giJMMARY: Pursuaat to Section 2-20-170, the Applicant is seeking a reinstatement of vested property
rights for a lot in the Brush Creek Village Subdivision. The Applicant has verbally indicated that a 3
year vesting period is desired.

LOCATION: The Lot is located in the BOCC approved Brush Creek V illage Subdivision a�d is legally
described as Block 7, Lot 1, Filing 1. PID #2643-213-OS-002.
ZONING/LOT SIZE: The Lot is zoned RS-30 and contains approximately 2.9 acres.
BACKGROIlND: This lot contains a continuous steep slope that begins at Medicine Bow Road where
access to the building site is provided. A building envelope was proposed and denied that was sited at the
top of the lot through the 1041 Hazard Review process in 2005. Pursuant to Hearing Officer Determination
No. 25-2006, the Lot could not comply with a provision in the 1994 Land Use Code that required driveways
not impact slopes > 30% for more than 100 lineaz feet. The applicant subsequently filed for a Takings
Hearing in which the BOCC found a takings had occurred and remediated that takings pursuant to
Resolution No. 81-2006. This remediation resolutio�, that includes conditions for construction, can be
viewed in the ApplicanYs submittal packet under Section 3.
The Applicant submitted for a building permit for a single family residence on July 8, 2009 under this
remediation resolurion. Shortly after the building permit was submitted, vesting for the remediation
resolution expired on July 12, 2009. The permit was not issued and subsequently expired on 7uly 8 2010.
Recently, the BOCC adopted an ordinance that extended expired 2010 building permits to the end of August
2011. This permit qualifies for that e�ctension and will now expire nea�t August.
Pursuant to section 2-20-1709(d), the Applicant submitted a complete reinstatement application within 1
year of the expired vested rights for the Lot.
REFFERALS: Staff refened the request to the Brush Creek Village Metro District and the Planning
Engineer. Planning Engineer comments can be viewed as Attachment A.

STAFF CObIMENTS:
vESTED RIGHTS EX1'ENSION: Pursuant to section 2-20-170(d), the BOCC shall consider the following
criteria in reviewing a request for a reinstatement of vested property rights:
1. The applicant's compliance with any conditions reguiring performance prior to the date of
application for extension or reinstatement of vested rights.
Response: To date, the Applicant has shown compliance with all applicable conditions in previous land
use approvals and permit submittal. As stated earlier, a building permit was submitted, expired, and then
extended under BOCC direction until August of 2011. A temporary access permit was applied for and
issued for construction of a rough road that could access the building site to conduct soil samplings, etc.
This is the only permit that was issued for the Lot.
2. The progress made in pursuing the project to date, including the effort to obtain any other
permits, such as building permits, and the expenditures made by the applicant in pwsuing the
project.
Response: The Applicant has provided renderings of the residence that would be constructed in the
future, however, has stated that the design may change. The Applicant purports that $115,000 has been
expended in azchitecture, engineering, contractor fees in the effort to submit a building permit.
3. The nature and extent of any benefrts already received by the Counry as a result of project
approval, such as impact fees or land dedications.
Response: In response to this standard, the Applicant states that a$6,534.83 building permit fee was
paid in addition to approximately $1,188 in other administrative fees. A$3,500 performance bond for
revegetation of the temporary access drive is also being held.
4. The needs of the County and the applicant that would be served by approval of the extension or
reinstatement request.
Response: The Applicant has azgued that reinstatement of vesting would serve a County need by
eliminating redundancy of duplicate applications and identical processes that might result in the same
outcome. As correctly stated by the Planning Engineer in Attachment A, pursuant to Section 7-20-
20(c)(5), if an identical application were submitted under an Activity Envelope process, it would be
denied because slopes > of 30% would be impacted for more than 100 lineaz feet. If denied a second
time, in theory, the Applicant would then apply for a takings heazing and the BOCC would have the
discretion to, again, find if a takings had occurred and remediate appropriately. This would be the same
process that the Applicant navigated through in 2005-06. Staff feels that this is a strong argument for the
BOCC to use if they wish to make a finding to reinstate vested rights.
STAFF DISCUSSION AND CiJRRENT CODE IMPLICATIONS:
It should be noted that the 2006 Land Use Code still requires that driveways not disturb slopes > 30% for
more than 100 lineaz feet. If an identical proposal was submitted, that proposal would have to be denied at
an administrative level.
A full building envelope review was conducted at the time of the takings hearings in 2006. No other current
Land Use Code standazds would be compromised if vesting would be reinstated, including but not limited
to, ridgeline review.

In 2005 and -06, the building envelope was reviewed under the 1994 Land Use Code and site plan review
was not required at that time. Under today's Code, the Applicant would be required to provide a site plan
for the Lot that located all development within approved envelopes. Given the size of the lot and its
physical constraints, site plan review would not result in significant changes to the approved envelopes.
RECOMI��NDATION: As the property has a current building permit application that is in process and
viable up until August 2011, Staff does not think it would be appropriate or necessary to reinstate the vested
rights of the land use approval at this time.
Staff recommends that the BOCC adopt a motion to deny the 1355 Medicine Bow Road LLC
Reinstatement of Vested Rights request, subject to the attached draft Resolution.

1. 1355 Medicine Bow Road LLC ("ApplicanY') has applied to the Pitkin County Boazd of County
Commissioners (`BOCC") to request a 3 yeaz reinstatement of vested properry rights.
2. The Lot is legally described as Filing 1, Block 7, Lot 1 of the BOCC approved Brush Creek Village
Subdivision. The address for the Lot is 1355 Medicine Bow Road.
3. The Lot is zoned AR-10 and is approximately 2.9 acres.
4. The Lot is currently vacant. The Lot was denied a building envelope through the 1041 Hazard Review

NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Boazd of County Commissioners that
it does hereby deny the 1355 Medicine Bow Road Reinstatement of Vested Rights request.

Comments:
This request continues to not meet the current land use code, and if it were to be reviewed
as a new applicafion I would recommend denial based on code section 7-20-20 (c) 5,
which limits driveway development on steep slopes.
If the application is approved I propose the following conditions:
➢ The applicant shall submit for a new Access Permit prior to the commencement of
any construction work. The permit applicafion shall include:
� A detailed landscaping and screening plan that addresses the driveway
retaining walls specifically.
• All requirements of the fire department.
➢ The applicant shall demonstrate that historic runoff rates are not increased due to
the proposed development; all historic and natural drainage patterns shall be
maintained.
➢ All retaining walls four (4) feet in height or tatler shall be engineered.
➢ All utilities shall be placed within the driveway alignment.
➢ A detailed drainage and erosion control plan shall be submitted with each
development permit. If the total development disturbs one (1) acre or more a State
Stormwater Permit shall be applied for and obtained.
➢ The applicant shall submit a detailed Construction Management Plan with each
development permit that addresses all phases of construction.

Our law firm represents 1355 Medicine Bow Road, L.L.C. (the "Applicanf'), owner of the
above referenced property situated within Brush Creek Village, Pitkin County, Colorado (the
"Property"). The Applicant is seeking Reinstatement of Vested Property Rights pursuant to Section 2-
20-170(d) ("ReinstatemenY') as the existing vested rights period lapsed July 1 Z, 2009.
BACKGROUND
The Property contains approximately 2.9 acres of varying slopes with oak shrub and sage brush
vegetation, some juniper trees and a view plane predominately to the Northeast. Additionally, the
Property is zoned AR-10 with access from Medicine Bow Road near its intersection with Juniper Hill
Road.
An initial 1041 Hazard and Ridgeline Review application to establish building and access
envelopes at the Property was submitted by the Property�s previous owner, Michael Vernon, in 2006.
The application was denied because the proposed access envelop exceeded disturbance of a 30% slope
for more than 100 linear feet in violation of subsection 3-80-050(c)(1)(e), Pitkin County Land Use
Code (the "Code"), 2004 edition.� Pursuant to Mr. Vernon's request for a"Takings'� determination
after the denial, the Board of County Commissioners (the "Board") issued Resolution No. 051-2006
on August 9, 2006 (the "Resolution") finding that the denial of Mr. Vernori s application amounted to
a Taking of all reasonable use of the Property because the only feasible access envelopes exceed
allowable disturbance. The Board cited that the Property was legally created as a part of Brush Creek
Village and remediated the Taking by ganting vested building rights through July 12, 2009. Gunter
Schaldach subsequently purchased the Property from Mr. Vemon and pursued development in
accordance with the Resolution.
� � The Code is now in its 2006 edition. Sections 7-20-20(c)(4), (5) now contain the excess disturbance prohibition
referenced herein.

� PRELIMINARY REPRESENTATIONS
The Applicant now seeks Reinstatement and makes the following representations concerning
its request:
1. The Applicant purchased the Property from Mr. Schaldach for valuable consideration
on May 25, 2010; less than two months prior to the outside deadline to apply for Reinstatement.
Z. Mr. Schaldach designed and submitted plans for a 4,768 square foot modulaz residence
at the Property (Exhibit 2A) and diligently pursued all necessary permits to construct the residence.
3, The Applicant seeks Reinstatement so as to allow more time to consider either building
entirely diffe ent p aw th n and access en elopes establ shed by thetResoluhon �gning an
4. Administrative efficiency will be served by granting this Reinstatement request as the
Takings determination in the effective Resolution is the only conceivable mechanism for approved
development at the Property. Access and building envelopes have been appropriately drawn in
accordance with the Resolution remediating the same.
� 5, The Applicant shall conform to conditions set forth in the Resolution in all respects
upon Reinstatement. Without approval of this Reinstatement, the Applicant will need to evaluate the
feasibility of development given the Takings issue and other development requirements.
PROPOSAL FOR REINSTATEMENT OF VESTED PROPERTY RIGHTS
This section of the land use application demonstrates compliance with the standards listed
below. Code standards appear in bold followed by the Applicant's response.
Section 2-20-170(d)
Extension or Reinstatement of Vested Property Rights: Reinstatement of Development Approval
(a) The ApplicanYs compliance with any conditions requiring performance prior to the date
of applicarion for extension or reinstatement of vested rights;
The Applicant understands that Mr. Schaldach substantially complied with conditions requiring
performance prior to the date of this application. Conditions set forth in the Resolution reflect
meaningful consideration of, inter alia, impacts to wildlife, wildfire mitigation, re-vegetation and
preferred structural design options. Site plans and architectural renderings prepared and submitted by
Gravitas, Inc. incorporate these design and mitigation conditions; particularly those design conditions
set forth in Condition 7 pertaining to heat traps, windows and glass, exterior walls and siding and
foundations. Additionally, Mr. Schaldach sought and received one variance pursuant to Condition 4 of
� the Resolution for a serpentine retaining wall in the access design that exceeded applicable height
restrictions.

As the initial denial of Mr. Vernon's 1041 application was based on proposed access enve opes
that exceeded allowable disturbance, the most critical conditions set forth in the Resolution are
necessarily those pertaining to access and building envelopes. Access Development Permit
Application no. 0036.2009.PAOM was approved on October 1, 2009 for preliminary development at
the Property (Exhibit 2B). Without convoluting the instant application with the full barrage of
azchitecture and design submittals to date, a few renderings demonstrate compliance with the most
critical conditions for development in the Resolution:
1. The Site Layout Plan (Exhibit 2C) incorporates the recommended wildlife buffer area
from the westem Property line, delineates proper access and development envelopes and indicates that
no material development shall occur outside approved envelopes pursuant to Conditions Z and ]0 of
the Resolution;
2, Civil Engineering drawings commissioned by Roaring Fork Civil Consultants, Inc.
(Exhibit 2D) address development on Mancos Shale and expansive soils, appropriately address access
traversing slopes in excess of 30% and evidence adequate drainage and erosion control pursuant to
Conditions 3(A), (C) and (D) of the Resolution;
3. The Foundation Layout (Exhibit 2E) adheres to appropriate seismic risk standards and
� demonstrates stabilization measures adequate to mitigate slope instability and shrink-well properties
pursuant to Condition 3(A) of the Resolution;
4. The Landscape Plan (Exhibit 2F) addresses revegetation of disturbed areas pursuant to
Condition 3(E) of the Resolution; and
5. The Roof Plan (Exhibit 2G) demonstrates compliance with applicable building code,
pitch and materials standards with its standing seam metal design pursuant to Condition 8(A) of the
Resolution.
Certain other conditions set forth in the Resolution are not yet ripe for compliance as
construction has yet to commence. While the residence may be redesigned, however, the Applicant
represents that it shall comply with all conditions of development.
(b) The progress made in pursuing the project to date including the effort to obtain any other
permits, such as building permits, and the expenditures made by the applicant in
pursuing the project;
Mr. Schaldach moved substantially towards construction of a modern and efficient modular
residence at the Property in strict compliance with the Resolution. Access permits have been issued
and only a few design issues hang in the proverbial balance of final building approval. Mr. Schaldach
� expended in excess of $ll5,000.00 on architectural and modular-specific design concepts, structural,
civil and soils engineering, interior design and surveying services at the Property. Additionally, Mr.

Schaldach spent countless hours consulting with his architects, attorneys, engineers and contrac ors
throughout his period of ownership.
The Applicant acquired the Property for $1,026,000.00 on May 25, 2010; less than two months
prior to the outside deadline to apply for Reinstatement. The substantia] consideration paid by the
Applicant for the Property reflects its intent to `acquire' the fruits of Mr. Schaldach's design and
development efforts in addition to the Property itsel£ Whether the Applicant pursues construction of
the modular structure designed and submitted by Mr. Schaldach or a different concept altogether, it
seeks to pursue an end product that is modern, efficient and consistent with current standards of
reduced mass and sustainable design.
��) The nature and extent of any benefits already received by the County as a result of
project approval such as impact fees or land dedicarions;
As the instant Reinstatement request concerns the proposed development of a modular
structure substantially less than 5,750 square feet within the established Brush Creek Village
subdivision, land dedications and impact fees are inapplicable. However, it should be noted that Mr.
Schaldach paid the following administrative fees throughout t�e Board of Adjustment fee,
the Property. (1) Building Permit initiation fee —$6,534.83; O 4 Access Permit fee —
retaining wall variance —$648.00; (3) Performance Bond —$3,500.00; and O
� $540.00.
(d) The needs of the County and the applicant that would be served by approval of the
extension or reinstatement request;
As indicated, a� development at the Property is contingent on a Takings ruling and
remediation of the same because the only feasible access envelopes exceed allowable disturbance.

in the Resolution so as to prevent the App �
inventing the wheel' concerning the Takings determination. With Reinstatement, the Applicant would
remain subject to stringent re-vegetation, wildfire and wildlife mitigation, structural design and permit
submittal conditions set forth in the Resolution. Absent Reinstatement as requested herein, the
Applicant, the Board and all interested agencies would be forced to duplicate the tedious and cost-
intensive Takings determination, remediation and issuance of conditional vested rights only to affect
the same outcome as Reinstatement. It is uncertain whether the Applicant would pursue development
at the Property absent Reinstatement.
(e) The Board shall also take into consideration the length of any appeal process or litigation
and the subsequent effect of a lessened vesting period for property rights.
No appeals processes ar litigation has affected development at the PropeRy.
The Applicant seeks Reinstatement so as to afford it more time to pursue development at its

approval of the Vernon ]041 Hazerd and Rldgeline Review subject to the following conditions, wbich slizll

1. The Applicant ehall adhere to all meterial representations made in the 1041 Hazard and Ridgeline
Review.

PITKIN CO[JNTY (hereinafter "COUN'I'Y") and 1355 Medicine Bow Road, LLC
(hereinafter "APPLICANT'� AGREE AS FOLLOWS:
1. APPLICANT has submitted to COLJNTY an application for
Reinstatement of Vested Rights (hereinafter, the "PROJECT").
2. APPLICANT understands and agrees thai Pitkin County Ordinance No. 30-2009 establishes a fa
structure far land use applicationa and the payment of all processing fees is a condition precedent to a detexmination of
application completeness. The fee struchue is based on the COUNTY'S policy that development shall pay, in futl, the
cost of development review in the COIINTY. Fxs have bear set to be consistent and fair to the public and to reflect the
expense incuered in prwiding such services to the public.
3. APPLICANT and COiJNTY agce that bxause of the size, naLUte or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full cxtent of the costs iuvolved in processing the
application.
4. APPLICANT and COUNTY agee that fees charged for the processing of land use applications shall
accumulate if an application i�ludes more dian one type of land use review.
5. COUNTY and APPLICANT tiurher ag�ee that it is impracticable for COI7NTY staff to compiete
� processing or present sufficient infom�ation to the Planning Commission and/or Boazd of County Commissioners to
enable the Planning Commission and/or Board of Counry Commissioners to make legally required Fmdings for project
approval, unless current billings aze paid in full prior to decision.
6. Therefore, APPLICANT agees that in consideration of the COUN7'Y'S waiver of iu right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of S 2.272.00
wlrich is based on hours of staff time, and if actual time spent by staff to process the application exceeds the average
numba of hours by more than 20%, then the CO[JN'lY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPLICANT fiuther agees that failure to pay
such accrued costs shall be grounds for suspension of processing.
