Your complaint for 1252 E. Sopris Creek has been referred to me for follow up. I have attached a
previous e-mail from Carrington Brown to you, in case you did not receive it. As noted, the
monitoring and enforcement of water wells for individual homes is carried out by the State of
Colorado, not by individual cities or counties. We do not have jurisdiction over them. The office of
Water Resources in Glenwood Springs should be able to answer any questions you have regarding the
well and steps you need to take as a renter to get the problem resolved, 945.5665.
In terms of the possible zoning violation, we show the property as a legal duplex. If there is a third
rental unit, please describe the rental units as described below and we will follow up.
I hope this information is helpful. If you have further questions, please contact me and I will try my
best to answer your questions or direct you to those who might.

We feel the first & biggest issue is the potential zoning violation.
Next would come a potential Building Dept issue of remodeling without a permit and in
violation of building code standards.
At the point of EH being a referal for the building permit, we would evaluate the sizing
of the septic system. If the building has to be brought back to the original 'duplex' we
would request that the components of the system be evaluated to be sure that it is still
functiong as designed.
As part of the this review, we require information on the water source. We would need to
know the water source and will need to see a well permit. The permit would indicate what
building(s)/properties can be served by the well.
I suggest that we be sure to keep good documentation on this one, which we do on all!
So keep me updated on the status of this one.

Sounds like they have sulphur in the water and that area does have lots of sulphur in the
well water. We do not regulate the water quality of private homes.
We also do not regulate well permits. Recently we have required a copy of the well permit
with our septic permit applications, but the house is pre -1970. Well permits state the

legal uses of the well. Thao regulated by the Colorado WA Resources Division,
945-5665.
Our septic files show we have a REPAIR permit issued in 1989 for four bedroom and not on
the 'uses', though the building is identified as a 'duplex'on our permit. We don't go
into houses to count bedrooms, it sounds like it should be handled as a zoning violation
since we have no record of complaints on the septic system not functioning properly. The
complaint on the septic is very vague,we would need more detail to do any type of
investigation.

I am forwarding this complaint to you as it sounds like it is an Environmental Health
issue. The building was approved to be a duplex by Com. Dev.some years ago and therefore
not a zoning violation. Joanna was involved in the decision I believe.
Please let me know if and how you will proceed and I will tell Peckat it is not a zoning
issue.

codes. It has been two years scence I have lived on the property and spoken with John B.
Richards. Now the guy had me served five days ago for the amount of 3,444.00. The amount
adds up for two months of rent that I did not pay for, for the reasons of breach of
covenant of habitability and breach of covenant of quiet. While I lived at the property
the water became contaminated with a brownish yellowish color and sewage smell for two
months. So we could not drink or shower in the water for two months and in the housing
contract he was responsible for water. All he did was pour bleach in two the water tank.
We had to buy our own water and shower at friend and relatives. John B. Richards has
taken a single family home and made it into a double occupied housing unit. It is being
rented out as a triplex. The house had a basement that he has been changed into a housing
quarter with two bedrooms, kitchen, full bathroom and a living room with a very low
structural beam running threw the house that you have to duck under when you walk from the
kitchen to the living room. The septic system is not set up properly or leeching properly
for the way he is using thelloperty. He doesn't even have As own water source for the
property he is taking the water from somebody else well on a totally different property.
The water from the well then pumps into a water tank than then feeds the housing unit.
John Richards is reporting the property as a single family to you guys and to his
insurance and to the I.R.S.
