RECITALS
1. Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado (°Director") may approve a Temporary
Commercial Use/Special Event Permit for commercial activities or special events.
2. Tyler Stableford Photography (hereafter, the °Applicant") has applied to the Director for approval
of a Temporary Commercial Use/Special Event Permit to photograph action shoots at °The Drool"
Ice Climb on the Jensen Open Space parcel near Redstone during the week of March 15, 2010,
preferably March 16~', weather permitting. The cast and crew consist of approximately 5 people.
3. County Risk Management has received and approved a Certificate of Insurance covering this
event and naming the County as an Additional Insured.
4. Open Space & Trails has approved the photo shoot and has issued a permit for the use of the
site.
5. The Director finds that, to the extent applicable, the application complies with the standards in
Subsection 4-30-50(i) of the land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit
for the Tyler Stableford Photography -'The Drool" Photo Shoot, subject to Applicant's compliance with
each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in connection with, the
application.
2. No emergency access to any location shall be blocked.
3. Parking shall be in available parking spaces at the trailhead only. No parking shall take place on
County roads.
4. The Applicant shall apply for and obtain a Temporary Special Use Permit from the Open Space &
Trails Department prior to the start deadline. The Applicant shall adhere to all rules, regulations
and standards detailed in the permit.
5. Failure to comply with the conditions of approval may result in revocation of this permit.

REQUEST: The Applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit in order to take ice climbing photographs at "The Drool" ice climb on the
Jensen Open Space property near Redstone. The one day shoot will take place the week
of March 15, 2010, preferably March 16"', weather permitting. The shoot will involve 5
people -the photographer, two climbers and two crewmembers. The Applicant will also be
required to obtain an Open Space & Trails Permit.

LOCATION: The Drool (Jensen) Open Space and Trails parcel at approximately 18600

BACKGROUND: This is a photo shoot for a private photography company which
specializes in 'action/adventure' shoots. The photo shoot will take place at "The Drool" ice
climb and involve iwo ice climbers in action. A small crew of five people is involved. The
Applicant is also obtaining a permit from OS & T, as they manage.
REFERRAL COMMENTS: The Application was referred to the following agencies: Pitkin
County Sheriffs Department (Tom Grady), Emergency Management (Ellen Anderson), the
Carbondale Fire Department and Open Space & Trails (John Armstrong).
OS & T issued a permit for this portion of filming as it takes place on lands managed by
them.
Ellen Anderson approved the application and confinned that insurance is in place for any
emergencies. The County has been named as a Certficate Holder/Additional Insured.
No comments were received from the Pitkin County Sheriffs Department or the
Carbondale & Rural Fire District.
STAFF COMMENTS:
Pursuant to Section 4-30-50(i) of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;

4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in tum, below.
Police Supervision: N/A
Public Parkins: The 5 person crew will use two private, insured vehicles to access the
Redstone area. They will park on OS & T property at the trailhead. The Applicant shall
adhere to all rules and regulations for parking.
Insurance: The Applicant has provided adequate proof of insurance in the correct form.
Site Set-Uo Maintenance and Clean-Ua: Outdoor set-up is minimal for this type of
event. The Applicant will provide set-up, maintenance and clean up, including trash
removal from the site. The Applicant shall follow the OS & T permit guidelines for use of
the site.
Emeraencv Services: Applicant has provided a plan for dealing with emergencies during
the shoot. This includes 911 services.
Safety of Oaerations: A first aid kit and shall be available on site. All dogs must be
leashed.
Conformance with Building Code: N/A
RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use/Special Event Permit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 30-2009 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the COUNTY'S policy that
development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be
consistent and fair to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
PROJECT, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate 'rf an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission andlor Board of County
Commissioners to enable the Planning Commission andlor Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ which is based on _ hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20°k, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

INFORMATION ON THE PERMIT PROCESS AND APPLICATION
The temporary use and occupancy of pubfic or private properties and7ar roadways for
commercial activities or special events that are not otherwise permitted within a specific Zone
District may be permitted by the Community Development Director. The Community
Development Department wordinates the review of these activitieslevents by various referral
agencies in order to ensure that the activitieslevents are wnducled in a safe manner, and that
any impacts on the community or on public resources are mitigated by the permiriee. The
permittee is required by the Code to demonstrate that adequate provisions have been made for
police supervision, public parking, insurance, site set-up, maintenance and clean-up,
emergency services, and safety of operations. A permit wilt not be issued unless these
requirements are satisfed.
Special Events include, but are not limited to the following:
> Public events for amusement or entertainment, such as concerts or festivals;
~ Fund-raising or non-commercial events to benefit nonprofit religious, educational, or
community service organizations; and
~ Foot races and bike races.
Temporary Commercial Uses include, but are not limited to the following:
~ Filming of movies, commercials, or promotional spots; and
~ Trade shows.

The Community Development Department will be the primary contact for the applicant during
the review process. Once the completed application and fee are submitted, Community
Development will distribute the application to the necessary referral agencies and, if necessary,
will schedule a date for the referral agencies to review the application with applicant and/or put
the refenal agencies directly in touch with applicant.
Following review of the application, the Community Development Director will issue an
Administrative Determination granting or denying the permit.
Special event permit applications and temporary commercial use permd applications shall be
submitted to the Community Development Department not lass than 60 days prior to the
event date, along with the following:
t. Fee for application:;7,872 (Major Events),;612 (Minor Events); make check payable
to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event or a
"Minor Event" will be determined by staff at the time of submittal. The fee is based on 2
hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff
review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the
applicant will be charged for time in excess of 2/6 hours at a rate of $312 per hour.
2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures,
street closures, all impacted properties (identifying owners), and parking.
3. Vicinity map.
4. Schedule of events/activities.
5. Detailed Safety and Operations Plan (see Attachment AL
6. Proof of General Liability insurance/indemnification (naming Pitkin County as an
"AddRional Insured") and proof of Liquor Liability insurance (if applicable).

D. If a major incident or emergency occurs in the County during the event, the Sheriff
reserves the dgM to remove any and atl emergency medical, fire and law resources from
the event.
E. The permittee shall adhere to all representations made in the application and in public
meetings.

SAFETY AND OPERATIONS PLAN REQUIREMENTS
The purpose of this part of your application process is to promote public safety in the
conduct of special events in Pitkin County. Please provide the following information as
it applies to your event Note that some questions will not be applicable, or appropriate, given
the nature andlor scale of your event.
Contact the Public Safety Council for additional information or direction regarding these
requirements.

numbers/frequencies (e. g., cell phone, radio). Where will this individual be
located during the event?
B. Who has overall responsibility for the safety of the event?
C. Describe (bullet topics) your safety briefing for event staff.
D. Outine, in detail, your safety preplans.

Safety and Operations Plan for The Drool ice climbing shoot
Dear Public Safety Council,
I am a fulltime adventure photographer in Carbondale seeking a permit to
stage a small. ice-climbing photo shoot at The Drool in Redstone for one
good-weather day the week of March 15 (suggested shoot day Tuesday
March 16). I intend to photograph with 1-2 experienced ice climbers to
create some images and short video clips for my business and promotional
purposes.
To begin with, I am a longtime professional climbing photographer and
former mountain guide with Aspen Expeditions, so I am highly experienced
and extremely safe with high-angle climbing and photography. I will
ensured the highest safety measures during our photo shoot, relying on
safety lines secured to the large trees atop the ice climb at all times for all
members of the team participating in the shoot. Please see my website

My business has a $2 million + liability insurance policy, workers' comp for
all crew, and we will have all participants sign waivers. We can list Pitkin
County and any other parties as `additional insured.'
I will be the primary contact for all safety issues; my cell # is 970-319-9009.
The Drool is located up an easy 5-minute hike on well-trodden snow from
Hwy 133, so access and egress is simple. I will have safety lines secured
from the trees atop the ice climb (which is only 50 feet tall, and the trees up
top are easy to walk to around the side, there is a packed trail), so there is
zero possibility of a high-angle rescue being needed.
I will have my well-stocked first aid kit on hand for any incidents that may
arise; and with our crew of 5 people, we will have plenty of people on hand
to assist with any potential accidents that could occur.
I honestly don't foresee any substantial risk hazards in this shoot, as we will
takes all necessary precautions to make this photo shoot a safe and
successful endeavor.

I received the forwarded email from John Armstrong. To film or shoot in Pitkin County you must obtain a Temporary
Commercial Permit through the Community Development office (me) and for this particular shoot you will also need a
permit for Open Space and Trails. We will do our best to get the permit out to you in a short amount of time; however they
generally take a minimum of a week.
I have attached apre-application conference summary outlining the information I need addressed for the Temp
Commercial Permit. I have also attached a blank permit (in word) which may not necessarily apply to your situation (it's
more focused on Special Events) just fill out the applicable portions. I spoke to John and the fee for the OS & T permit is
pretty low (less than $100).

The fees are based on the number of hours a standard Temporary Commercial Permit takes our department to obtain the
referrals from various County agencies (their time is included in the fee as well). In this instance if John confirms this our
Department would consider reducing the fee by half for the use of the photos.

CDOT maintains quite a wide pull out along 133 which is well used by fishermen and Castle
photographers in the summer and utilized by the ice climbers in the winter. It will hold a lot of vehicles. I have a

10) Pitkin County Open Space and Trails maintains the right and authority to amend or cancel this permit at anytime should the
applicant fail to abide by conditions agreed to or if public health, safety and welfare so dictate.
11) The permittee may be assessed an Impact Fee for extra services provided by Pitkin County Open Space and Trails.
Payment, if required, is due upon submittal of this application unless other arrangements have been approved.
12) This permit does not grant exclusive use of the site. Permittee shall ensure that the rights and privileges of other park visitors
are recognized.
13) Permittee must demonstrate possession of applicable permits at all times during the permitted activity and present such
