Special Review approval and GMQS exemption approval are also requested for the caretaker dwelling unit. 2) The property is located at 372 Sunnyside Lane (previously 2047 McLain Flats Road), and is more specifically described as Exhibit A. 3) The parcel is zoned RS -20 and contains approximately 8.1 acres. 4) The Hearing Officer approved an activity envelope and granted special review approval to utilize two TDRs for additional floor area and for a caretaker dwelling unit, pursuant to Determination No. 16- 2007. The vested rights expired on June 26, 2010, however, the approval to utilize two TDRs remains valid. 5) The Director finds that the request complies with the applicable provisions of the Code, as follows: A) The activity envelope contains slopes of less than 30 %. B) The wildfire hazard is rated as low, and can be mitigated pursuant to the provisions of Sec. 7-20 - 60(c) of the Code. C) The parcel is adjacent to elk winter range, but redevelopment of the parcel will not create any additional impacts on wildlife. D) The parcel is within the mapped Scenic View Protection Area as seen from McLain Flats Road. The existing house is minimally visible from the road; the replacement residence will be located in the same general location and the structures will be built in previously disturbed areas. The floor area will be broken up into three forms — the residence, the garage and the caretaker dwelling unit; the structures are located at the toe of the slope as far from McLain Flats Road as possible; new and existing vegetation will be used to screen the structures; and natural materials and coloring will be utilized. The development otherwise complies with the standards of Sec. 7- 20 -120 of the Code. E) The proposed residential development is exempt from growth management up to 5,750 square feet of floor area, pursuant to Sec. 6 -30 -1 10(a) of the Code, which allows for replacement of existing floor area. F) The Hearing Officer's approval for use of up to two TDRs for additional floor area up to 10,750 square feet has not lapsed and the submitted plans for Site Plan Review represent utilization of all 10,750 square feet. Vos Caudill, Pitkin County, CO Determination No. 1-2011 Page 2 2. The conditions of this Administrative Decision shall replace the conditions of Hearing Officer Determination No. 16 -2007. 3. Prior to submission of any building permit applications for the new residence and caretaker dwelling unit, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30 - 20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 4. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior of the buildings shall utilize indigenous earth tone materials or colors and the roofs shall have a non - reflective color or composition. Reflective roof materials, with the exception of materials associated with solar or photovoltaic equipment, shall not be used unless the materials are treated to eliminate reflectivity prior to installation. All exterior lighting shall comply with the lighting code. 5. The parcel is exempt from Growth Management for up to 5,750 square feet of floor area. At building permit application for the new residence, the Applicant shall surrender two TDR Certificates and a copy of the deed(s) evidencing the Applicant's acquisition of the Certificates (if applicable), in order to develop up to a total of 10,750 square feet of floor area exempt from Growth Management. 6. Prior to issuance of a building permit for the residence and /or the caretaker dwelling unit, the Applicant shall: A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable. Any building permit application submittal shall include demonstration that the water supply is adequate for each dwelling unit for which a permit is requested (i.e., the principal residence and/or the CDU) B. Obtain an access permit for any major improvements to the driveway, which shall be approved by the Planning Engineer and Aspen Fire Department. C. Obtain a fireplace /woodstove permit from the Community Development Department, if necessary. D. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. If the total development disturbs one acre or more, the Applicant shall apply for and obtain a State Stormwater Permit. All historic and natural drainage patterns shall be maintained. E. Pay the applicable road and employee housing impact fees. F. Obtain an on -site wastewater treatment system (OWTS) construction permit. G. Submit a construction management plan for review and approval by the Planning Engineer. H. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes and landscape plan. 1. Submit a tree mitigation and landscape plan. 7. The Applicant shall obtain an Earthmoving, Clearing and Grubbing Permit for all pond, water feature and landscaping improvements that move more than 50 cubic yards of soil. The permit application shall address all State requirements; document water rights; provide engineering of all overflow structures, recirculation systems, etc.; and shall include approval from the Salvation Ditch Company for all improvements that affect the ditch. Determination No. _�_-2011 Page 3 8. The Applicant shall comply with the following standards for Development in a Low Wildfire Hazard Area: A. Defensible Space: The area around all buildings /structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): I ) Brush, debris and non - ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around all structures. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). 3) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shal I be from the edges of the crowns of the fuel. 4) All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. 5) Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. 6) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 7) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 8) All deadfall up to a one hundred (100) foot perimeter shall be removed. 9) No new conifer trees shall be planted within ten (10) feet of a residence. 10) No flammable mulches shall be placed within two (2) feet of a residence. 1 1) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: I) All roof coverings shall be constructed of non - combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. Determination No. L -2011 Page 4 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Maintenance and Miscellaneous Requirements I ) Roofs and gutters shall be kept clear of debris. 2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one -fourth (' /o) inch maximum. 3) Any outbuilding shall adhere to the same wildfire requirements. 4) Yards shall be kept clear of all litter, slash and flammable debris. 5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7) Firewood /wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8) Swimming pools and ponds shall be accessible by the local fire district. 9) Fences shall be kept clear of brush and debris. 10) Wood fences shall not connect to other structures. 1 1) Fuel tanks shall be installed underground with an approved container. 12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire- resistive construction on the exterior side of the walls. 13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14) Addresses shall be clearly marked with two (2) inch non - combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non - combustible post. 15) Utilities shall be extended underground. 9. The Applicant shall comply with the following measures to mitigate impacts to wildlife: A. Native vegetation shall be maintained outside of the activity envelope. B. Contractors /construction workers shall be required to provide bear proof containers for all edible and food related trash. C. Trash /garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to issuance of a certificate of occupancy. E. Fencing outside of the activity envelope shall comply with the following wildlife fencing standards: 1) Mesh or woven wire fences are prohibited outside of the Activity Envelope. 2) Wood rail fencing shall employ three rails or less, be the round or split rail type, shall not exceed 54 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between the lower two rails. 3) Wire fencing must be three (3) strands or less. The top wire should be a twelve- point -five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. 4) All non - conforming fencing on the property must be brought into compliance. Determination No. I -2011 Page 5 E. Avoid fruit- bearing trees and shrubs in any landscaping. F. Construction workers are prohibited from bringing their dogs on site. G. All outside doors shall utilize only solid round handled door knobs, unless another type is required by the applicable Building Code for disabled accessibility purposes. 10. No development including grading, excavation, fill placement, berming, landscaping, vegetatidn removal or disturbance, well or septic system shall occur outside of the approved activity envelope, except as necessary to comply with the wildfire mitigation measures described above. 11. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 12. All areas disturbed by construction shall be re- vegetated with native shrubs and grasses within one growing season of the project's completion. 13. The caretaker dwelling unit shall be limited to 1,000 net livable square feet. The kitchen shall contain a minimum of a two burner stove with at least a 5 cubic foot oven that can bake and broil, sink of at least 14 "W X 16 "D X 5.25 "H, and at least a 5.3 cubic foot refrigerator and 0.73 cubic foot freezer. The Applicant shall provide two off - street parking spaces for the caretaker unit. The caretaker dwelling unit must have separately accessible utilities. This does not preclude shared utilities. 14. Prior to issuance of a building permit for the caretaker dwelling unit, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor plans of the unit shall be submitted to the Housing Office with the deed restriction. The Housing Office may inspect the unit for compliance with these conditions of approval prior to issuance of a Certificate of Occupancy. 15. No development in excess of 30" above or below natural grade shall occur within the setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 16. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 17. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 18. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code § 2 -20 -170 and C.R.S. § 24 -68 -105. This application seeks to renew /refresh the previous approvals granted for the property, and additionally requests Site Plan approval for a replacement home, a detached CDU and accessory uses all to be located within the previously approved Pfeifer Activity Envelope. This 8.1 +i ' acre metes and bounds parcel's general location relative to the surrounding area is depicted on the Vicinity Map below. The subject property's Parcel Identification Number is 2643 - 274 -00 -002. The property lies outside the Urban Growth Boundary (UGB), in Pitkin County's designated Rural Area. Legal access is gained from Sunnyside Lane via McLain Flats Road. True, the Pitkin County Hearing Officer, is attached as Exhibit 8. Finally, a signed fee agreement and the mailing addresses of all property owners within a 300' radius are included as Exhibits 9 and 10, respectively. This application is divided into four sections. Section I provides a brief introduction to the application, while Section II furnishes an overview of the neighborhood and subject property (existing conditions). Section III of the application summarizes the applicant's proposal. Section IV addresses the proposed development's compliance with the review criteria of the Land Use Code. For the reviewer's convenience, all pertinent supporting documents are provided in the various exhibits to the application. While the applicant has attempted to address all relevant provisions of the Code and provide sufficient information to enable a thorough evaluation of the application, questions may arise which require further information and/or clarification. Haas Land Planning, LLC will gladly provide such additional information as may be required in the course of the application's review. 808005 Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 II. THE NEIGHBORHOOD & SUBJECT PROPERTY (Existing Conditions) The subject property's address is 372 Sunnyside Lane (previously 2047 McLain Flats Road), and its general location relative to the surroundin$ environs is depicted on the Vicinity Map provided in Section I, above. It is an 8.1` acre lot, and its Parcel Identification Number is 2643 - 274 -00 -002. The property lies outside the Urban Growth Boundary (UGB), in Pitkin County's designated Rural Area. The property is located below the Starwood Subdivision, to the east of McLain Flats Road, and is accessed directly from Sunnyside Lane via McLain Flats Road. Approximately 1.5 acres are located at the toe of the slope and the remainder of the property is undevelopable steep slopes to the east. Since this property is located in the RS -20 zone district it is considered a substandard lot; however, the lot is currently improved with a driveway, a single - family dwelling, and a tennis court. The Salvation Ditch enters the property from the south and exits at the north end of the site, and has been used to create several water features within the property boundaries. Additionally, a gravel driveway used to access the neighboring parcel to the northwest traverses the property. Natural vegetation at the site consists of oak, willow and native grasses. The site slopes from east to west and has a wildfire hazard rating of "Low Hazard." Most of the approved Activity Envelope is comprised of slopes with less than a 30% gradient. The envelope area has been heavily graded to establish terraces for the existing house, tennis court, and associated improvements. This grading has resulted in small areas of slopes in excess of 30 %, but these are considered minor anomalies that have been deemed acceptable for development (see Exhibit 8, Findings). The parcel is not located in any mapped wildlife habitat areas, but is adjacent to Elk Winter Range. The Colorado Division of Wildlife reviewed the proposed development site during Activity Envelope approval and stated that the redevelopment of this property should not have any additional negative impacts to wildlife as long as the applicant follows the general requirements of Section 7 -20 -70 of the Code. The letter from CDOW is attached as Exhibit 5. Generally speaking, the neighborhood in which the subject property is located is substantially built out. Most lots in the area are developed with homes ranging from large to very large in size. Homes in the area tend to be set back off McLain Flats Road for privacy and orientated toward the south/southeast facing views. Most properties include horse facilities comprised of stables/barns, corrals, and power — irrigated pastures. The homes are, for the most part, relatively spread out and tend to be built into or on top of slopes to take advantage of the views. Many surrounding properties include CDUs and exceed or have the approval to exceed 5,750 square feet of floor area. `onoW Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 Page 3 III. THE PROPOSAL The applicant is seeking approvals to reaffirm an Activity Envelope with Vested Property Rights and Special Review approval for a Caretaker Dwelling Unit (CDU) on the subject property. These approvals, in addition to Special Review approval to establish the property as a TDR Receiver Site were previously granted pursuant to Pitkin County Hearing Officer Determination No. 16 -2007 and allowed for up to 10,750 square feet of development (with the purchase of two TDR). The TDR approval does not lapse, but the vested rights associated with the other approvals expire on June 26, 2010. The applicant requests that the TDR approval already granted be reaffirmed as part of the forthcoming Determination. In addition to renewing the previous approvals mentioned above, the applicant is now further requesting Site Plan approval for the single - family replacement home, the CDU, and accessory uses. The approved Activity Envelope does not contain any slopes of greater than 30 %, other than some isolated, discontinuous spots which are the result of man-made improvements that took place on the site to create the terraces for the existing home, driveway, patios, and tennis court. These slopes were found by the Hearing Officer to be minor slope anomalies pursuant to Section 7- 20- 20(c)(3) of the Code (see Exhibit 8). The property is not known to be affected by any other types of Pitkin County regulated geologic hazards, except for Mancos Shale and expansive soils which can be mitigated under the Code. Natural vegetation at the site consists of oak, willow and native grasses. The site has a "Low" wildfire hazard rating. There are no mapped or otherwise regulated wildlife habitat types affecting the property, nor is the site known to be affected by floodplains, wetlands, riparian areas, or historical or archaeological resources. Although the parcel is adjacent to Elk Winter Range, the CDOW reviewed the proposed development during Activity Envelope approval and stated that the redevelopment of this property should not have any additional negative impacts to wildlife. Moreover, the boundaries of the Activity Envelope ensure a minimal impact development with complete mitigation. The approved Activity Envelope is now being augmented with a Site Plan Review detailing the parameters for development of the single - family home, the detached CDU, and the accessory uses. Section 7 -20 -120 establishes Scenic View Protection areas that are proximate to and most visible from specific roads in the County, including McLain Flats Road. The standards of Section 7 -20 -120 are designed to minimize the visual impact of new development, as well as to preserve the character of all Rural Areas of the County. Scenic Review for the development of a single - family residence and CDU must take place during this Site Plan Review. The new home is proposed to be built on previously disturbed ground where the tennis court and the existing home now reside. The existing home is barely visible from McLain Flats Road and as can be seen from the photographic simulations provided by Michael Doyle Architects, the replacement home will have similarly limited visibility. The additional square footage of the proposed replacement residence will not create any greater visual impacts from McLain Flats Road than is Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 Page 4 OD00 ©� already part of the area's character. Both the home and CDU will use earth -toned wood and stone materials that will blend in well with the surrounding topography and existing built environment. The proposed location for the CDU is southeast of the existing residence and will have minimal (if any) visibility from McLain Flats Road. The CDU will be similar to the replacement home in style and materials, and features a rusted metal roof, tapered stone walls and a suspended canopy over the entry. As the proposed site plan demonstrates, only 9 trees that currently screen the tennis court will need to be removed in order to facilitate this development. The replacement home, a pond and some new sod will occupy the area where the tennis court is now located. Six (6) new spruce trees are proposed to help screen the replacement home from view. In addition, two new spruce trees will be planted to the north of the new, detached CDU. All of the other existing trees on the property (over 40 trees) will remain. This is only the preliminary landscape plan, and a final tree removal and mitigation plan will be supplied for review and approval with the building permit application. Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 5 IV. REVIEW REQUIREMENTS The applicable review standards of the Code are addressed in this section of the application and in the following order: A) Activity Envelope and Site Plan ( §2- 30- 20(g)(2) & (3)); §7 -10 -50 and §7- 10 -60); B) Environmental Protection and Natural Hazards ( §7 -20): 1. Site Preparation and Grading ( §7- 20 -10); 2. Water Course and Drainage ( §7- 20 -30); 3. Scenic View Protection Areas and Rural Character Guidelines for Building Location ( §7- 20- 120(d) and (e)); 4. Landscaping and Vegetation Protection ( §7 -20 -130); 5. Lighting ( §7 -20 -140); C) Roads, Driveways and Parking ( §7 -30); D) Public Services and Utilities ( §7 -50); and E) Approvals for the Single - Family Home and CDU: 1. Special Review Approval for a CDU ( §2- 30- 30(h)); 2. GMQS Exemption for a CDU ( §6- 30- 40(c)); 3. GMQS Exemption for Remodeling and Replacement ( §6 -30 -110). A Activity Envelope and Site Plan Sections 2- 30- 20(e)(2)&(3) 7 -10 -50 and 7- 10-60 As previously mentioned, the applicant has already received Activity Envelope approval pursuant to Hearing Officer Determination No. 16 -2007. This application seeks to have that approval renewed as since the vested rights for that approval are set to expire on June 26, 2010. There have been no Code amendments adopted since 2007 that would affect the approvals granted in Hearing Officer Determination No. 16 -2007. The applicant is now further seeking Site Plan Review approval for development of a single - family home and customary accessory uses, including a CDU. Section 2-30 - 20(g)(2) of the Code provides the criteria for approval of a Site Plan as follows: A Site Plan shall be approved if it complies with (a) all applicable provisions of this Land Use Code, (b) any Activity Envelope previously approved for the property pursuant to Section 7- 10 -50, and (c) all prior development approvals applicable to the subject property. Where the property contains Constrained Areas, the Community Development Department staff shall follow those Priorities for Locating New Activity or Development listed in Section 7- 10 -60. �9 Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 n�t7C If an Activity Envelope has not been previously established for the property pursuant to Section 7- 10 -50, one shall be established as part of the Site Plan Review process. The proposed Site Plan complies with all applicable provisions of the Code, as demonstrated throughout this application. The general location and configuration of the proposed development is consistent with the already approved Pfeifer Activity Envelope. The only constrained areas affecting the subject property result from the Low Wildfire Hazard rating and slopes in excess of 30 %, which were previously found to be minor slope anomalies. The proposed Site Plan is fully consistent with the priorities for locating new activities and development. More specifically, the proposal follows and adheres to the standards and criteria of Section 7- 10 -50, which require the avoidance of: areas of statewide interest; steep and potentially unstable slopes; water courses, drainage channels and areas subject to erosion; floodplain hazard areas; geologic hazard areas; wildfire hazard areas; wildlife habitat areas; river and stream corridors and wetlands; irrigated lands for food or crop production; historic preservation areas; and archaeological resource areas. In general, this application seeks to minimize impacts on surrounding properties, maximize compliance with the requirements of the development standards in Chapter 7 of the Code, and maximize compliance with the Comprehensive Plan goals and objectives (see also Section "IV.B." of this application, below). All "Constrained Areas" on the subject property are being avoided to the extent practicable, but where avoidance is not practicable due to physical constraints or balancing of concerns, complete mitigation is provided. After the Site Plan is approved, all applicable local, state and federal permits will be obtained prior to any clearing, grading, grubbing, or earthmoving that exceeds fifty (50) cubic yards, or changes in the natural drainage of the site. Also, the natural grade, topography, vegetation and drainage of areas outside the defined areas will not be disturbed, except as specifically permitted by the Land Use Code and any associated approvals. Prior to any development activity on the parcel, the boundaries of the Activity Envelope will be identified with construction fencing, and such fencing will remain in place until development has been completed. An Erosion Control Plan is provided herewith, along with a Conceptual Drainage Plan. B. Rural Character, Environmental Protection, and Natural Hazards (Section 7-20) 1. Site Preparation and Grading, Section 7 -20 -10 In accordance with Section 7- 20- 10(a), Grading and Fill Placement, all grading and fill placement shall take place within the defined (and previously approved) Activity Envelope, and all grading and fill placement exceeding 50 cubic yards is indicated on the Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 Site Plan. The Activity Envelope is the most level portion of the site as this is the area where the existing house, tennis courts and driveway are located. Pursuant to Section 7- 20- 10(b), Clearing, Grabbing and Vegetation Removal, all clearing or grubbing of land, or removal of vegetation shall take place within the approved Activity Envelope, except for the removal of noxious weeds, which may occur outside of the Activity Envelope. The Site Plan documents compliance with the requirements of this Section and Section 7 -20 -130. Section 7- 20 -10(c) of the Code governs tree removal and mitigation. The applicant understands that each tree with six (6) inches or larger diameter at breast height (D.B.H.) that is removed within the Activity Envelope shall be replaced with one (1) or more trees with total D.B.H. at least equal to the caliper(s) of the tree(s) removed, unless the removed tree(s) are diseased or required to be removed for wildfire mitigation pursuant to the provisions of Section 7- 20 -60. All revegetation shall also comply with the Pitkin County Revegetation Guidelines. As the proposed site plan demonstrates, only 9 trees that currently screen the tennis court will need to be removed in order to facilitate this development. The replacement home, a pond and new sod will occupy the area where the tennis court is now located. Six (6) new spruce trees are proposed to help screen the replacement home from view, while two new spruce trees will be planted to the north of the new, detached CDU. All of the other existing trees on the property (over 40 trees) will remain. This is only the preliminary landscaping plan, and a final tree removal and mitigation plan will be submitted for review with the building permit application. In accordance with Section 7- 20- 10(d), the applicant will use care to protect the natural terrain and other natural features of the landscape (there is no stream vegetation on the property) within the Activity Envelope. 2. Water Courses and Drainage, Section 7 -20 -30 A preliminary drainage report prepared by Hans Brucker of Pinnacle Design is attached to this application as Exhibit 7. At the time of building permit application, the proposed development of the site will demonstrate maintenance of historic drainage patterns to reasonably preserve the natural character of the site and prevent property damage. The flow of natural water courses will not be impeded, and adequate drainage will be provided for all low points. On -site treatment of storm water will be designed to detain and allow infiltration of runoff prior to discharge to any water body. All erosion related impacts associated with development of the property will be minimized and addressed as part of the building permit application. Erosion control will be accomplished by minimizing disturbance to natural vegetation and soil cover, ensuring that all cuts and fills are adequately designed and revegetated, and providing provisions for protection of vegetation from fire. Also, see the Drainage and Erosion Control plans prepared by Pinnacle Design and provided herewith. Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 Runoff volumes and peaks within the development site, and in areas affected by runoff from the development site, will not exceed the levels attributable to the undeveloped site as determined by a professional engineer licensed in the State of Colorado. The drainage related improvements discussed in the previous paragraph and those indicated on the accompanying plans will also aid in minimizing erosion. The development will not affect irrigation of any agricultural lands, and it will not adversely affect the exercise of any existing and decreed irrigation water right. Flood irrigation is not and will not be practiced on the subject property. Basements, if any, and soil absorption on -site wastewater treatment systems will be placed in locations where they will not be impacted by seepage from irrigation ditches. Sedimentation controls will be implemented before and throughout development, and there will be no run -off into any water body, wetlands, or riparian area. Finally, use and development of the property will comply with all state and federal statutes and regulations concerning the protection and enhancement of water quality, and will be consistent with maintenance of the Stream Classifications for the Roaring Fork River watershed, as identified in Section 208 of the Roaring Fork Watershed Management Plan, while emphasizing the most efficient use of water. This development shall not result in the introduction of any contaminants to groundwater, or interfere with any recharge area or aquifer. No building shall be constructed immediately downhill of a ditch unless the ditch can be placed in a culvert, lined, or otherwise treated to avoid leakage of water downhill towards the building. 3. Scenic View Protection and Rural Character Guidelines for Building Location, Section 7- 20- 120(d) and (e) In order to preserve the character of Pitkin County, careful attention must be paid to the visible impacts of all proposed developments. Section 7 -20 -120 establishes Scenic View Protection areas that are proximate to and most visible from specific roads in the County. The standards of Section 7 -20 -120 are designed to minimize the visual impact of new development, including expansions to existing structures, as well as to preserve the rural character of all Rural Areas of the County. Since this property is visible from McLain Flats Road, and McLain Flats Road is a road specified in Section 7- 20- 120(b) of the Code, the Section 7- 20- 120(d) standards for development must be followed and are addressed below. Architectural photographic simulations of the proposed development have been prepared depicting the character of the proposed home from McLain Flats Road. As the provided materials show, this home will use new and existing vegetation to screen the majority of the replacement residence and CDU from view so as to minimize visual impacts. Additionally, there is a lot between this property and McLain Flats Road that has approvals to build a 10,750 square foot home and is expected to be under construction soon. That new residence will also obscure much of this development from view. The locations chosen for both the replacement home and CDU are in previously disturbed areas that have already been graded and terraced. The replacement home will be located where the tennis court and a portion of the existing home currently reside. The @00012 Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 CDU is proposed to be located just southeast of the existing residence. The home and CDU will not be located on the highest or most visible portion of the site and will not project above a ridgeline. There is no way to completely eliminate visibility of the proposed development from McLain Flats Road. However, the existing home is minimally visible from McLain Flats Road, and any visual impacts of the replacement home and CDU will be similar to that associated with the already existing home on the property and homes on surrounding lots along and closer to McLain Flats Road. In addition to screening, both the home and CDU will use earth -toned wood and stone materials that will blend in well with the surrounding topography. The plans demonstrate an effort to adhere as closely as possible to the standards for Scenic View Protection by minimizing negative visual impacts. The CDU will be similar to the replacement home in style and materials. The review criteria of Code Section 7- 20- 120(d) are provided below in italicized print and each is followed by a response demonstrating compliance and/or consistency therewith, as applicable. (1) The proposed development shall utilize existing topography and natural vegetation, such as ridges, hills, and existing trees, to screen buildings to the maximum extent practicable when viewed from those right -of -way listed in subsection (b) above. Vegetation screens some of the existing home from McLain Flats Road. The applicant will replace the existing home and build a detached CDU as well. The applicant will plant new spruce trees and maintain others to help minimize the visibility of the development from McLain Flats Road. As previously mentioned, the replacement home will be built in the location where the tennis court and a portion of the existing home reside, while the CDU will be just southeast of the existing residence. Although both structures will be visible from McLain Flats Road, they will have similar visual impacts as those associated with other homes on McLain Flats Road. (2) The proposed development shall avoid the location of structures within the Scenic View Protection Areas, and shall avoid the location of structures within any Viewplane identified in the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan if possible. If location outside the Scenic View Protection Area and defined Viewplanes is not practicable, then the proposed development shall not be located on the highest ground or most visible portion of any site as viewed from those corridors listed in subsection (b) above. There is no way for this development to completely avoid the Scenic View Protection Area. However, this development will not be located on the highest ground or most visible portion of the site as viewed from McLain Flats Road. Further, as mentioned above, the use of vegetation and the home that will be built on the neighboring lot will largely obscure the development from view. Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 (I,�UU1 (3) The proposed development's height and bulk shall be designed to avoid, to the maximum extent practicable, the visibility of buildings from those corridors listed in subsection (b) above. This may include, but shall not be limited to, breaking the mass of the building down into a series of smaller forms, articulation of the building fapades to avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane. 000014 Although the home will be somewhat visible from McLain Flats Road, it will be in character with existing development patterns on McLain Flats Road. Furthermore, this development is proposing to split up the FAR into three distinct forms: the replacement home, the attached but seemingly separate garage /guest area, and the detached CDU. (4) The proposed structure shall be placed so it does not project above a ridgeline such that a structure silhouettes against the sky when viewed from those corridors listed in subsection (b), unless there are no alternate building sites on the lot or parcel. The proposed residence and CDU will not project above a ridgeline. There are no ridgelines affecting the subject site as the topography continues to ascend well above the home and CDU. (5) The proposed development shall be designed to complement the natural topography of the land through the use of techniques such as earth - sheltered design, the use of natural materials and coloring, the use of low - reflectance materials, or clustering of structures on the least visible portions of the site. When a building is proposed near a ridgeline, then its form (particularly its roof form) shall replicate, parallel, or complement the natural form of the ridgeline so that it appears to be an element of the natural ridgeline. The applicant intends to utilize natural materials and coloring. Both the home and CDU will utilize earth -toned wood and stone materials that will blend in well with the surrounding topography. (6) The proposed development shall preserve natural vegetation and avoid development within irrigated meadows, to the maximum extent practicable. The natural vegetation will be preserved. All trees to be removed were planted by the applicant's family. Disturbed areas will be replanted as represented and/or reseeded with a native mix of grasses and forbs, as applicable. Any seed mix will be chosen in consultation with the County's Land Management Department. No irrigated meadows will be impacted. (7) The proposed development shall install utilities in locations and through procedures that minimize visual impacts to the maximum extent practicable. All utilities will be installed underground and in locations that minimize visual impacts. Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 Page 11 (8) All satellite dishes in the proposed development shall be located to minimize visibility from those rights -of -way listed in subsection (b), and shall use earth tone colors and/or screening to minimize their visual impact. Any satellite dishes will be located so as to minimize visibility from McLain Flats Road, and will use earth tone colors and/or be screened. (9) The proposed development shall not use earth moving and berms as the primary means of compliance with these regulations, but earth moving may be utilized in conjunction with other techniques to comply with standards in this section. Where earth moving techniques are necessary, man -made forms should be undulating and natural in appearance. Earth- moving and berms will not be needed to comply with these regulations. The natural topography of the lot and vegetation will provide necessary screening of the proposed development. Additionally, compliance will be achieved by breaking up the mass into three distinct forms and committing to the use of earth -toned and natural exterior building materials. (10) In the Rural Areas only, development shall be located so that activities and development occur in at least one of the locations specified in subsection 69 as they may apply to the particular property. This standard actually refers to subsection (e) and is addressed below. (11) EARTH TONE MATERIALS The exterior of all development, except development located and designed in the form of a ranch compound, shall be built or painted with indigenous earth tone materials or colors. The exterior of a ranch compound should be built or painted with indigenous earth tone materials, or shall be painted or stained using local, traditional ranch colors, which shall include shades of red, brown, or white. Paints or stains that simulate weathered barn wood also shall be permitted. Earth tone and indigenous materials will be used where and to the extent possible. The designs proposed are in complete harmony with this standard. As previously mentioned, the intent is to use a mix of earth -toned wood and stone for the exterior of the replacement home and CDU. (12) ROOFS All roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. 1000015 Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 All roofs will have a non - reflective color or composition. Roofing materials will be treated to ensure that they are non- reflective. (13) REVEGETATION OF DISTURBED AREAS Lands disturbed by earth moving or berms should be revegetated using native species that are already growing on or near the site. Topsoil shall be stockpiled and placed on disturbed areas. Irrigation shall be provided to the revegetated areas if it is necessary to ensure survival ofplanted native species. All disturbed areas will be revegetated. Also, see the response to standard (6) above. (14) DRIVEWAYS AVOID DIVIDING MEADOWS AND PASTURES To the maximum extent practicable, roads and driveways shall be located to skirt the edge of and avoid dividing meadows and pastures and to avoid major road cuts. Roads and driveways should take advantage of the screening potential of natural topography and existing vegetation. Existing roads and driveways shall be used where practical. To enhance screening, a row of trees may be planted along the roads or driveways. To the maximum extent practicable, roads and driveways located around the edge of or in meadows shall be laid out with soft, curving edges and shall avoid straight line corridors that are incongruous with the natural setting. The proposed driveway will follow the existing driveway alignment, and will take advantage of the natural topography and existing vegetation to screen it from view from McLain Flats Road. No meadows or pastures will be divided. All developments in Rural Areas are subject to additional guidelines that must be followed, pursuant to Section 7- 20- 120(e) of the Code. Development in Rural Areas should be located so that activities and development occur in one or a combination of the following locations as they may apply to the particular property: (1) at the edge of an open meadow or pasture; (2) behind an existing stand of vegetation; (3) behind or built into a change in natural topography; or (4) within a pasture or meadow, clustered in the form of a ranch compound, or adjacent to or integrated into an existing ranch compound. These standards are primarily aimed at undeveloped land on which a property owner is choosing a suitable new building site. In this case, the replacement home will be situated where the existing tennis court and a portion of the existing residence currently reside, on previously disturbed ground, and within the already approved Pfeifer Activity Envelope. The detached CDU is proposed to be built on previously disturbed ground, just southeast from where the existing home sits. Taking into account both scenic considerations and environmental concerns, the chosen sites are the only appropriate choices, are fully consistent with existing development patterns along McLain Flats Road, and will result in a development that is less visible than most of the homes on McLain Flats Road. O n O tt 1 6 Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 Page 4. Landscaping and Vegetation Protection, Section 7 -20 -130 The proposed development will comply with the Pitkin County Landscape Guidelines to preserve existing vegetation, to ensure that man made improvements are screened from view, and to preserve the rural character of the County. The predominant vegetation on the property is oak, spruce, willows and native grasses. As the proposed site plan demonstrates, only 9 trees that currently screen the tennis court will be removed to facilitate this development. The replacement home, a pond and some yard area will occupy the current location of the tennis court. Six (6) new spruce trees are proposed to help screen the replacement home from view, while two new spruce trees will be planted to the north of the new, detached CDU. All of the other existing trees on the property (over 40 trees) will remain. A final tree removal and mitigation plan will be submitted with the building permit application, and after the proposed structures and required road widening areas, if any, have been staked and approved by the Fire Marshal. In addition to the general requirements of Code Section 7 -20 -130, the applicant understands that, in the Rural Area, landscaping must be installed to: screen satellite dishes and other telecommunications equipment when located within five hundred (500) feet of adjacent public roads and visible from such roads; screen parking areas and service areas when viewed from adjacent public roads; comply with the standards of Code Sections 7- 20 -70, 7- 20 -80, or 7 -20 -120; and, revegetate disturbed areas. These additional provisions will be followed through the use of indigenous species of shrubs and trees, and the clustering of such shrubs and trees into groupings similar to those naturally occurring in the area. 5. Lighting, Section 7 -20 -140 The standards of Code Section 7 -20 -140 are applicable to all exterior lighting in Pitkin County. No lighting will be installed that violates the standards of said Section. All exterior lighting will be designed in a manner where the bulb is not directly visible from adjacent and neighboring properties or from McLain Flats Road. A detailed Lighting Plan will be included with the building permit submittal. C. Roads, Driveways, and Parkin¢ The applicant understands that all new road and driveway construction must receive a development permit from the County Engineer and Community Development Director, and that, outside of the Aspen UGB, roads and driveways must be designed and constructed in compliance with the Pitkin County Road Standards and Specifications and the Pitkin County Asset Management Plan. Also, all off - street parking spaces must conform to the standards of Code Section 7- 30- 20(b). The applicant agrees to comply with all of the above referenced standards. The minimum number of off - street parking spaces for the proposed development is three: two for the primary residence and one for the CDU. Notwithstanding the foregoing, if more than 5 bedrooms are proposed, the -f JO 0 01 7 Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 Page number of off - street spaces required is instead determined by the Community Development Director, pursuant to Table 7 -3 of the Code. The site plan shows that three outdoor parking spaces , separate and without interference with, a four -car garage are proposed for the development. D. Public Service and Utilities All development must comply with the provisions of Section 7 -50 regarding the design and installation and/or extension of public services and utilities. The Code states that extensions of public utilities shall take place within a defined Activity Envelope, which may include separate designated areas, different from those portions of the Activity Envelope designated for primary structures, accessory structures, or driveways. Additionally, disturbed areas are required by the Code to be revegetated. These standards will be followed by the applicant. Electrical, telephone and cable services already exist on the property. This property has an existing private well, for which there are no regulatory standards relative to drinking water quality. The existing septic system will be replaced by a new system. The septic system will be designed to comply with current regulations of the Pitkin County's Environmental Health and Natural Resources Department. Necessary approvals and permits will be obtained from the Colorado Department of Public Health and Environment, Water Quality Control Division. E. Approvals for the Sinele- Family Home and CDU Although the County has already granted Special Review for a CDU as well as GMQS Exemptions for the CDU and replacement residence (see Exhibit 8), the vested rights for these approvals expire on June 26, 2010. Therefore, the applicant is now requesting to renew these approvals in association with an Activity Envelope and Site Plan approval. The development's compliance with the required Code sections is demonstrated below. 1. Special Review for a CDU, Section 2- 30 -30(h) Pursuant to RS -20 zoning provisions and Section 4- 30 -50(e) of the Code, special review is required to allow a detached CDU. The subject property is located within the Rural Area of Pitkin County and it is zoned RS -20. CDU are allowed in the zone district provided special review approval is obtained, pursuant to Section 2- 30- 30(h), which establishes the criteria for approval of such uses. This application for special review approval to develop a detached CDU complies with all of the following standards, as demonstrated below: (a) The special review use shall be consistent with the applicable County Master Plan. In terms of general consistency with County Master Plans, a CDU allows for the on -site housing of an employee in Pitkin County. The site is within a substantially built - out area, and this CDU approval will be compatible with the existing neighborhood. Several CDU exist in the area and have been approved via special review. n is Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 Page 15 (b) The special review use shall not conflict with any applicable sections of the Pitkin County Land Use Code, including the County Land Use Policies in Chapter 1. The County Land Use Policies contained in Chapter 1 of the Code state that, "The dominant policy of Pitkin County is to conserve and protect from further degradation the present natural environment and its resources." The approved activity envelope, along with the conditions of the Site Plan Review approval and the commitments provided in the foregoing portions of this application will ensure that the development of this site will promote this "dominant policy." The proposed special review use does not conflict with any applicable sections of the Code. (c) The proposed development must not materially endanger the public health, safety or welfare. The development proposed on the subject property will not endanger the public health, safety or welfare. The CDU will be located within the already approved Pfeifer Activity Envelope, where the only environmental hazard (a low wildfire hazard) will be mitigated in accordance with County requirements. (d) The proposed development must not substantially injure the value of adjoining or abutting property. The County has approved numerous CDU in the last several years; not a single such approval or development has ever been demonstrated to injure, let alone substantially injure, the value of adjoining or abutting property. The development proposed on the subject property will not injure the value of adjoining or abutting properties. (e) The special review use shall be consistent with the intent of the zone district in which it is proposed to be located. The proposed Special Review Use (a detached CDU) will be located in the County's RS -20 zone district. The proposed development is fully consistent with the Intent of the RS -20 zone district. Only replacement of the existing residence, and customary accessory uses are proposed at a density consistent with the zoning. Environmental hazards have been avoided and/or mitigated, as appropriate, and the applicable use and dimensional standards are being complied with. ()9 The special review use shall be compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or shall enhance the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. Generally speaking, the neighborhood in which the subject property is located consists of large homes on parcels of land raging from 3 to 16 acres or more. This site sits just below the Starwood subdivision. Homes and associated improvements and Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 adO019 outbuildings in the area tend to be fairly large, and somewhat spread out. Indeed, many of the properties in the surrounding area have primary structures and out buildings (often used for CDU); many have been developed with CDU and/or barns and square footages similar to or greater than that proposed. The proposed development follows but does not increase upon these patterns. That is, the proposed development is wholly consistent with the character of the area. Also, please refer to the responses provided for the previous standards and those associated with Scenic Review. (y) The location, size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, traffic generation, parking, trash, service delivery, air /water pollution or other impacts on natural resources, noise, vibrations and odor on surrounding properties. Given the immediate environs and development patterns, the location, size and design of the special review use requested herein is in complete harmony with the surrounding area. The proposal envisions a low- density, single - family residential development with a house size that is consistent with neighboring homes. The activity envelope ensures an ability to maintain open space in a functional manner while avoiding or mitigating all environmental hazards, as appropriate. The impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties will be more or less nonexistent. The CDU will not result in any significantly different impacts on/to pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations or odor than is the case with the existing development or with any of the surrounding properties. Parking needs of the site will be provided for within the activity envelope and will meet County requirements with respect to amount and configuration. Trash will be stored indoors or in compliant bear- resistant containers. Service delivery will be no different than any single - family home in the area or elsewhere. Finally, adequate separation exists between the home site and neighboring properties to ensure minimization of noise, vibration or odor impacts. (h) There must be adequate public facilities and services to serve the special review use, including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. There are already adequate public facilities and services to serve the CDU, as there is already a single - family home on the property, and the surrounding area is already mostly developed to its limits. Roads, electric, gas, and telephone lines are already in place for the existing home and the surrounding single - family residences, and no significant enlargement of services and facilities will be required to accommodate the negligible difference in demand presented by the CDU. y 0 U n 10) 2 0r1 Pfeifer Site Plan Application -PID# 2643- 274 -00 -002 Page 17 The property benefits from a surrounding area with adequate public facilities and services to serve both the replacement of the single - family residence, and a CDU. It is not expected that the ability to include a CDU will result in undue impacts to parks, police, hospitals, or schools. (i) The proposed special review use must comply with any additional standards or requirements stated for such use in Sec. 4 -30 and/or Sec. 2- 40 -20. The applicant understands that there are additional standards and public notice requirements for the CDU. The applicant will comply with the requirements of Section 4- 30 -50, as is discussed in Subsection 2 below. 2. GMQS Exemption for a CDU, Section 6- 30 -40(c) The applicant has already received a GMQS exemption for a CDU, detached from the primary residence pursuant to Section 6- 30 -40(c) of the Code, which states that: One (1) Caretaker Dwelling Unit ( "CDU') may be exempted from Growth Management on any lot or parcel located in a zone district in which a CDU is an allowed use, a use allowed by special review, or a use allowed as part of a master plan, as shown in Table 4 -1. The CDU may be either attached to a single-family dwelling unit ('principal dwelling') or other use or may be detached from the principal dwelling or other allowed use if it complies with the standards in Sec. 4- 30-50(e). The proposed CDU is located in the RS -20 zone district and, as mentioned above, was already approved by special review. The CDU will comply with the standards of Code Section 4- 30 -50(c) through (g) as follows: the CDU will not exceed one thousand (1,000) net livable square feet; the floor area of the caretaker unit will be included in the total allowed floor area for the lot or parcel; at least one (1) off -street parking space will be provided for the CDU; the applicant will deed restrict the CDU in a manner which makes clear that it will not be required to be rented, will not be sold or otherwise conveyed or separated from the original parcel, and will be limited to occupancy by not more than two (2) adults, and related children, who have been found by the Housing Office to qualify as employees of the community or members of the owner's immediate family, even though they may not qualify as employees of the community; the CDU will be rented for terms not less than six (6) months if rented; and the CDU restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling be removed or modified in a manner that renders it incapable of occupancy as a dwelling unit. 3. GMQS Exemption for Remodeling and Replacement, Section 6 -30 -110 A GMQS exemption for replacement of the existing home was also approved pursuant to Hearing Officer Determination No. 16 -2007. Nevertheless, the applicant would like to have that approval refreshed as part of the forthcoming Determination. As ­000021 Pfeifer Site Plan Application -PID# 2643 - 274 -00 -002 Page such, Section 6 -30 -110 of the Code governs the creation of a GMQS exemption for replacement of an existing home as follows: (1) The applicant shall demonstrate that the structure proposed for remodel or replacement was legally created by producing a valid copy of the building permit for the structure. The existing residence was legally established. The building permit for the existing home on the property is on file with the Pitkin County Building Department, (2)The remodeling, replacement, or addition to a non - conforming structure shall comply with the standards of Sec. 9-40 as applicable This is not a non - conforming structure. (3) The use of the structure shall not be changed as part of the exemption for the remodel or replacement. There is no change proposed to the use of the structure. While it will be replaced, its use will remain single - family residential. (4) The remodeling or replacement shall occur on the same lot or parcel on which the existing structure is located, but shall not be limited to the same footprint as the structure being remodeled or replaced. The replacement will occur on the same lot on which the existing structure is located. Since this lot was legally created prior to June 12, 1978, Section 6- 30- 110(c) of the Code allows for the replacement of the existing home to be exempted from GMQS subject to the following conditions: 1. Replacement Size Limited If the total size of the structure(s) on the lot or parcel is less than or equal to the base maximum size permitted by Table 5 -1, then the existing structures can be replaced and can be expanded, up to a total of the base maximum size permitted by Table 5 -1 on the lot or parcel. The existing home is approximately 5,385 square feet (per the Pitkin County Assessor's records). According to Table 5 -1 the applicant is entitled to receive a GMQS exemption for development of up to 5,750 square feet of floor area on this lot. The additional floor area requested by the applicant has already been approved through the use of two (2) TDR, and that approval does not lapse. Elk and mule deer will travel across the property and adjacent to it. Wildlife friendly fencing should be considered if new fencing is proposed. The parcel lies within a black bear fall concentration area and human- conflict area. In fact, there have been human-bear conflicts at this residence. The proposed activity envelope encompasses the existing home, outbuildings, tennis court, and disturbed areas. Redevelopment within the proposed envelope should not have any additional negative impacts to wildlife as long as the measures outlined within section 7 -20 -70 of the land use code are followed. Care should be exercised to minimize any native mountain shrub habitat loss in the southeast comer of the proposed envelope. The following recommendations will help minimize impacts to wildlife and minimize human- wildlife conflicts: 1. all fencing be wildlife friendly as per code 2. maintain native habitat outside activity envelope and as much as possible in the southeast comer of the envelope. 3. round handled door knobs be used for all outside doors instead of lever handles in order to minimize a bear's ability to gain entry 4. contractors/construction workers are required by code to provide a bear proof container for all edible and food related trash in order to minimize an attractant for bears. Dear Mr. Horn: This letter presents the results of Yeh and Associates, Inc. geological hazards evaluation for the subject property. This evaluation is intended to provide an assessment of the geological hazards which may affect development of the property. This evaluation consisted of field reconnaissance and review of existing literature. Our investigation was conducted in accordance with Section 7- 20-20 Steep and Potentially Unstable Slopes and Section 7 -20 -50 Geologic Hazards, Sections (b) through (i) of the Pitkin County Development Standards. Planned improvements within this area include a new driveway location and residential structure. SITE CONDITIONS We visited the property on March 29, 2007. The site is located above McLain Flats Road along the eastern side of the valley formed by the Roaring Fork River. This lot is currently occupied by a house tennis courts and several retaining walls and fill slopes. The site has been subjected to considerable grading to fit the existing house into the base of a slope formed by the Mancos Shale Formation. The Salvation ditch enters the property from the south and exits at the north end of the site and is used to create several water features within the property boundaries. Natural vegetation at the site consists of oak, willow and native grasses. Most of the parcel has been developed and has ornamental vegetation planted as part of the development. The elevation at the subject parcel is approximately 7800 feet. The site slopes from east to west at an overall gradient of approximately 15% to 30 %. Bedrock outcroppings are not visible on the site. Surficial deposits on the site are residual colluvial soils derived from the Mancos Formation consisting of silts and clays with shale fragments. RESULTS Section 7 -20 -20 Steep and Potentially Unstable Slopes In general, the site is moderately sloping with well vegetated, stable natural slopes. There are areas within the proposed activity envelope where short slopes greater than 30% exist near the driveway and ditch. Slopes steeper than 45% above and below the tennis court are man-made cut and fill slopes constructed to provide a horizontal platform for the courts. The slope above the tennis court is partially retained by a wood wall, which is currently failing. Any cuts or fills, which are part of the future development should be sloped or stabilized with engineered walls or other solutions which are commonly used in this area. Additional investigation should be conducted as part of the design of the improvements to determine the types of temporary or permanent retaining systems most suitable for the project. Rock reinforcement and meshing, soil nail, tieback, micropile; mechanically stabilize earth, cast -in -place concrete and other wall types are commonly used to stabilize steep slopes in the Roaring Fork Valley. The impacts of steep and potentially unstable slopes can be mitigated. Section 7 -20 -50 (f) Mancos Shale and Section 7 -20 -50 (h) Expansive Soil and Rock The site is located on Mancos Shale bedrock and Mancos derived soils. The bedrock in the area dips at around 10 to 15 degrees to the north, northeast. The Mancos Formation consists of grey and olive -grey shale, siltstone, and calcareous shale units. Some layers contain bentonite and are susceptible to volumetric change upon changing moisture content. Overburden soils which are derived from this formation are susceptible to swelling, shrinking and consolidation. Hydrocompactive soils and expansive bedrock may be encountered. Significant settlement of the structure could result from variations in the moisture content of the foundation soils. There are many techniques available for founding structures on deposits of this type. The choice of solutions will depend on the anticipated loading, site grading, results of future investigation, and risk tolerance of the owner. Some possible solutions include driven piles, drilled shafts, micropiles, and subexcavation and replacement. A geotechnical engineering investigation specific to the proposed construction should be conducted. The report from this investigation will provide site specific recommendations for foundation design and site development. The potential for swelling bedrock and swelling or hydrocompactive soils should be considered during this investigation. The potential impacts of the Mancos Shale and expansive soil and rock can be mitigated. Section 7 -20 -50 (c). (d).(e). (fl. (e). (h). The proposed redevelopment is situated on a Lot containing approximately 7.1 acres located east of McLain Flats Road. The Lot includes a single - family residence and a detached caretaker dwelling unit. Existing grades within the building envelope are mostly manmade and range from between two (2) and ninety (90) percent. Generally, the Lot slopes from east to west and includes vegetation consisting of oak brush, serviceberry, sagebrush, aspen trees, lawn grass and native grasses. The Salvation Ditch, which flows from south to north, is located west of the existing residence and contains two piped sections, which accommodate the existing access drive and front yard. In addition, an existing water feature, with a small landscape pond, is located north and west of the existing residence. There are no major drainage channels or waterways located on or near the property, A comprehensive soils report for the Lot has not been completed within the building envelope. However, based on our experience working in the area, soils are known to include topsoil overlying silty clay with cobbles and boulders. The foundation soils will likely exhibit expansive properties at certain depths. However, based on previous percolation test results, the soils are sufficiently free draining to accommodate the use of drywells for on site storm water detention. 000043 June 25, 2010 Mr. Mitch Haas Page 2 of 5 PINNACLE DESIGN CONSULTING GROUP, INC GRADING, DRAINAGE, AND EROSION CONTROL PLAN: A comprehensive grading and drainage plan has been developed to provide adequate drainage around the proposed residential structures. The new development plan will include approximately 9,250 square feet of enclosed residential improvements. The grading and drainage plan routes storm water across the site via the use of surface swales and subsurface piping. In addition a proposed water feature with landscape ponds will assist in routing storm water runoff through the development area. The grading and drainage plan also includes the use of boulder landscape walls and a concrete retaining wall to minimize slope disturbance. A twelve (12) inch culvert pipe has been designed to convey surface water under the fire truck turnaround area, to the historic, down - gradient receiving area. Foundation drains have been designed to discharge to daylight rather than to drywells given ground water concerns from the adjacent Salvation Ditch. EROSION CONTROL: Due to the disturbance proposed on the Lot, special care should be taken to minimize the impact of storm water runoff and its erosion potential. Existing slopes should be retained to the extent possible with mechanical retaining walls as provided on the plan and, if required, should not be constructed steeper in gradient than a 1.5:1 horizontal to vertical unless retained. In addition, all excavations should be planned to minimize to the extent possible, damage to surrounding vegetation. Slopes steeper than 1.5 horizontal to vertical should be revegetated with erosion control blankets as soon as possible after excavations have occurred. In addition, silt fence should be erected on the lower portion of all disturbed areas (See Plan Sheets 1.3 and 1.3.1). MAINTENANCE: Subsurface pipes and culverts should be checked for debris buildup on an annual basis. Any encountered debris should be removed as required to ensure that facilities are working properly. Drywells should be checked annually during construction and on an every other year basis after construction, to ensure that they are functioning as designed and to check for debris buildup. If debris and sift are encountered, it should be removed via pumping or other mechanical means. Foundation drainage should be piped to daylight as opposed to a drywell given the close proximity of the Salvation Ditch and the potential for groundwater. 4. New improvements shall maintain historic offsite flow patterns. 5. Erosion control measures recommended above should be strictly followed. 6. Seed mixtures and fertilizer shall be applied by spraying them on 3:1 or steeper gradient slopes in the form of an aqueous mixture. Seeding mixtures and application rates shall be in accordance with the final specifications on the landscape plan. Portions of the proposed driveway will include grades up to a maximum of 9.4 %. In addition, the new driveway will be widened to sixteen (16) feet to accommodate emergency vehicles and fire truck access. The driveway will include an emergency vehicle turnaround/guest parking area to facilitate fire truck turning movements. Cut and fill slopes associated with the new access drive have been designed to be no greater than 1.5:1 horizontal to vertical in order to minimize slope disturbance. In addition, the final surface of the new driveway will include four (4) inches of hot bituminous pavement overlying six (6) inches of Class 6 aggregate base course. SHALLOW UTH.IMS: Currently, existing primary electric, telephone, cable television and natural gas exist at the site and will provide adequate service for the development. Given the proposed size of the new residence and caretaker dwelling unit (CDU), a new 2 -inch natural gas service should be extended to the development from an existing 2 -inch natural gas main located southwest of the existing driveway spur. New secondary electric, cable television and telephone services should be installed for both the new residence and CDU as shown on the proposed utility plan. WATER SERVICE: Water service to the Lot is supplied by the White Horse Springs Water District. Based on a discussion with the Aspen Fire Protection District, the existing system will provided adequate flow and pressure. An existing six (6) inch water main is located along the west property line, from which a one (1) inch water service currently extends to the existing residence. We recommend that this existing water service be upgraded to a new two (2) inch copper water service for future domestic water demands and fire sprinkler supply (See Sheets 1.4 and 1.5). ON -SITE WASTE WATER SYSTEM: Based on a review of the existing septic system as- builts, there are currently two (2) septic tanks and three (3) seepage pits on site. This type of treatment system is likely the best design for the site given the steep slopes and proximity to the Salvation Ditch. However, the existing system will require upsizing given the increased floor area being proposed. INC. of 2,100 square feet requiring the addition of another seepage pit having the dimensions of 14' x 14' x 9' deep. Given our review of the site, there appears to be sufficient area within the building envelope to accommodate the additional seepage pit. In addition, the septic tank capacity will have to be increased to a total volume of 2,750 gallons. This will necessitate the replacement of the existing tanks with two (2) new septic tanks, having a capacity of 1,000 gallons and 1,750 gallons respectively. In the final design, we are recommend that a 1,000 gallon pump vault and distributing valve be installed to convey effluent to the seepage pits. If the ISDS is upgraded as recommended above, it will provide adequate capacity and the proposed development will comply with current Pitkin County Environmental Health Department guidelines.
