Owl Creek Meadows LLC ("Applicant") has applied to the Community Development Director of Pitkin County, Colorado ("Director"), pursuant to Sec. 6-30-140(c) of the Land Use Code ("Code"), to obtain exempt bam squaze footage for an agricultural operation that includes hay production. The Applicant is requesting an additional 1,830 squaze feet of exempt barn space. The Applicant was issued a permit fora 2,198 square foot exempt pole barn. 2. The parcel is located off Mandalay Lane is legally described as Lot 1 of the Non-B000 approved Owl Creek Meadows Subdivision. (Legal Description -Attachment A) PID#: 2735-043-03-001. 3. The pazcel is zoned LIIZ - 35 and contains approximately 42 acres. The Lot is vacant, however, an Activity Envelope and Site Plan was approved pursuant to Administrative Decision No. 68-2009 (562857) for construction of a water line. The Site Plan was recorded at B92 P21. 4. The Director finds that the Applicant has successfully shown compliance with Section 6-30-140(b) of the Land Use Code. 5. The Director further finds that the plans submitted for the pole barn indicate that the structure will be used for an agriculture purpose. The Director further finds that if a different barn is proposed or use of the barn changes, additional review is necessary. The barn can be viewed as Attachment B (2 pages total). 6. The adjacent neighbor was notified of the application and stated there were no concerns with the proposal. THE DIItECTOR DOES HEREBY APPROVE an additional 1,830 square feet of exempt barn square footage for an agricultural operation for Owl Creek Meadows, subject to the following conditions, which shall run with the land and be binding on all successors in interest: Prior to issuance of a building permit for the new barn or other agricultural structures, the Applicant shall submit a deed restriction to the Community Development Department for approval and recordation. The deed restriction shall specify that the exempt squaze footage shall only be used to hay storage and storage of associated agricultural implements. The deed restriction shall allow the County to inspect the barn(s) at any time for compliance with the specified use limitations, subject to the provision of reasonable notice to the property owner. 2. The barn shall be limited to a total of 4,026 square feet. 3. The Applicant shall adhere to all material representations made in the application. APPLICANT understands and agrees that Pitkin County Ordinance No. 030-2009 establishes a fee structure for land use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. The fee structure is based on the County's policy that development shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair to the public and to reflect the expense incurred in providing such services to the public. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it may not be possible at the time of application to ascertain the full extent of the costs involved in processing the application. 4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall accumulate if an application includes more than one type of land use review. 5.
