agent to perform the work indicated in accordance with the Pitkin
County ISDS Regulation in effect at the time of issue. This permit becomes invalid 6 months from the date that the permit was
issued unless system construction has commenced or an extension has been approved in writing by the Department.
As-built drawings must be included with this permit before the final approval will be issued.

The fee for a ISDS application is $330 for a permit that takes 6 hours or less for the department to approve. If approval takes
longer than 6 hours, a rate of $55 per hour will be charged. The maximum fee is $1000. The basic fee of $330 is due al the time
of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second, before
final approval of the ISDS permit.
Application for an individual sewage disposal system is hereby submitted. I hereby certity that the above information is true and
accurate and that I have provided true and accurate information on locations of all existing and proposed wells, contour
intervals, buildings, property lines, ditches, slopes, waterlines, springs, suction or irrigation lines, drinking water cisterns, drain
tiles, irrigation ditches, lakes, water courses, streams, floodplains, dry gulches, and existing septic systems. I hereby certify
that any such features not shown on attached site map are not present. Issuance of the permit does not imply the approval of
any other permit required for construction pursuant to Pitkin County codes. No construction may be undertaken until all
approvals and permits have been obtained.
The Aspen/Pitkin Environmental Health Department, Pitkin County and employees of these agencies will be held harmless
should the individual sewage disposal system fail or malfunction. The permit to construct is issued on information submitted by
the applicant or his/her representatives. The owner assumes full responsibility in case of failure of the system.

NOTE: SEPTIC PERMIT APPLICATIONS CANNOT BE ACCEPTED UNTIL ALL OF THE
INFORMATION BELOW IS INCLUDED.
The soils test and system design must be done by a Registered Professional Engineer. You should plan
to meet with the RPE at your site to discuss where the soils tests should be done to meet all of the
County regulations and where you want to put your house. The RPE will be your contact for issues you
want to discuss about your system's size and location. Each box should be checked to indicate the
following have been submitted before the application can be accepted.
^ Environmental Health has been called to look at profile hole
^ Completed application form
^ Engineer design stamped by a RPE registered in the State of Colorado. (One set).
Design must be based on the Pitkin County ISDS Regulation, Revised 2001.
^ Site map must include locations of all existing and proposed wells within setback distances
(including on surrounding properties), contour intervals, all proposed and existing buildings,
property lines, ditches, slopes of greater than 15% in the area of the drain field, water lines,
sprinkler systems, springs, suction (irrigation) lines, drinking water cisterns, drain tiles, irrigation
ditches, lakes, ponds, water courses, streams, floodplains, floodways, dry gulches, or existing
/ septic systems. This must include all such features on neighboring properties within setbacks.

^ Proof of adequate water supply: (Well must be drilled before septic permit can be issued.):
For private wells, recent well driller's pump test showing gpm actually produced, well permit
showing legal supply. The minimum yield from the well or water storage shall be .07
gallons/minute/person which is 100 gallons/person/day. There must be storage or yield capable
of a 24-hour supply for domestic purposes only (not including fire protection or irrigation)
For community systems, proof there is adequate water for all houses served by the system.

charged beyond first six hours, up to $1,000. Tank only fee $110. Please make check payable

You must obtain written approval from Community Development before submitting this
application if your septic system is outside the building envelope and any part of the
system is more than 30" above grade.
A WAIVER IS AVAILABLE FOR SUBMITTING A BUILDING PERMIT APPLICATION PRIOR TO
OBTAINING AN INDIVIDUAL SEWAGE DISPOSAL SYSTEM PERMIT.

Note: Percolation test holes were hand dug in the bottom of backhoe pits and soaked on July
23, 2001. Percolation tests were conducted on July 24, 2001. The average percolation
rates were based on the last two readings of each test.

On June 14, 2002, High Country Engineering personnel observed the construction of the ISDS for
the Busk Residence, Tract 5, Seven Oaks Subdivision in Pitkin County, Colorado. One 2000-gallon
septic tank and 58 standard Infiltrator units had been installed in a trench configuration. The
Infiltrator unit placement has been changed from the original design to best fit the system into the
limited space provided, while still meeting all the required setbacks. These changes were discussed
with the engineer and the contractor prior to placement. 2 sheets of 6-mil plastic were used to line
the west side of the field to a depth of 24" to help meet the cut slope setback of 4 times the height of
the cut slope. No backfilling had taken place. The installation of the system is in conformance with
the intent of the design. If you have any questions, or need additional information, please contact

Subject: Subsoil Study for Foundation Design and Percolation Testing, Proposed
Residence, Tract 5, Seven Oaks Subdivision, Pitkin County, Colorado
Dear Mr. Busk:
As requested, Hepworth-Pawlak Geotechnical, Inc. performed a subsoil study and
conducted percolation testing for foundation and septic disposal designs at the subject
site. The study was conducted in general accordance with our agreement for
geotechnical engineering services to you dated July 16, 2001 which was expanded to
include foundation bearing conditions. The data obtained and our recommendations
based on the proposed construction and subsurface conditions encountered are presented
in this report. Evaluation of potential geologic hazards at the site is beyond the scope of
our study.
Proposed Construction: The proposed residence will be a single story wood frame
structure above a walkout lower level and located within the building envelope as shown
on Fig. 1. Ground floor will be slab-on-grade. Cut depths are expected to range
between about 3 to 10 feet. Foundation loadings for this type of construction are
assumed to be relatively light and typical of the proposed type of construction.
If building conditions or foundation loadings are significantly different from those
described above, we should be notified to re-evaluate the recommendations presented in
this report.
Site Conditions: The ground surface in the building area is moderately sloping with
about 15 feet of elevation difference across the building envelope. A small draw
roughly bisects the building azea and a deeply incised gully is located just to the north
and partly within the property as shown on Fig. 1. The steep valley side is located just
to the east of the property. The building area had been recently cleazed of vegetation
and the surrounding area consists of scrub oak.
Subsurface Conditions: The subsurface conditions at the site were evaluated by
excavating two exploratory pits and one profile pit at the approximate locations shown
on Fig. 1. The logs of the pits aze presented on Fig. 2. The subsoils were variable and
encountered about '/z foot of topsoil above loose to medium dense silty sand with rock

fragments to cobbles and small boulder size. At Pit 1, within the upper part of the
building area, weathered sandstone bedrock was encountered at 3 feet. The soils are
colluvial/debris fan deposits and would be expected to have hydrocompression
(settlement when wetted) potential. The laboratory test results are summarized in Table
I. No free water was observed in the pits at the time of excavation and the soils were
slightly moist.
Foundation Recommendations: Considering the subsurface conditions encountered in
the exploratory pits and the nature of the proposed construction, we recommend spread
footings placed on the undisturbed natural soil or bedrock and designed for an allowable
bearing pressure of 1,500 psf for support of the proposed residence. Footings placed
entirely of the underlying bedrock can be designed for an allowable bearing pressure of
4,000 psf. The upper soils are likely compressible when wetted under load and there
could be some post-construction differential foundation settlement especially between
soil and rock bearing areas. Footings should be a minimum width of 20 inches for
continuous walls and 2 feet for columns on the soils. Loose disturbed soils and rock
encountered at the foundation bearing level within the excavation should be removed
and the footing bearing level extended down to the undisturbed natural materials.
Exterior footings should be provided with adequate cover above their bearing elevations
for frost protection. Placement of footings at least 42 inches below the exterior grade is
typically used in this area. Continuous foundation walls should be reinforced top and
bottom to span local anomalies such as by assuming an unsupported length of at least 12
feet. Foundation walls acting as retaining structures should be designed to resist a
lateral earth pressure based on an equivalent fluid unit weight of at least 45 pcf for the
on-site granular soil as backfill.
Floor Slabs: The natural on-site soils, exclusive of topsoil, aze suitable to support
lightly loaded slab-on-grade construction. There could be some potential for differential
settlement if the subsoils become wetted. To reduce the effects of some differential
movement, floor slabs should be separated from all bearing walls and columns with
expansion joints which allow unrestrained vertical movement. Floor slab control joints
should be used to reduce damage due to shrinkage cracking. The requirements for joint
spacing and slab reinforcement should be established by the designer based on
experience and the intended slab use. A minimum 4 inch layer of free-draining gravel
should be placed beneath basement level slabs to facilitate drainage. This material
should consist of minus 2 inch aggregate with less than 50% passing the No. 4 sieve
and less than 2% passing the No. 200 sieve.

All fill materials for support of floor slabs should be compacted to at least 95 % of
maximum standard Proctor density at a moisture content near optimum. Required fill
can consist of the on-site soils devoid of vegetation, topsoil and oversized rock.
Underdrain System: Although free water was not encountered during our exploration,
it has been our experience in mountainous areas and where bedrock is shallow that local
perched groundwater can develop during times of heavy precipitation or seasonal
runoff. Frozen ground during spring runoff can create a perched condition. We
recommend below-grade construction, such as retaining walls and basement areas, be
protected from wetting and hydrostatic pressure buildup by an underdrain system.
The drains should consist of drainpipe placed in the bottom of the wall backfill
surrounded above the invert level with free-draining granular material. The drain
should be placed at least 1 foot below lowest adjacent finish grade and sloped at a
minimum 1 % to a suitable gravity outlet. Free-draining granular material used in the
underdrain system should contain less than 2% passing the No. 200 sieve, less than
50% passing the No. 4 sieve and have a maximum size of 2 inches. The drain gravel
backfill should be at least 11/z feet deep. An impervious membrane such as 30 mil PVC
should be placed beneath the drain gravel in a trough shape and attached to the
foundation wall with mastic to prevent wetting of the bearing soils. The impervious
membrane is not needed where the foundation beazs on the underlying bedrock.
Surface Drainage: The following drainage precautions should be observed during
construction and maintained at all times after the residence has been completed:
1) Inundation of the foundation excavations and underslab areas should be
avoided during construction.
2) Exterior backfill should be adjusted to near optimum moisture and
compacted to at least 95% of the maximum standazd Proctor density in
pavement and slab areas and to at least 90% of the maximum standard
Proctor density in landscape azeas. Free-draining wall backfill should be
capped with about 2 feet of the on-site, finer graded soils to reduce
surface water infiltration.
3) The ground surface surrounding the exterior of the building should be
sloped to drain away from the foundation in all directions. We
recommend a minimum slope of 12 inches in the first 10 feet in unpaved
areas and a minimum slope of 3 inches in the first 10 feet in pavement

and walkway areas. A swale will be needed uphill to direct surface
runoff around the residence.
4) Roof downspouts and drains should discharge well beyond the limits of
all backfill.
5) Landscaping which requires regular heavy irrigation should be located at
least 5 feet from the building. Consideration should be given to the use
of xeriscape to limit potential wetting of the hydrocompressive soils
below the foundation caused by irrigation.
Percolation Testing: Percolation tests were conducted on July 24, 2001 to evaluate the
feasibility of an infiltration septic disposal system at the site. One profile pit and three
percolation holes were dug at the locations shown on Fig. 1. The test holes (nominal 12
inch diameter by 12 inch deep) were hand dug at the bottom of shallow backhoe pits
and were soaked with water one day prior to testing. The soils exposed in the
percolation holes are similar to those exposed in the Profile Pit shown on Fig. 2 and
consist of silty sand and gravel soils with rock fragments to small boulder size. The
percolation test results are presented in Table II. Based on the subsurface conditions
encountered and the percolation test results, the tested area should be suitable for a
conventional infiltration septic disposal system. Pitkin County requires that the septic
system be designed by a professional engineer.
Limitations: This study has been conducted in accordance with generally accepted
geotechnical engineering principles and practices in this area at this time. We make no
wazranty either expressed or implied. The conclusions and recommendations submitted
in this report are based upon the data obtained from the exploratory pits excavated at the
locations indicated on Fig. 1 and to the depths shown on Fig. 2, the proposed type of
construction, and our experience in the area. Our findings include interpolation and
extrapolation of the subsurface conditions identified at the exploratory pits and
variations in the subsurface conditions may not become evident until excavation is
performed. If conditions encountered during construction appear different from those
described in this report, we should be notified at once so re-evaluation of the
recommendations may be made.
This report has been prepared for the exclusive use by our client for design purposes.
We are not responsible for technical interpretations by others of our information. As
the project evolves, we should provide continued consultation and field services during
construction to review and monitor the implementation of our recommendations, and to

changes may require additional analysis or modifications to the recommendations

COLORADO, FINDING A TAKING AND REMEDIATING THE TAKING FOR THE
LE BLANC 1041 HAZARD REVIEW AND GENERAL SUBMISSION

RECITALS
Nathan and Carol Le Blanc ("Applicants") have applied to the Pitkin County Hearing Officer for
1041 Hazard Review and General Submission.
2. The property is described as Tract 5 of Seven Oaks Subdivision and is located across the Crystal
River from the "BRB" in the Crystal River Valley.
3. The parcel is zoned RS-30 and contains approximately 1 acre.
4. The Hearing Officer denied the request at a duly noticed public hearing on January 16, 2001,
pursuant to Determination No. 1-2001.
The Applicant submitted a request for a takings determination pursuant to Sections 3-290, 4-150
and 5-220 of the Land Use Code on 7anuary 30, 2001, to determine whether the Hearing OtTicer's denial of
the application constitutes a taking of private property without just compensation.
6. The BOCC considered the takings request at a regular meeting on February 14, 2001, at which
time further evidence and testimony were presented with respect to the taking. The BOCC determined that
a taking had occurred pursuant to Sections 3-290' and 4-150 of the Code.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that the denial of the LeBlanc 1041
Hazard Review and Genera] Submission constitutes a taking pursuant Yo Sections 3-290 and 4-I50 of the
Pitkin County Land Use Code.
BE IT FURTHER RESOLVED by the BOCC that it does hereby remediate the taking by
granting approval, subject to the following conditions, which shall run with the land and be binding on all
successors in interest
1. The Applicant shall record a 24 X 36 inch mylar 1041 Hazard Review Site Plan in accordance
with Section 5-70-040 of the Land Use Code. The applicant shall depict anaccess/septic
envelope on the site plan to be approved by Community Development prior to recordation. The
site plan shall also be submitted in digital format for integration in to the County Geographic
Information System (GIS) prior to submission of a building permit or septic permit.
2. The Applicants shall obtain an access permit from the Pitkin County Engineer prior to building
permit submission
3. Any structure over 30" in height wifl~in the required setbacks shall receive Board of Adjustment
approval prior to building permit submission.
4. The Applicants shall comply with the fo0owing landscaping and wildfire defensible space mitigation
standards:
a. Brush, debris, and non-ornamental vegetation shall be removed within a minimum 20 foot
perimeter around the structure.
b. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a
mii>imum thirty-foot (30') perimeter around a structure built on flat ground.

c. For a distance of 15 feet around all structures, vegetation shall be maintained at 6 inches or less
in height
d. For a distance of 100 feet in every direction, shrubby material shall be thimted. Shrubs shall be
thinned so that clumps are no larger in diameter than 2 times the height.
e. Existing trees shall be thinned for a distance of 100 feet around the cabin. Tree crown separation
within this perimeter shall have a minimum of 30 feet between the edges of the crowns. All
branches from trees within this perimeter shall be pruned to a height of 10 feet above the ground
or half the total height of the tree, whichever is less.
f. All branches that extend over the roof eaves shall be trimmed and all branches within 15 feet of
the chimneys shall be removed.
g. Remove deadfall within 100 foot perimeter shall be removed.
h. The Applicant shall be responsible for the continued maintenance of the defensible space
requirements.
The Applicants shall comply with the following additional wildfire mitigation standards:
a. Roofs shall have a Class A, non-combustible roof system. Woad shakelshingle roof coverings
are prohibited m' all wildfue hazard areas. Roofs with less than a 3:12 pitch aze not permitted in
1041 Wildfire Areas unless they comply with the following:
i. All roof coverings shall be noncombustible materials as defined in the Uniform Building
Code (LJBC) 1997 Section 1504 and installed on a Class A roof assembly.
ii. All roof coverings shall have a surfice that shall facilitate the natural process of clearing
the roof.
iii. All roof designs shall facilitate the natural process of clearing roof debris. Protrusions
above the roofline, such as parapets, shall be prohibited.
iv. Roofs shall be installed as required by UBC 1997 Chapter 15 and shall have a minimum
slope of 1:48.
v. All roof designs, coverings, or equivalent assemblies shall be specifically approved by
the Fire Marshal prior to submittal of a building permit application.
b. Vents shall be screened with corrosive resistant wire mesh with mesh Y4 inch maximum.
c. Roofs and gutters shall be kept clear of debris.
d. Yards shall be kept clear of all litter, slash, and flammable debris.
e. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from .
any structure.
f. Firewood/wood piles shall be stacked on a parallel wntour a minimum of 15 feet away from the
structure.
g. Swimming pools or ponds shall be accessible to Fire Department vehicles.
h. Fences shall be kept clear of brush and debris.
i. Wood fences shall not connect to the structure.
j. Fuel tanks shall be installed underground with an approved container.
k. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the
structure with standard defensible space vegetation mitigation around any above-ground tank.
Any wood enclosure aoound the tank shall be constructed with materials approved for 2 hour fve-
resistive construction on the exterior side of the walls.
I. Each structure shall have a minimumof one 10 pound approved ABC fire extinguisher placed in
a visible and accessible location.
m. Addresses shall be cleazly marked with 2 inch non-combustible letters and shall bevisible and
installed on anon-combustible post.
6. The Applicants shall comply with the following wildlife mitigation standards:
a. Dogs shall be kenneled on the property
b. Fencing shall be prohibited outside the building envelope
c. Native vegetation shall be maintained outside the building envelope as long as it
complies with the wildfire mitigation standards listed above.
d. When existing vegetation must be altered for access or utility purposes, the Applicant
shall cooperate with the County and the Colorado Division of Wildlife to devise a
vegetation compensation plan.
e. The Applicant shall install bear proof trash containers as approved by the Pitkin County
Wildlife Biologist prior to certificate of occupancy.
f. FruiC bearing trees shall not be planted on the property.
g. Landscaping shall include vegetational screening on the east side of the building
envelope to minimize the effects of increased human activity on wintering animals.
h. An orange safety fence shall be required around the building envelope to prevent
unnecessary vegetation disturbance during construction.

property.

8. The gully on the north side of the building envelope shall be kept clear of debris.
9. Pursuant to Ordinance No. 022-2000, the Applicant is subject to the Fair Share Requirements and
shall pay a road impact fee as calculated at the same time as building permit-issuance.
10. Floor area exempt from growth management shall be limited to 5,750 square feet. Floor area shall
be calculated based on the definition in effect at the time of building permit submittal.
11. The Apphcants shall adhere to all material representations made in the application or in public
meetings or hearings and shall consider those representations to be conditions of approval, unless
amended by other conditions.
12. This approval and takings remediation shall be valid for one year from this date and thereafter
any development on the property must comply with these conditions and any subsequent changes
to the County Land Use Regulations.

This letter is concerning a property locnted in tract 12,
SW quarter, WK quarter of aactioa 34, township 8 south, rang 88 vent,
Seren 8akr Subdivision, presently owned by r9r. Kenneth `Relaon. At the
request of Terry Sortie, a member of this department Baited the above
mentioned property for the purposae of an inspection of the water and
savage disposal systems.
;`he water supply to the dwelling is from the Seven Oaks
water system, which has been inspected, and the water sampled. Ths water
is sampled on a monthly basis, and the swat recent sample, taken on llecember
6, 19TL, was reported as safe.
A chacY. of the area in which the sewage disposal system is
locnted was made, and no evidence of malfunction of that system xes found.
However, it should be noted that the duelling had been vacates for about
two and s half months prior to the inspection.

your office stating that the well and septic tank meet
FHA specifications. The home was built in 1969 and the
original owner's name was Dennis Long. The property was
recorded on November 14, 1969 in Pitkin County. The legal
description of the land is as follows: a tract of land
being tract ~~12, situated in the N.G,7. quarter, N.E. quarter
of section 34, township 8, so. range 88, west of the 6th
n.m. line westerly of westerly right of way line of 20 foot
roadway. The seller is Kenneth Melson, 925-6193, and he
has indicated he caould be willing to accompany you to the
house. Enclosed is $25.00, a decree of the water rights
(which you may or may not need), and a picture of the home.
