GRE II LP ("Applicant"), has made a request to the Community Development Director of Pitkin County, ("Director"), pursuant to Section 7-10-30(b) and Section 7-20-120(c)(4)(b) of the Pitkin County Land Use Code ("Code"), to exempt an addition to an existing residence from formal planning review. 2. The property is zoned RS-20 and wntains approximately 37.4 acres; PID#: 2643-233-00-002. 3. The property is located at 1025 Star Mesa Road (Legal Description, Attachment A). 4. The Applicant has not formally applied to the Community Development Department, however the Community Development Director can make a finding to exempt a development activity from review. The Applicant has provided information to the Director in the form of elevation renderings and a brief review of previous land use approvals. The proposed addition to the existing residence has been located within the previously approved building envelope and avoids constrained areas. 5. A building envelope was recorded for the parcel at Book 523 Page 851; however a site plan has never been recorded. 6. The existing residence obstructs a ridgeline as viewed from Woody Creek Road. The proposed addition (Attachment B) will be visible from Woody Creek Road; however it has been located. and designed to minimize the perceived mass of the existing residence. Window screening will aid in mitigating its visual impacts. The Director finds that the request is reasonably consistent with the requirements of the Pitkin County Land Use Code specifically Section 7-10-30(b) and Section 7-20-120(c)(4)(b). EXEMPTED by the Director, subject to the following conditions: The Applicant shall adhere to all previous approvals unless otherwise amended by this Administrative Determination. 2. The Applicant shall adhere to all representations made during the exemption process. Any deviation from what was represented will require additional review. 3. No vesting of property rights is associated with this exemption: 4. The Applicant shall submit a payment of $624 for 2 hours of staff time to process the exemption. Large windows facing Woody Creek Road shall utilize window treatments that screen obtrusive light during nighttime hours. If the residence is not occupied and lights are utilized for safety purposes, window treatments shall be on timers to appropriately screen light. 6. The Applicant shall comply with all provisions of Section 7-20-120(d) of the July 6, 2006 Land Use Code unless otherwise amended by this Determination. 7. Failure to comply with the conditions of this Decision may result in revocation of previous land use approvals and/or legal action. I asked Mike Kraemer (the Planner who drafted the exemption determination) our questions; here are the answers. First, the 2006 exemption has no vesting associated with it; therefore it cannot be used for any new additions/remodels which you are planning. It was only good for the one time. Second, if you wish to have the new additions/remodels which lay within the existing building envelope reviewed for exemption, there is a 2 hour/$624 planning fee + $25 for web tech fee for staff time to process the exemption (one hour for site visit, one for review & determination) [We have had 2 fee changes since the 2006 exemption; the current fee is $312/hr. If you choose to go this route you should submit your elevation plans (for the residence), along with the Scenic View Protection Exhibits/Technical Report for review; also you will need to submit the 2 foot topo information for the area of the swimming pool and the proof of water and the floor plan (remember that Accessory structures with bathing facilities require special review as do CDU's. Please note that the exemption will NOT apply to any work done outside the existing envelope. If the applicant intends to propose development outside the existing envelope, we will require a minor amendment to a development permit application to be submitted. The fee for that is 3 hours with a $936 plus $25 for the web tech fee. You will note that in order to process both reviews the totals match the fees and requirements as listed on the pre- appsummary which I prepared (5 hours, $1639; the exemption/minor amendment route will actually cost $25 more). Additionally, under the Site Plan process your client would obtain a vested right which acts as insurance against changes in the Land Use Code over the next three years as opposed to having no vested rights with the Minor Amendment & the exemption....food for thought! By using the existing programming the location of an addition to the east was determined. The mass and scale of the addition sensitively expands the living space to the east. The Administrative Decision No. 95-2006, pertaining to a proposed addition in the same location assisted our process in determining overall mass of the addition, although a departure from the rigid form of the existing residence. This assists in minimizing the perceived mass from the site as well as having minimal impact on the view from Woody Creek Road.
