Restivo's intended use of composting toilet in cabin project. Dear Ms. MacKenzie, I own a business concerned with re -selling renewable energy products. A customer we are working with, Chuck Restivo, asked me to write a letter con- firming that his intended use of the Biolet composting toilet he is intending to use in his cabin project is without reservation appropriate with the toilet's design and capabilities. Chuck mentioned the intends to rinse his hands, face, etc. while making use of the cabin and we have experimented and learned this amount of liquid to be approximately one (1) to three (3) pints per day. This volume of liquid, in addition to use of the composting toilet for its intended usage, would be well under the manufacturer's rating for liquid capacity. Please keep in -mind, this is a large capacity toilet intended for six (6) people with full-time usage requirements. This toilet has a forty -percent (40%) larger composting chamber is vented by a small. solar fan, all within an attractive body of durable, polished ABS plas- tic. This model has been tested and approved by the National Sanitation and was proven to be the safest composting toilet on the market and exceeded all requirements by a wide margin. Its design has been voted the most user- friendly of all high capacity composting toilets. With a seat height of 19.5", it is very comfortable to use (it has no awkward footstool). The toilet is an on-site, self contained, biological toilet, where human waste (feces, urine) and toilet paper are collected, excess liquid is evaporated and solid material is decomposed to a soil -like, hygienically safe product (humus) without producing an unpleasant odor. It is designed to maintain a warm and humid environment inside the unit, encouraging biological degradation of the waste through scav- enging action of the aerobes. Within a relatively short period of time, human waste and toilet paper are efficiently transformed into a small amount of fertile compost. The toilet reduces the volume of the waste entering the toilet by approximately 95%, leaving only 5% of an end -product, which can be recycled back to nature in a safe way, and without polluting the environment. This model is tested and approved under NSF -Standard 41, for residential use by a family of four to six and is designed to handle occasional overloads. This testing was performed in three shallow holes excavated with a backhoe, to a depth i ifthiny-four inches and completed by digging a smaller hole in the bottom of each backhoe excavation with hand tools. The total depth of the percolation holes ranged between forty-five and font -nine inches. Before the test, the sidewalls were strapped, and four inches of gravel were placed in each rest hole.. Chuck Restivo and Leslie Strawbridge, hereinafter "Applicants", have applied to the Board of County Commissioners of Pitkin County, Colorado, hereinafter "Board", for approval of the construction of a single family residence, pursuant to the Pitkin County Land Use Code. 2. The Applicant's lot is zoned RS -30 and is approximately 38 acres in size. 3. Said lot is described as Parcel 6 of the west Sopris Creek Subdivision (formerly Terliamis Tracts), more specifically described in Exhibit A, attached. 4. The Pitkin County Planning and Zoning Commission reviewed this application on February 7, 1995 and has forwarded a recommendation of denial to the Board, based on severe wildfire hazard on t)ie.subjW;t property. S. The Board heard this application at a regularly scheduled meeting on June 14, 1995, at which time evidence and testimony was presented with respect to this application. 6. The Board determined that the proposed development does I not meet the criteria established in Section 3-807 (A)(1&2) of the Land Use Code. The Board determined that the previous denial does constitute a regulatory taking as defined in the Pitkin County Land Use Code. In order to avoid this situation, the Board resolved that the Applicant will be granted an approval to build a single-family residence on the subject property, provided the existing subdivision roads are improved to a standard acceptable to the County Engineer and the Applicant complies with all other required conditions of approval in this document. Fuel tanks shall be installed underground with an approved container. k. Regarding vegetation: 1) All vegetation shall be removed within 10 feet of the structure. This area should be maintained in the future as low ground cover (to a height not more than 6 inches). 2) Vegetation shall be thinned within a minimum of 100 feet around the structure, with a minimum of 20 feet crown separation between clumps of oak/serviceberry. Remaining clumps shall not have an aggregate crown diameter in excess *of 20 feet. Dead limbs and ladder fuels that could carry fire into the crowns of the brush shall be eliminated. Slash shall be properly disposed of by chipping, hauling away, or piling and burning during a safe time period. 3) Maintenance of the "defensible space" shall be required in order to retain it's value as wildfire m�tigatioA. Oak and serviceberry tend to sprout vigorously after cutting, so it will be necessary to trim back vegetation every year or two. 4) Removal of natural vegetation within the building envelope shall be kept to a minimum, based on the recommendations of the Division of Wildlife. 1.'
