Dff r I 2010 1. Pursuarrt to C.R.S. 39-8-101, the Board of CouMy Commissior�(BOCC) of Pitkin Courrty shaN comprise the Board of Equaliz�ion (BOE). 2. T'he BOE is charged with the duty of assuring that the Assessor fairly and equafly applies a�raisal proc�dures. 3. The volume of appeala � 2010 will exceed the amourtt of time that the BOCC has avaNable to sit as the BOE. 4. Pursuant to C.R.S. 39-8-102(2)(� the BOE has the authority to appoirrt independerrt referees (hea�ing afficxrs) who aro experienced in property valuatior� to conduct hearings, and on behalf of the BOE, make findings and submit recommendations to the BOE for its �nal action. 5. The BOCC wishes to appoint hearing officers to act on b�ehaif of the BOE. 6. The BOCC ha� considered the applications and qualifications of persons irtterested tn ac�ing as hearing offi�rs on behalf of the BOE and desire to make appointments at this time. 7. Pursuant to C.R.S. 39-8-108.5, if a pet�ioner is not saatisfied with the BOE's decision they could choose to go to arbitration. 8. Pursuant to C.R.S. 39-8-108.5, the BOCC shall develop a ilst of persons who shall be qualff�c! to act as arbltratora of propeity valuation disputes. Such list shall be kept in the offtce of the county clerk and recorde�. . 9. Pursuar�t to C.R.S. 39-8-108, qualif�+d arbitrators in addition to beir�g either an attamey licensed to prac�Ce Isw ln the state, an appraiser who is a member of the instttute of real estate appraisers or its equrvalent, a former county assessw, a rotirod judge or a licensed real estate broker must also be a rcgistered or cert'rFied appraiser. 10. The BOCC has considerod the appl"ications and qualifications of the persons iMerested in acting as arbitrators pursuarn to C.R.S. 39-8-108 and desire to approve a list of arbitrators at th� time. The County's obligation under the Workers' Compensation Statute requires Pitkin County and you to formalize the terms of this engagement in a notarized writing. Service as a Hearing Officer to hear appeals of property tax valuation set by the Assessor on behalf of the Board of Equalization (Board of County Commissioners). Compensation shall be at a rate of $150/hour. It is mutually agreed that the County does not have an exclusive right to your services and it is contemplated that you may provide similar work to other businesses, governments and non-profit organizations. You acknowledge that the work performed for Pitkin County will be that of an independent contractor and that no employee-employer relationship is created. You have full control over how the services are performed and it is expected that work will be conducted in accordance with industry standards by applying professional judgment. The County will provide, if necessary, documents and information to complete the work described in the preceding paragraph. The County representative signing this letter is available to you to discuss any details related to this engagement. This letter of engagement will terminate on December 31 St and will require a new document in succeeding years to be effective.
