RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, DENYING THE FLEISHER SUBDIVISION EXEMPTION FOR OPEN
SPACE PARCELS
Resolution No. �� -2010
RECITALS
1. Donald J. Fleisher, ("Applicant") has applied to the Board of County Commissioners of Pitkin County,
Colorado ("BOCC") for an open space subdivision exemption to subdivide the 35 acre Lot 36 of Sopris
Mountain Ranch parcel in to a 30 acre open space parcel to be covenanted to open space and a remainder 5
acre development parcel.
2. The property is zoned RS-30 and contains approximately 35 acres.
3. The property is known as Lot 36 Sopris Mountain Ranch.
4. The BOCC reviewed the application at a duly noticed public hearing on April 14, 2010, at which time
evidence and testimony were presented with respect to this application.
5. The BOCC finds that the application is not consistent with the intent of the subdivision exemption
provisions of the Pitkin County Land Use Code.
NOW, TAEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County,
Colorado, that it does hereby deny the Fleisher Parcel Subdivision Exemption for Open Space
Parcels.
PUBLISHED IN THE ASPEN TIMES on the 14` day of March, 2010.
