FOR THE FILMING OF THE FOOD NETWORK'S HOLIDAY SPECIAL IN ASPEN WITH
GIADA DE LAURENTIIS

RECITALS
1. Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ("Director") may approve a Temporary
Commercial Use/Special Event Permit for commercial activities or special events.
2. Citizen Pictures (hereafter, the "Applicant") has applied to the Director for approval of a
Temporary Commercial Use/Special Event Permit to film the Food Network's Holiday Special in
Aspen with Giada De Laurentiis at a private residence at 3768 Snowmass Creek Rd and other
various locations from March 7, 2010 to March 14, 2010 as necessary. The cast and crew
consist of approximately 10- 15 people.
3. County Risk Management has received and approved a Certificate of Insurance covering this
event and naming the County as an Additional Insured.
4. Aspen Skiing Company has approved filming at Snowmass Mountain. Filming at the Snowmass
ski area requires a US Forest Service permit. The City of Aspen has also issued a permit for
filming at locations within their jurisdiction.
5. The Director finds that, to the extent applicable, the application complies with the standards in
Subsection 4-30-50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit
for Food Network's Holiday in Aspen with Giada De Laurentiis, subject to Applicant's compliance with
each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in connection with, the
application.
2. No emergency access to any location shall be blocked
3. Parking shall be on private property only. No parking shall take place on County roads.
4. The Applicant shall apply for and obtain a US Forest Service Temporary Special Use Permit prior
to the start deadline.
5. The Applicant shall apply for and obtain a Temporary Special Use Permit from the City of Aspen
prior to the start deadline.
6. Failure to comply with the conditions of approval may result in revocation of this permit.

REQUEST: The Applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit in order to film the Food Network Giada at Home, Aspen Christmas Special.
The shoot will take place 03/07/10 through 03/14/10. Filming will involve 10-15 people -
Giada, her family, and a few crew members, the cameraman and will be in various
locations within the City of Aspen, Pitkin County ,Basalt and the Snowmass Ski Area. The
primary location within Pitkin County is:
- A Private Residence on Snowmass Creek Rd
APPLICANT: Citizen Pictures (thereafter, "Applicant').
REPRESENTATIVE: Jenna Reynolds
LOCATIONS: A private residence at 3768 Snowmass Creek Rd; PID #2645-111-01-002.
BACKGROUND: This is a shoot for the Food Network. It is an Aspen Christmas Special,
Giada at Home. Citizen Pictures will film Giada De Laurentis in various locations, primarily
cooking and enjoying "Holiday activities" with her family. They will also film at the Roaring
Fork Club. In addRion they will be filming at various locations within the City of Aspen and
also at Snowmass Ski Resort. Filming will take place from March 7"' through March 14"'. A
crew of 10-15 people will be involved; additional family members and local area children
may be involved. The Applicant is also obtaining permits for the USFS to shoot at
Snowmass and from the City of Aspen in order to shoot in town.
REFERRAL COMMENTS: The Application was referred to the following agencies: Aspen
Skiing Company, Pitkin County Sheriffs Department (Tom Grady), USFS, Emergency
Management (Ellen Anderson), Basalt 8 Rural Fire Department and the Snowmass/Capitol
Caucus.
The Aspen Skiing Company confirmed that filming was to take place in Snowmass and
provided written permission. The USFS issued a permit for this portion of filming as it takes
place on Forest lands.
Ellen Anderson approved the application and confirmed that insurance is in place for any
emergencies. The County has been named as a Certficate Holder/Additional Insured.
Bill Harding appreciated the notice and the Snowmass/Capitol Caucus also approved.

STAFF COMMENTS:
Pursuant to Subsection 3-200-030 of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must confonn to applicable building codes and other
County regulations. Each of these requirements is addressed, in tum, below.
Police Suaervision: N/A
Public Parkino: The 10-15 person film crew will use a private, insured vehicle to access
the various locations. Applicant shall adhere to all rules and regulations for parking.
Insurance: Applicant has provided adequate proof of insurance.
Site Set-Ua. Maintenance and Clean-Ua: Outdoor set-up is minimal for this type of
event. The Applicant will provide set-up, maintenance and clean up, including trash
removal from the site.
Emergencv Services: Applicant has provided a plan for dealing with emergencies during
the shoot. This includes 911 services.
Safety of Oaerations: A first aid kit and fire extinguisher shall be available on site.
Conformance with Building Code: N/A
RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use/Special Event Pennit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.

PITKIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT
AGREEMENT FOR PAYMENT OF LAND USE~~APPLICATION FEES
PITKIN COUNTY (hereinafter "COUNTY") and ~ ~( ~'~ Cl ~-lry~~
(hereinafter "APPLICANT") AGREE AS FOLLOWS:
1. APPLICANT has submitted to COUNTY an application for ~ (~_~
(hereinafter, the "PROJECT").
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 30-2009 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the COUNTY'S policy that
development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be
consistent and fair to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
PROJECT, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ lna~ which is based on2~hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20%, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

Hi Jenna
The address is located in Pitkin County, so you will be required to obtain a permit from us. I have attached apre-application
summary which outlines the fee and the additional requirement needed.
Let me know as well on the approximate locations (if any) you will be using for outdoor shots. You may be required to obtain a
permit from our Open Space & Trails department depending on certain locations.
In the meantime, I will need some additional items from you, ASAP, in order to continue on with the permit process:
~,1. A check for permit fee, $624 made out to Pitkin County Treasurer. Unfortunately we are not able to process credit cards at
this time.
~. An Executed Agreement for Payment form. A copy is provided as the last page of the above attachment.
~3. A consent letter from Fred Feitshans (the registered owner of the parcel for the 3768 Snowmass Creek Rd).
~4. The Certificate of Insurance with Pitkin County listed as an additional insured (our name should appear in the box at the
bottom left hand box).
Prior to permit issuance, I will need consent letters from Ski Co for the area you will be using. I will also need copies of any
additional permits (USES, OS&T, etc) you are required to obtain.
I will go ahead and forward the electronic application (thank you for the copy & send) out to the County referral agencies to begin the
permitting process. Please let me know ASAP what mountain you will be using.

Yes, I already touched base with Snowmass as well, the website was a little confusing and honestly some of the officials I have
talked to haven't been able to figure it out either :)
I am aware of the permitting for the mountain... Like I said as soon as I find out where our host wants to ski, I will go through the
proper channels.
The private home we are filming at is
3768 Snowmass Creek Rd.
Snowmass, CO
The Snowmass Village folks said that was old Snowmass and probably not their jurisdiction, they also didn't even know if I would
have to permit it. So I am thinking it might be Pitkin County's area... Maybe you can help me pinpoint it.

Although the system doesn't allow you to send the application out simultaneously, it does allow you to copy the first submitted
application and re-send it to other jurisdictions. Although we all use the same system, we don't really work with each other, so it's
unlikely that the City would notify us or Snowmass Village. You may want to call Snowmass if you haven't already done so. I don't
know what they require; here in the County we do require a permit even if flming in private homes. Just to let you know you may
also need a pennit from the USFS depending on where on each mountain you are filming (SkiCo should be able to help you
determine if you are on private or forest land. If you think you will filming outside the City or outside TOSV (long range scenic
views, etc.) we should probably have you do a permit with us.

I left you a voicemail too! Just an FYI... The website only allows me to submit the permit to one jurisdiction so I just sent it to
City of Aspen... You cannot submit it to all three so I am glad you found it somehow :)
Also... I am not sure which ski resort our host wants to ski at, but when I do, I will let you know ASAP and add that to the permit.
I am in touch with Aspen Ski Company.
And... If we are shooting at a private home in Snowmass, do you need a permit? Some cities you do, some cities you don't.

Hello All
A representative for the Food Network has contacted Pitkin County to obtain a Temporary Commercial Permit in
order to f Im footage of a visit here in the Aspen Area. They have included at least two locations which fall under
County jurisdiction for permitting: A private residence located at 3768 Snowmass Creek Rd. and the Roaring
Fork Club located at 100 Arbany Ranch Rd. They will also be filming at one of the Mountains in the area (location
still to be determined) and have been in contact with Ski Co.
In addition to obtaining specific approvals in order to film from each property owner, the Applicant must obtain a
'permit' from the County. We routinely refer these applications to the appropriate party for any comments,
questions, or conditions to be included in the County approval permit. The Applicant has indicated filming will
start on March 8th and run through March 13th. It will be a total of 12-15 people total and very low key.
If you have any comments, questions, etc I ask that you have them to me no later than Noon on Thursday
March 4th. You are free to contact the applicant directly with questions or you can send them to me and I will
forward them on.

Event Summary: We have a film crew of 10 people. We will be taking a passenger
van and one box truck with us to various locations. We will be staying at a hotel in
the city of Aspen. We will be shooting mostly at a private home in Aspen, but when
we shoot in town (Hotel Jerome and ski area) the areas will be open to the public.
We do not have volunteers, security or vendors. We shoot with two hand held
cameras and a few lights that do require regular house power.

Communication Plan: Staff - we are a crew of less than ten so we are always
together. I can email the staff list when it is completed prior to 3/5.
Emergency - we would use the local hospital (urgent care center) for any
emergencies.
Public Information - we will post filming in progress posters at the public locations
(the hotel jerome and the ski slopes). we do not put anyone on camera who does not
wish to be on camera.

Security Plan: We will not have a security person. We are a small film crew of 10

be using public parking. We only have two vehicles.

home, we will also recycle and throw our trash away at this home.
We will not be using portable toilets, but public restrooms at the ski area and at the
Hotel Jerome.

Food Permit: Giada will be making food at her family's private home, but there
will be no food sales or distribution.
The local kids will be decorating and eating cookies (for free) at the Hotel Jerome

We are so excited to feature Aspen in our holiday special for the Food Network! Attached is our proof of
insurance for City of Aspen and Pitkin County.
This schedule is still in its rough form... So I will update it if anything changes (that could very well be). I will be
in touch with both of you as often as I can be! Cari Anne, I don't know if this affects our payment??
Here's a look at the schedule.
3/6 -Director/Camera man Dan Fox arrives in Aspen (he may shoot a couple scenics of town that night, he is
solo).
3/7 -Rest of Crew arrives in Aspen (there are 10 of us total). We are just going to check out town. Dan may
shoot a couple more scenics in town.
3/8 - We will be at GDL's family home in Snowmass setting up the kitchen she is cooking in (we are not shooting
this day)

This looks pretty straightforward to me.
I noticed that the applicant said they would be using local hospital for emergencies, and that they had
liability insurance. I just want to make sure they are 100% covered for any possible medical issues,
including ambulance.
They did not request any traffic control services for the Jerome event. I'm wondering if Aspen Police
has any input on this, based on their experience with similar events.
Other than that, if the Jerome and ski areas are OK with them using their restrooms and trash facilities, it
looks good to me.

Hello Ellen,
The event at the Jerome is a hotel cookie decorating event in the dining hall from 3-6p on the 11th. We have
two handheld cameras and we will be capturing Giada and her daughter making cookies. We have also asked
the country day school to walk over with 20 students max (accompanied by teachers) from the school at 3p to
join us. I don't think this would cause any traffic problems as there really are no additional vehicles and
everyone is indoors. (our entire crew is staying at the Jerome and they are shuttled around in a passenger van).
The Jerome is okay with us using their bathrooms and the crew is only 3 people total for the skiing shoot so I
think public restrooms will work, III check with Melissa over at Aspen Ski Company, but we are only thereon the
slopes for about an hour hour and 1/2... We may not even go to the bathroom.

Just checking in after being out. The attached message is from our Emergency Management
Coordinator. I know you are working with the City for a permit with them as well, but Ellen does
ask about the event at the Jerome. So that is a heads up.
I received the faxed copy of the Certificate of Insurance so we ok there. I see you found the address
so that's good.
Now we are in the waiting period. I have asked for all comments to be in to me by noon on
Thursday and will keep you appraised of comments etc as they come in. Please keep me up to date

Citizen Pictures/Food Network (Jenna Revnoldsl, hereinafter called the Holder, is hereby authorized to
use, subject to the terms and conditions of this permit, National Forest System land (NFSL) identified below,
as it occurs at the Snowmass Ski Area within the Aspen-Sopris Ranger Districts of the White River National
Forest.
This authorization covers approximately 5 acres and/or N/A miles.
The holder is authorized to conduct the following activities and/or install the following temporary
improvements on the permitted area: Conduct a commerical picture motion film.
The below locations are authorized under this permit:
• Snowmass Ski Area: Elk Camp Gondola Area and top of Village Express
Access and shooting within any ski area will be managed by the Aspen Skiing Company (ASC letter of
authorization in permit fle). This authorization covers one (1) day of filming on NFS land. One weather day
will be allowed with prior Forest Service notification.
This Special Use Authorization covers National Forest Svstem land only.
No use is authorized within designated Wilderness Areas.
TERMS AND CONDITIONS
1. Use under this permit shall begin on 03/73/2010 and end on 03/13/2010. The permit shall not be
extended.
2. The fee for this use is $150.00 (One hundred and fifty dollars). It shall be paid in advance and is not
refundable.
3. The holder shall conduct the authorized activities according to the attached approved plans and
specifications.
4. The holder shall not install any improvements not specifically identified and approved above.
5. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands
without specific prior written permission from the authorized officer.
6. The holder shall comply with all Federal, State, county, and municipal laws, ordinances, and regulations
which are applicable to the area or operations covered by this permit.
7. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness,
sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the
expense for all damage, other than ordinary wear and tear, to National Forest System lands, roads and
trails caused by the holder's activities.
8. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees,
hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to
individuals. After securing permission from the authorized officer, the holder shall remove such hazards.
9. The holder shall be liable for any damage suffered by the United States resulting from or related to use of
this permit, including damages to National Forest resources and costs of fire suppression.

10. The holder shall hold harmless the United States from any liability from damage to life or property arising
from the holder's occupancy or use of National Forest lands under this permit.
11. The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all
lawful and proper purposes not inconsistent with the intent of the permit or with the reasonable exercise
and enjoyment by the holder of the privileges thereof.
12. This permit is subject to all valid existing rights and claims outstanding in third parties.
13. This permit may be revoked upon breach of any of the conditions herein or at the discretion of the
authorized officer. Upon expiration or revocation of this permit, the holder shall immediately remove all
improvements except those owned by the United States, and shall restore the site within 1 day(s), unless
otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become the
property of the United States, but that will not relieve the holder of liability for the cost of their removal and
restoration of the site.
14. This permit is a license for the use of federally owned land. It does not grant any interest in real property.
This permit is not transferable. The holder shall not enter into any agreements with third parties for
occupancy of the authorized premises and improvements.
15. Appeal of any provisions of this permit or any requirements thereof shall be subject to the appeal
regulations at 36 CFR, Subpart C, or revisions thereof.
16. This permit is accepted subject to the conditions set forth herein, condition(s) 1-20 and attached to and
made a part of this permit.
17 . The Permittee will remove all trash generated by the film shoot The area will be maintained in a neat and
ordedy fashion at all times.
18. This authorization covers only one shooting day at the specified locations unless amended.
19. A letter of authorization from the Aspen Skiing Company will be required as a condition of approval of
this permit.
20. The above clauses shall control if they conflict with additional clauses or provisions.

Cari Anne, We tossed the information about the photo shoot application around caucus members a little
bit by e-mail (we are between meetings right now). The conclusion that was tentatively reached is that
there will be virtually no impact on the Snowmass/Capitol Creeks valleys since the house at 3768
Snowmass Creek Rd is set so far off the County road, and there won't be too many vehicles involved.

This is just a reminder that referral comments are needed by Noon tomorrow,
Thursday, March 4th. Below is a more up-to-date shooting schedule. Both the City of
Aspen &USFS are also permitting the applicant. Town of Snowmass is fine as long
as the applicant receives our permit and the USFS to shoot skiing at Snowmass. I will
be issuing the permit on Friday, March 5th

1 have not yet received the check for the fee, which must be received prior to permit issuance. Did you
mail it via post office or UPS?
Paperwork wise I still need the following as they become available:
I) Owner letter of consent from Roaring Ford Club, allowing the use of the property.
2) Owner of record letter of consent (Fred Feitshans) for allowing the use of the house on Snowmass
Creek Rd. I realize that it belongs to Giada, but we require the owner of record to issue consent.
3) A copy of the permit issued by TOSV and/or USFS to ffim at Snowmass
4) A copy of the permit issued by City of Aspen.
5) A copy of the permit issued by USFS.
6) Ski Co letter of consent to film on their property.
