In addition, the Applicant is requesting a minor amendment to revise the activity envelope on Lot 2 to coincide with the amended lot line. 2) The lots are located off of Spruce Street. The house on Lot 1 is located at 50 Spruce Court. The lots are described as Lots I and 2, Leddy- Cooper Subdivision. 3) The lots contain 52,421 and 39,897 square feet, respectively, and are conforming in size in the R -30 zone district. 4) The Board of County Commissioners (`BOCC ") approved the Leddy- Cooper Subdivision, pursuant to Resolution Nos. 017 -2008 and 139 -2008; the plat is recorded in Plat Book 92 at Pages 24 -25. The BOCC granted a growth management allotment of 9,923 square feet of floor area for Lot 2, pursuant to Resolution No. 006 -2008; the growth management covenant is recorded as Reception No. 563855. 5) The Director finds that the proposed amendments comply with the applicable provision of the Code: they do not affect the degree of compliance with the standards of the Code, change the use of the proposed development or the basic character of the approved use, increase off -site impacts, endanger the public health, safety or welfare, or increase the floor area, and are consistent with representations made during the subdivision review. 6) The Director further finds that while the size of Lot 2 will increase as a result of the lot line adjustment (from 39,897 to 44,651 square feet), the lot area of Lot 2 will remain the same due to the deduction of two access easements (44,651 — 4,856 = 39,795 square feet), and, therefore, the allowable floor area will remain the same. NOW, THEREFORE, BE IT APPROVED by the Pitkin County Community Development Director that approval is hereby granted for a minor plat amendment for Lots 1 and 2, Leddy- Cooper Subdivision and a minor amendment to a development permit for Lot 2, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The provisions of BOCC Resolution Nos. 006 -2008, 017 -2008, and 139 -2008 shall remain in full force and effect, except as amended herein. 2. Within 60 days of the date of this approval and prior to submission of any building or other development permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development an amended Plat and an amended Activity Envelope Plan. The above Administrative Decision No . -2010 Page 2 referenced approvals shall be a condition precedent to finalization and recordation. The plat and Activity Envelope Plan shall be amended as follows, prior to submission: A. Please note that we were required by Pitkin County to change our address on Lot 1, Leddy- Cooper Subdivision, from 704 Spruce Street, Aspen, CO, to 50 Spruce Court, Aspen, CO on a date subsequent to our original GMQS application approval. Per the Pitkin County Pre- application Conference Summary items 1 through 6, we submit the following information: Prior Approvals: a. BOCC Resolution No. 017 -2008 (Reception No. 547077) -- Owners received Conceptual Subdivision approval to subdivide the Property into Lots 1 and 2 of the Leddy- Cooper Subdivision b. BOCC Resolution No. 006 -2008 (Reception No. 546115) -- awarded the requested allotment of 9,350 square feet of floor area for the new lot (Lot 2). c. Administrative Decision No.32 -2009 (Reception No. 559209) dated May 19, 2009 -- corrected the final maximum floor area on Lot 2 from 9,350 to 9,923 d. BOCC Resolution No. 139 -2008 (Reception No. 555334), dated 12/17/2008- - approved Detailed Submission, Final Plat and a Caretaker Dwelling Unit for Lot 2 e. GMQS Covenant in association with the Pitkin County 2007 Urban Growth Boundary Residential GMQS new lot allotment awarded to Lot 2, Reception No. 563855, dated July 15, 2009. The Owners request a movement of the lot line between Lots 1 and 2 in order to create a greater distance from the existing home on Lot 1 to Lot I's southern property line, although the reconfiguration results in an increase in the total square footage of Lot 2 from 39,897 square feet to 44,651 square feet.
