NORTHWEST COLORADO COIJNCIL_OF GOVERNMENTS APPROVE A
BASALT SANITATION DISTRICT (BSD) 1041 APPLICATION AND A
STATE OF COLORADOSITE APPLICATION ALLOWING BSD TO EXPAND
IT'S. WASTE WATER TREATMENT WORKS
Resolution
RECITALS
1. The Pitkin County Board of Commissioners recognizes the need for the Basalt
Sanitation District to expand the wastewater treatment works it owns and operates.
, 2. The Pitkin County Board of Commissioners recognizes the desire and willingness
of the Basalt Sanitation District Board of Directors to join forces with citizens' of the
Roaring Fork Valley to work towards the goal of maintaining clean water in the Roaring
Fork River drainage;
3. The Pitkin County Board of Commissioners recognizes the passage of Resolution
1, series of 1999 by the Basalt Sanitation District Board of Directors as an act of good
faith towards addressing the critical need, of public sewer service to areas now being
served by individual sewage disposal systems, recognizing these individual systems have
a calculated life span that, if not acted upon failure, can create a significant public health
concern:
4. The Pitkin County Board of Commissioners recognizes the Complexity of
arranging to provide public sewer service to outlying areas, but realizes the need to
pursue such an effort in specific instances.
NOW, THEREFORE BE IT RESOLVED by the Board of County
Commissioners of Pitkin County, Colorado, that they recommend to Eagle County and
the Northwest Colorado Council of Governments, approval with conditions of the Basalt
Sanitation District 1041 and State Site Application:
1) Prior to the Colorado Department of Public Health and Environment,
Water Quality Control Division issuing an approval of the Site Application, and
an approval to construct, Basalt Sanitation District (BSD) must meet an
conditions established by North West Colorado Council of Governments and
Eagle County as part of the 1041 Permit review process.
2) Basalt Sanitation District shall outline a realistic and workable plan to
provide for sewer service to Holland Hills, Wingo Junction and Lazy Glen. This
plan will include at a Minimum the following:
'A) BSD must indicate a willingness to include within the District and provide
public sewer service to the Holland Hills Subdivision, Wingo Junction, and Lazy
Glen Mobile Home Park upon petition by said areas, and to enter into
preinclusion with entities representing such areas agreements incorporating the
terms thereof.
B) No taps for lots not platted and recognized as being legally platted shall be
sold off the sewer like serving properties located between the Roaring Fork Club
up to and including Lazy Glen Mobile Home Park; unless there is an
understanding of intent reached between those property owners and the political
entities of Pitkin County, Eagle County, Basalt Sanitation District, and the Town
of Basalt. This document will take the form of an Inter -Governmental
Agreement (IGA). The IGA will include, but not be limited to, provisions
relative to ultimate density of housing along the Highway 82 sewer trunk line that
is acceptable to all parties of the IGA. The IGA should be completed as soon as
practically possible.
C) BSD shall provide engineering estimates of sufficient detail to assign
specific costs for all major elements of sewer line alignment, design, and
installation. Major elements shall include, among other components; right-of-way
access, trunk lines, collection lines, and service linesthat will be required in the
Highway 82 alignment.
D) BSD shall provide an analysis of construction costs to include the detail
requested in item C above. This will include, but not be limited to; tap fees,
service charges, any other costs that maybe assigned to a homeowner who will
ultimately be served by the District, and alternative method analysis of the most
efficient way to allow the Roaring Fork Club to recover costs they have spent
installing the sewer line to it's present location.
E) BSD shall present to NWCCOG and all referral agencies of the Site
Application; sewage flow calculations that will define the status of the BSD
waste treatment works relative to it's ability,to serve existing and future
customers (to include Holland Hills, Wingo Junction, and Lazy Glen Mobile.
Home Park). BSD shall reserve capacity in the expanded waste treatment plant to
serve Holland Hills, Wingo Junction, and Lazy Glen for 10 years starting on the
completion date of the plant -expansion.
F) BSD shall negotiate with the Roaring Fork Club to assure cost recovery for the
sewer line installed by the Club will not exceed 70% of the allowable initial
investment collected equally from the first 200 taps served by the line extension.
In no event shall the recovery fee exceed $2,083 per tap.
3) BSD shall provide assurance that it will be in compliance with all
conditions of the Regional Water Quality Management Plan (208 Plan) as
adopted by Eagle and Pitkin County, now and in the future.
