Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. Citizen Pictures (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to film the Food Network's Holiday Special in Aspen with Giada De Laurentiis at a private residence at 3768 Snowmass Creek Rd and other various locations from March 7, 2010 to March 14, 2010 as necessary. The cast and crew consist of approximately 10- 15 people. 3. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. 4. Aspen Skiing Company has approved filming at Snowmass Mountain. Filming at the Snowmass ski area requires a US Forest Service permit. The City of Aspen has also issued a permit for filming at locations within their jurisdiction. 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for Food Network's Holiday in Aspen with Giada De Laurentiis, subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. No emergency access to any location shall be blocked 3. Parking shall be on private property only. No parking shall take place on County roads. 4. The Applicant shall apply for and obtain a US Forest Service Temporary Special Use Permit prior to the start deadline. 5. The shoot will take place 03/07/10 through 03/14/10. Filming will involve 10-15 people - Giada, her family, and a few crew members, the cameraman and will be in various locations within the City of Aspen, Pitkin County ,Basalt and the Snowmass Ski Area. The primary location within Pitkin County is: - A Private Residence on Snowmass Creek Rd APPLICANT: Citizen Pictures (thereafter, "Applicant'). REPRESENTATIVE: Jenna Reynolds LOCATIONS: A private residence at 3768 Snowmass Creek Rd; PID #2645-111-01-002. BACKGROUND: This is a shoot for the Food Network. It is an Aspen Christmas Special, Giada at Home. Citizen Pictures will film Giada De Laurentis in various locations, primarily cooking and enjoying "Holiday activities" with her family. They will also film at the Roaring Fork Club. In addRion they will be filming at various locations within the City of Aspen and also at Snowmass Ski Resort. Filming will take place from March 7"' through March 14"'. A crew of 10-15 people will be involved; additional family members and local area children may be involved. The Applicant is also obtaining permits for the USFS to shoot at Snowmass and from the City of Aspen in order to shoot in town. REFERRAL COMMENTS: The Application was referred to the following agencies: Aspen Skiing Company, Pitkin County Sheriffs Department (Tom Grady), USFS, Emergency Management (Ellen Anderson), Basalt 8 Rural Fire Department and the Snowmass/Capitol Caucus. The Aspen Skiing Company confirmed that filming was to take place in Snowmass and provided written permission. The USFS issued a permit for this portion of filming as it takes place on Forest lands. Ellen Anderson approved the application and confirmed that insurance is in place for any emergencies. The County has been named as a Certficate Holder/Additional Insured. Bill Harding appreciated the notice and the Snowmass/Capitol Caucus also approved. Od~:~~l d ~,~G~ STAFF COMMENTS: Pursuant to Subsection 3-200-030 of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1. Police supervision (if necessary); 2. Public parking; 3. Insurance; 4. Site set-up, maintenance and clean-up; 5. Emergency services; and 6. Safety of operations. Additionally, temporary structures must confonn to applicable building codes and other County regulations. Each of these requirements is addressed, in tum, below. Police Suaervision: N/A Public Parkino: The 10-15 person film crew will use a private, insured vehicle to access the various locations. Applicant shall adhere to all rules and regulations for parking. Insurance: Applicant has provided adequate proof of insurance. Site Set-Ua. Maintenance and Clean-Ua: Outdoor set-up is minimal for this type of event. The Applicant will provide set-up, maintenance and clean up, including trash removal from the site. Emergencv Services: Applicant has provided a plan for dealing with emergencies during the shoot. This includes 911 services. Safety of Oaerations: A first aid kit and fire extinguisher shall be available on site. APPLICANT understands and agrees that Pitkin County Ordinance No. 30-2009 establishes a fee structure for land use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the expense incurred in providing such services to the public. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it may not be possible at the time of application to ascertain the full extent of the costs involved in processing the application. 4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall accumulate if an application includes more than one type of land use review. 5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision. 6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $ lna~ which is based on2~hours of staff time, and if actual time spent by staff to process the application exceeds the average number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent. I have attached apre-application summary which outlines the fee and the additional requirement needed. Let me know as well on the approximate locations (if any) you will be using for outdoor shots. You may be required to obtain a permit from our Open Space & Trails department depending on certain locations. In the meantime, I will need some additional items from you, ASAP, in order to continue on with the permit process: ~,1. A check for permit fee, $624 made out to Pitkin County Treasurer. Unfortunately we are not able to process credit cards at this time. ~. An Executed Agreement for Payment form. A copy is provided as the last page of the above attachment. ~3. A consent letter from Fred Feitshans (the registered owner of the parcel for the 3768 Snowmass Creek Rd). ~4. The Certificate of Insurance with Pitkin County listed as an additional insured (our name should appear in the box at the bottom left hand box). Prior to permit issuance, I will need consent letters from Ski Co for the area you will be using. I will also need copies of any additional permits (USES, OS&T, etc) you are required to obtain. I will go ahead and forward the electronic application (thank you for the copy & send) out to the County referral agencies to begin the permitting process. Like I said as soon as I find out where our host wants to ski, I will go through the proper channels. The private home we are filming at is 3768 Snowmass Creek Rd. Snowmass, CO The Snowmass Village folks said that was old Snowmass and probably not their jurisdiction, they also didn't even know if I would have to permit it. So I am thinking it might be Pitkin County's area... Maybe you can help me pinpoint it. Although we all use the same system, we don't really work with each other, so it's unlikely that the City would notify us or Snowmass Village. You may want to call Snowmass if you haven't already done so. I don't know what they require; here in the County we do require a permit even if flming in private homes. Just to let you know you may also need a pennit from the USFS depending on where on each mountain you are filming (SkiCo should be able to help you determine if you are on private or forest land. If you think you will filming outside the City or outside TOSV (long range scenic views, etc.) we should probably have you do a permit with us. Just an FYI... The website only allows me to submit the permit to one jurisdiction so I just sent it to City of Aspen... You cannot submit it to all three so I am glad you found it somehow :) Also... I am not sure which ski resort our host wants to ski at, but when I do, I will let you know ASAP and add that to the permit. I am in touch with Aspen Ski Company. And... We have two handheld cameras and we will be capturing Giada and her daughter making cookies. We have also asked the country day school to walk over with 20 students max (accompanied by teachers) from the school at 3p to join us. I don't think this would cause any traffic problems as there really are no additional vehicles and everyone is indoors. (our entire crew is staying at the Jerome and they are shuttled around in a passenger van). The Jerome is okay with us using their bathrooms and the crew is only 3 people total for the skiing shoot so I think public restrooms will work, III check with Melissa over at Aspen Ski Company, but we are only thereon the slopes for about an hour hour and 1/2... We may not even go to the bathroom. Use under this permit shall begin on 03/73/2010 and end on 03/13/2010. The permit shall not be extended. 2. The fee for this use is $150.00 (One hundred and fifty dollars). It shall be paid in advance and is not refundable. 3. The holder shall conduct the authorized activities according to the attached approved plans and specifications. 4. The holder shall not install any improvements not specifically identified and approved above. 5. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands without specific prior written permission from the authorized officer. 6. The holder shall comply with all Federal, State, county, and municipal laws, ordinances, and regulations which are applicable to the area or operations covered by this permit. 7. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness, sanitation, and safety acceptable to the authorized officer. The conclusion that was tentatively reached is that there will be virtually no impact on the Snowmass/Capitol Creeks valleys since the house at 3768 Snowmass Creek Rd is set so far off the County road, and there won't be too many vehicles involved. No one raised any objections to doing the filming in our valleys.
