The Lot is generally described as Lot 28 within the non -BOCC approved Sopris Mountain Ranch Subdivision and is located at 111 Sopris Mountain Ranch Road. PID #: 246533401008. 2. The Lot is approximately 35.19 acres in size, is in the RS -30 zone district, and is conforming in size. 3. The Lot is currently developed with a single family residence. The Lot is part of a conglomerate 1041 Hazard Review for Sopris Mountain Ranch pursuant to BOCC Resolution 91 -171 (Reception No. 348646). 4. The Applicants initially submitted a site plan review for extensive landscaping, construction of a pond, and ground mounted panels. After Staff preliminary review and a site visit, it was determined that the Applicants could proceed with landscaping and other work that was contained within the previously approved building envelope. Construction outside the approved envelope required an amendment. The Applicants have also eliminated the request for ground mounted solar panels and have now proposed that they be mounted on the roof. 5. The Director finds that the Applicants have addressed Section 2- 20- 150(b) of the Code and have shown compliance with these standards for an amendment to their previous approval. The amended envelope will not violate provisions in Chapter 7 of the Land Use Code. APPROVED by the Director, subject to the following conditions: 1. The Applicants shall submit for a fire sprinkler permit for the 10,000 gallon fire suppression water tank. 4. Prior to submission of the fire sprinkler permit for the water tank, the Applicant shall he required to submit for approval by the County Attorney and Community Development an amended envelope plan in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The Sheffers have several options available to them to secure an alternative source of supply for their pool. They need to be listed separately as swimming pool or wading pool etc on the actual permit itself. That is why I requested proof of where the water to fill the pool will come from — they look at not only the use (filling the pool) but also the evaporation etc. If the Sheffer's desire to use their well water in their pool, they will need to submit a new permit to the Colorado Division of Water for that use. In this particular instance I have a Applicant who is claiming that pools can be filled based on the 'domestic' use listing on a well permit and that fact that the permit does not state a specific limitation. In this particular instance, the property has a two acre development lot. Although the house is large, I would estimate that the landscaping /yard area around the home is at least % of the envelope (at least). Once again, I appreciate any clarification I can get on the matter. The specific well permit is included in the attachment. This permit, No. 161998, was issued to the original property owner Chris Newbert who was the original owner of the property now owned by the Sheffers. I have attached a copy of the original permit along with a legal description of Parcel 28, a copy of the Well Completion Report, the Pump Installer's Report and the Change in Ownership form, which changed the State's registration of the well from Newbert to Sheffers. As shown on the well permit, it was issued by the Colorado State Engineer's Office on June 21, 1991 and permitted as the only well on a parcel of land including 35 acres. The Conditions of Approval indicate the well shall be used in such a way as to cause no material injury to existing water rights. As the only well permitted on 35 acres, the State refers to such a well as an exempt well as it is assumed to have de minimis impacts on other wells and water rights and is exempt from water rights administration by the State due to the permit limitation on pumping rate and annual withdrawal and its negligible impact on the aquifer. The well was permitted to pump at a rate of not more than 15 gallons per minute and permitted to withdraw not more than 1.5 acre feel per year. Under the Detailed Description of water use, the permit states, "All domestic uses with State and County approved septic and leach field. " All domestic uses includes the irrigation of up to one acre of lawns and gardens and all household uses, which the State typically accepts as including fire protection, a pool, hot tub, car washing, domestic animals, et cetera. If a permit is intended to limit the uses of water from a well, those limitations are contained within the Conditions of Approval section of the permit, and no limitations were found in this permit. Therefore, the use of water from this well for pool and water feature make -up water (I understand the pool would be filled by another source) falls within the parameters of the issued well permit. The addition of the pool is also typically viewed as a benefit for fire suppression in rural locales such as Sopris Mountain Ranch. It is my understanding that the storage of water in such pools during wildfire season is desired by the local fire BEACH ENVIRONMENTAL, LLC Page 2 July 13, 2010 - marshal. Each of these uses is an appropriate and beneficial use of water from the well so long as the annual total diversion of 1.5 acre feet (488,745 gallons) is not exceeded. The installation of a reflecting pool, pond, flow -form water feature, and spa. 2. The installation of patios extending from the south side of the existing house around to the east and adjoining the driveway. 3. The installation and expansion of the radius of the driveway with concrete surfacing, of which 1000' sq. ft will have snowmelt. 4. The installation of a 6kw PV system spanning the existing leach- field, as approved by Environmental Health. 5. The installation of a berm and various trees on the west side of the house to help mask the house from adjoining properties and the County road. 6. The installation of 10,000 gallons of water storage at the entrance of the driveway for fire suppression as needed by the Basalt Fire Protection Dist., and irrigation. As noted in the pre - application Conference summary, the existing building envelope was established through a 1041 Hazard review and a building permit (2 -89) issued on 06/18/1992 and a Certificate of Occupancy issued on 02/18/1993. Removal of any trees will actually bring us into compliance with the wildfire assessment. Revegetation in the area of the water storage will be with County approved grass mixes. The tank or tanks are located where no tree removal is necessary. All areas downhill from the planned excavations will be protected to specifications of the County. • 7- 20 -20; All excavation and relocation of materials is within previously leveled ground. The areas at driveway will actually be improved through the stabilization of banks through the installation of low retaining walls and boulders. • 7- 20 -30; There are no flowing water courses across the Building envelope. All flows from melting snow flow toward the bar ditch adjacent to Sopris Mountain Ranch road or into the bar ditch adjacent to the driveway and directed to a culvert under the drive. None of the improvements planned will hinder those existing conditions. Sedimentation control will be in place prior to excavation. • 7- 20 -60; Wildfire hazards are covered in the report from Hougland A Associates, dated June 3r 2010. The existing house is sprinkler'd and the appropriate water storage is available. We intend to increase the water storage by 10,000 gallons placed as recommended by the Asst Fire Marshal, Brian Benton, of the Basalt 6 Rural Fire Protection District. „ • 7- 20 -70; We are willing to comply with any mitigation requirements recommended by this process. The only area of planned disturbance of native vegetation is where the fire water storage tanks will be located, and that is native grasses and sage. Only other native vegetation disturbance will be to comply with the fire hazards recommendations. • 7- 20- 120(d); No portion of this improvement will be visible from West Sopris Creek road, except trees to mask existing structure. Box 97 Carbondale, Colorado 81623 704 -0347 ph Subject: Wildfire Hazard Mitigation Recommendations for The Sheffer Residence, Lot 28, Sopris Mountain Ranch, Pitkin County, Colorado Dear Mr. Cole, Thank you for meeting me on site at the Sheffer residence on Tuesday, June 1 s1 to orient me to the property and the proposed work to be done there. I also appreciate your providing me with the Grading Plan, Planting Plan and other helpful information. The existing home is constructed on a platform providing a setback of from 20 to 30 feet to the 30% +- down slope to the northwest and 15 to 30 feet to the 30% +- up slope to the southeast. It appears as if consideration was given to providing some effective defensible space around the home when it was constructed. The trees around the house within 15 to 20 feet consists of mostly aspen, some scattered conifer and what appears to be a cottonwood or two. There are some ornamental bushes and the area around the house appears to be irrigated sod and native grass that at this time has been maintained at 6 inches or less. The native slopes above and below the house are typical of the area and thickly covered by scrub oak, service berry, other native brush and grasses. Because of the steep slopes, the type and continuity of this vegetation I determine that the area is within a High Wildfire Hazard Area. However, the location of the house and the work already done to provide defensible space provides a very good opportunity for some improvement. The providing of a Planting Plan for my review provides me the opportunity to comment and make recommendations in the interest of the Owner's. Vegetation Management and Modification Recommended: Around the house and beyond the furthermost projection of combustible construction for a distance of 15 -feet the Planting Plan appears to indicate primarily noncombustible hard scape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well - trimmed and irrigated plants. Woody 000035 vegetation should not be planted within this area. Firewood or other combustible materials should not be stored within this area. If the owner would like to have a few ornamental trees near the house this may be done if the 15 -foot area is extended outward from the furthest growth expected from the mature trees. In other words, these trees should have defensible space as the buildings do. The southwest corner of the house is within about 20 feet of the 30% down slope. The Planting Plan indicates a dwarf blue spruce and some aspen trees and shrubs near the corner of the house. Within about 10 feet of these the PP indicates some conifer on the down slope. Given the native vegetation in this area I believe that this will provide a continuous fuel path to the house. I recommend that there be at least 15 feet between the canopies of trees planted near the house and the conifers on the slope. I further recommend that this cluster as well as the cluster of conifers to the northeast be separated from any native vegetation on the slope by a distance of 20 feet. I understand that the Owner's wish to provide screening for the house on the northwest side. The Planting Plan appears to provide for this and is acceptable as long as the separation from the native vegetation is accomplished as described in the paragraph above. 2. Beyond the 15 -foot area up to 50 feet down slope of the house thin existing trees and brush into individual or clusters. Oak and service berry should be thinned and clustered. Much of the oak is naturally clustered in this area and that can be taken advantage o£ No brush or shrubs which when mature will be tall enough act as ladder fuel should be provided or maintained around the trees. Clusters of bushes or shrubs should be separated from each other and from those beyond the 50 foot area by a distance of 2 '/z times the height of the mature vegetation. The diameter of a cluster should be limited to 2 '/z times the height of the mature vegetation. A� an example: If the expected mature height of the vegetation is 10 feet then the diameter of the cluster should be no greater than 25 feet and the distance between clusters should be greater than 25 feet. Ideally the plant material growing between trees and clusters of bushes or shrubs is grass maintained at 6- inches or less. Cut materials should be either removed or chipped and spread. 3. The driveway to the house has native vegetation and a considerable amount of standing dead and deadfall adjacent to the driveway. I recommend that for a distance of 10 feet from the all weather surface of the driveway the oak, service berry and other native brush be thinned and the standing dead and deadfall be removed. Remove or chip all standing dead and deadfall within 100 feet of the house. The plans indicate no additions to the house and appear to be hardscape and non combustible construction. Sometimes I'm able to find info that would lead me to the file in case it was misfiled, but not here. I do see that the field is not trenches, but in fact an evapotranspiration bed. The soils were very poor and this type of system was sometimes used when soil conditions were not optimal. Digging into the area of the field would not be advised, however, if you were able to straddle it, as you are proposing, that would be OK. Unfortunately, I have no information to give you (like an as -built drawing) which would give field dimensions, etc... Digging into the field at all could be very bad. I'm going to assume this system may actually contain a liner. Sorry I can't be of more help. Maybe the owner kept files of some sort when they bought the property. I asked specifically if the Emma Caucus needed to review these plans and get approval from the Caucus for them to move forward on this project. As I suspected, Joanna stated this will not need Caucus approval. She did mention the pool would require a permit and that is a County matter. If for any reason the Sheffer's do need Caucus approval, please let me know and I do what I can and as quickly as possible to run that by the Executive Committee for consideration and discussion. I doubt the Caucus members will feel it necessary to review this sort of thing as we would be forever be bogged down by landscaping requests unless negative visual impacts to the area would occur.
