This memo is intended to give some background information on existing infrastructure and buildings on
the property and what limitations may exist, as well as to provide thoughts about future planning.

Permits and documentation:
Permit 80009 was repaired in 1980 consists of a 1000 gallon tank that serves units 7&8 and another
1000 gallon tank that serves Lot 11 and runs into a 25' x 60' absorption area located about 300' from the
residences. The permit indicates approval for 3+1+1 bedrooms (although we know unit 8 added a
bedroom in 1987 and this department signed off at that time).
Permit 79081 was repaired in 1979 and serves units 9 & 10. The existing 1000 gallon tank and drywell
remained in service and an additional 540 square feet of absorption area was added (10'64') adjacent
to the residence on lot 11. This permit indicates approval for the system to serve 3 bedrooms.
Permit 76048 was an original permit for systems that serve the new residential duplexes. Units 1&2 are
served by one 1250 gallon tank and a 10'x80' absorption area. Units 3&4 and units 5&6 have the exact
same size system components serving each. All tanks are adjacent to the units and all absorption areas
are located near units 1&2. The permit indicates approval for 12 total bedrooms, so one could assume 2
bedrooms in each unit, since each duplex is served by separate systems.
There is another old document, presumably from the early 1970s, from K R Whittlesey that indicates the
position of the exiting septic in front of what we could assume are units 7&8 and 9&10. It appears that
some of that system remains in use while other components of that system were removed.
In 1980 when Resolution 80-37 was approved, this department wrote a memo citing a letter from the
Sopris Creek Cabins Homeowners Association showing intent of the HOA to maintain all of the systems
every two years. It also states that the declarations and covenants of the subdivision include any
common area to be available for individual sewage disposal systems (ISDSs).
Maintenance:
It is recommended that the tanks not only be pumped, but checked for integrity all system compontens
be evaluated through an inspection process similar to that required when obtaining a "OWTS Use
Permit" to assure all tees are on the tanks properly and it is recommended that effluent filters be
installed on the outlet tees to assure no solids are traveling to the fields.
The areas above the absorption fields should be protected. There should be no additional irrigation, no
heavy equipment, and no large animals grazing over the area. Ideally, the areas should be fenced to
assure there is no additional compaction. Native grasses and vegetation is preferred for effective
evapotranspiration in the field areas.
Looking ahead:
Many of these systems are aging and it is important to look forward so as systems fail or additional
development is requested, any system addition or repairs can be efficient and compliant with current
regulation. Many of the system components on the property are not clustered in a method that is
consistent with current regulation. In addition, many of the system components may not meet current
setback standards to the well on your property or water courses (Sopris Creek). A "master plan" should
be developed so as system repair and replacement is necessary, this plan can be implemented. A septic
system designer should be consulted so a design can be developed that is in compliance with Pitkin
County's Onsite Wastewater Treatment System Regulation (6.28) and the Colorado Department of
Public Health and Environment's WQSA-6.
Water.
Well permit 43200 was issued in 1970. This permit was recently clarified by the Colorado Division of
Water Resources. "Central System serving Sopris Creek Cabins (1 units), see SEOSB-35 comment.
Location clarification & ownership verification needed. Limit historic use prior May 8, 1972."
These comments indicate that more work should be done with the Division of Water Resources to
assure all legal issues with this well are resolved. The comments also indicate that the structures
"legally" served by this well were inexistence prior to 1972. Duplexes 1&2, 3&4, and 5&6 were all
constructed after 1972 and presumably are not legally served by this well.
Building/Planning/Zoning:
There can be no increase of bedrooms until the septic systems are appropriately sized and located.
The pre -1972 units could expand number of bedrooms or other areas requiring increased water usage if
the septic systems were appropriately sized and located.
The post- 1972 units will not be able to do any expansions of areas requiring increased water usage until
appropriate legal water system is established and approved by the Colorado Division of Water
Resources and septic systems are appropriately sized and located.
All the duplexes are "existing nonconforming uses" and any expansions /additions would require
approval by the BOCC through a public hearing process per Land Use Code Section 9-50-30. Given the
lot sizes, presumably setback variances would also be required.

C — I looked at the documents you left me (put back on your chair) & do not see anything in here that clearly
demonstrates proof of adequate legal water supply for this whole Sopris Creek Cabin subdivision. (And what Lot are we
talking about? Our ancient file seems to cover multiple Parcels).
I spoke to Lance and he said Suzanne is also in discussions with Michael Ernemann about this property. The Planning
file(s) may have more info in them than what we were given, and I'm fairly sure there's more recorded w/the C&R's
Office — but it is still up to the applicant to make his/her case (not for us to do the research).
It sort of looks like there is an old, existing well out there on Lot 11 (in production as of 5-22-71) that would not have
required a well permit (based on pumping and its use) if it had satisfied the 3 single-family dwelling requirement. This
could explain why Ernemann told you there was no well permit on file with the State. However, the Div. of Water
Resources noted in the documents we have that the existing well did not satisfy the 3 single-family dwelling requirement
--- and it does looks like they just went on using this well for multiple dwellings.
It also looks like there were steps being taken back in the late 70s/early 80s to get a well permit to accommodate the
multiple dwelling use that required a water supply plan/augmentation — but there is no indication where that whole
process went.
You also said Ernemann was thinking of drilling a well but was concerned about timing (up to 2 yrs) due to the need for
augmentation & that there was some "change in boundaries" that had occurred (different from what he had been told
at some point in the past). I am guessing that he may be referring to the Basalt Water Conservancy District's (BWCD)
two different water service areas and that this development is located in "Area B" --- which does require BWCD
substitute water supply plan contractees to get individual augmentation plans, approved by the Water Court, up -front.
May be time for someone to consult w/a water attorney....
