A question has coarse up about the sewer system on the property I owned on West Sopris Creek.
(Marty Mylott owns it now).
Lamont Kinkaid'was the Pitkin County inspector who ran the perk test, checked out my work and
passed the system Since I had tom down a large cinder block building, I had plenty of blocks to make a
1500 gallon septic tank. I made it twice as large as required as I had hoped to someday convert the house
to a duplex For the bottom of the tank, I poured concrete, the walls were blocks filled with concrete and
sealed with tar. I then poured the top ;with concrete leaving an outlet to pump if necessary.
The drywell is either 18 or 20 feet deep. It was as deep as a large backhoe could reach. It was
about 10 feet in diameter, on the bottom and coned up with washed gravel on the outside. I poured a
concrete capon it so to be safe. The reason it was so big was I was trying to use up all the blocks.
Kinkaid said great!
I gave all my records to Dick Osmond when he and his brother bought the property from me.
I started the house in around 1965. Pitkin County did not have building permits for the Sopris
Creek area, only septic and electrical if I remember correctly.
Kinkade advisedne with the building process of the house. He had more knowledge than I and
he really helped me out

The Aspen/Pitkin Environmental Health Department has reviewed the details of the Mylott
application under the authority of the Pitkin County Land Use Code and has the following
comments.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
"It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection
and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if service
is available.'
We assume the application is to replace the existing small house with a new house. The applicant
presently has a house on the site and we have no reason to assume the water is less than
•adequate, so we assume it will adequately serve the new house. If the existing house is to remain,
the applicant should provide documentation that the well provides sufficient water, and there are
legal rights, to serve both houses.
SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: "It is the policy of the County to
ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal
systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System
Regulation.*
Lots in the area are served by individual septic systems. The applicant has indicated that the
existing septic system is inadequate for the new house and a new system will be installed. We
have no record of a permit for this lot, and nearby systems are quite old, and it is likely that this
system could not be expanded and would have to be replaced in any case. In order to know if a
septic system can be designed for the new house, it is necessary to know the size of the house
and number of rooms. The lot has a number of features which will make it more difficult to place a
septic system and meet required setbacks. These include the pond and the two ditches, well, well
building, and water faucet, as well as the irrigation and water lines. Given the small size of the lot
and these features, a large house may not be possible on this lot. As an example, a 3000 sq. ft.
house with four bedrooms would have to have its septic system 132 ft. from any wells and 82 ft.
from ditches.
WATER QUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710:

'It is the policy of the County to preserve and protect its present water resources. To this end it is the policy of the County that no land use be
initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of
established water -dependent agricultural activities; or which would result in increased salinizalion of water resources, loss of minimum stream
flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also the policy of the
County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon
by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by
meadows and wetlands.'
The Environmental Health Department will be addressing water quality impacts on down stream
water quality. This application is not expected to impact down stream water quality if the minimum
horizontal distances between components of the system and physical features are in accordance
with the Pitkin County Sewage Regulations. However, on this lot, with the presence of ditches,
wells, ponds, and irrigation lines, extra caution will be required to ensure no water contamination
occurs.
The Environmental Health Department is charged with preserving and protecting the quality of
Pitkin County's water resources. Since a large percentage of the population is dependent upon
water from wells, elimination of groundwater pollution, and protection of aquifers and their
drainage areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of
water discharge which can contaminate water supplies. This Department recommends that
nonpoint sources of discharge be retained on the property of origin which can be accomplished
through landscaping, drainage patterns, detention ponds, and dry wells for water runoff from
buildings.
AIR QUALITY: Sections 2-13 and 3-602:
•'only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County. Developments may not
constitute an indirect or direct air pollution source under Federal, State or County regulations.'
This project is not expected to contribute significantly to degradation of air quality in Pitkin County.
FUGITIVE DUST
Activities such as road building and landscaping require a Fugitive Dust Plan. This plan would
need to include, but is not limited to, fencing, watering of haul roads and disturbed areas, daily
cleaning of adjacent paved roads to remove mud that has been carried out, speed limits, or other
measures necessary to prevent windblown dust from crossing the property line or causing a
nuisance.
A condition should be approval by the Aspen/Pitkin Environmental Health
Department of the fugitive dust control plan, containing enough measures to ensure
that dust does not become a nuisance or blow onto adjacent property.
FIREPLACE
The applicant must file a fireplace/woodstove permit with the Environmental Health Department
before the building permit will be issued. The less densely populated parts of the county like this
site may have two devices per building: a maximum of one wood burning fireplace and a second
device which can be either a gas log fireplace or a certified woodstove. In addition, unlimited

numbers of decorative gas appliances are allowed. Coal may not be burned in any device. No
wood burning device may be installed in barns or agricultural buildings.
A condition of approval for this application is the receipt and approval of the
fireplace/woodstove permit by the Environmental Health Department before the
building permit can be issued.

DETERMINATION OF THE HEARING OFFICER OF THE COMMUNITY DEVELOPMENT
DEPARTMENT OF PITKIN COUNTY, COLORADO, REGARDING
THE MYLOTT 1041 HAZARD REVIEW AND CONCEPTUAL
1. Martin and Maureen Mylott, hereafter "Applicants", have applied to the Pitkin County Hearing
Officer, hereafter "Hearing Officer", for a 1041 Hazard Review and Conceptual Submission to
establish a building envelope for replacement of an existing residence with a new single-family
residence.
2. The property is located at 034 West Sopris Creek Road and is specifically described in Exhibit
A.
3. The property is zoned RS-30/PUD and contains approximately 3.43 acres.
4. The Hearing Officer heard this application at a public hearing on May 27, 1998 at which time
evidence and testimony were presented with respect to this application.
NOW THEREFORE, BE IT RESOLVED by the Pitkin County Hearing Officer that
• approval is hereby granted to the Mylot 1041 Hazard Review and Conceptual Submission, subject to
the following conditions:
1. Prior to the issuance of a building permit, the Applicants shall submit an amended 1041 site
plan to the Community Development Department for approval and recording. The final site
plan shall include the follows:
A. The site plan shall be identified as "Mylott 1041 Hazard Review."
B. The building envelope shall be delineated on the site plan. The setbacks for the building
envelope shall include a 50 foot front yard setback, a 30 foot side yard setback, and a 30
foot rear yard setback. The corral and barn on northeast comer of the property shall be
eliminated.
C. A vicinity map shall be included on the face of the site plan.
D. The appropriate signature blocks shall be included on the face of the site plan.
E. The site plan shall identify the 100 year flood plain for West Sopris Creek. All structures
shall be located outside of the 100 -year floodplain.
F. The following 1041 Hazard Review warning and disclaimer shall be placed on the site
plan:
"The provisions of these regulations do not in any way assure or imply that areas outside
of the designated hazard area will be free from hazards, or that approved mitigation
measures will guarantee the safety of any property. "
0 2. The Applicant shall implement the following measures to mitigate impacts to wildlife:

A. All fencing shall comply with the amended Pitkin County fencing standards.
B. All garbage shall be kept within bear -proof garbage containers.
C. All haystacks shall be fenced with 8 -foot mesh fencing to prevent game damage.
D. There shall be a limit of one dog on the property. If a dog is to reside on the property, a
kennel shall be constructed prior to the issuance of a Certificate of Occupancy.
No development, including grading, landscaping, vegetation removal or disturbance, shall
occur outside of the approved building envelope, except for utility and driveway extension
and maintenance.
4. All of the structures shall incorporate landscaping with wildfire defensible space
considerations.
5. A fireplace/woodstove application must be filed and approved by the Environmental Health
Department prior to the issuance of a building permit.
6. Prior to the issuance of a septic permit, documentation shall be provided to the
Environmental Health Department regarding the quantity and quality of the well water on the
site and the legal rights to the shared well.
7. Prior to the issuance of a building permit, a septic permit shall be obtained by the
Environmental Health Department. The septic system must be located within the building
envelope. The system shall comply with the County's septic regulations and be designed by
• a registered professional engineer.
8. Prior to building permit, the Applicant shall submit a Fugitive Dust Plan to the Environmental
Health Department. The plan shall include measures to ensure that dust does not become a
nuisance and blow onto adjacent properties.
9. For any free market residential structure of 5,000 gross square feet or greater, the applicant
shall comply with Section 4.01.01(B) of the Pitkin County Road Management and
Maintenance Plan, which requires the applicant to provide construction trip and residential
trip generation studies. The applicant shall comply with this provision as it is in effect at the
time of building permit issuance to the satisfaction of the County Engineer.
10. Prior to Certificate of Occupancy for the new residence, the existing residence shall be
demolished.
11. All material representations made by the applicants in the application or in public meeting
shall be adhered to and considered conditions of approval, unless amended by other
conditions.
