Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. Hooters of America/MP Media & Promotions Inc., (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit for Hooters Snow Angels photo shoot, taking place March 30, 2010 at the Woody Creek Tavern and April 2, 2010 at the Pine Creek Cookhouse/Town of Ashcroft from 6AM to 8 PM. The cast and crew consist of approximately 8 people. 3. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. 4. The USFS has approved the photo shoot and has issued a permit for the use of their locations. 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. The photo shoot will take place at the Woody Creek Tavern on March 30'h, 2010 from 8AM to 5PM and at the Pine Creek Cookhouse/Town of Ashcroft on April 2, 2010 from 8 AM to 5PM. The crew will consist of approximately 8 people. APPLICANT: Hooters of America/MP Media & Promotions Inc. REPRESENTATIVE: Kristi Quarles LOCATIONS: 1) Pine Creek Cookhouse/Town of Ashcroft (12700 Castle Creek Rd); PID # 2999-061-00-901; Woody Creek Tavern (002 Woody Creek Plaza); PID #2643-161-05- 002. BACKGROUND: This is a photo shoot for the Hooter's Snow Angels calendar and magazine ads. The photo shoot will take place at two locations above on two separate days. The Applicant must also obtain a permit from the USFS for the Town of Ashcroft/Pine Creek Cookhouse location. REFERRAL COMMENTS: The Application was referred to the following agencies: Pitkin County Sheriffs Department (Tom Grady), Emergency Management (Ellen Anderson), the Aspen Fire Protection District, the USFS, The Maroon/Castle Caucus, The Woody Creek Caucus, Risk Management, and the Aspen Historical Society. The USFS issued a permit for the portion of shoot as it takes place on lands managed by them. Ellen Anderson approved the application and confirmed that insurance is in place for any emergencies. The County has been named as a Certificate Holder/Additional Insured. The Pitkin County Sheriff's Office, the Aspen Fire Protection District and the Aspen Historical Society approved the application. The Sheriffs Office will add crowd control patrols as needed. No comments were received from the Maroon/Castle Caucus or Woody Creek Caucus. STAFF COMMENTS: Pursuant to Section 4-30-50(i) of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: I o~ /y 1. Police supervision (if necessary); 2. Public parking; 3. Insurance; 4. Site set-up, maintenance and clean-up; 5. Emergency services; and 6. Safety of operations. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in turn, below. Police Supervision: The Sheriff's Office will add crowd control patrols as needed. Public Parking: The 8 person cast and crew will use private, insured vehicles to access the locations. They will park in provided parking lots and will leave room for other users at both locations. Parking for the Tavern is located on the East side of River Road. The Applicant shall adhere to all rules and regulations for parking. Insurance: The Applicant has provided adequate proof of insurance in the correct form. Site Set-Up, Maintenance and Clean-Up: Outdoor set-up is minimal for this type of event. The Applicant will provide set-up, maintenance and clean up, including trash removal from the sites. The Applicant shall follow the USFS permit guidelines for use of the Town of Ashcroft and Pine Creek Cookhouse Sites. Emergency Services: Applicant has provided a plan for dealing with emergencies during the shoot. This includes 911 services. Radio communications with the Cookhouse staff will be used in addition to a hard line for emergencies. Safety of Operations: A first aid kit and shall be available on site. They have three locations selected - 2 in the County, 1 in the City. The two County locations are: Pine Creek Cook House (412) and the Woody Creek Tavern (3/30). I have attached the online permit we received along with the Certificate of Insurance. The applicant will be obtaining and forwarding the appropriate Owner's release forms (we should have them tomorrow). I have also requested 'site plans' or maps Additional information: o Two private vehicles will be used to shuttle the 8 people involved in the shoot to & from the above locations. All parking will take place in the parking lots provided by the establishments. o The Emergency Plan is the use of cell phones to 911 or stabilization and transport from location to local hospital. All liability will be on the Applicant. (Last year they had a designated contact at all locations responsible for dealing with emergencies. The holder shall conduct the authorized activities according to the attached approved plans and specifications. 4, The holder shall not install any improvements not specifically identified and approved above. 5. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands without specific prior written permission from the authorized officer. 6. The holder shall comply with alt Federal, State, county, and municipal laws, ordinances, and regulations which are applicable to the area or operations covered by this permit. 7. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness, sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the expense for all damage, other than ordinary wear and tear, to National Forest System lands, roads and trails caused by the holder's activities. 8. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees, hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to individuals. After securing permission from the authorized officer, the holder shall remove such hazards. 9. The holder shall be liable for any damage suffered by the United States resulting from or related to use of this permit, including damages to National Forest resources and costs of fire suppression, !Z Ma r. 29. 2010 4,03PM St. Reds/Aspen No. 1824 P. 3 10. The holder shall hold harmless the United States from any liability from damage to life or property arising from the holder's occupancy or use of National Forest lands under this permit. 11. The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all lawful and proper purposes not inconsistent with the intent of the permit or with the reasonable exercise and enjoyment by the holder of the privileges thereof. 12. This permit is subject to all valid existing rights and claims outstanding in third parties. 13. This permit may be revoked upon breach of any of the conditions herein or at the discretion of the authorized officer. Upon expiration or revocation of this permit, the holder shall immediately remove all improvements except those owned by the United States, and shall restore the site within 1 day(s), unless otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become the property of the United States, but that will not relieve the holder of liability for the cost of their removal and restoration of the site. 14. This permit is a license for the use of federally owned land. It does not grant any interest in real property. This permit is not transferable. The holder shall not enter into any agreements with third parties for occupancy of the authorized premises and improvements. 15. Appeal of any provisions of this permit or any requirements thereof shall be subject to the appeal regulations at 36 CFR, Subpart C, or revisions thereof. 16. This permit is accepted subject to the conditions set forth herein, condition(s) 1-20 and attached to and made a part of this permit. 17 . The Permittee will remove all trash generated by the film shoot The area will be maintained in a neat and orderly fashion at all times. 18. This authorization covers only one shooting day at the specified locations unless amended. 19. Filming within the AschcoR Ski Touring permit area will require approval /rom American Adventure Productions (John Wilcox). 20.
